COUNCIL CHM1BERS - APRIL 22, 1981
TENTH MEETING
.
Council met pursuant to adjournment and as notified to meet April 22nd
in place of April 21st because of conflict with County Council.
All members present.
Reeve Arbour in the chair, opened the meeting with prayer. A number of
ratepayers were present for the first part of the meeting as well as the
media, namely CKVR TV - Barrie Examiner and other reporters.
The minutes of the last regular meeting were on motion of Halfacre and
Vousden confirmed as printed and received. Carried.
Clerk presented copies of letters forwarded from last regular meeting
as follows:

On motion of Vousden and Halfacre copies of letters as presented and
forwarded accepted as satisfactory.

Presented copy of letter to W.D. Russell, Q.C. requesting legal oplnlon,
advice and direction to Council with respect to meeting of March 30, 1981
at which Allan K. McLean submitted his resignation as Reeve, and Council
accepted his resignation and declared the seat vacant. Council then
appointed Councillor R.S. Arbour as Reeve to fill the vacancy and filled the
vacancy of Councillor by appointing Allan Johnson.
Presented letter from W.D. Russell, Q.C. in reply, being a legal opinion
as requested by Council.
Also presented letter from Peter Mills, Q.C., Solicitor from the firm of
Stewart, Esten confirming legal opinion as requested prior to last regular
meeting, which had been verbally given by telephone.
The letter from Stewart, Esten was first read to Council. The letter
expressed the firm's opinion that Council had acted within the terms of
the Municipal Act and that in their opinion the two appointments were
made properly, as all members of Council were in attendance and all
members took part in motions and voting, with no remaining member of
Council having made objections to the proceedings at the meeting of
March 30th, 1981.
On motion of Halfacre and Vousden the letter of oplnlon from St,ewart,
Esten as read, be received and filed for necessary reference. Carried.

The letter from W. D. Russell, Q.C. was next opened and at the request of the
Reeve, copies were made for each Councillor, before the letter was read.
In his letter, Mr. Russell listed the documentation reviewed and that
the legal opinion is based on the fact situation numbered 1 - 16.
Also listed 5 alternatives that any member of Council could have taken. The
conclusion of the letter being that the only way that the proceedings
of March 30th can now be unwound is by an Order of the Court. Council
had acted within their rights as elected representatives and within the
provisions of the Municipal Act. Full details of the letter are not
recorded as letter is on file.
Reeve R. S. Arbour after letter had been read again reviewed the points
and advised that as result of the legal opinion, the present Council would
accordingly stand until the next election. He concluded that he had prepared
his resignation, should the legal opinion have been that appointments had
not been made in accordance with the Municipal Act.
Deputy-Reeve Davie then addressed himself to the letter of legal oplnlon
from the Solicitors, stating that he was dissappointed and that he was
speaking not only for himself but also for number of ratepayers. He advised
he would be meeting with ratepayers as to whether further action will be necessary
or be taken. He concluded that no further time of Council should be taken
up at this time and Council should proceed with the business scheduled on
the agenda.

It was then moved by Deputy Reeve Davie and seconded by Councillor Vousden
that the legal opinion of W.D. Russell, Q.C. as had been requested by Council,
be received and filed for any necessary reference. Carried.

Letters from concerned ratepayers, Oro Station Area Ratepayers Association,
and Simcoe Side Ratepayers Association were next presented, expressing their
opinions with respect to Council's action in filling the vacancies by
appointment.
After all letters were read, the following action was taken.
On motion of Halfacre and Davie that the letters received from Ratepayers
Associations and concerned ratepayers of Hawkestone Police Village and
surrounding area, be received and filed for reference.
Presented memo from Manager, Municipal Roads Office, advising that the
Annual Return, Statement of Expenditure on roads in 1980, as submitted, has
been approved and forwarded for payment of balance of subsidy for 1980,
in the amount of $51,746.42. Clerk advised the cheque had been received
on April 21, 1981.
On motion of Halfacre and Vousden, the memo from M.T.C. advising of
approval of 1980 balance of Road Subsidy and receipt of cheque in the
amount of $51,746.42, accepted as satisfactory.
Presented copy of letter from Skelton, Brumwell and Associates Ltd.
to Simcoe County Health Unit with respect to application forms and
drawings for Lots 19 and 20, PlaniM~118 (Lakeview Estates Subdivision)
and certifying that the buildings proposed for the lots will be compatible
with proposed lot grading plan for the subdivision (Drawing No. 7381-5) as
required in Subdivider's Agreement.

