Pg. 261 COUNCIL CHAMBERS - OCTOBER 19, 1981 TWENTY-THIRD MEETING Council met pursuant to adjournment with all members present, except Councillor Alan Johnson who was absent. Reeve R.S. Arbour in the chair. The meeting was opened with prayer at 9:00 a.m. The minutes of the last regular meeting of October 5, 1981 were on motion of Halfacre and Vousden, confirmed as printed and received. Presented copies of letters forwarded as instructed at the meeting of Council held on October 5, 1981 as follows: -Law Construction Ltd., advising of tender accepted to complete services on Plan M-66 and Arnott Construction Ltd., advising that tender of Law Construction Ltd., had been acdepted with copies to Stuart N. Keyes and Associates Limited requesting he forward comments on letter from Jo-Con Developments regarding services on Plan M-66. -Jo-Con Developments requesting that Council be advised by Bank that the Letter of Credit will be renewed prior to October 30, 1981 and advising that Council has re- quested Township Engineer to forward comments on their, letter regarding services, with copies to Royal Bank of Canada and Engineers for Jo-Con (Reid & Assoicates). Pg. 262 TWENTY-THIRD MEETING - OCTOBER 19, 1981 . -Harold Bristow advising that the Township of Oro is not prepared to recommend amendment to O. P. and Restricted Area Zoning By-Law for use proposed for the said lands. -Hon. Roy McMurtry re: proposed Emergency Plans Act. -Secretary, Simcoe Side Ratepayers Association with respect to preparing a Horse- shoe Pitch on Park Lands, Lots 138,139,143 & 144, Plan 1488. -Terry Ware- advising that the Oro Council are not prepared to rent the Town Hall for New Years party. -Ontario Good Roads Association reservation of rooms for OGRA Convention. -County of Simcoe Recreation & Cultural Services Committee - registration for recreation and the law Seminar for Delegate, Deputy Reeve Steve Davie. -Chris Martin and T. McNamara requesting report and record of toll dues charged at Hawkestone and Carthew Bay Wharves in 1981. On motion of Halfacre and Davie, copies of letters as presented and forwarded as in- structed from meeting of Council held on October 5, 1981 accepted as satisfactory and ordered placed on file for reference. . Presented letter from D.S. White of Stewart, Esten advising that as instructed by Council, he had advised Mr. Jacobson that the Township was not prepared to deal with the original road allowance shown on Plan 860 in a piece-meal fashion and suggested that Mr. Jacobson contact all the owners on Plan 860 and then make a single rep- resentation to the Municipality on behalf of the owners of all lots on Plan 860. Letter enclosed copy of Mr. Jacobson's reply, demanding a conveyance of the road allowance pursuant to Section 462. Mr. White suggests that as resolved on July 6th by Council to proceed with the conveyance, it would be the easiest manner to re- solve this matter, and it does not appear that Mr. Jacobson will be satisfied with anything else. All costs of preparing the By-Law and conveyance should be at the expense of Mr. Jacobson. On motion of Davie and Vousden, that Oro Council would be prepared to pass a By-Law to convey the Original Road Allowance between Lots 20 & 21, Concession 14, across lot 8 of R.P. 860 subj ect to the Township Solicitor being satisfied that Council could not by way of a Quit Claim Deed convey same, since Registered Plan 860 had been signed and approved by the proper authorities with the wording "Road Closed" on the Plan. And, should it be necessary to proceed under Section 462 of the Municipal Act, all other lot owners on Plan 860 over which the Road Allowance pas4 ses, be advised of the conveyance under Section 462, which is to take place for Lot 8, Plan 860, since the other lots in question are in the same position. And, they be advised that upon request from them for the conveyance along with support- ing affidavits that no conveyance or compensation has been received by any pre- decessor, the Township could proceed with a necessary By-Law to convey to each lot owner the portions of the Road Allowance in order to clear up the entire Original Road Allowance across Plan 860. All legal costs and By-Law preparation for the con- veyance to be the responsibility of each lot owner. Clerk advised that Mrs. Joanna McEwen, Chairman of the History Committee had received a request for a copy of Kith'n'Kin for the Islay Museum and would request Oro