Presented copy of letter from D.S. White, Township Solicitor, to Big Cedar Parks advising that the Township is prepared to accept $1,500.00 for parts 1 & 2 of Reference Plan 51R-9591, and this purchase price the Township would deduct 250.00 the cost of opinion of value also all legal costs. The balance of the proceeds will be paid to Mr. G. Langman in accordance with the provisions of the Municipal Act. And, further that the Township are not prepared to proceed with the conveyance of parts 3 & 4 of Ref. Plan 51R-9591 until parts 1 & 2 are resolved. Presented letter from Ministry of Culture and Recreation with respect to 1980 Statement and Application for 1980 Recreation Grant under Regulation 200, advising that the grant has been recommended in the amount of $2,115.50 and is subject to final approval by the Minister. On motion of Vousden and Johnson, letter be received and placed on file. . . . ~ Pg. 220 TWENTIETH MEETING - SEPTEMBER 1, 1981 Presented letter from Project Analyst, Capital Grants Unit, Ministry of Culture & Recreation with respect to Jarratt Community Hall Wintario Grant Program, File # BAR-8-58405 and unclaimed balance of an approvel grant amount. Letter suggest com- pletion of "Request for Wintario Grant Payment" as soon as work is completed. Clerk advised a letter had been forwarded to Secretary, Jarratt Community Hall Committee suggesting that the earlier work is completed the sooner the application can be completed for balance of grant. To date no reply has been received. On motion of Halfacre and Vousden, Clerk to again contact the Jarratt Community Hall and advise of letter and request that all necessary invoices and reports be made available in order to have the Request for Final Payment completed. Presented letter from D. Brown, Project Analyst, Capital Grants Unit with respect to Shanty Bay Community & School Centre, Wintario Grant file #BAR-8-58188, advising of unclaimed balance of an approved grant, for which the original estimate submitted an amount of $7,132.84 is eligible for expenditure. Letter suggests that the Township on behalf of the project may wish to submit a request for the balance of the grant, in order that the file may be closed. On motion of Vosuden and Johnson, letter be received and Clerk to contact the Shanty Bay Community and School Committee and request that they advise when further expen- ditures are proposed in order that a reply may be forwarded to the Ministry. Presented letter from A.W. Smith, Fish & Wildlife Supervisor, Huronia District, Ministry of Natural Resources, in reply to Township letter of August 5, 1981 with respect to number one problem for deer, namely dogs. Letter advises that the Ministry does its' best to control dog predation and does not intend to initiate any bounty system, but prefer to continue to handle the situation as in the past and that in this regard co-operation is essential. On motion of Vousden and Johnson, letter be received and filed for reference. Presented letter from D.S. White with respect to purchase of land from Mr. R. Beal, advising that he has been unable to contact Mr. Beal by telephone and that a letter had been forwarded to him immediately after the mail strike and further upon obtain- ing necessary signatures for deed, a cheque in the amount of $1,820.00 for the purchase of the property will be required from the Township. On motion of Vousden and Johnson, letter be received and upon Solicitor's request for the cheque in the amount of $1,820.00, being the agreed purchase price, Treasurer authorized to forward same. Presented letter from D.S. White, Township Solicitor, forwarded duplicate copy of Deed for land obtained from Ronald Arthur Briggs, part of Lot 15, Conc. 7 according to Reference Plan 51R-I0224, being the lands for Road Widening of 15/16 SideRoad. Deed Registered as Instrument No. 743374. Also fees for professional services in this regard. On motion of Halfacre and Vousden, letter and copy of Deed for lands from Ronald A. Briggs for widening of 15/16 Side Road according to Reference Plan 51R-I0224, registered as Instrument No. 74334, dated August 11, 1981. And further that the fees for professional services be added to Road Accounts for the Month of August. . . . Pg. 221 TWENTIETH MEETING - SEPTEMBER 1, 1981 The following recommendations, from meeting of the Committee of Council meeting held on August 27, 1981 were further considerd: 1) Committee of Council recommend that Council authorize the transfer of Water Truck, the former Fire Tanker Truck No.2 Station, Hawkestone,to the Roads Department to enable better administration of maintenance, etc. On motion of Vousden and Halfacre, that the Water Truck,be transferred from Township general to the Oro Township Road Department to enable proper and easier administration of maintenance of the vehicle and that it be shown as vehicle No. 2 in the Roads Department. 