COUNCIL CHAMBERS - MARCH 16, 1981
EIGHTH MEETING
Council met pursuant to adjournment with all members present except
Reeve Allan McLean.
Deputy Reeve Stephen Davie in the chair.
The minutes of the last regular meeting were on motion of Vousden and Halfacre,
confirmed as printed and received.
Presented copies of letters forwarded as instructed at the last regular
meeting as follows:
Ministry of Transportation and Communications forwarding results of tenders
received for the supply of 6 ton truck, snow plow harness, two way sander
and dump body and requesting Council's approval of acceptance of the tender
of Hitch House Ford - enclosing original tenders as received for MTC inspection;
BP Canada advising of Council's acceptance of quotation to supply fuel and
signed copy of Consumer Sales Agreement, also copies of letters to other
fuel suppliers advising of the acceptance of fuel quotation;
Stewart, Esten, Solicitors requesting that further committment be obtained
from Big Cedar Parks in writing to assume all costs for the Road Closing
between Lots 5 and 6, Concession 13, also further consideration regarding
closing of road allowance under Section 462 of the Municipal Act;
Secretary, Orillia Public Library Board advising that Council authorize the
signing of the Agreement for 1981 on basis of the Township matching the Provincial
Grant;
N.V.C.A. forwarding cheque for account for the Township's share of aerial
photography re: Fill and Floodline mapping - also presented letter from N.V.C.A.
advising of status of project;
Information Orillia forwarding grant for 1981;
Mr. Ray Campbell, forwarding resolution of Council with respect to lot levy
in the amount of $300.00 remain the same for the Guthrie Industrial Subdivision
to the date of the extension of draft plan approval;
Presented copy of letter to Trustees Hawkestone Police Village advising that
Council are prepared to reduce the special levy of the Trustees by 50% subject
to the Trustees being prepared to levy an amount of the balance of the 50%
of the Trustees budget;
Stuart N. Keyes and Associates Ltd. - forwarding cheque to cover account for
professional services in 1980;
Simcoe Water Services re: application to purchase water from Shanty Bay
subdivision, advising Council are not prepared to sell water for the purpose
of water supply to a water service supplier;
Douglas Lewis, M.P. acknowledging receipt of three flags and Council's
appreciation of same.
On motion of Vousden and Arbour copies of letters as presented and forwarded
accepted as satisfactory and ordered placed on file.
Presented letter from Small Craft Harbours Branch, Fisheries and Oceans,
Government of Canada in reply to Township letter of February 17th, requesting
"dollar ceiling limit on minor maintenance" pertaining to the lease for the
administration of Government Wharves - Township of Oro, Hawkestone, Shanty Bay,
Carthew Bay. Letter advises that present policy limits minor maintenance to
$100.00 for each occasion and setting out the annual lease for the three wharves

at an annual rental $100.00 or 15% of gross revenue collected, whichever
is the greater. Also outlines remuneration to persons managing the facility
on behalf of the Township.