Council mail a copy free of charge to the Islay Museum from the Township of Oro. . On motion of Davie and Vousden, that a copy of Kith'n'Kin be forwarded to the Islay Museum free of charge as a gesture of good will from the Township of Oro. . . . Pg. 263 TWENTY-THIRD MEETING - OCTOBER 19, 1981 Presented account from Mr. Marvin Brewer, Manager, Pitfield MacKay Ross Limited for office equipment consisting or 2 office desks, 14 office chairs, 3 office filing cabinets and one coat rack for a total cost of $550.00. On motion of Vousden and Davie, that the Treasurer be authorized to issue a cheque in payment of the office furniture to Marvin Brewer, Manager, Pitfield MacKay Ross Limited to a total of $550.00. Presented registered letter from Transport Canada, Director, Aids & Waterways Coast Guard forwarding "Declaration of Exemption" from provisions of Section 5 (1) of the Navigable Waters Protection Act, Part 1, in response to Letter of Application submitted by the Township on July 24, 1981, to erect Marker Buoys to demarcate swimming and beach area at Oro Memorial Park. On motion of Halfacre and Davie, "Declaration of Exemption" (Form 5) file 8200-81- 1234 (CGAN/M) dated October 8, 1981, for Marker Buoys to demarcate swimming and beach area at Oro Memorial Park, Part Lot 26, Concession 9, Township of Oro be re- ceived and Clerk to forward acknowledgement of same and advise that the work had been completed June 30, 1981 and Marker Buoys had been removed by September 30, 1981 and would be annually installed for the swimming season and removed at the end of each season. Presented Wharfmasters report 1981, from Gordon Grant, the appointed Wharfmaster for Shanty Bay Wharf. Report outlined the following: 1. Dock Activity - well attended for recreational purposes as listed 2. Dock Condition - General condition good-suggests re-securing fender timber on east side. Suggest major repairing of SW corner of dock where cement has spalled off 3. Boat Docking - Numerous boats tied up for short period-no charge-5 boats charged for overnight docking toal return $16.70 (charged at .10<;: per foot) - More boats could have been charged for overnight if more time available-found that some boats would come late at night and leave early in the morning 4. General On motion of Halfacre and Vousden, report of Gordon Grant, Wharfmaster, Shanty Bay Wharf accepted as satisfactory and same be filed and report of operation be for- warded prior to May 1, 1982 along with report from Hawkestone and Carthew Bay when received. And, that Shanty Bay Ratepayers Association and Gordon Grant be sent a letter of appreciation for the work and interest carried out by Mr. Grant and that the Township would appreciate the Shanty Bay Ratepayers Association to continue this service in 1982 and that the Township will be advised accordingly. Presented copies of letters from Planner, Community Planning Review Branch, Ministry of Municipal Affairs and Housing with respect to files 43T-25103 Hastings Subdivision, to Skelton, Brumwell & Associates Ltd., and File 43T-76089 to Paul Kitchen for pro- posed Plan by A. Randsalu for Block Y, Plan 902, Concession 9. Letter advised of draft approval lapsing. Pg. 264 TWENTY-THIRD MEETING - OCTOBER 19, 1981 . File 43T-25103 - previous extension to November 18, 1981 - recommended for exten- sion by Council on September 21, 1981 to November 18, 1982. File 43T-76089 - Draft approval dated November 23, 1978. On motion of Davie and Vousden, copies of letters be received and filed for refer- ence. File 43T-25103 having been dealt with and File 43T-76089 be referred to when further request is made by developer. Presented letter from W.J. Leslie of Stewart, Esten, summary of results of the prosecution against Racco, oulining the professional services and account for same to a total of $1,317.00. The results were three convictions on three accounts (a) under Section 7 of By-Law 1031 - fine for $50.00 plus directing that Mr. Racco remove chickens from his property within 30 days and further ordered thereafter that he be restricted from keeping of domestic fowl (b) Section 5(1) of The Ontario Building Code Act - fined Mr. Racco $100.00 (until November 15th to pay same) (c) Section 2 of By-Law No. 1102 - suspended sentence and same restraining order as for (a) above. On motion of Halfacre and Vousden, letter containing results of conviction against Mr. V. Racco be received and Treasurer authorized to issue