2) Committee of Council recommend that the Road Superintendent be authorized to allow all but a skeleton staff to take one day holiday during the International Plowing Match 1981, which is to take place in Vespra and Oro Township. On motion of Johnson and Vousden, that the Road Superintendent be authorized to operate with a seleton staff one day during the week of the International Plowing Match 1981, which is to be held in the Townships of Oro and Vespra in 1981 and that all except the skeleton staff of the Road Department take one day of Holidays. 3) Matter of level of employee Robert Bidwell was referred to the Road Committee for recommendation and after consideration, the following action was taken: On motion of Vousden and Halfacre, that Robert Bidwell be classified to include Part time Grader Operator at a rate of 7.00 per hour from Truck Driver with rate of 6.85 per hour effective first Pay period of September. The matter of letter from Oro Station Ratepayers Association further to the atten- dance of Mr. David Williams at the Committee of Council meeting held on August 27, 1981 with respect to three items of concern to the Associaiton, was further consid- ered and the following action was taken: On motion of Halfacre and Vousden, the Oro Station Area Ratepayers Association be advised that the (1) reconstruction of the Lakeshore Road from Line 5 to Line 9 is proposed to proceed over a period of years and subject to funds that can be pro- grammed each year (2) The matter of "stop signs" at intersection of County Road 20 & 27 is to be further pursued with the Barrie Suburban Road Commission (3) Securities for Phases 2 & 3 of Plan M-157 (Shelswell Subdivision) have to be arranged prior to development commencing beyond phase 1, also that Shelswell Blvd. had been assumed by the Municipality prior to draft approval of Plan M-157. The matter of the Park Superintendent as discussed at the Committee of Council meeting was further considered and following resolution passed: On motion of Halfacre and Vousden, that the Park Superintendent, Mr. Robert Holmes, be requested to attend the next Committee of Council meeting on September 17, 1981. ~ . . . ....... Pg. 222 TWENTIETH MEETING - SEPTEMBER 1,1981 Presented letter from Township Solicitor, Paul Hermiston in response to copy of Township letter to Stuart N. Keyes, Township Engineer, requesting he prepare Tender call to complete unfinished services on Plan M-71 (Torpey Subdivision) advising that his only concern is that the work to be done does not exceed speci- fications or standards which the Subdivider would originally have had to meet. Also copy of letter to Township Solicitor from Canadain National Railways in reply to his letter with respect to fencing, as per plan M-71, advising that the Railway had granted approval to the said Subdivision based on conditions as outlined by the Minister of Housing in their letter of May 8, 1974. Since the Railway is not a party to his agreement, it is therefore considered the responsibility of the developer or Municipality to ensure this fence is erected. On motion of Vousden and Halfacre, Solicitor's letter and copy of letter from C.N.R. to Solicitor, be received and Township Engineer be forwarded copies for his information to prepare necessary tender for the completion of unfinished work on Plan M-71 and be again presented when the tender specifications are reviewed. Clerk advised that on August 31, 1981, he had received a call from the Ontario Provincial Police, at home, at approximately 7:30 a.m. to advise that two trucks, which had been stolen, had been used to ram the African Church, Lot 11, Cone. 3, causing serious damage to the building. The call had been a request to have these trucks moved to the Township Machine Shed where same could be dried off for finger printing process. This message had been given to the Road Superintendent, to expect the trucks. Half an hour later, at approximately 8:00 a.m., same Officer had called the Township Office requesting someone from the Township to attend prior to attemp- ting to remove one of the trucks which had been forced partially inside the building. Coucillor Stan Vosuden was contacted and he indicated he would proceed to the site, also the Road Superintendent, when able to contact him, was asked to go to the site. After this the news media had contacted the Office, as well as calls from County Clerk, members of the Simcoe County Historical Society. Before able to contact the Deputy Reeve, he called the office to enquire as to reports. The Insurance Agent was next contacted and available information given to him. The O.P.P. had again been contacted before 5:00 p.m. and was advised that Constable Muir would call this morning. Also telephone call had been received from Carolyn Sheffield Wilson expressing a concern as to the restoration of the African Church due