Approximately 150 signatures on petition.
On motion of Vousden and Halfacre that the letter and petition be received
and letter be forwarded to Mr. R. W. Hosler and request he attend a
meeting with this Council to review the matter of Wharf Manager since
Council are desirous of keeping the wharves in operation, subject to Small
Craft Harbours being able to direct an economical way of managing such a
program without extensive cost to the Township. Copy of letter to be sent
to Doug Lewis, M.P.
Presented copy of letter to Simcoe County Board of Education in reply to
request for reduced speed limit on Simcoe County Road No. 20 in Shanty Bay,
advising that this is under the jurisdiction of County of Simcoe and
Barrie Suburban Road Commission.
On motion of Halfacre and Arbour, copy of letter as presented be received
and filed for reference.
Presented letter from Dr. Basil Chadwick in reply to Township letter of
March 3, which advised Council would be prepared to meet with him,
when on spring road inspection. Letter advises of telephone number to
. contact and would still request meeting with Council prior to site inspection.
On motion of Vousden and Arbour letter to Dt. Chadwick and reply be placed
on file and Dr. Chadwick be advised of the date when Council will be attending
at the site, giving sufficient notice to allow him to arrange for attendance.
Presented copy of letter to Vincent Racco, owner of Lots 7, 8 & 9, Plan 1098
with respect to keeping of fowl. Clerk advised that Mr. Vincent Racco had
been in the office on March 9, 1981 in response to the letter.
On motion of Halfacre and Arbour that Mr. V. Racco be advised that the
keeping of chickens in a residential area is contrary ot Township By-law
No. 1102, therefore should the chickens and other fowl, or rabbits not be
removed, Council will have no alternative but to refer the matter to the
Township Solicitor for action.
Presented letter from Barrie Public Library Board advising that contract for
1981 had been forwarded to Secretary of Oro Township Library Board.
Also letter from Orillia Public Library Board forwarding copy of Contract
Agreement for 1981. Clerk presented copy of letter forwarding contract
Agreement to Secretary, Oro Township Library Board requesting authorized
signing officer.

On motion of Halfacre and Vousden letters and contract agreements as received
from both library boards and copy of letter forwarding same to Secretary
TOWllShip Library Board for signature accepted as satisfactory and be placed
on file.

Presented letter from Paul G. M. Hermiston, Q.C. advising that executed
copies of the Agreement, which are attached, for the partial security
in accordance with the terms of the agreement. Deed for Lot 4, Plan M-71
has also been delivered to the Township Solicitor. Letter requests that
the Agreement be executed and returned to him. Also further advises that
the Agreement and Deed will not be registered until assurance is presented
that collateral mortgages against the property have been discharged and the
taxes have been paid to the end of 1980. He further suggested that this
matter now traversed to fall sittings pending the completion of the work
in accordance with the agreement and that he will await instructions in
this regard.
On motion of Halfacre and Vousden, letter and copies of the Agreement be
received and Reeve and Clerk authorized to sign the Agreement on behalf
of the Corporation of the Township of Oro and Clerk to return same to the
Solicitor with request to register the Agreement along with Deed once
the collateral mortgages have been discharged. And further that Oro
Council would be agreeable to having the matter scheduled for trial at
the sittings traversed to the fall sittings pending the completion of
the work.
Presented recommendation of Committee of Council to accept the application
of Linda Wismer for Office Assistant as advertised, for which six
applicants were interviewed by the Committee of Council at a meeting held
on March 12th. Of the 40 applications received, 18 had been interviewed
by Administrative Staff and six selected for Committee of Council to
interview. Council after review and consideration took the following action.

On motion of Vousden and Halfacre, that the recommendation of the Committee
of Council be accepted and the application of Linda Wismer for Office
Assistant be accepted and that her remuneration be set at $9,100.00
per annum on the basis of a six month probation period. Also that
Mrs. Wismer commence employment immediately. Clerk to advise all
applicants accordingly.
Presented recommendation of the Committee of Council with respect to the
Township sponsoring a Day Camp Program funded by the Federal Summer
Canada 1981, Student Employment Program, for which Wendy Proulx as
Program Director had presented a proposal of the project to Committee
of Council held on March 12th, 1981.
After consideration of Committee of Council recommendation, Council were
in agreement to proceed with the program as proposed and passed the
following resolution.

On motion of Vousden and Halfacre, Oro Council are prepared to sponsor a
Day Camp Program funded under the Federal Student Employment Program,
Summer Canada 1981. The Day Camp Program is to be under Program Director
Wendy Proulx, at no cost to the municipality other than the use of Oro
Memorial Park for the program from July 6th to August 28th, or until
the date the program ceases prior to August 28th. Oro Council are to be
informed of all requirements that the Township is to be involved in prior
to the signing of the application by the Reeve and Clerk on behalf of the
Corporation.

