COUNCIL CHAMBERS - OCTOBER 5, 1981
TWENTY-SECOND MEETING
Council met pursuant to adjournment with all members present. Councillor Vousden
attended the N.V.C.A. meeting until 11 a.m.
Reeve R.S. Arbour in the chair.
The meeting was opened with prayer at 9:00 a.m.
The minutes of the last regular meeting were on motion of Halfacre and Johnson,
confirmed as printed and received.
Presented copies of letters forwarded as instructed at the last regular meeting of
September 21, 1981 as follows:
-Ministry of Transportation & Communications forwarding 1981 Petition for Interim
Payment on Road and Bridge Expenditures from January 1st to August 31st, 1981.
-Barrie Examiner and Packet & Times re: Tenders for Winter Sand and Snow Removal
Equipment.
-Letter to M.T.C. advising of tender calls which are to close October 16, 1981.
-Stewart, Esten re: R. Ryder with respect to claim for compensation due to re-
construction of 15/16 Side Road.
-Ronald F. Thompson, Insurance Adjuster, forwarding costs of damages to repair and
restore the African Church.
-Dr. D.G. Hill advising of proposed date for service and requesting he advise whether
the Society could assist in the service. Clerk advised that a telephone call had
been placed and that the Black History could not attend on October 11th or alter-
native date of October 18th, 1981. Accordingly the Committee have now postponed
the service to early in Spring of 1982.
-Letters to Edward Robinson and Charles Sanderson forwarding cheque for work of
restoration and advising them of service in Spring of 1982.
-Carolynn (Sheffield)Wilson reply to letter advising that service would not be held
until early spring of 1982.
-Skelton, Brumwell & Associates Ltd., re: Timothy Acres Subdivision advising that
Council conditionally approve red line revision of the Plan.
-Skelton, Brumwell & Associates Ltd., re: Guthrie Plains Subdivision (Hastings) for-
warding resolution that Council are prepared to extend the Draft approval for the
Subdivision (file 43T-25103) for a period of one year to November 16, 1982, sub-
ject to the Minsitry being in favour and that the estimated costs of $175,000.00
in the present Subdividers Agreement is to be exclusive of costs of wells and
Engineering costs.
-Barrie Examiner and Orillia Packet - notice for applications for person or persons
to carry out duties as Superintendent and Caretaker of Oro Memorial Park for the
1981-82 season.
-Mitchell Square Women's Institute re: construction of ramp for handicapped and dis-
abled at Oro Town Hall.
-Eldon Greer forwarding copy of letter from MTC re: acceleration/deceleration lanes
characteristics at Commercial entrances along No. 11 Highway.
-J.E.T. LeMay re: Purchase of Road Allowance (Promenade) Plan 626.
-Ministry of Agriculture & Food re: Application for Tile Drainage Loan from Ivan
Clark - requesting early approval for 1982 of the said application be considered for
increase in 1982 Allocation for the Township.

-Marvyn Graham - re: Live Stock Valuers Report, forwarding cheque for claim in
amount of $51.88 for Chickens killed.
-Ukranian National Federation re: Parking of Trailers in OSl lands, being the youth
camp area of the development.

Public Highway.
-Crawford Heating and Air Conditioning advising that quotation had been accepted
for furnace servicing for 1981-82 season with copies to Ron Dinsmore Heating and
E.M.Oliver Heating advising of same.
-Oro Horticultural Society advising that members of Council and their spouses would
be attending the Annual Awards night on October 5, 1981.
On motion of Johnson and Halfacre, copies of letters as presented and forwarded ac-
cepted as satisfactory and ordered placed on file.
Presented letter from Robert Holmes, Supt. and Caretaker, Oro Memorial Park 1981
Season, requesting Council to advise as to whether his contract is renewable and
what is his position for 1982. He also makes enquiry as to whether the Township
would be prepared to purchase his equipment in the booth. Clerk also advised that
Mr. Holmes had been forwarded a copy of the notice calling for applications for
Supt. and Caretaker of Oro Memorial Park.
On motion of Halfacre and Johnson, letter be received and tabled for further refer-
ence when applications for Park Supt. and Caretaker are considered.
Presented copy of letter to Stewart, Esten Township Solicitor in reply to letter
from D. S. Wbite of the aforementioned firm advising that Big Cedar Parks Limited are
not interested in picking up Parts 1 & 2 of Plan 51R-9591 at the Township estimate
of $1,500.00 and that the Township should not withhold the conveyance of Parts 3 & 4
until the matter of parts 1 & 2 have been resolved. And, further requesting legal
opinion as to whether the Township could fence the Road Allowance (Parts 1 & 2)
along with Park Area.
Presented as well, letter of reply from D.S. White, advising that the Township has
the authority to construct a fence on its road allowance, suggesting as well that
a survey should be obtained to ensure that the fence is constructed on Township
property.