to family interests. The matter was discussed at great length by Council and Deputy Reeve Davie presented a proposal in the form of a draft resolution dealing with the damages andlrgencyto repair same which proposal after further consideration was accepted as follows: It was moved by Councillor Halfacre and Seconded by Councillor Johnson that - - Whereas : Thoughtless vandals recently have done extensive damage to the African Church, located at Line 3, and the Old Barrie Road, which property belongs to the Township of Oro. Whereas: The damage done is rather extensive and demands immediate attention, so as to avoid deterioration and to disuade intruders and trespassers, and avoid further liability. Whereas: The existence of the African Church structure appears to this Council to indicate: Pg. 223 TWENTIETH MEETING - SEPTEMBER 1, 1981 .. 1) That the people being now in this community, as all through our past, see fit to preserve this historical site. That the existence of the Church represents first freedom to a large community that share our past, and our pride in our Township and our heritage. That the building deserves the dignity and respect due to any house of worship in this Township. 2) 3) Now therefore, be it resolved that Mr. Ed Robinson be retained to immediately repair the damage done, and forward bill for same. Further, Mr. Robinson be ad- vised to contact Mr. Eric Scott and Mr. Charles Sanderson for their comments or suggestions. Further that Mr. Robinson be advised that time is of the essence, and Council would most appreciate prompt attention. Clerk to advise all pertinent agencies, historical and others of the resolution. Carried unanimously. On motion of Vousden and Halfacre, that the matter of offering a reward leading to the apprehension and conviction of persons responsible be further considered at the next regular meeting of Council. . On motion of Johnson and Vousden, that following the decision to repair and restore the African Church as quickly as possible, Council propose to hold a Service on the Site of the Co loured African Espiscopal Methodist Church (African Church) for which purpose the Black Historical Society and the Simcoe County Historical Society be asked to participate in the service. And, further that a suggested date be Thanks- giving Sunday in the afternoon. Road Superintendent, Fred Haughton, was present at 1:00 p.m. to present his report for work done during the month of August and Vouchers 8 & 8A to cover same. On motion of Vousden and Halfacre, the report of the Road Superintendent as presented be accepted and Treasurer authorized to issue cheques in payment of same to a total of $70,251.53. The matter of walkway on north side of Shanty Bay Road in Shanty Bay to the School, was again discussed and the Road Superintendent advised that the work is to commence tomorrow subject to weather conditions. Deputy Reeve Steve Davie presented Road Superintendent, Fred Haughton, with a Decal from Ontario Good Roads Association to recognize that the Township Road Superintendent has completed another three day course in the "C.S. Anderson" Road School sponsored by the Ontario Good Roads Association. The decalis to be fixed to the certificate previously presented to the Road Employee. . Mr. Stuart N. Keyes was present at 1:30 p.m. to review the tender specifications for with three sets of plans and tender specifications for the Torpey Subdivision at Shanty Bay, Plan M-71, as prepared by Stuart N. Keyes & Associates Ltd. The tender specifications were all reviewed and discussed with Mr. Keyes taking into consideration the letter from the Township Solicitor suggesting that the tender call not be such as to better the standards above the requirements of the Subdividers Agreement. . . . """'lIlIIII Pg. 224 TWENTIETH MEETING - SEPTEMBER 1, 1981 On motion of Halfacre and Vousden, that the Tender and specifications and appended Drawing No.1, for Plan M-71, for the completion of unfinished services on the Torpey Subdivision, Plan M-71, as presented found satisfactory with the revision of item 13 as discussed and agreed to. Stuart N. Keyes to call the tenders which are to be in the hands of the Clerk two weeks after tender call, provided that the Ministry of Transportation and Communications have indicated that the tenders as prepared will complete the unfinished services to the satisfaction of the Ministry for assumption by the Township. Also that the Township Solicitor after having re- viewed the tenders is satisfied. The Planning Administrator was present at 2:15 p.m. to review planning and development matters. The following was presented: Ministry of Municipal Affairs & Housing, Guideline publication on the use of section 41 (formerly 35b) of the Planning Act, with regard to parkland dedication require- ments for other than plan of subdivision development. City of Barre, Committee