Arbour in the chair - opened the meeting at 9:00 a.m. with Prayer. The minutes of the last regular meeting held on June 15th, were on motion of Johnson and Vousden, confirmed as printed and received. Presented copies of letters forwarded as instructed from the last regular meeting as follows: Ministry of Transportation and Communications requesting approval for Subsidy of 18 ton trailer (used) purchased to transport Backhoe/Sander and other Township Equipment. M.T.C. approval of quotation of Morris Shelswell, Excavating and Grading to Cut- Grub-Clear and Haul Stumps, Trees and Rocks from 15/16 Side Road - Also letter of approval from M.T.C. On motion of Vousden and Johnson, copies of letters as presented and forwarded be accepted as satisfactory and same be placed on file for reference. On motion of Vousden and Halfacre, that Council will monitor the Flea Market opera- tion and should further complaints be received the matter will be re-considered. Pg. 183 SIXTEENTH MEETING - JULY 6, 1981 . Recommendations from Committee of Council meeting held on June 25, 1981, were considered with the following action taken: On motion of Vousden and Davie, that the Road Superintendent be authorized to dis- pose of the #18 Ford (~ Ton) Truck by obtaining quotations from two Oro Auto Wreck- ing yards. On motion of Vousden and Johnson, that in view of request from Oro Township Rate- payers for Boat Launching facilities, a letter be forwarded to Orillia Township Council, seeking co-operation from the Township of Orillia to jointly con$tru~t a Boat Launching facility at the foot of the Town Line between Oro and Orillia Town- ship at Carthew Bay, to serve Boat Launching facilities for Ratepayers of the Townships of Oro and Orillia. On motion of Halfacre and Davie, that the Park Committee arrange a meeting with the appointed Wharfmasters of Carthew Bay, Hawkestone and Shanty Bay, to establish a common docking or berthage fee, according to tariffs set out in Regulations and other matters. And, further that signs for the docks be obtained as quickly as pos- sible. . Presented letter from Ministry of Culture and Recreation with respect to balance of Grant under Community Recreation Centres Act for Jarratt Community Hall in the amount of $1,331.73, advising that the letter is to confirm that the funds to pay this grant will be available in the 1981/82 fiscal year, and further advises that should the project not qualify for payment in the confirmed fiscal year, the com- mittment may have to be withdrawn. Clerk reported that the Secretary of the Jarratt Community Hall Committee had been advised accordingly. On motion of Davie and Vousden, letter be received and placed on file and applica- tion for final payment of Capital Grant be forwarded when all renovations to the Jarratt Community Hall have been completed and necessary inspections and reports as required have been received. Presented letter from D.S. White, Solicitor with respect to Unopened Road Allowance, between Lots 5 & 6, Concession 13, Big Cedar Parks Ltd. Letter requests that the deeds for Parts 3 & 4 of Plan 51R-9591, be executed and forwarded to his office. And, further that it is suggested that Parts 1 & 2 could be resolved should the Township agree to sell Parts 1 & 2 to Big Cedar and turn the proceeds of the sale over to Mr. G. Langman in accordance with Section 462(3) of The Municipal Act. Big Cedar have expressed interest in purchasing 1 & 2 and would like to know if it would be available for purchase and if so, at what price. On motion of Davie & Johnson, that a Council obtain an opinion of Value of Sale for Parts 1 & 2 prior to proceeding with conveyance of Parts 3 & 4 to which Council are agreeable. The Reeve called a recess to attend the opening of the O.M.B.Hearing of Amendment No. 12 and Restricted Area By-Law No. 1213/80. . Prior to Lunch, Council reconvened to pass a resolution as requested by the Solicitor as follows: Presented for consideration, a draft policy prepared by the Township's Planning Consultants, Ainley & Associates, to be incorporated by amendment into the Official Plan of the Oro Planning Area. ~ . . . ~ Pg. 184 SIXTEENTH MEETING - JULY 6, 1981 The proposed amendment would be added to Section 4 of The Official Plan - "General Development Policies" and would set out certain matters that Planning Board and Council would have regard to in considering an amendment to the Land Use Plan and/ or the implementing Zoning By-Law where additional areas for a particular use or a change in designation is required. On motion of Halfacre and Johnson, that Council are prepared to adopt the draft policy presented by way of an amendment to Section 4 of The Official Plan of the Oro Planning Area. The Chief Building Official was present at 1:05 p.m. and presented his report for the Month of June as follows: There were 20 Building Permits and 2 Plumbing Permits issued with