03 02 1981 Council Minutes . . . COUNCIL CHAMBERS - MARCH 2, 1981 Pg. 72 SEVENTH MEETING Council met pursuant to adjournment with all members present. Reeve McLean in the chair until noon, after which Deputy Reeve Stephen Davie assumed the chair. Reeve McLean having to attend a previous committment. The minutes of the last regular meeting held on February 16, 1981 were on motion of Arbour and Vousden confirmed as printed and received. Presented copies of letters forwarded as instructed at the last regular meeting to: Ministry of Transportation and Communications forwarding resolutions requesting approval for additional cu.yds of sand re-mixed and approval for the 2,600 cubic yards of crushed gravel applied on 15/16 Sideroad in 1980 under construction for which written approval had not been requested nor received; Ministry of Transportation and Communications forwarding OB-MR-28 and FB-MRA 36 & 36A, the Program of Proposed Expenditures for Highway Improvements for 1981, along with letter of explanation - and request for Supplementary Allocation of subsidy moneys for 1981 and supporting program OB-MRA-28 for reconstruction of 15/16 Side Road for which normal subsidy money allotted was not sufficient without affecting other pro-rams scheduled under construction for 1981, additional subsidy allocation requested being in the amount of $55,000.00; Orillia Public Library Board requesting the Board enter into contract for library services on basis of the Township matching the Provincial Grant as had been agreed to by the Barrie Public Library Board; Oro Agricultural Society advising that Council have authorized a grant in the amount of $900.00 to be forwarded after August 1, 1981; Shanty Bay Ratepayers Association and Oro Station Ratepayers Association forwarding copy of letter from Barrie Suburban Road Commission with respect to pathway on north side of Shanty Bay Road, speed limit and intersection County Road 20 and 27 (sign) and lights; Secretary, Jarratt Community Hall Committee forwarding balance of loan authorized to complete the renovations; Small Craft Harbours Branch re: government wharves - requesting further information; Ministry of the Attorney General and the Hon. John Chretian, Minister of Justice and Attorney General of Canada - forwarding resolution endorsing the resolution of the Regional Municipality of Hamilton-Wentworth; Chairman Traffic Committee for International Plowing Match with respect to removal of culverts after the plowing match on 15/16 Side Road and other Township roads where parking entrance is required; President Simcoe Side Ratepayers Association re: park lands on Plan 1488, Lots 138, 139, 143 & 144, with respect to wood sold as result of clearing of lot; Ontario Humane Society re: increase of per capita fee from $2.05 to $2.10 for 1981; Stewart, Esten Solicitor forwarding cheque for professional services re: land purchased from Robert Marshall - part Lot W~ 2, Conc. 6; Ministry of Natural Resources returning original licence for Township pit which is to be replaced with new licence showing increase tonnage to 90,000 tons (82,000 tonne). Also new licence issued on Feb. 10/81 upon receipt of original licence; . . . SEVENTH MEETING (Conti d) MARCH 2, 1981 Pg. 73 Willow Park Motel, registered letter being a follow up letter with respect to account for log jam removal completed October 16, 1980; On motion of Davie and Halfacre copies of letters as presented and forwarded accepted as satsifactory and be placed on file for reference. Presented letter from D. S. White, Solicitor (Stewart, Esten) with respect to Big Cedar Parks Ltd., regarding unopened road a110wance between Lots 5 and 6, Concession 13 requesting closing and conveyance of same. Solicitor advises that in the firm's opinion, Big Cedar Parks Ltd. is entitled to a conveyance of Part 3 and 4, on Reference Plan 51R-9591 but are only entitled to proceeds of sale of Parts 1 and 2, Section 462(3). Letter further advises that the Township should proceed and convey Parts 3 and 4 to Big Cedar Parks Ltd., pursuant to Section 462(1), as has been done in previous cases, a By-law should be passed closing the road and a declaration of the Clerk be prepared stating that records have been searched and no record of compensation having been paid for the existing travelled road. A duplicate copy of the conveyance from the Township to Big Cedar Parks Ltd. for Parts 3 and 4 was enclosed. Also further letter advising that the Township will have to determine whether or not it is prepared to sell the easterly portion of this unopened road allowance and forwarding copy of letter from C. M. Loopstra to D.S. White with respect to conveyance of Parts 1 and 2. On motion of Halfacre and Vousden that the matter be referred back to the Township Solicitor and request further committment from Big Cedar Parks. Oro Council are not prepared to proceed any further until the Big Cedar Park Estates assume in writing that they are prepared to assume all costs in this regard and are concerned as to whether in fact Parts 1 and 2 may be closed under Section 462 since the road leads to water. Or alternatively should any of the road allowance in question be closed under Section 462. Presented letter from Murray S. Minshall, Area Consultant, Ministry of Culture and Recreation in