Presented letter from M.T.C. letters of approval for the overun on
remix of stockpile of sand by 600 cu.yd3" in 1980, being further to
approval dated October 9, 1980 and overun on approval of tender to crush,
load, haul and apply 5/8" gravel for 21,898 cu.yds. @ $1.25 to a
total of $27,372.50, which was applied under construction on 15/16 Side Road.
As well as approval for overun of liquid calcium to supply and apply
69.29 tonnes of liquid calcium as per tender at $129.50 per F.E. tonne,
this approval being in addition to approval of April 29, 1980.
On motion of Halfacre and Arbour letter of approval be received and filed
for necessary record and audit purposes.
Presented letter from the Hon. James Snow, Minister of Transportation
and Communications further to his letter of December 16, 1980 in reply
to Township letter of November 28, 1980 requesting the Township be advised
of status of overpass and Line 9. Letter now advises that the study has
now been fully assessed and that a decision has been reached in favour
of the construction of the interchange. Accordingly, the Regional Staff
and Highway Development Branch have been instructed to include the
interchange in the five year program and now to prceed with the pre-engineering
of same.
On motion of Halfacre and Arbour, letter be received and a letter be written
to the Hon. James Snow requesting that the matter of release to the
local M.P.P. and the letter received be clarified since the release
indicated the funds were to be scheduled in the 1981-82 program.

The Planning Administrator was present at 11:20 a.m. to review planning
and development matters. The following was presented.
Presented resolution of Oro Planning Board regarding an Open House Meeting
to be held at the Town Hall on Monday, March 23, 1981 at 8:00 p.m. to
present a draft Official Plan Amendment which would permit one additional
accessory residential dwelling to be erected on a bona fide farm operation
for 40 hectares or more for accommodation of full time farm help. The
purpose of the Open House Meeting is to present the draft Amendment to
the public to obtain their reaction and input to the proposal. Members
of Council are requested to attend the meeting.
Presented resolution of Oro Planning Board recommending application to
the Minister of Housing for financial assistance under the Community
Planning Study Grant Program to update the Township's Official Plan policies,
particularly for that area of the Township north of Highway No. 11 towards
a total estimated expenditure of $30,650.00.
On motion of Halfacre and Vousden that Council concur with the recommendation
of Planning Board and authorize the Clerk and Planning Administrator to
forward the necessary terms of reference and application for a Community
Planning Study Grant towards a total estimated expenditure of $30,650.00
to the Ministry of Housing.

Presented resolutions of the Oro Township Committee of Adjustment adopting
a 1981 budget for Committee purposes in the amount of $3,500.00 and
requesting an appropriation from Council in the amount of $1,500.00 towards
operational expenditures.
On motion of Vousden and Arbour that the proposed budget of the Oro
Township Committee of Adjustment for 1981 expenditures in the amount of
$3,500.00 requiring an appropriation in the amount of $1,500.00 be accepted
and incorporated within the Township Budget for 1981.
Presented letter and plans from Dearden and Stanton Ltd., indicating that
they have on behalf of Ruth Langman and Dorothy Illingworth, applied to
the Minister of Housing for a proposed subdivision on part of the west
halves of Lots 5 and 6, Concession 14.
On motion of Vousden and Halfacre, that letter and plans be received and
placed on file.
Presented letter from Will. J. Dolan Planning Consultants Ltd. requesting
attendance before Council to present his firms availability to carry out
planning consulting work for the Municipality.
On motion of Vousden and Halfacre that letter be received and placed on
file. Wm. J. Dolan Planning Consultants Ltd. be advised that Council
are presently satisfied with works being carried out by Ainley and
Associates Ltd.
Presented correspondence, communications, etc. as follows:
Ministry of Agriculture & Food, Live Stock Branch, re: Dog Licensing and
Poultry Protection Act with respect to proper procedures in respect to
the evaluation of Live Stock killed or injured by dogs and wolves;
Also letter with respect to Warble Fly Control confirming that the
Warble Fly Control Act was repealed at the last session of the legislature;
Ministry of Culture and Recreation regarding Wintario Grants again in
effect and further that grant applications for facilities subject to
Ministry of Labour closure, or for collapsed buildings will be eligible
for Wintario assistance;
Copy of Notice for "Public Meeting" to be held on Monday, March 23rd, 1981
to review and comment on proposed Amendment No. 13 to the Official Plan;
Simcoe County Mutual Fire Aid Association advising of next regular meeting
to be held at the Shanty Bay Community and School Centre and sponsored by
the Township of Oro Fire Department;

