TWELFTH MEETING
Council met pursuant to adjournment with all members present.
Reeve R.S. Arbour in the chair.
The meeting was opened by the Reeve at 9:30 a.m. with prayer.
The minutes of the meeting of April 22nd and 27th were on motion of Vousden
and Halfacre, confirmed as printed and received with correction on Page 139
stating that the picnic rates shown are to be for weekdays and picnic rates
for Saturdays, Sundays and Holidays to be $2.00 per person.
Presented copies of letters forwarded as instructed at the meeting of
April 22nd and 27th, as follows to:
The Hon. James Snow, Ministry of Transportation and Communications, acknowledging
letter with respect to overpass at Line 9 and Highway No. 11;
Ivan Clark re: drainage and cleaning of ditch;
St. John Ambulance forwarding Annual Grant;
Successful tender Contracts 81-01; 81-02; 81-03; 81-04; 81-05; 81-06 and

On motion of Johnson and Halfacre, copies of letters as presented and
forwarded accepted as satisfactory and be placed on file.
Recommendations of Committee of Council regarding services Plan M-66 (Jo-Con
Developments) and matter of issuance of building permits on Phase 2,
following inspection of the roads and services on Thursday with Township
Engineer, Stuart N. Keyes, Peter Smith, Consulting Engineer for Jo-Con
Developments, Township Road Supt. and members of Council.

On motion of Halfacre and Johnson that the matter be tabled until correspondence
is received from the Township Engineer and Jo-Con Developments and building
permits be withheld for Phase 2 of Plan M-66 at this time.
Presented letter from Stewart, Esten, David S. White, in reply to Township
letter of April 8, 1981 with respect to keeping of fowl on Lots 7, 8, and 9
of Plan 1098 being a residential area.
On motion of Davie and Vousden that the matter be referred to the Solicitor for
necessary legal procedure, according to Solicitor's letter of April 29th, 1981.
Presented letter from Stuart N. Keyes~ Township Engineer~ in reply to Township
letter of April 9~ 1981 with respect to culvert into Hawkestone Park from
Cedarbrook Crescent on Plan M-157.
On motion of Johnson and Vousden that the Road Supt. be authorized to install
a 18" x 20' culvert (16 gauge) at the entrance to Hawkestone Park from
Cedarbrook Crescent, Plan M-157 as indicated on project plan 7719 and
Quadrant Development be billed for 50% of the cost of the culvert and
installation. And that the matter of bridge over open culvert be further
considered when the development is complete.
In accordance with the agenda for the meeting~ 11 applications for Tax
Adjustments under Section 636(A) of The Municipal Act~ were presented for
Council's consideration with the following action taken:
Application No.1 - William & Grace Bateman~ EPT Lot 18~ Con. 3. A barn on
the above property was demolished on January 16~ 1981 and is therefore
entitled to a cancellation of building taxes from February 1 to December 31~ 1981.
Taxes are to be cancelled on the Public Residential Assessment of 146.
Taxes to be written off in the amount of $30.62.
Application No.2 - Salvatore Mascioli, SPT Lot 20~ Conc. 3. Since Tenant #0001
ceased to carryon business on a portion of the property in 1979~ we recommend
that taxes to the owner be cancelled on a conversion of rates from commercial
public to residential public~ based on the occupant assessment of 1000~ from
January 1 to December 31~ 1980. Taxes to be rebated in the amount of $57.79.
Application No.3 - Salvatore Mascioli~ SPT Lot 20, Conc. 3. The above
occupant ceased to carryon business on a portion of the property at this
address in 1979. Business taxes based on the business public assessment of
300 are to be cancelled from January 1 to Decmeber 31~ 1980. Taxes to be
rebated in the amount of $69.58.
Application No.4 - Mary Lois Crawford, NPT Lot 11~ Conc. 4. Since Tenant #0001
Snider~ Marion and Greaves~ Gary ceased to carryon business at this location
on February 28~ 1981, we recommend that taxes to the owner be cancelled on
a conversion of rates from Commercial Public to Residential Public based on
the occupant assessment of 1113 from March 1 to December 31~ 1981. Taxes
to be written off in the amount of $37.42.
Application No.5 - Marion Snider and Gary Greaves~ NPT Lot 11~ Conc. 4. The
above occupant ceased to carryon business at this address on February 28~ 1981.
Business taxes based on the business public assessment of 330 are to be
cancelled from March 1 to December 31, 1981. Any new occupant will be added
by Supplemental Assessment. Taxes to be written off in the amount of $73.92.