On motion of Johnson and Davie, letter be received and filed for further reference
and until the Committee of Council have further reviewed the matter after attending
at the site.
Presented letter from D.A. Webb, Senior Municipal Supervisor, Ministry of Transpor-
tation & Communications, acknowledging submission of proposed tender forms for Winter
Sand and Snow Removal Equipment and advising that the proposed documents meet with
the approval of the Ministry.
On motion of Davie and Johnson, letter be received and filed for reference when
tenders are considered.
Presented memorandum from Ministry of Culture and Recreation forwarding cheque in
the amount of $2,115.50 being amount of grant under Regulation 200, for grant applied
for the 1980 statement and application for 1981 Recreation Grant.
On motion of Johnson and Halfacre, Recreation Grant in the amount of $2,115.50 be
received and amount of same be forwarded to Arena Committee to cover portion of
Secretary's wages, Power Skating Instructors and Heat & Hydro Maintenance.
Presented from Nottawasaga Valley Conservation Authority, notice of meeting of the
Water Control Advisory Board, to be held on Monday, October 5, 1981 and that the
second item on the Agenda is the scheduled introduction and presentation of the Oro
Fill and Floodline Mapping as prepared by Cumming,Cockburn and Associates Ltd., as
directed at the last regular meeting. Coucillor Stan Vousden is attending the meeting.
Also presented letter from Cumming,Cockburn & Associates Ltd., forwarding set of
maps showing the Regional Storm Floodlines along Willow Creek.
On motion of Halfacre and Johnson, notice of meeting be received and filed, the mat-
ter of the report be further considered when Councillor Vousden presents his report
On the attendance of the presentation and copy of the report is received for Council's
review along with set of maps received from Cumming, Cockburn & Associates Ltd., and
copy of areas in question be forwarded to D.S. White.
Presented letter from Ontario Black History Society expressing the Society's appre-
ciation for the speedy action in repairing and restoring the African Church and
that the Society is looking forward to participating in a memorial service at the
Church in Spring of 1982. And, enclosing a cheque in the amount of $350.00 to help
defray some of the costs of rebuilding the Historic African Church.
Also presented a letter from West Oro Baptist Church forwarding a cheque in the
amount of $100.00 towards the repair costs of the damages to the African Church.
Presented as well, further letter from Daniel G. Hill, President, Black History Society
acknowledging receipt of correspondence of September 22, 1981 along with copies of
letters to Contractors, Ed Robinson and Charles Sanderson and copy of letter to
Carolynn Sheffield Wilson. Clerk also reported on telephone call from Carolynn Shef-
field Wilson advising that the persons from the Collingwood area would be prepared
to assist in organizing a memorial service this fall.
On motion of Johnson and Davie, letters be received along with the donations from
the Black History Society and West Oro Baptist Church and that the parties be advised
of date of the service to beheld in the Spring of 1982 and that the donations received
be set up under ledger account for the purpose of past and future maintenance of the
African Church.

Presented letter from Shanty Bay Public School expressing appreciation for the
newly constructed safety path along Ridge Road adjacent to the Shanty Bay School.
On motion of Davie and Johnson, letter be received and placed on file and photocopy
be presented to the Roads Department.
Presented letter from Philip J. Stefaniak of Jo-Con Developments in reply to
Township letter of September 2, 1981, requesting confirmation, in writing, as to
when work is proposed to be completed on Plan M-66. Letter outlines that it is not
feasible to complete the servicing of the sub-division at this stage as construction
of homes will damage grading, ditching, culverts, etc. The earth berm and fence will
also be completed at the same time as the servicing, as it is not practical to com-
plete until the homes are constructed.
On motion of Davie and Johnson, that copy of the letter from Jo-Con Developments
be forwarded to Township Engineer, who is to forward his comments in order that
same may be dealt with at the next Committee of Council meeting on October 14, 1981.
On motion of Davie and Johnson, letter be received and Clerk to reply and request
that Letter of Credit due on December 9, 1981, be renewed and same be received by
the Township by October 30th, or letter from the Royal Bank of Canada advising that
same will be received by the Township thirty days prior to expiry date.
Presented letter from D.S. White, Solicitor forwarding account for Professional
Services rendE1Edon various files, to a total of $801.75.
On motion of Halfacre and Johnson, account as presented be received and Clerk to re-
quest Solicitor to aportion the various files and account be listed in accounts pay-
able for the month of September.