On motion of Vousden and Arbour Statement of Gross Receipts of Bell
Canada to be used for 1981 taxation be accepted and Treasurer to apply
same as apportioned to establish mill rates for 1981.
Mrs. Grant, Girl Guide Leader from Shanty Bay, brought 6 girl guides to
the Council Meeting at 11:30 a.m. and remained for half an hour. Before
leaving questions were asked by the Girl Guides. Mrs. Grant thanked Council
for the opportunity and advised that the girls were to receive their
Citizens Badge and one criteria was that they attend a meeting of
Municipal Council. Deputy Reeve Stephen Davie thanked them for coming.

of Township properties for 1981, the rate being based on $14.00 per hour.

retained for the cutting of grass on Township properties as specified

(incorporated as the Children's Aid Society of Simcoe County) requesting the
use of Oro Memorial Park for their annual Children's Picnic on July 8th
or alternatively July 9th in case of rain.

On motion of Halfacre and Vousden, that the Family and Children's Services
of Simcoe County be advised that Oro Council would again be prepared to
accept the fee of $10.00 and that Oro Memorial Park will be reserved for
July 8th, 1981 and provisions made for July 9th, should the weather not
permit the picnic to be held on July 8th, due to rain.
Presented a letter from the Township of Medonte advising that the Council
of the Township of Medonte are interested in entering into an agreement with
the Township of Oro regarding the operation of the Jarratt Community Hall.
Since the hall serves both Townships, it is felt that the need of the hall
can be best met if both Municipalities are involved and work together.
On motion of Halfacre and Vousden, letter be received and Clerk to advise that
the Township of Oro would consider entering into an agreement but would first
like to meet with representatives of Medonte Council and members of the
Jarratt Hall Committee in this regard.
Presented letter from Ontario Humane Society with respect to consideration
of the Ministry of Natural Resources to amend the present wildlife regulations
to change the regulations which govern the keeping of wildlife in captivity
and their reasons for objecting to this amendment.
On motion of Halfacre and Vousden, letter be received and tabled for further
consideration.
Presented letter from the Clerk of Simcoe County advising that the County
at itBsession on February 26, 1981 authorized a grant to be given to Simcoe
County Federation of Agriculture for 1981. The grant being conditional upon
the Federation not requesting a further grant from each Municipality.
On motion of Halfacre and Vousden that the Clerk be instructed to contact
the County of Simcoe for clarification.
Presented from the Continuing Education Division of Georgian College advising
of a special Technology course "Home Insulation for Energy Conservation"
to be held on Tuesdays and Thursday from 7 - 10 p.m. for 10 weeks, starting
on April 7, 1981. Fee for same being $75.00. Clerk advised that the Chief
Building Official would be interested in attending.
On motion of Vousden and Halfacre, that this letter be referred to the Building
and Fire Committee and to authorize the Committee to proceed should they
feel it necessary to have the Chief Building Official attend.
Presented letter from Simcoe County Industrial/Commercial Development Officer
with respect to Weed Inspector 1981. Also copy of letter in reply advising
of the Township of Oro appointing Ivan Speers as the Weed Inspector for
the Township of Oro and the appointing of the Township Road Supt to
assist in this regard.
On motion of Vousden and Arbour, letter of the County Industrial/Commercial
Development Officer and reply forwarding information and forwarding of letter
to Mr. Ivan Speers advising that he had been appointed as the Weed Inspector
for the Township of Oro accepted as satisfactory and letter be placed on
file for reference.