Application No.6 - Vernett Holdings Ltd. Pt Lt. D & E Con. 1. Since
Tenant No.0002 Dynes Wismer Limited ceased to carryon business at
this location on March 13, 1981, we recommend taxes to the owner be
cancelled on a conversion of rates from Commercial Public to Residential
Public based on the occupant assessment of 16,040 from April 1 to
December 31, 1981. Should the premises again be used for business
purposes this year the occupant assessment wil be converted to the
commercial tax rate by supplemental. Taxes to be written off in the
amount of $485.05.
Application No. 7 - Dynes Wismer Limited, Pt. Lt D & E Con. 1. The
above occupant ceased to carryon business at this address on March
13, 1981. Business taxes based on the Business Public Assessment of
9620 are to be cancelled from March 14, to December 31, 1981. Any
new occupant will be added by Supplemental assessment. Taxes to be
written off in the amount of $2,047.21.
Application No.8 - Gerald M. Vanamelsvoort,Spt. Lot 4 Con. 4. Because
of a gross error on the assessment roll (Transposition of figures from
Tenant 0001 to Tenant 0002) the owner of the property is entitled to
a cancellation of taxes from January 1 to December 31, 1981. Taxes
to amended on the property based on the Tenant Assessments. Taxes to be
written off - Conversion $49.04, Commercial Public $210.81. Total $259.85.

Application No.9 - Gerald M. Vanamelsvoort, Spt. Lot 4 Con. 4. The
business tenant of the above property has been inadvertently overcharged
by reason of a gross error on the assessment roll and is therefore
entitled to an adjustment in business taxes from January 1 to December
31, 1981. Taxes to be cancelled based on the Business Separate
Assessment of 596. Taxes to be written off in the amount of $160.67.
Application No. 10- Helen L. McKay, Wpt. Lot 15 Con. 10. The barn on
the above property was demolished in January 1981 and is therefore
entitled to a cancellation of Building Taxes from February 1 to December
31, 1981. Taxes to be cancelled based on the public residential assess-
ment of 48. Taxes to be written off in the amount of $10.06.
Application No. 11- Frederick & Louise Janes, Ept. Lt 16 Plan 655. The
cottage on the above property was demolished in November 1979 and is
therefore entitled to a cancellation of building taxes from January 1
to December 31, 1981. Taxes to be cancelled based on the Public
Residential Assessment of 319. Taxes to be written off in the amount
of $90.90.
On motion of Halfacre and Johnson , the above properties, as
recommended by the Assessors of the Simcoe County Assessment Office
(Region 16) for assessment reductions be accepted and the appropriate
tax adjustments be applied.

The matter of the Township Insurance Policy was further considered with
respect to recommendations presented by the Township Insurers with regard:
to content and equipment floater.
On motion of Halfacre and Johnson that recommendation on page 2 of "Risk
Management Report 1981, Recommendation for Content and Equipment Floater"
be accepted by Council and the deductible limit be at $500.00 and suggested
amounts be incorporated as shown to total of $283,000.00.
On motion of Davie and Vousden, that recommendations of Committee of Council
be accepted in principle and items 1 to 7 be approved as follows:
Item 1 - The low quotation of R. Law Construction be accepted and work
performed under supervision of Road Supt.
Item 2 - Council authorize membership to OACETT.
Item 3 - Road Supt. be authorized to have trucks painted by Trans Canada Coating.
Item 4 - Council agree with Road Supt. to reduce the use of road oil.
Item 5 - The level not be sold at this time.
Item 6 - Council authorize the hiring of an extra road employee and summer
help for survey purposes.
Item 7 - A letter of reply be forwarded to Mr. Robert Ryder with respect to
concern regarding flooding.
Item 8 - Mutual Agreement Drain be drafted once profile drawing has been completed
by Road Supt.
The following recommendations of the Waste Disposal Committee from Committee
of Council meeting of April 30th were further considered.
1 (a)
AC 840 Front End Loader - when this machine is not in operation at
the Waste Disposal Site, it should be utilized by the Roads Department
on a cost-share basis.
1 (b)
Tires for Front End Loader - as of April 14, 1981 the two front tires
of the above mentioned machine were returned after being filled with
a special foam. The machine has been operational for two weeks and
the expenditure for these special tires appears to be most beneficial.
The other three tires are to be loaded prior to the winter hours, on
a cost-share basis with the Roads Department.
2.
Keys held by various Contractors, Agencies and private collectors -
it is the committee's recommendation, in view of the abuse previously
shown by a private collector in the Township (namely Edward Handy)
and by the personnel at the Edgar Occupational Centre, that the lock
on the gate should be changed.
One key to be allocated to the District Fire Chief, Al Moore, of the
Edgar Occupational Center and he alone to be responsible for same;
one key each to be given to the Roads Department, Browning and Sanders,
Fuda Foods and Pinegrove Collection Contractor.