Motion carried.
The matter of progress of the fly-over at Line 9 and No. 11 Highway was again
brought before Council with the following action taken:
On motion of Halfacre and Johnson, Clerk to write a letter of enquiry to the MTC as
to progress on the 9th line overpass, and whether the tender for same is being
called this fall along with other tenders that may be scheduled along No. 11 Highway.
Presented a letter from Allan K. McLean, M.P.P. asking for comments ttomCouncils
within his area as to whether in favour of proposed three year term as presented by
the Hon. Claude Bennett.
On motion of Halfacre and Vousden, Clerk to reply that the majority of members of
Oro Council would be in favour of a two year term, although members of Council see
financial advantages in a three year term, as well as an oportunity of better plan-
ning programs, but in general the two year term would appear to be more feasible for
a Rural Municipality. The result being 4 in favour of a 2 year term and 1 maybe.

Deputy Reeve Davie brought to the attention of Council the proposed legislation
with respect to Emergency Planning.
On motion of Davie and Halfacre, that Council of the Township of Oro support the
proposed Plans Act and would request that upon passing of the Legislation, Munici-
palities be advised whether sample By-Laws will be available to Municipalities.

On motion of Halfacre and Johnson, Report of Chief Building Official on permits
issued for the month of September be accepted as satisfactory.
Chief Building Official presented the matter of follow up of two properties,
firstly the Building Permit for a Mink Housing, for which a building permit has
now been issued; secondly, the matter of contravention of a garage attached to
the house by Kenneth Crawford for which a buil~ing permit had been issued for a
detached garage. In reply to which letter from Mr. Crawford was presented, advising
that he could not meet dates outlined by Chief Building Official and Zoning Adminis-
trator, for the complying with requirements.
On motion of Vousden and Halfacre, that the Chief Building Official to reply to
Mr. Kenneth Crawford's letter and as follow up to letter setting out terms to
complete the work to comply with the Building Permit issued and inform Mr. Crawford
that Council have instructed that unless the work as set out in letter of September
22 is completed, the Township will have no alternative but to commence legal action
for the contravention and that the Chief Building Official be authorized to take
the matter up with the Solicitor. And, further that Mr. Crawford be advised that
Commercial operation of body work may not be carried out in the said building.
Chief Building Official also reported on progress of reviewing the plans for the
construction of Time Share Units proposed by Horseshoe Valley. He advised that two
items are still to be resolved before a permit may be issued.

Councillor Johnson brought to the attention of Council the verbal request from
Ray Shorchet for permission to have a building permit to erect a residence prior to
the 21 days required after decision of the Committee of Adjustment granting the
Minor Variance.
On motion of Vousden and Davie, that Council are not prepared to vary the require-
ment of the Planning Act with respect to Minor Variances.
Road Superintendent, Fred Haughton was present at 1:00 p.m. and presented his re-
port for work done during the month of September and Vouchers 9 and 9A to cover same.
On motion of Vousden and Davie, report of Road Superintendent accepted as satisfac-
tory and Treasurer authorized to issue cheques in payment of same to a total of
$49,883.40.
Presented copy of letter from D.A. Webb, Senior Municipal Supervisor, to Stuart N.
Keyes & Associates Ltd., advising that the Proposed Plan and Tender for completion
of services on Torpey Subdivision (Plan M-71), acknowledging tender form and
Drawing No. 1 and advising that the proposal meets with the approval of the Ministry,
with exception of wording on page 1, whichihiicates roads to be assumed by MTC upon
completion of the work, should read assumed by the Township, and for MTC the word
assumed should be changed to subsidized. Also presented copy of tender call as it
appeared in the Packet & Times and Barrie Examiner.

Clerk advised that as authorized at a meeting of Oro Council held on September 1,
1981, tenders were called for the completion of services on Plan M-71 (Torpey Sub-
divison) upon notification from MTC that the tenders as prepared by Stuart N. Keyes
& Associates Limited meet with MTC requirements with revision of wording on page 1.
(assumed should read subsidized). The tender ad had appeared in the Barrie Examiner
and Orillia Packet for two issues. In response, 2 tenders were received by 3 p.m.,
Friday, October 2, 1981, the closing time, for tenders as follows:

After the tenders were reviewed by the Township Engineer and Road Superintendent,
the following action was taken:
On motion of Davie and Vousden, that the tender of Law Construction Limited to
complete the unfinished services on Plan M-71 (Torpey Subdivision) according to
tender form as prepared by Stuart N. Keyes & Associates Ltd., being the tender
form u~n which the tender has been quoted, for a total of $43,063.00. Clerk to ad-
vise Law Construction accordingly with request that the firm complete the work as
early as possible and that the Ministry of Transportation and Communications be
advised. And, further that the Township Engineer supervise all work according to
the tender specifications.