cheque in payment of Same to a total of $1,317.00. Presented letter from Carol Hardin registering complaint of condition of Shelswell Park due to neighbouring property owners dumping leaves and refuse onto the park land. And, further suggesting that a fence be erected along the east side of the Park. . On motion of Davie and Halfacre, letter be received and Clerk to reply and advise that Council have scheduled an on site inspection of Park area. Presented letter from Sheridan Nurseries Limited forwarding Tile Drainage Applica- tion for Loan under The Tile Drainage Act, 1971, for a Tile Drainage System on part Lot 16 and Part Lot 17, Concession 9. Drainage System to be constructed on 13 acres for approximately 15,500 feet. On motion of Vousden and Halfacre, that the application for a Loan under the Tile Drainage Act, 1971, as revised, from Sheridan Nurseries, be approved and applied to the 1982 Allocation on basis of 50% of the toGl estimated cost of $7,850.00, being $3,925.00 for which a Loan in the amount of $2,900.00 is eligible, being 75% of the estimated 50% of the total cost of the Drainage System. Clerk to advise Sheridan Nurseries accordingly and also that the total allocation for the Township is $10,000.00 and may have to be further pro-rated should further qpplications be re- ceived for 1982 allocation. Presented letter from Ministry of Agriculture & Food, Food Land Development Branch, with respect to Tile Drainage Allocations 1981-82 advising that the allocation for 1981-82 is based on one years demand only and on the August survey. The Ministry strongly urges Municipalities to consider limiting loans on a 50% level. On motion of Vousden and Halfacre, letter be received and recommendations be taken into consideration when application for Tile Drainage Loans are presented for appro- val. Total cost of meeting of May 5, 1981 being $95.50 and that the Township of Oro share of the costs is in the amount of $23.88. . . . Presented from Consumer's Gas letter forwarding copy of Ontario Energy Board order E.B.R.O. 381-2 dated October 7, 1981. On motion of Vousden and Davie, Ontario Energy Board Order E.B.R.O. 381-2, dated October 7, 1981 be received and filed for reference. Presented copy of Telepost from R. Michael Warren, President of Canada Post Corpora- tion announcing the birth of Canada Post Corporation on October 16, 1981. On motion of Halfacre and Vousden, copy of message from Canada Post Corporation be received and filed. Chief Building Official James Shellswell was present at 11:30 a.m. and reported on (1) The prosecution by Township Solicitor against V. Racco and his attendance at the Court. (2) Matter of proposed plans for the Time Sharing Units of Horseshoe Valley - Chief Building Official advised of review of plans for the construction which he had reviewed with the Advisory Branch of the Ministry. On motion of Davie and Vousden, report of Chief Building Official on the two matters presented be accepted. The report of Stuart N. Keyes as presented to Committee of Council regarding the letter from Jo-Con Developments was further considered and the following action was taken: On motion of Davie and Halfacre, the comments of the Township Engineer to Council after reviewing the letter from Jo-Con Developments be forwarded to Jo-Con Develop- ments requesting that action be taken accordingly. Recommendation of Committee of Council to forward letter to MTC requesting added signing for Line 7, now signed as County Road No. 27 and Fairgrounds Road at the intersection of No. 11 Highway. On motion of Davie and Halfacre, that a letter be forwarded to Ministry of Transpor- tation and Communications as an enquiry as to whether the Ministry would be pre- pared to add the wording "formerly Line 7" with sign now indicating Fairgrounds Road. Deputy Reeve Davie again brought to attention of Council the dangerous problem of the Hydro pole at intersection of Line 5 on the decelaration lane from Highway No. 11 onto Line 5. On motion of Davie and Vousden, that a letter of enquiry be forwarded to MTC expres- sing Council's concern about the Hydro Pole being only a matter of inches from the pavement along the decelaration lane from No. 11 Highway onto Line 5, proceeding in an easterly direction (according to Highway direction). Recommendation of Committee of Council to erect signs at the Waste Disposal Site setting out days and hours the site is open to the public. . . . Road