reply to Township enquiry regarding financial assistance towards the maintenance osts of the African Episcopal Church. On motion of Davie and Vousden letter be received and placed on file for reference. Presented letter from Dr. Basil Chadwick as a result of copy of Township letter to D. K. Carroll, his solicitor regarding proposed meeting of his property as scheduled by Council, requesting an appointment with Council either at the next or following meeting of Council. On motion of Davie and Vousden Clerk to reply and arrange for Mr. Chadwick to attend at the site when the inspection is to take place, during Council IS tour of road inspection, of which date Dr. Chadwick is to be notified. Presented letter from D.S. White, Solicitor with respect to road widenings concerning Newson, McQuaig and Thompson, advising that arrangements have been made for persons to attend to sign necessary deeds. Pg. 74 SEVENTH MEETING (Conti d) MARCH 2, 1981 Presented letter from Director of Education, Simcoe County Board of Education, regarding Transportation Committee reporting of its meeting with the citizens of Shanty Bay, held on Thursday, January 22, 1981 at which the question of the safety of students attending Shanty Bay Public School walking the distance from the Village to the school, was discussed. Director advises that the busing of the children would not be any solution and would not in any way relieve the unsafe condition. The Transportation Committee recommended to the Board that the only real solution to the problem would be for the Township of Oro to construct a walkway from the main intersection to the school. The letter also contains two resolutions passed by Simcoe County Board of Education regarding this matter. On motion of Davie and Arbour letter be received and referred to Road Committee for their recommendations in this regard. Presented Polling Place Rental Agreement for use of Town Hall for the Provincial Election, as signed on behalf of the Township. Fee for polling place being $50.00. On motion of Halfacre and Vousden, Polling Place Rental Agreement be received. Presented letter from H. J. Christian, Administrator Extension Services, Parks and Recreational Areas Branch, in response to Township letter of February 13, 1981 following meeting with Mr. Christian in Toronto. Letter sets out alternatives as requested by Council, for Oro Memorial Park and clarification to several specific questions set out in letter of February 13, 1981. On motion of Davie and Vousden, letter be received and referred to Parks Committee who are to report back to Council with recommendations. Presented letter from Paul G. M. Hermiston, Q.C. solicitor with respect 0 L. J. Torpey advising that the matter is on the trial list to be heard in the Supreme Court. The trial list commences March 9, 1981. On motion of Vousden and Davie, letter be received and filed for reference. Presented letter from Secretary-Treasurer, Orillia Public Library advising that the Township letter of February 17, 1981 regarding the 1981 contract had been brought to the attention of the Library Board at meeting held on February 18th and that the Orillia Library Board is prepared to offer a contract at two times the 1981 Provincial Grant (amount not yet known) divided by one third. On motion of Arbour and Vousden, that letter and agreement be received and Oro Township Library Board, Chairman and Secretary, be authorized to sign the Agreement on the basis of matching the 1981 Provincial Grant being the same agreement as with the Barrie Public Library Board receiving 2/3 of the Grant and Orillia 1/3 and the Township matching the grant accordingly. Presented account from Nottawasaga Valley Conservation Authority for aerial photography (1300 hectares) for fill and floodline mapping - Willow Creek, account having been paid to J. D. Barnes Ltd., to a total of $1,009.10 of which the Provincial Federal share of 90% was $908.10 and the Township of Oro share being in the amount of $100.90. Presented letter from Ministry of Transportation and Communications, Traffic Section, enclosing copies of proposed signing for this yearls International Plowing Match in Simcoe County. Clerk advised that copy of letter and plans of Traffic Control Devices were forwarded to the Chairman of the Simcoe County Plowing Match Traffic Committee. On motion of Davie and Halfacre letter and plans of Traffic Control Devices as presented be received and placed on file, action taken in forwarding copy of letter and copies of signing plans to Traffic Committee accepted as satisfactory. Presented letter from Chief Inspector, the Weed Control Act, Ministry of Culture and Food with respect to Appointment of Weed Inspector for 1981. On motion of Halfacre and Davie, that Ivan Speers be re-appointed as the Township Weed Inspector according to By-law No. 1206/80 and Clerk to complete form and return same to Chief Weed Inspector. Presented letter from Chairman, Board of Directors, Information Orillia expressing appreciation of the Township1s recognition of the service by way of an annual grant and requesting Council consider increasing the grant in 1981 due to significant increase in their operation budget. Also copy of Chairman's Report and Treasurerls Report from 1980. On motion of Vousden and Halfacre, Oro