3. Burning of waste or brush at Disposal Site - this practice will be
totally discontinued.
4.
Stickers on vehicles for the purpose of identifying Oro Township
Ratepayers - the Committee sees the issuance of these stickers would
cause a problem and an expense and therefore is not warranted.
5. Consideration has been given to the opening of the Waste Disposal
Site on Sundays - the additional cost is not warranted.
6. Installation of a telephone at the Waste Disposal Site - with regard
to break-ins, vandalism, and mis-use, it is the opinlonof the Committee
that the installation of this piece of equipment is not feasible.
In view of the fact that in the fall of 1981, the Roads Department
will be stock-piling sand and salt at the site, it is for Council's
consideration at that time, that the Committee recommends that a hand
held radio for communication to the Roads Department Office, at a
cost between $950.00 and $1,000.00 should be purchased.
7.
The hours worked by the Superintendent of the Waste Disposal Site
(James Clayton) - in view of the fact that summer hours have been in
existance one month, no change in the summer hours is recommended.
As of November 1st, 1981 the winter hours commence and it is recommended
by the Committee that the hours be changed to 8:00 a.m. to 5:00 p.m.
making a 36 hour week in the winter, with no reduction in the basic
salary of this employee of a 40 hour week. The unsafe conditions
after dark in the winter make this a much more viable work-week.
If this employee can be used by the Road Superintendent, to operate the
machine for truck loading of sand and salt one day a week, the employee
is to be paid straight time over his 36 hour week.
On motion of Vousden and Halfacre, that the recommendations of the Waste
Disposal Committee be accepted, items 1 to 7 listed and included in Committee
of Council minutes. And further that Adult Occupational Centre and Mr. E. Handy
be advised with respect to item 2, keys for Waste Disposal Site.
On motion of Davie and Halfacre, that James Clayden, Waste Disposal Supt. be
given the same five cent (.05~) per hour increase as clothing allowance, being
the same as Road Employees and that this be retroactive to January 1, 1981.
Motion Defeated.
The Chief Building Official, Jim Shellswell was present at 11:30 a.m. to
present his report for thelmonth of April.

On motion of Vousden and Halfacre that the report of the Chief Building
Official as presented be received and filed.
The matter of extension to sewage lagoon on W~ Lot 17, Con. 7 operated by
Lloyd Squire was further considered by Council and the following action
was taken.
On motion of Halfacre and Johnson that Oro Council, after having consulted
with the Township Consultants - Ainley & Associates Ltd., and the Ministry
of Housing verbally and have been advised in writing by the Consultants that
the existing sewage lagoon on W~ Lot 17, Concession 7 is not in conformity
with the Official Plan and requires an Amendment to the Official Plan
to permit a sewage lagoon. Council are of the opinion that an extension
to the present sewage lagoon which is not in conformity with the Official
Plan and Restricted Area Zoning By-law, approval for an extension cannot be
authorized without an Amendment to the Official Plan and Restricted Area
Zoning By-law as recommended by Ainley & Associates Limited.