a breakdown as follows: 3 Residential Dwellings at a value of 6 Accessory Buildings at a value of 5 Additions at a value of 2 Alterations at a value of 1 Residential Frost Wall at a value of 1 Agricultural Building at a value of 1 Renewal 1 Demolition $113,600.00 26,280.00 48,420.00 6,000.00 5,000.00 10,000.00 $209,300.00 Value of Permits for June 1980 Money received for Permits $574,260.00 $ 1,016.00 On motion of Halfacre and Johnson, that the report of the Chief Building Official as presented be received as satisfactory. Chief Building Official related the matter of action against Vincent Racco, Plan 1098, Lots 7,8, & 9. And that Mr. V. Racco had obtained a Building Permit for the Accessory Building including addition to same. Road Superintendent, Fred Haughton, was present at 1:30 p.m. to present his report for work done during the Month of June. On motion of Vousden and Davie, that the Report of the Road Superintendent for the Month of June and Vouchers 6 and 6A to cover same, be accepted as satisfactory and Treasurer authorized to issue cheques in payment of same to a total of $133,734.95. Presented letter from D.S. White, of Stewart, Esten, in response to Township letter of May 28, 1981, with respect to Road Allowance between Lots 20 & 21, Concession 14, following the request from Martin Jacobson, Soliaitor for S.H. Jacobson to convey a portion of the said Road Allowance as shown on RP 860, pursuant to the provisions of Section 462 of The Municipal Act. Township Solicitor, D.S. White advises that in the Firm's opinion, the matter should not be proceeded with further until an up-to-date survey showing both the trespass road and the Original Road Allowance has been com- pleted. Clerk also reported that following receipt of this letter, Mr. D.S. White had been contacted and as a result he had advised that he would write to Solicitor for S.H. Jacobson, requesting that the aforementioned survey be prepared by his client, without any cost to the Township. Pg. 185 SIXTEENTH MEETING - JULY 6, 1981 . On motion of Davie and Halfacre, letter be received and the Township Solicitor be advised that Council of the Township of Oro would be agreeable to proceeding with the conveyance of the Original Road Allowance, but are not agreeable to assuming any costs in this matter, as in Council's opinion the costs for survey, deeds and other documents required for the request conveyance, and all legal costs should be the responsibility of the party requesting same. Presented copies of letters from William J. Leslie, Solicitor with respect to action on behalf of Township of Oro vs V. Racco, owner of Lots 7,8,& 9, Plan 1098, regard- ing the keeping of fowl in a residential area and infraction of Building By-Law for erection of an Accessory Building and addition thereto. And, copy of letter to Mr. W.J. Leslie, advising that Mr. V. Racco has now obtained a Building Permit from the Chief Building Official for the said accessory building, and accordingly, it would appear that the charge for an accessory building without a permit no longer applies. On motion of Johnson and Vousden, copies of letter from Solicitor and copy of letter to W.J. Leslie, Township Solicitor, be received and filed for reference until fur- ther inf01:!nation or correspondence is received from Mr. W. J. Leslie. Presented letter from M.H. Seeley, Head Traffic Section, Ministry of Transportation and Communications advising that the submissions from Central Oro Ratepayers Associa- tion, forwarded for their attention had been reviewed and that the Ministry would have no objections to initiating parking prohibition, provided the following two conditions are met: . 1. Receive a resolution from Council requesting parking prohibition in the vacinity of the restaurant in question. 2. The Ministry strongly suggests the restaurant owner be informed of these proceed- ings. If he endorses the prohibition, there should be no problem receiving the re- quired Order-in-Council. With respect to the issue raised by C.O.R.A. regarding marking and lighting at over- passes on No. 11 Highway. It is the opinion of the Ministry the interchanges are marked quite adequately at the present time. The Ministry also are of the opinion that need further illumination is not demonstrated. The Ministry suggests the Township may pro- ceed with further illumination, provided the Township agrees to assume all costs as- sociated with installation, maintenance and energy. On motion of Halfacre and Johnson, letters be received and the Central Oro Ratepayers Association be forwarded a copy of the letter from the Ministry of Transportation and Communications. Presented letter from L. Boht, Shanty Bay Very Interested Parents with respect to Path or Walkway in Shanty Bay and advising that funds have been raised towards the costs of the construction of same. Letter further requests that the V.I.P. 