of Adjustment, Notice of Hearing, Submission No. A46/81. Copy of correspondence re: proposal call forwarded to Ainley & Associates Ltd., Curries Cooper & Bybrand, F.F. Reinders & Associates Ltd., M.M. Dillon, Phillips Planning & Engineering Ltd., and Wm. J. Dolan Planning Consultants Ltd., requesting proposals based on terms of reference pertaining to a major Official Plan Up-dating for that part of the Official Plan north of Highway No. 11. Submittals required not later than September 17, 1981. Next Planning Board meeting tentatively scheduled for September 24, 1981, Ministry staff to be present to review proposals. On motion of Halfacre and Vousden, that correspondence as presented be placed on file. Presented MMAH approval of Amendment No. 13 to the Official Plan of the Oro Planning area. On motion of Johnson and Halfacre, that approval of O.P.A. No. 13 be acknowledged, Planning Administrator to prepare and register duplicate originals of the document in the Registry Office as required by the Planning Act., Presented further to Council's request of July 6, 1981, Oro Planning Board resolution recommending re-zoning of Part of Lots 1 & 2, Range 1, from 'AN-Natural Area' to 'H-Holding' as per development application P1/81, and a draft by-law to effect such re-zoning. Presented recommendation in respect to amendment of By-Law No. 1212/80, which would have the effect of reducing the rounded metric equivalent of a 15 foot side yard setback requirement from 5 metres (16'4 3/4") to 4.5 metres (14'9 1/8") , and draft by-law to effect same. On motion of Vousden and Halfacre, that the report of the Planning Administrator be accepted. Draft by-laws to be considered later in the meeting. The matter of unfinished services on Plan M-66, Jo-Con Developments and Letter of Credit, for same, which expires on December 9, 1981, was considered by Council, with the following action taken as a result: Pg. 225 TWENTIETH MEETING - SEPTEMBER 1, 1981 . On motion of Vousden and Halfacre, that Jo-Con Developments Ltd., be requested to confirm in writing of dates work is to be completed on Plan M-66, consisting of roads, including culverts which are damaged, ditching, grading, completion of earth berm, and chain link fence. Council would suggest that the Bank Letter of Credit, due December 9, 1981, be reviewed and up-dated should work not be carried out in 1981. Alternatively, should Council receive no communications in this regard, the Letter of Credit will be called prior to expiry date of December 9, 1981. Mr. Harold Bristow was present as arranged on the Agenda with respect to Lot 1, Plan 1195. Mr. Bristow related his proposal for the use of the property for resale of Auto Parts, and store or show room. As an additional service, a mechanic would be available to install the used part if requested. The business would not necessi- tate the storing or parking more than 8 to 10 vehicles at anyone time. The matter was left over for further discussion later at this meeting with the following action taken: On motion of Vousden and Halfacre, that Mr. H. Bristow be advised that the proposal as presented would not conform with the Official Plan and Township Restricted Area Zoning By-Law, since it would involve parking or storing of wrecked vehicles or vehicles for wrecking purposes. The letter of reply to explain the requirements of the zoning. The matter of encroachment on 20' right of way, Plan 935 for access to Lake Simcoe was brought before Council, concerns having been expressed by Grandview Beach Ratepayers Association. . After consideration by Council the following action was taken: On motion of Vousden and Johnson, that the Planning Administrator contact the Township Solicitor with respect to 20foot right of way on Plan 935, as to owner- ship of same and the Survey Plans for Lots 8 & 9, Plan 1291. Councillor Halfacre abstained from vote with reason of conflict. Motion carried. Presented letter from Ministry of the Evironment forwarding Certificate of Complicance, regarding approval of Modification to your existing livestock facilities located on the E~ Lot 14, Concession 7, Township of Oro which has been reviewed and Certificate of Compliance HC/B/9/81 has been issued subject to conditions outlined therein to Ernie Foley. On motion of Vousden and Johnson, letter and Certificate of Compliance HC/B/9/81 be received and placed on file and copy be presented to Chief Building Official. Presented letter from Ontario Plumbing Inspectors Association re: The Ontario Plumbing Inspectors Association Conference to be held September 13th to 16th, in Sarnia. And Newsletter of the Association, Issue No. 25, August 1981 including last minute information for seminar. . On motion of Johnson and Halfacre, letter be received and placed on file. Presented letter from Ministry of Municipal Affairs and Housing enclosing Ontario Municipal Energy Program