On motion of Vousden and Johnson, copy of letter be received and filed for
reference and a copy be made for Chief Building Official.
Presented two letters from Trustees, Hawkestone Police Village, with
respect to payment of audit fees for Hawkestone Community Hall.
Clerk advised that the audit fees for Hawkestone Community Hall had been
paid by the Municipality in 1980, which had not paid because the
account had been returned to Ontario Hydro because of error in computor
print-out and requesting that the surplus for Police Village for 1980 be
applied to payment of the account when received, and not used to reduce the
Trustee's levy for 1981. Clerk advised that the 1980 surplus had not been
applied to calculate the Trustee's mill rate for 1981 and that the Township
Auditors had been contacted in this regard.
On motion of Davie and Vousden that the letters as presented be received
and Clerk to reply and also advise that the 1980 street light account will
be paid out of the 1980 surplus and that the surplus has not been applied to
reduce the Trustees 1981 levy. Council are of the opinion that it would
be helpful if the Trustees could submit accounts on a regular basis,
so as to be on time for monthly accounts.

Presented letter from Robert Patten, Assistant Resources Manager,
Nottawasaga Valley Conservation Authority forwarding copies of regulations under
the Conservation Authorities Act, in regard to use of lands owned by the
Authority and used by the Public, as requested by Council at last regular
meeting. Letter also advises of rates used by the Authority and posting
of signs.

On motion of Davie and Halfacre letter and copies of regulations be received
and filed and matter be referred to the Park Committee for their information.

Clerk advised of telephone enquiry from Reid and Associates Ltd., consui:tants
for Jo-Con Developments with respect to building permits for Phase 2,
Plan M-66. Also presented summary of unfinished services on Phase 1.
On motion of Davie and Halfacre, the matter be tabled and further considered
at the Committ of Council Meeting on April 30th, and recommendation be
presented to Council at the next regular meeting and that in the interim, the
Road Supt., Township Engineer and Council arrange to meet with Peter Smith
of Reid & Associates.
Presented letter of credit from the Royal Bank, Barrie, on behalf of
Graham Ford Sales Ltd. (Hitch House Ford Ltd.) as requested by Council
in the amount of $3,200.00 as assurance for trade-in Ford 1975, L-9000
Truck, being picked up prior to delivery of new truck as per tender.
Also copy of letter to Hitch House Ford Ltd. returning cheque in the
amount of $3,200.00 as agreed to by Council.
On motion of Davie and Vousden, letter of credit in the amount of $3,200.00
be received and copy of letter forwarded to Hitch House Ford Ltd. returning
cheque be filed for necessary reference. And, further that the Clerk to bring
the matter of letter of credit to the attention of Council at the first
meeting in September and advise of status at that time.

Presented letter from the Hon. James Snow, Minister, Ministry of Transportation
and Communications in reply to Township letter of March 17, 1981,
requesting clarification of the timing for construction of proposed interchange
on No. 11 Highway at Line 9, Township of Oro. Letter advises that the
earliest estimated completion of the design in mid 1982. Pre-contract
engineering activities on the project have already commenced.
On motion of Vousden and Johnson, letter be received and filed for
necessary reference in this regard and Clerk to reply and express
Council's appreciation of his reply.
The matter of appointing a member of Council and Planning Board to the
Craighurst Planning Committee was next considered by Council.
On motion of Halfacre and Vousden, that the Reeve and Chairman of the
Oro Planning Board be appointed as representatives to the Craighurst
Planning Committee and Clerk to advise the Secretary of the Committee
accordingly.