's be advised of the next steps. . On motion of Davie and Vousden, letter be received and Clerk to reply and advise that the matter of developing the path way is still proposed by Council and if possible Prior to School opening. Council would commend the effort of the V.I.P.'s in ralslng of $1,000.00 and would suggest that further efforts to raise funds to offset the cost of the Pathway should be continued. Pg. 186 SIXTEENTH MEETING - JULY 6, 1981 . Presented copies of letters from Reid & Associates Ltd., to Stuart N. Keyes and to Allan G. Cook Limited with respect to Jo-Con Subdivision services still to be com- pleted. On motion of Vousden and Halfacre, copies of letters as presented be placed on file for reference. Presented a copy of a letter from Planmac Consultants Ltd., to the Township's Engineer, Stuart N. Keyes regarding the Water Supply System for the Quadrant Developments Subdivision in Hawkestone, Plan M-157, and advised that Mr. Keyes has received a copy of the Subdivision Agreement, including the Engineering Agreement Schedule, of the proposed development. On motion of Davie and Halfacre, that the Township Engineer be requested to advise Council in writing as to whether or not the matters as set out in Planmac Consultants Ltd., letter dated June 15, 1981 conform with all provisions of the Subdividers Agree- ment, or alternatively, whether the proposed servicing is adequate to service the development and recommendation as to amendment of the Subdividers Agreement. Presented copy of are-zoning applicat-on by Helen Holden-Quinlan and John N.D. Holden, to re-zone part of Lots 1 & 2, Range 1 from 'NA-Natural Area' to 'H-Holding'. On motion of Vousden and Davie, that the re-zoning application be received and referred to Ora Planning Board for consideration at their next regular meeting. . Presented letters from the Ministry of Environment and Ministry of Industry and Tourism in respect to the proposed tourist campground on part of lot 20, Concession 11 at the Driftwood Restaurant location. On motion of Davie and Halfacre, that the Planning Administrator prepare a draft of the necessary zoing by-law amendment to re-zone part of the east half of lot 20, Concession 11 from 'A-Agriculture' to 'T2-Tourist Campground' to be presented to Council on receipt of recommendation from the Ministry of the Environment with respect to the feasability of water supply servicing. On motion of Davie and Vousden~ Clerk to advise that in order to carry out a Commercial operation on this property would require a Zoning change and Council are not prepared to re-zone Municipal property for Commercial purposes. On motion of Davie and Vousden, Clerk to advise that in Council's oplnlon there does not appear to be sufficient need in that area at the present time~ but Council would be prepared to support an application of this nature should a Transportation firm be prepared to apply for such franchise and an adequate number of residents in the area be prepared to petition for such service to a Transportation Company. The Township do not propose to enter into a transit system at this time. Presented letter from Ray and Lorriane McCallum~ operators of the General Store in Hawkestone~ along with a 'snack bar', requesting approval of Council to open a Retail Outlet for the sale of Beer on Lot 3~ Plan 217~ on a temporary basis for the summer months. . . . Pg. 189 SIXTEENTH MEETING - JULY 6, 1981 On motion of Halfacre and Johnson, that the Township of Oro does not have approval for a Retail Outlet within the Township of Oro, only to sell liquor and beer with meals and liquor in a licensed Dining Lounge. Presented a resolution of the Township of Kingston reading as follows: "That Kingston Township Council hereby requests the Provincial Government to review the education tax system in consultation with the Municipalities of Ontario with serious consideration being given to amending the present property tax base formula and further consideration be given to amending the provincial Grant system to provide more funds to Municipalities. A copy of this resolution be sent to all Municipalities in Ontario seeking their support. On motion of Johnson and Halfacre, letter and resolution be received and the Council of the Township of Oro support the resolution of the Township of Kingston and The Minister of Education, Treasurer of Ontario, The Organization of Small Urban Municipalities and Local M.P.P. be advised accordingly. Presented copy of resolution from the Town of Leamington, requesting support of same which reads: "That the Government of Ontario be requested to institute a low interest mort- gage program for home buyers in the Province similar to that enjoyed by the residents of Nova Scotia as follows: -Mortgage interest rates vary according to family income. -The highest interest rate, for those families earning a maximum of $30,000.00 per year, is the value of the