Clerk presented report of Road Supt. for work done during month of April,
as prepared by him, and in his absence due to his attendance at Road School
in Guelph, and Vouchers 4 and 4A to cover same.
On motion of Davie and Vousden, report of Road Supt. be accepted, as presented,
and Treasurer authorized to issue cheques in payment to a total of $23,492.00.
The Planning Administrator was present at 1:30 p.m. to review planning and
development matters. The following correspondence was presented:
Ministry of Housing, advising of receipt of O.P.A. No. B and the Ministry's
circulation of same;
Township of Vespra, circulation copy of By-law No. 81/10 in regard to the
proposed re-zoning of part of Lot 32, Concession 1, W.P.R. Township of Vespra.
On motion of Vousden and Halfacre that correspondence as presented be
placed on file.
Presented photographs taken by the Chief Building Official on May 1, 1981
of Part of Lot 21, Concession 6, with regard to a forthcoming delegation
by Mr. Richard Hunt in respect of a proposal to rezone the property from
IIT2 - Tourist Campgroundll to IICI - General Commercialll.
Presented letter from Ministry of Transportation and Communications advising
of Highway Contracts W.P. 162-75-09 on No. 11 Highway from 7.4 km. north
of Highway 169 Washago including structures, which will require fill and grade
material. Letter indicates four aggregate sites in the Township of Oro which
will be included to bidders as potential sources for gravel extraction as
Way Side Pit. Letter requests Council's comments. Clerk advised that these
areas have been listed in the last several years by M.T.C. for Highway
Construction Work. Reason for letter being for Council to comment regarding
the listing of the pits.

On motion of Johnson and Davie, Oro Council would have no objection to the Pits
listed in the letter dated April 22, 1981 namely R. Sparrow - Lot 9,
Concession 6; Cook Construction - Lot 7, Cone. 8; Middelton (now Belcourt)
Lot 8, Cone. 8; and Hodgkinson - Lot 7, Cone. 10, being included in the
Aggregate Source List for Wayside Pits, for Contract W.P. 162-75-09 on No. 11
Highway, but would request a meeting with the successful bidder and
representative from the Ministry of Transportation and Communications to
obtain assurance that the necessary provisions will be included to provide
for dust control, special speed limit of trucks using the Township
roads to the pit or pits, as well as essential provisions for school bus
routes on the roads involved, with respect to safety of children.
Presented letter from Beverley Martin, Treasurer for Hawkestone Community Hall
Committee, being a letter of resignation from the said Hall Committee since
he is moving to Barrie. He further advises that Steven Cook will be taking
over his office as of May 1, 1981.
On motion of Vousden and Johnson letter of resignation from Beverley Martin
as member of Hawkestone Community Hall Committee and Treasurer be accepted,
and recommendation that Steve Cook replace him meets with the satisfaction
of Council and Steven Cook be appointed as a member to the Hawkestone Community
Hall Committee and he be advised accordingly as well as the President of
Hawkestone Community Hall Committee.
Presented letter from the Council for Canadian Unity with respect to
Canada Week - June 25th to July 1, 1981, letter encourages Canadians to
celebrate Canada's Birthday. Also enclosing suggested proclamation.
On motion of Davie and Vousden, that the Township of Oro proclaim Canada Week
and the suggested proclamation be used and posted in appropriate places once
it is signed by the Reeve.
Presented letter from Earl Richardson, Secretary, Craighurst Planning Area
confirming meeting of Craighurst Planning Committee to be held on May 5th,
1981 at the Craighurst Hall at 8:00 p.m. The agenda includes the election
of a Chairman.
On motion of Davie and Halfacre, that the Reeve and Chairman or Vice Chairman
of Planning Board to attend.
Presented letter from Robert Ryder expressing concern about possible flooding
from creek adjacent to his property because of the improvement and building
up of 15/16 Side Road in Concession 2, and requesting opportunity to attend
a Council Meeting to explain in more detail the sources of concern.
On motion of Johnson and Halfacre, letter be received and Clerk to reply and
advise that Council appreciate having this matter brought to their attention.
In Council's opinion the residence has been erected in a low lying area, and
the Road Supt. has advised that during construction in this area of 15/16
Side Road, all precautions were taken for the flowing of water. Council feel
that a meeting with Council at this time would not resolve any matters. It
may also be noted that should the widening of the bridge be programmed in
the future, additional precautions, if required, will be investigated at
that time.