On motion of Vousden and Davie, that Council withold circulation
response to the Ministry of Housing on subdivision proposal 43T-81011 pending
notification from the Ministry of the Environment and/or Simcoe County
District Health Unit indicating approval of the required sub-surface sewage
disposal and drainage plans to service the proposed development. And
further, that the Planning Administrator contact the Ministry of the
Environment with respect to their response to the Ministry of Housing.
Presented registration information regarding the Ministry of Housing's
Planning Staff Workshop to be held on June 4, 1981 at the King Campus
of Seneca College.
On motion of Davie and Vousden, that the Planning Administrator be authori0ed
to attend and expenses be paid.
Clerk advised that as instructed at a meeting of Oro Council held on
March 16, 1981 tenders had been advertised in the Daily Commercial News
(two issues) and one issue of the Barrie Examiner and Orillia Packet,
calling for tenders for dust control 81-01; Pit Run Gravel 81-02;
Crushing and applying curshed gravel 81-03; Surface Treating 81~04;
Asphalt Surfacing - 81-05; culvert pipe 81-06; Equipment Rental 81-07
as well as calling for quotations for non asphaltic oil for dust control.

On motion of Vousden and Johnson tenders be received and Road Supt. to
review all tenders and report to Council at the next Committee Meeting
on Apr. 30th for Council to recommend acceptance of a tender at the next
meeting on May 4th, 1981.

On motion clDavie and Johnson, that the tenders for equipment rental,
as presented, be received and Road Supt. to correlate all equipment and
hourly rates, for reference when equipment is required.

Road Supt. Fred Haughton presented a letter from County Weed Inspector
with respect to meeting to be held on April 24, 1981 at the County
Administration Building.
On motion of Davie and Vousden, that the Road Supt. be authorized to attend
a Weed Control Information Meeting to be held on Friday, April 24th, 1981
at the County Administration Building.
Mr. Ron Johnston, Township Insurance Agent and Mr. Wayne Erdelac from
Frank Cowan Insurance were present according to appointments to review the
Township Insurance Policy and Premium for 1981, the due date for policy premiums
being May 1, 1981.
Mr. Erdelac reviewed the Township Insurance Policy and Premiums for same
and offered certain recommendations as well as answering questions of Council.
On motion of Halfacre and Vousden, that the presentation and recommendation
of the representative of Frank Cowan Insurance be further reviewed and
Township will advise of any changes following same.
Presented letter from Ainley & Associates in reply to Township's letter
requesting comments on the proposed lagoon extension on part Lot 17,
Concession 7. The comment of Ainley & Associates refers to an Amendment
to the Official Plan and Restricted Area By-law.
On motion of Halfacre and Vousden, letter be received and further reviewed
when Mr. Lloyd Squire is present for his appointment.

Mr. Lloyd Squire was present at 4:15 p.m. according to appointment
with respect to enlargement of lagoon for sewage disposal and a survey
plan was presented showing the present lagoon system and proposal for
enlargement.
When Mr. L. Sq~irewaspresent, the letter received from Township Planners
Ainley and Associates, which was previously presented to Council was again
read for Mr. Squire's benefit and discussed with Mr. Squire.
On motion of Vousden and Halfacre that the Planning Administrator or
Clerk to contact the Ministry of Housing as to whether an amendment
to the Official Plan and/or Restricted Area By-law is required for the
use of an existing sewage lagoon in an agricultural area and if an
amendment is necessary could this be accomplished by a By-law to include
a sewage lagoon in an agricultural area and the extension to the present
lagoon which has been approved by the Ministry of Housing.
Presented letter from St. John Ambulance, Provincial Headquarters applying for
a grant to help volunteers to continue to serve the community.
On motion of Johnson and Davie Oro Council authorize a grant to St. John
Ambulance in the amount of $50.00 for 1981.

Presented a letter from Ivan Clark with respect to water problem on the
second line of Oro. Letter advises that the matter had been discussed
with the Road Supt.

On motion of Davie and Vousden Clerk to advise that the Road Supt.
has been authorized to improve the drainage by cleaning the ditch
subject to easement for this work is obtained from Mr. Ivan Clark,
costs 6f which are not to be the responsibility of the Township.
The Township undertakes the ditching only and will not assume any damages
and/or replacing of the fencing.
Presented a letter from the Liquor Licence Board advising that an
application has been made by Trehaven Golf and Country Club for
a patio (dining lounge) Licence. The purpose of this notice is to
enable Council, if they so desire, to make representation to the Board
concerning the application and allow the Municipality to advise departments
and agencies concerned.
On motion of Davie and Vousden, letter be received and copy of letter
be forwarded to Simcoe County Health Unit, Chief Building Official
and Zoning Administrator.
On motion of Johnson and Davie, adjourn to meet again on Monday,
April 27th, 1981 at 9:30 a.m. to complete the business scheduled for
this meeting.