Council authorize a grant in the amount of $30.00 to Information Orillia for 1981. Presented memorandum from B.B. Walsh, Fire Service Advisor, Orillia District Office for the office of the Fire Marshall, Ministry of the Solicitor General with reference to Regional Fire Training School for the County of Simcoe to be held April 6th - 10th, 1981. A copy of this memorandum and two application forms have been sent to the Chief of the Township Fire Department. Applications for persons attending are to be completed and returned no later than March 12, 1981. On motion of Arbour and Davie memorandum be received and filed and referred to Fire Chief and Fire Committee for completion and forwarding of names of applicants to attend the Regional Fire Training School, subject to provision in the Budget for same. Presented letter from Mrs. Mary Rist, Lot 6, Plan 1098 requesting Council to enforce By-law with respect to keeping of fowl in a residential area as well as results of same by way of offensive odours and.run off water from the yard. Letter is a reminder of last year's problems. Clerk presented copies of letters forwarding to Vincent Racco, Lots 7, 8 and 9, Plan 1098 forwarded August 7th and 27th, 1980 and copy of letter from Simcoe County Health Unit to Mr. V. Pg. 76 SEVENTH MEETING (Cont'd) MARCH 5, 1981 On motion of Arbour and Halfacre letter from Mrs. Mary Rist, copies of letters forwarded to Vincent Racco in 1980 as presented be received and a letter be forwarded to Vincent Racco requesting he advise Council whether any fowl is still kept on the premises and what action he has taken on the letter from Simcoe County District Health Unit. And further that Council would hav~ no alte~native but to proceed with necessa~ action as indicated in letter of August 27, 1980, shou1d the conditions ~equired by the Simcoe County District Health Unit and the Township not have been carried out. Copy of letter to be sent to concerned neighbour and the S.C.D.H.U. James Shellswell, Chief Building Official was present before Council at 11:30 a.m. with respect to building matters. Mr. Shellswell reported on the Occupancy Certificate for residence completed on Jo-Con Development by Knar Investments as presented to Council on February 16th advising that Simcoe County District Health Unit had not issued Use Permits. According to Council IS resolution the Occupancy Certificate was to be suspended until the Use Permits were received from Simcoe County District Health Unit. Chief Building Official advised that the Use Permits have now been issued by the S.C.D.H.U. The Planning, Administrator was present at 11:40 a.m. to review planning and development matters. The following was presented: S. Koole, 264827 Ontario Ltd., regarding O.P. Amendment No. 12 and By-law No. 1213/80, requesting any notice of hearing, and response; T. Holmberg, regarding By-law No. 1213/80, requesting appointment for hearing and response; Committee of Adjustment, Notices of Hearing regarding submission No. IS Bl/81 - Burton, B2/81 - Randsalu and B3/81 - Bidwell; Letter to M. Walt advising of enactment of By-law No. 1230/81 designating part of Lot 21, Concession 5 as being subject to site plan control provisions and outlining the requirements necessary to proceed with development; Letter to D. Smith, solicitor, regarding zoning of the Forsythe property, part of Lot 21, Concession 5, forwarded as directed from the last meeting of Council; Letter from the Simcoe County District Health Unit advising that they have no objection to the issuance of Occupancy Permits for Lots 26, 50, and 59 on Plan M-66; Copy of letter from Skelton, Brumwell & Associates to Ainley & Associates regarding the zoning of Lot 12 on the proposed Windfield Estates plan of subdivision. On motion of Vousden and Halfacre, that correspondence as presented by placed on file. Advised of recommendations of Oro Planning Board regarding the preparation of amendments to the Township's Official Plan for the area north of Highway No. 11, and advised that Council have been requested to attend the next meeting of the Board on March 5, 1981 at 8:00 p.m. to review the draft terms of reference for the works proposed to be undertaken. Pg. 77 SEVENTH MEETING (Conti d) MARCH 2, 1981 . On motion of Halfacre and Davie, that report of the Planning Administrator found satisfactory. Presented letter from Corporation of the Town of Newcastle, forwarding resolution of the Town of Newcastle requesting support of their resolution that the request of the Town of Lincoln relative to interest on overdue taxes not be endorsed. Clerk advised that the Township of Oro had not endorsed the resolution. On motion of Vousden and Davie, letter be received and filed with no action taken. Presented letter from Ducks Unlimited (Canada) being an application for an easement allowing the flooding of waters over an abandoned right-of-way in Lot 17, Conc. 2. Advising that the affected landowners favourably support improvement of the existing wetland and the installation of an earthen dam and subsequent water level management. The same permission as granted by the landowners would be required in the form of an easement from the Township. On motion of Halfacre and Arbour letter be received and copy forwarded to N.V.C.A. for comments prior to any decision