Presented resolution from Town of Stayner opposing the 1981 Operating
Budget passed by Simcoe County Board of Education.
. On motion of Halfacre and Vousden, letter and resolution be received and
filed with no action taken.
Presented a letter from the Township of Georgina objecting to introduction
of Private Members Bill with respect to allow the construction of generating
stations on the Musquash River and Go Home Lake. Letter requests support
of their concern.
On motion of Davie and Vousden, letter be received and filed for future
reference.
Presented letter from Mrs. Mary Rist, Plan 1098, requesting Council's approval
to erect a fence on the west side of their property to a greater height than
authorized under By-law No. 1123 in residential area.
On motion of Vousden and Johnson, letter be received and Clerk to advise of
Fencing By-law and make reference to alternatives under Section 6.1(d) a
privacy screen.
Mr. Richard Hunt, one of the co-owners of Part of Lot 21, Concession 6, was
present at 3:05 p.m. as arranged, to discuss with Council his proposal
for re-zoning of their property from "T2 - Tourist CampgroundJ! to "C1 -
General Commercial". Further to the Township's letter of August 8, 1979
and November 26, 1979 the terms and conditions of demolition permit
No. 170/78 have have not been complied with.

The application for re-zoning was presented to Council including
first application of 1976 and later application of June 5, 1979.

On motion of Davie and Vousden, that Oro Council will request the Chief Building
Official and Fire Chief to inspect the property with respect to uses other
than for a single family residence and fire and plumbing regulations, prior
to further consideration for the re-zoning of the property for which Mr. Richard
Hunt is to present an updated plan of the proposal for rezoning, which may
only be accomplished by a Site Development Agreement under Section 35(a)
of The Planning Act, should Council be prepared to entertain the rezoning.
Mrs. Lynn Boht and Mr. Gordon Grant were present at 3:50 p.m. as scheduled
on the Agenda with respect to the walkway on the north side of Shanty Bay
Road from the Community Centre property easterly to Shanty Bay Public School.
Mrs. L.cBoht advised that the purpose of attendance was to enquire as to
status of walkway and whether any estimated costs have been arrived at.
It was suggested by Council that the Shanty Bay Community should be prepared
to raise funds to cover the costs of the walkway and the Road Supt. would
be requested to prepare costs for the construction of the walkway.

Roy Briggs and Ronald Arthur Briggs, Part ~~ Lot 15, Cone. 7, as shown
on R.P. 51R-I0224 for the erection of a nine strand post and wire
fence for a distance of 150-353 metres in length and construction to M.T.C.
standard DD-901, by the purchaser be authorized and same be signed by the
Reeve and Clerk on behalf of the Corporation of the Township of Oro and
executed by the Vender. After execution of the document same be forwarded
to Solicitor to complete the transaction as necessary.

On motion of Johnson and Halfacre, letter forwarding capacity rating for
Edgar Occupational Centre for capacity of 258 and a total amount of $12,900.00
be accepted and same be confirmed as approved for application for 1981
Municipal and County Levy and Clerk to forward the 1981 Tax Bill to the
Occupational Centre after July 1, 1981.
A By-law to amend Restricted Area By-law No. 1031 as amended was presented,
the purpose of the By-law being to re-zone part of Lot 21, Concession 5, from
"A-Agriculture" to "C2 - Highway Commercial" and to permit, be exception,
the sale of used automative vehicles from the subject lands.
On motion of Davie and Johnson that a By-law to amend Restricted Area
By-law No. 1031 as amended, as introduced be numbered as By-law No. 1236/81
and read a first time.

On motion of Vousden and Halfacre, that By-law No. 1236/81 read a first time,
be read a second time.

On motion of Halfacre and Johnson, that By-law No. 1236/81 read a second time,
be read a third time.
On motion of Vousden and Davie, that By-law No. 1236/81 now read a third time,
do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Planning
Administrator to circulate the By-law as required pursuant to the
provisions of Section 35(24) of The Planning Act.
Deputy Reeve Davie reported on the grave yard on the north side of County
Road No. 11 adjacent to the Waste Disposal Site.
On motion of Davie and Halfacre, that the matter of maintenance of the grave yard
on north side of County Road No. 11 adjacent to the Waste Disposal Site be
to the Roads Department for annual maintenance.
The matter of Dog Licenses not yet obtained was again discussed.
On motion of Davie and Vousden, Councillor Vousden and the Clerk to contact
persons to sell dog licence on a door to door basis to dog owners who have
not obtained a 1981 licence and may advertise for same if necessary.
On motion of Vousden and Johnson the following accounts were passed for