On motion of Halfacre and Vousden, Treasurer's report of receipts for the month of
September as presented be accepted as satisfactory.
Presented for Council's consideration Oro Planning Board resolution dated September 21,
19S1 with regard to a proposal on Mr. Harold Bristow to rezone Lot 1, R.P. 1195 to
permit use of the property for the dismantling of cars and the wholesale/Retail sale
of used car parts, further to a resolution of Council made September 1, 19S1.
On motion of Vousden and Halfacre, that Council are not prepared to recommend an
amendment to the Oro Official Plan or Restricted area By-Law No. 1031 in respect of
a proposal by Mr. Harold Bristow to use Lot 1, R.P. 1195 for the dismantling of
wrecked automobiles and for the wholesale/retail sale of used automotive parts.
Council are of the opinion that such use is neither in conformity with the intent
and purpose of the Township's Official Plan, nor appropriate for the subject lands.

Presented letter from the Hon. James Snow, Minister, Ministry of Transportation and
Communications, announcing the Ministry is again offering educational programmes
On quality standards and design and construction technology to Municipal employees
involved in those related areas. Clerk advised that the Road Superintendent had
received a copy for review and comments as to participation in the programme.
On motion of Vousden and Halfacre, that the matter be tabled and referred to Road
Committee for recommendation.
Presented report of Live Stock Valuer, Ernest Bidwell, for one ~we killed, owned
by Bruce Anderson, valued at $150.00, and affidavit of owner as required. Live Stock
Valuer's report advises that the ewe was killed by wolf or wolves, basing his opin-
ion on method of kill with everything cleaned up except the bones. Also affidavit
of applicant Bruce Anderson.

On motion of Johnson and Halfacre, report of Live Stock Valuer be accepted and
Treasurer to forward cheque in the amount of $150.00 to Bruce Anderson for the
ewe killed, by wolf or wolves, and Clerk to make application to Ministry of
Agriculture and Food for grant.
Presented report of Live Stock Valuer Bruce Anderson for 2 lambs killed on Lot 17,
Concession 13, on September 21, 1981, owned by Jack Perryman. Value placed on each
lamb is $65.00 for a total of $130.00. Live Stock Valuer indicates in his report
that the method of kill and clean up would indicate that the lambs were killed by
the same wolf or wolves and that the owner has seen wolves in the area at various
times.
On motion of Vousden and Johnson, that report of Live Stock Valuer be accepted and
Treasurer authorized to issue cheque in payment for the two lambs killed to a total
of $130.00 and forward same to Jack Perryman and Clerk to complete forms to claim
damage by wolves and forward same.

to John Bradbury, Lot 21, Concession 4, namely 18 roosters and one duck killed and
10 chickens injured with values as follows:

Report states that the total weight of fowl was estimated as 285 lbs., and that the
fowl had been kept in a closed in yard, where the poultry was killed in the day
time. Also that the roosters were ready to be dressed for market. Clerk reported
that Mr. Bradbury had telephoned and advised of the killing of chickens which would
appear to have been dogs and that although the chickens were in a closed in yard
and barn, which may not be adequately secure enough to keep out dogs entirely. Also
presented copy of affidavit of John Bradbury.
On motion of Vousden and Halfacre, the report of Live Stock Valuer be accepted and
that because it is not sufficient evidence of a completely secured enclosure,
Council are not prepared to pay the full value of the Live Stock Valuer's report
and Treasurer be authorized to issue cheque to an amount of 75% of $282.00 being
$211.50 to John Bradbury.

Gerald Fenn, Lot 25, Concession 3, namely 7 roosters and 4 turkeys killed and 7

On motion of Johnson and Halfacre, report of Live Stock Valuer be accepted and that
since the valuer indicated that some of the chickens were in the enclosure, Council
are of the opinion that only a percentage of the estimated value be paid and that
Mr. Gerald Fenn receive reimbursement on basis of 50% of the total estimated value
to an amount of $107.50. Clerk to advise owner that better protection be arranged
for in order to prevent dogs from entering enclosure.