Guidelines for Municipalities. On motion of Johnson and Halfacre, letter and guidelines be received and filed. ~ Pg. 226 TWENTIETH MEETING - SEPTEMBER 1, 1981 . Presented letter from the Hon. Robert Welch~ Minister~ Ministry of Energy, with respect to Oil Conversion and Energy Conservation Program~ in which it is recom- mended that the Township consider making use of the Ministry's Program to convert Municipal burning equipment to an alternate fuel and improve the thermal quality of Municipal buildings. On motion of Johnson and Halfacre~ letter~ news release along with guidelines de- tailing the procedure for making applications for oil conversion assistance, be received and filed for necessary use, should the Municipality,~after further investigation, propose to make an application. Presented circular letter from Ministry of Transportation and Communications with respect to Municipal Motor Vehicle Licensing fees for Municipal Vehicles~ further the Provincial Treasurer's instructions that preferential fees for Municipally owned motor vehicles will be withdrawn and replaced by the applicable standard fees established under the Highway Traffic Act, effective for 1982. Also directing atten- tion to a provision contained in the Highway Traffic Act which may assist in assur- ing that the Municipality does not overpay it's 1982 vehicle license fee, in accordance with Paragraph 14 of Section 5(1) of Regulation 418 (the regulation containing all vehicle fees). Presented letter from Mrs. H.A. Astridge, who has a trailer parked at Dale's Marina and Tourist Camp Grounds~ advising of a tree falling on a car and trailer, damaging Same. Apparently, the tree was on the Road Allowance. On motion of Johnson and Vousden, that Mrs. H.A. Astridge be advised that the Road Allowance at this point is under the jurisdiction of the County of Simcoe. On motion of Vousden and Halfacre~ that the Road Superintendent be authorized to order sufficient salt for the 1981-82 season. Presented letter from Ontario Good Roads Association forwarding Membership Research Questionnaire. Clerk advisded that the Road Superintendent had completed the questionnaire and same is presented for Council's review and/or additional completion should Council have any further comments. Presented letter from Horseshoe Valley Resort advising that Horseshoe Valley Ltd.~ had not informed the Township of the change in water rates for 1981 from $90.00 to $100.00~ therefor requesting that the $10.00 be added to the 1982 rates of which property owners on Plan 1587 have been advised. Horseshoe Valley Ltd will be for- warding a printed notice to the Township to enclose with water bills in 1982. . . . Presented letter from D. Woronka requesting permission to cut a dead Maple Tree in Oro Memorial Park advising that he would be responsible for cleaning up the brush and removing the tree. On motion of Johnson and Halfacre, that D. Woronka be authorized to cut the tree provided all brush along with the wood is removed when the tree is cut and that the stump be left at a heigh of 3 to 4 feet. Presented a letter from L.J. Torpey as authorization to place clean fill and level same on Lot 4, Plan M-71, when such fill is available. On motion of Vousden and Johnson, letter of authorization to place available fill on Lot 4, Plan M-71, be received and copy be presented to Road Superintendent for information should clean fill become available. Presented letter from Simcoe County District Health Unit following an inspection of Oro Memorial Park, listing work required for the 1982 season at the Park with respect to drinking fountains, washroom and change rooms. On motion of Johnson and Vousden, that the letter be referred to the Park Committee for attention and proposal of action to be taken. Presented memorandum from Ministry of Transportation and Communications forwarding "Application for Interim Payment under the Public Transportation and Highway Improvement Act on Expenditures made in the year 1981". Memorandum advises that petitions will be accepted anytime between August 31st and November 27th, 1981. On motion of Vousden and Johnson, memorandum and Application for Interim Subsidy be received and Clerk-Treasurer to complete necessary application forms and forward same. Presented letter Irom Gernott Serf, owner of Lot 25, Plan 1594, Concession 9, with respect to arrears of Taxes on the property, requesting employment to assist in paying off arrears of taxes. Clerk brought to the attention of Council the request from Ontario Hydro Social Club to hold a corn roast in Shelswell Park. On motion of Vousden and Johnson, that Council would have no objection to the Ontario Hydro Social Club having a Corn Roast in Shelswell Park, provided that they install portable toilets for the evening and that they clean up the park after use and take the necessary precautions for the open fires.