Province's borrowing rate plus ~ of 1 %. -Interest rate decrease ~ of 1% for each *875 of annual income below $30,000.00 down to a maximum figure of 11%. -Interest rate remain fixed for the life of the mortgage. -Mortagages are non-assumable and apply only to owner-occupant homes. And further that this resolution be circulated to all Municipalities within Ontario for endorsement with the request that notice of such endorsement be forwarded to their local member of the Legislature Assembly. On motion of Halfacre and Johnson, that the Council of the Township of Oro support the resolution of the Town of Leamington. Presented from Clerk, County of Simcoe, Report No. 26 of the General Government Com- mittee with respect to sale of all County Publications - The Visible Past; The Recent Past; All for a Beaver Hat and The History of Simcoe County. Also Report No. 12 of the Agriculture, Planning and Development Committee, endorsing the resolution of the Borough of York, which urges the Ontario Government to legis- late the Ontario Fire Code with specific inclusion of (Part 9) which deals with up- dating of fire safety standards, where required. On motion of Davie and Vousden, Certificate of Compliance as presented be received and filed with a copy to Chief Building Official. Presented letter from Ministry of Housing with respect to IITraining of Municipal Housing Inspectors - 1981 Study Session, to be held August 30 and September 1 & 2, 1981, and major forum,_ entitled IIBuilding Toward 2001" - November 1 - 4, 1981. On motion of Davie and Halfacre, letters be received and filed for reference and copy be presented to Fire and Building Committee for review and comment. Presented from City of Barrie copy of By-Law 81-47, being a by-law to amend the City of Barrie Restricted Area Zoning By-Law No. 69-33, by re-zoning part of a Residential Hold Zone south of Grove Street to Major Institutional. Clerk advised that the By-Law is beyond the 400 foot required area for circulation but it is being forward of abut- ting Municipality and that the By-Law would not appear to affect the Township of Oro. On motion of Davie and Vousden, copy of notice of By-Law 81-47, as presented be re- ceived and placed on file for reference. Presented a proposed application for approval of Project and Committment of Capital Grant under the Community Recreation Centres Act, 1974, for Hawkestone Community Hall for the purpose of upgrading the Hall as follows: 1) Insulate the building 2) Windows to be replaced - upper and lower 3) Upgrade Fire Regulations 4) Renovation to interior of building 5) New lights, dry wall, new ceilings 6) Renovation of exterior - new eaves trough, painting of building. Total proposed cost being estimated at $9,515.42. On motion of Johnson and Halfacre, that once all necessary information is received, Clerk to complete the application for approval of Project and Committment of Capital Grant. Presented letter fromMinistryof Natural Resources addressed to the attention of Deputy Reeve Davie with respect to authorization of marker buoys in front of Oro Memorial Park and regulation for control of same in response to meeting held on April 14, 1981 on the site by Mr. A. Bosman and Park Committtee. On motion of Halfacre and Davie, letter be received and Park Committee to reply to letter from the Ministry of Natural Resources with respect to Water Lot and erection of Marker Buoys in front of Ora Memorial Park Beach Area. On motion of Halfacre and Johnson, that the Park Committee be authorized to purchase the Markers for the Beach Area at Memorial Park and have same erected. ~ . . . ~ Pg. 191 SIXTEENTH MEETING - JULY 6, 1981 Presented letter from Stuart N. Keyes as an estimate to move and place on foundation pad at a cost of $31,460.00. On motion of Vousden and Davie, that the letter of estimate be referred to Committee of Council for consideration. Reeve advised that Pitfield, Ross, McKay are closing their office and the used office equipment was available at a reasonable price and since the Chief Building Official required a new or better used desk this would be an opportunity to obtain same along with other office furniture which could be used by the Township. On motion of Davie and Vousden, Oro Council concur with the letter from the County of Simcoe to Ministry dated October 27, 1980 and are prepared to accept the transfers as set out in the letter with reference to letter from the Ministry dated September 29, 1980 subject to the Township Raod Superintendent being in agreement with the Transfers as set out in the letter of the Township to the County of Simcoe and letter from the County to the Ministry of Transportation and Communications as forwarded by L.E. Clar~, P. Eng. Simcoe County Engineer. Councillor Vousden reported on Waste Disposal and requested a breakdown:of expenditures for the Waste Disposal Site for the next Committee meeting.