Superintendent, Fred Haughton, was present at 1:00 p.m. to present his report on Roads: He advised that the Township Truck as tendered was delivered to the Township Yard today, October 19, 1981. After which he remained for the opening of the tenders. On motion of Vousden and Davie, report of Road Superintendent be accepted. Road Superintendent, Fred Haughton, remained present for the opening of the tenders for Winter Sand and Snow Removal Equipment. Clerk advised that as directed at a meeting of Oro Council held on September 21, 1981 a tender advertisement for Winter Sand, to supply, screen, haul and stockpile ap- proximately 5000 tons of sand (3000 ton at Waste Dis~osal Site and 2000 Ton at Patrol Yard 15/16 Sideroad and to load, haul and Stockpile -600 c.y. of sand from Township Gravel Pit to Township Waste Disposal Site and to remix stockpile at Township Patrol Yard on 15/16 Sideroad approximately I700 c.y.) had been placed in the Barrie Examiner and the Orillia Packet, two issues. On motion of Davie and Vousden, that the tender of Cliff Varcoe Ltd., as received on Township tender form, to supply,screen,haul and stockpile at Waste Disposal site approximately3000 Ton of sand at 2.16 per ton to an amount of $6,480.00 and to supply, screen, haul and stockpile at the Patrol Yard on 15/16 Side road, approxi- mately 2000 Ton of sand at 2.69 per ton to an amount of $5,380.00 and to load, haul and stockpile approximately:!:: 600 c.y. of sand from Township Gravel Pit to the Waste Disposal Site at 1.99 per c.y. for an amount of $1,134.00 and to remix:!:: 700 c.y. of sand at the Patrol Yard, 15/16 Side road at 1.14 per c.y. to an amount of $738.00 for a total tender price of $13,932.00 be accepted, subject to the approval of the Ministry of Transportation and Communications. On motion of Davie and Vousden, that the tender of Jim Kenny for snow removal equipment for Route C of Township tender form 81-09 on the roads of Plan 1069, Barrie Terrace, Plan 663 and Colborne St., and Plan 1561 for the 1981-82 season with one White 2-105 tractor (four wheel drive-120 hp) with Hagedoorn double auger 9 foot blower at a flat rate of $21.00 per hour, according to tender specifications be accepted, subject to the approval of the Ministry of Transportation and Communi- cations. Clerk further advised that as instructed at a meeting of Oro Council held on September 21, 1981, a notice was placed in the Barrie Examiner and Orillia Packet, for person or persons to carry out the duties as Superintendent and Caretaker of Oro Memorial Park, as set out by Council and to operate the Concession Booth. The Planning Administrator was present at 2:27 p.m. to review ~Janning and develop- ment matters. The following was presented: Resolution of Oro Planning Board, dated Ocotber S, 19S1, recommending that F.J. Reinders & Associates Ltd., be retained to undertake the proposed North Oro Study Official Plan Update, under the Provincial Community Planning Study Grant Program. On motion of Halfacre and Davie, that Council, subject to receipt of a Community Planning Study Grant from the Minister of Housing, retain the professional consul- ting services of F.J. Reinders & Associates Limited, to complete;prior to March 1, 1983, the proposed North Oro Study, directed at reviewing and updating the Township Official Plan policies to determine the most desireable planning strategy for the North Oro area. Prior to the commencement of any work related to the North Oro Study, F.J. Reinders & Associates Limited be requested to prepare and enter into a contrat- ual agreement with the Township of Oro related to the study and the Planning Administrator be requested to obtain the necessary grant committment from the Ministry of Housing. Presented Ontario Municipal Board Decision regarding the public hearings held on July 6th - 9th, 19S1 in reference to certain portions of Official Plan Amendment No. 12 by the Minister of Housing, and for approval of Restricted Area By-Law No. 1213/S0. Decision approves O.P.A. 12 designations referred to the O.M.B. by the Minister, and By-Law No. 1213/S0 save and except the zoning applied to certain lands owned by Mr. & Mrs. Morton Dale, Mr. & Mrs. Percy Lock, Windfield Country Estates and Norshell Developments Limited. ~ . . . Pg. 271 TWENTY-THIRD MEETING - OCTOBER 19, 1981 On motion of Davie and Vousden, that the Ontario Municipal Board Decision with regard to Official Plan Amendment No. 12 and By-Law