And, that since the owner of the Poultry has advised that the dog owned by Wendy
Graungaardand Tom Trembly, Clerk to write a letter to the owner of the dogs and
request that the Township be reimbursed for damages.
Presented report of Live Stock Valuer Bruce Anderson for one Sheep (ewe) killed,
owned by Melville Mawdsley, Lot 15, Concession 14, valued at $125.00. Live Stock
Valuer indicates that the killing was the work of a wolf, the report describes
method of injury as it relates to the predator being a wolf and that the injury
resulted in having to destr~the ewe.
On motion of Johnson and Halfacre, that the report of Live Stock Valuer, Bruce
Anderson be accepted and Treasurer authorized to issue cheque for same to a total
amount of $125.00whenthe necessary affidavit of the owner has been taken. And,
that the Clerk to complete the application for the grant, to reimburse the claim
paid by the Municipality for the sheep killed by Wolf.
Presented letter from Nottawasaga Valley Conservation Authority with respect to
1982 Preliminary Budgffand 1982-86 Multi-year Forecast and requesting all member
Municipalities to advise of any projects that can be undertaken by the Authority
during that time frame.
On motion of Vousden and Halfacre, that Clerk to reply and advise N.V.C.A. that
the Township of Oro have no new projects programmed at the present, however, some
could arise once the Flood and Fill Line Mapping has been reviewed.
Presented letter from Ministry of Labour with respect to the Occupational Health
and Safety Act, 1978 which includes arenas in the definition of an IIIndustrial
Establishmentll and that in accordance with Section 121 of Ontario Regulations
states that Health and Safety requirments of the Building Code Act, 1974 apply to
all Industrial Establishments. And further, that the last recorded inspection on
the Ministry file for the arena is 1975, it is therefore requested that the arena
be inspected this year by a qualified Engineer and a copy of the report be for-
warded to the Ministry of Labour.
On motion of Halfacre and Johnson, that a letter be forwarded to the Township of
Oro Committee forwarding copy of letter advising that the required inspection is
to be carried out in accordance with the Occupational Health and Safety Act, 1978
and that the Township Engineer, Stuart N. Keyes & Associates be retained to carry
out the inspection in order that a report of the inspection may be forwarded as
requested.
Presented from the County of Simcoe Recreation and Cultural Services Committee
notice of Seminar to be held on Saturday, November 7, 1981 at Georgian College and
registration form which is to be completed for person attending, registration
fee being in the amount of $8.00 per person.
On motion of Vousden and Halfacre,registration form be completed for Deputy Reeve
Davie to attend the Seminar.
Presented letter from Ontario Good Roads Association advising of the 1982 Convention
and request for accomodation. The Convention is to be held on February 22nd to
February 24th, 1982. Enclosed with letter is Reservation Form which is enclosed with
request for completion and returned since reservations are processed as received.

Councillor Halfacre brought to the attention of Council the matter of
preparing part of the Park Lands on Plan 1488, for Horseshoe Pitch by
Simcoe Side Ratepayers Association as requested by the Association in a
letter previously presented to Council.
On motion of Halfacre and Johnson that a letter be forwarded to the Simcoe Side
Ratepayers Association advising that Oro Council would have no objection to
the Association preparing an area for a Horseshoe Pitch on the south west
area of the park land area.
Councillor Halfacre brought to the attention of Council the matter of the
reports from the three Wharfmasters and that the only report received was
from Mr. Gordon Grant for Shanty Bay Wharf.
On motion of Halfacre and Johnson that a letter be forwarded to the Wharf Masters
of Hawkestone and Carthew Bay and request that they present their report
for 1981.
Councillor Johnson reported on his attendance at the Annual Meeting of the
Simcoe County District Health Unit which he attended on September 23, 1981 and
presented copy of the Agenda and Simcoe County District Board of Health
for August 1981.
On motion of Halfacre and Davie, that the report of Councillor Johnson be
accepted as satisfactory.
Mr. William J. Leslie, Solicitor, was present before Council at 4:15 p.m. to
discuss the matter of legal action against V. Racco/Township of Oro.
On motion of Halfacre and Johnson that Council go into Committee of the Whole
to discuss the legal matters pertaining to the Racco/Township of Oro legal
action at 4:30 p.m.
On motion of Vousden and Johnson that Council come out of the Committee of
the Whole at 4:45 p.m.
It was moved by Councillor Vousden and seconded by Deputy Reeve Davie that
the Township Solicitor proceed with the litigation against Mr. V. Racco.
On motion of Johnson and Davie, that the Chief Building Official be authorized
to attend Ontario Building Official's Annual Conference at Sarnia on
October 25th to 28th, 1981, and that the Township pay for the registration and
expenses.