Road Supt. Fred Haughton was present at 1:30 p.m. as per agenda and
reviewed with Council the recommendations of the Committee of Council
with respect to the calling of tenders. After consideration of same
the following action was taken.
On motion of Vousden and Arbour that tenders be called for Dust Control,
Contract 81-01; to load, haul and apply Pit Run Gravel, Contract 81-02
Crush, load, haul and apply 5/811 crushed gravel, Contract 81-03; Application
prime and surface treatment, Contract 81-04; Asphalt surfacing, Contract 81-05;
Corrugated culv~t pipe, various sizes, 81-06; also quotations are requested
for the supply of up to 30,000 gallons of non-asphaltic road oil, as per
tender specifications on Township Tender forms. Tenders to be placed in
the Daily Commercial News, Barrie Examiner and Orillia Packet and tenders
to close at 4:30 p.m., April 16, 1981.
On motion of Vousden and Halfacre, that tender ads be placed in the Barrie
Examiner and Orillia Packet for the rental of equipment for various Township
road building requirements. Tenders to close at 4:30 p.m. on April 16, 1981.
On motion of Vousden and Halfacre that the quotations from Keith Maxwell for
grass cutting on Township road sides and specific Township lots for a lump
sum price of $1,900.00 as per written quotation, be accepted for 1981.
On motion of Vousden and Halfacre that the Road Supt. be authorized to have
Ontario Land Surveyor prepare surveys for any and all proposed land
acquisitions required along 15/16 Side Road east from Line 3, for the
distance proposed for 1981.
On motion of Vousden and Arbour, that Tuesday, March 31st and Wednesday,
April 1st, 1981 be set aside for Road Inspection commencing at 8:00 a.m.
On motion of Vousden and Halfacre, that Road Supt. be authorized to negotiate
a time of the release of the trade-in truck on the new 6 ton truck after
print-out is received from Ford Company that the truck order is approved
and upon the signing of an agreement by Hitch House Ford acknowledging
receipt of the truck for the tender trade-in value of $3,200.00.
Presented from Ontario Hydro proposed layout of an underground electrical
distribution system, including street lighting, for the Windfield
Subdivision, requesting review of the proposal and if satisfactory, to
confirm in writing.
On motion of Vousden and Halfacre proposed layout for underground electrical
distribution system, including street lighting, for the Windfield Subdivision
as presented be forwarded to Township Engineer, Stuart N. Keyes and Associates
requesting he review same and conform approval and or comments in writing.
Presented letter from G. J. Duggan, owner of Ltos 14 and 15 and part of
Lots 7 and 13, Plan 629 (Concession 14) registering a complaint against the
owner of Lot 16, Plan 629 with respect to a pipe system across the back lot
of his property, which drains onto his property. Also copy of letter from
T. Kent Dempsey to Mr. G. J. Duggan in reply advising that the problem arose
due to the freezing of the pipe and same will be corrected in spring.

be received and filed for reference, since the owner has advised that the
problem which occured due to natural causes by frost will be corrected as
soon as possible in the spring and Clerk to reply to Mr. Duggan accordingly.
Presented letter from Victorian Order of Nurses, Simcoe County Branch,
extending an invitation to attend the Annual Meeting of the Branch, to
be held on Thursday, March 26, 1981.
On motion of Vousden and Halfacre letter be received and filed for reference.
Presented letter from Ministry of Intergovernmental Affairs, Subsidies
Branch, advising that the payment schedule for 1981 unconditional grants are
as follows for cheque mailing dates:

Presented letter from Corporation of the Township of Tilbury West, forwarding
resolution regarding the patriation of the Canadian Constitution, requesting
Council endorse same.
On motion of Arbour and Halfacre, letter be received and filed for
reference, no action taken.
Presented letters from D. S. White, Solicitor forwarding report of completion
of land purchases for road purposes, 15/16 Side Road and Deeds
from William Roy Newson and David John McCuaig and accounts for professional
services for each. Part Lot 15, Cone. 1 - Newson, cost of $197.50 and
David McCuaig - $369.60 including obtaining partial discharge of mortgages.
Deeds registered #729413 for Newson and #728715 for McCuaig;
On motion of Vousden and Halfacre that the accounts of Stewart, Esten and
letter explaining the professional services rendered for each of the land
purchases along with registered deeds, Instrument #729413 and #728715 be
received and placed on file for reference and account be paid to Stewart,
Esten according to statement for Newson in the amount of $197.50 and
McCuaig $369.60 to a total of $567.10.
Presented letter from Mrs. L. Boht, Shanty Bay Ratepayers with respect
to IIcross walkll, additional IIWatch for the Childrenll signs - hazardous
curve on County Road 20 (between Lines 3 & 4) reduced speed limit, etc.
on Shanty Bay Road (County Road 20) through Shanty Bay. Letter outlines
recommendations for proposed walkway and financing of same, requesting
advice in this regard.

On motion of Halfacre and Arbour letter be received and Clerk to advise
that the Township Council will be on Road Inspection at the end of the
month at which time they will inspect the area, after which the Road
Committee would be prepared to meet with the Shanty Bay Ratepayers with
respect to the financing of the project upon their request.
Presented letter from Oro Township Horticultural Society requesting confirmation
of bookings for use of Town Hall and requesting permission to plant a tree or
open a new flower bed at one of the Township properties, i.e. fire halls,
historical monument at East Oro or Park in Shanty Bay. Also requesting
Council's support by way of continued annual grant.
On motion of Vousden and Halfacre, that Council authorize a grant to an amount
of $200.00 for 1981 and also that any planting of a tree to commemorate
the Anniversary of the Ontario Horticultural Society be at the Oro Township
Fire Hall at Shanty Bay and that the booking for the use of the Township
Hall be confirmed.
Mr. Terry Hehn of Greer, Fleming, Rolland and Company, the Township Auditors,
was present at 3:40 p.m. to present the Township of Oro Financial Report
for 1980, as audited. Mr. Hehn reviewed the Financial Statement and answered
questions of Council regarding same. Copy of the statement for publication
was also presented.
On motion of Vousden and Arbour that the Financial Statement and necessary
financial information return as presented by the Auditor and reviewed with
Council and Treasurer be accepted and Treasurer to forward duplicate copy
of the 1980 Financial Information Return to the Ministry of Intergovernmental
Affairs as required. And that the audit fees, when received from the
Auditors be presented for payment. And further, that the Clerk-Treasurer to
have the statement for publication placed in the local papers in short form.
Deputy Reeve Davie thanked Mr. Hehn for his presentation and explanation
of the Financial Statement.
Representatives from Oro Township Arena Board were present at 4:40 p.m. with
respect to 1981 budget and other matters. The proposed budget was presented
by Paul Miller, Chairman of the Ora Township Arena Committee. Present
with Paul Miller was Mr. William Staines, member of the Arena Committee.
Mr. Miller also presented the matter of payment of the Insurance Premium in
the amount of $3,600.00 wich the Committee request the Council to pay.
Also a further request for seating of $2,600.00 and funding for power skating
of $500.00 to a total of $7,300.00. Council advised that the matter
of the requested payments would be further considered at the budget meeting
scheduled by Council for March 30th, 1981.
On motion of Arbour and Halfacre that the Township pay the insurance premium
to Ron Johnston insurance to a total of $3,418.00.
Several other items of business were brought to attention of Council but
were left for further review and consideration.

Deputy Reeve Davie reported that he had attended at a meeting of
the Barrie Airport Committee and advised that a report of this meeting
is on Township files and available for review by any member of Council
or Planning Board.
On motion of Halfacre and Arbour, adjourn to meet again on Monday,
March 30th for a Budget Meeting with next regular meeting to be held
on April 6th, 1981 at 9:30 a.m.