No. 1213/80 be received and placed on file. Planning Administrator to arrange for finalization of matters as required therein. Committee of Council recommendations were again presented for consideration fol- lowing the opening of tenders and applications for Park Superintendent. Committee of Council recommendation that Draw1ngs be prepared by the Township Engineer for the moving of large pavillion was further discussed by Council and, On motion of Halfacre and Davie, that the Park Committee Chairman make arrangements with the Inspector, Simcoe County District Health Unit to meet with Council at Oro Memorial Park to review matters referred to in letter of August 26, 1981 as signed by C.R. Hatfield, Public Health Inspector. And further that the Township Engineer be present at this meeting. The Committee of Council suggestion to establish a Park and Recreation Study Com- mittee was further discussed at great length by Council with Deputy Reeve Davie making a presentation of his homework on the proposal, relating that he had dis- cussed same with Ainley & Associates and ratepayers and that in his view it was a planning matter and that Planning Board should have some input. Also that in his opionion and that of the Planning Consultants, such a Committee should consist of more than three members as had been suggested at the Committee of Council meeting. This view was not entirely shared by all members of Council and after some continued_discussion, the following resolution was introduced: On motion of Halfacre and Vousden, as earlier discussed by Council it is moved that: a) A Park and Recreation Study Committee be established b) That the said Committee be composed of a chairperson and two members c) That a complete inventory with physical description be completed of Township Park lands. d) That all aspects and needs for future recreation be assessed e) That three persons familiar with the Township and recreation requirements be invited in writing to form this Committee, namely - William O'Brien, William Staines and Dr. Alex Bolechowsky And, further that should this Committee be of the op1n1on, that additional members would be beneficial, such number could be added by Council, when a request is re- ceived from the Committee. Motion Carried. Recommendations of Committee of Council to set a date for a recognition and appre- ciation night was next considered and after much discussion the following action Was taken: On motion of Vousden and Halfacre, that as recommended by Committee of Council a recognition and appreciation night be set for-November 30, 1981 at 8:00 p.m. and a list of persons to be recognized be prepared for service on Council of 4 years or more and 'lanning Board or Committee of Adjustment, a period of 5 years, also list of persons to be invited be prepared and notice be sent. The evening to con- sist of presentations, entertainment and concluded with a buffet lunch. . . . Presented letter from D.S. McEwen, Ministry of Transportation and Communications, further to Township letter to M. Seeley, Head Traffic Section, expressing concern regarding anticipated safety problems with decelaration tapers at Commercial en- trances along Highway No. 11, due to increased speed limit from 80 to 90 km/h. Letter advises that the Ministry is not convinced that the increased speed posted will result in unsafe conditions. And, further advises that it is suggested to Traffic Section to make the Ontario Provincial Police aware of the concern and request they, the O.P.P., monitor the operation of the entrances. On motion of Vousden and Davie, copy of letter as presented be received and filed for reference, until furhter information is received from MTC or OPP. Presented letter from D.S. White, Solicitor, forwarding copy of Deed from R. Beal for land for 15/16 road widening and report of certification of title and account for professional services, be received and account be added to the October Road Accounts to an amount of $198.50. And, that the Solicitor be requested to draft the necessary By-Law to assume the travelled road. Presented copy of letter from Skelton, Brumwell & Associates Limited to Ministry of Municipal Affairs & Housing, forwarding request for extension of Draft approval for Hastings Subdivision file 43T-25103, along with copy of Township resolution which advised that the Township was prepared to support an extension to Draft approval for one year to November 18, 1982.