of Council in this regard. Oro Council are of the opinion that an easement of a road allowance should not be granted. . Presented letter from South Lake Simcoe Conservation Authority to inform of the authority's continued concern of the water quality of lakes Simcoe and Couchiching and the water courses that drain into them. Also attached is a copy of a letter from the authority to the Hon. Rene Brunelle requesting a meeting to determine the status of the recommendations of the strategy report. On motion of Vousden and Davie letter and attachment be received and filed for reference. Presented a circular letter from the Hon. William Davis, Premier of Ontario with respect to policy of the Ontario Government to encourage preference to buying Canadian products and the creation of the Office of Procurement Policy in the Ministry of Tourism. On motion of Vousden and Davie, letter and attachments be received and placed on file for rtference. Presented letter from the Ministry of the Environment regarding "Notice of a Presentation on the Municipal Regulations, Bringing Municipalities under the Environmental Assessment Act". Letter further advises that half day workshops will be held in Peterborough and Toronto, representatives from Municipalities in the County of Simcoe are to attend at a work shop in Toronto to be held late in March or early in April. Road Supt. Fred Haughton was present at 1:00 p.m. and presented his report for work done during the month of February and Vouchers 2 and 2A to cover same. On motion of Halfacre and Vousden the report of the Road Supt. as presented was accepted as satisfactory and Treasurer authorized to issue cheques in payment of same to a total of $18,040.00 Road Supt. Fred Haughton as instructed at the last regular meeting had reviewed the quotations received to supply fuel. One quotation was based on fuel supplied to company owned tanks and other three on basis of supplying fuel to Township owned tanks and equipment. As result of the review Road Supt. Haughton presented report, a copy of which had been presented to each member of Council. The Road Committee at a meeting held on February 26, 1981 recommended that BP Canada quote be accepted for the supply of fuel, gasoline, diesel and furnace oil, to the Township with their equipment, subject to BP replacing the present pumps with updated pumps. On motion of Vousden and Arbour that the quotation of BP Canada to supply fuel, diesel, gasoline and furnace oil, to the Township for a two year period, be accepted, subject to BP replacing the present pumps with updated metric mode pumps and utilization of presently owned tanks as specified and Clerk authorized to sign the agreement on behalf of the Corporation of the Township of Oro. Road Supt. brought to the attention of Council the matter of outlining the trees around the gravel pit. On motion of Arbour and Vousden the matter of obtaining quotations for the cutting of wood at the Township Gravel Pits be referred to the Road Committee for recommendations. On motion of Vousden and Arbour that the Road Supt. be authorized to purchase survey equipment and supplies subject to allocation within the budget. Presented letter from Ontario Good Roads Association with respect to the "1981 LJ. Mahony" Road School, and courses available for same. Also the 1981 "C. S. Anderson" Road School, both to be held from May 3rd to May 6th inclusive, which has ten distinct courses. Pre-registration is required which must be submitted prior to April 24, 1981. Registration fee for either Road School is $175.00 and must accompany the pre-registration application. On motion of Arbour and Halfacre, that Road Supt. Haughton be authorized to attend the "C.S. Anderson" Road School to be held from May 3rd to May 6th, 1981 and necessary pre-registration form be completed and forwarded along with required registration fee. Road Supt. On motion of Vousden and Arbour, account for professional services rendered as presented be accepted and Clerk to forward cheque in the amount of $2,632.50 and at the same time be requested to advise and confirm his hourly rate for 1981. Recommendation of Committee Meeting of February 26, 1981 with respect to Park Committee was presented to Council for consideration. On motion of Vousden and Halfacre, that Mr. Stuart N. Keyes be retained to look into the work involved and costs for the repair of the large pavillion at the Park and prepare a cost of his repair proposal. Road Supt. reported back to Council after having reviewed the tenders and suggested that Council should give consideration to Frink equipment in order to maintain interchangeable equipment. On motion of Halfacre and Vousden that the tender of Hitch House Ford (Division of Graham Ford Sales Limited) for the supply of one 1981 Ford L-9000, six (6) ton diesel truck, cab and chassis, according to tender specifications be accepted, for a tender price of $39,452.30 less trade-in of one 1971 Ford truck (#12) L-900 gas, 5 ton truck c/w plow, wing, harness and 2-way dump box/sander as is, for an amount of $3,200.00 leaving net price of $36,252.30, plus O.R.S.T. of $2,537.66 for total tender price of $38,789.96 and also that the tender of Hitch House Ford for a frink snow plow harness, model 714, for an amount of $7,715.00 plus O.R.S.T. of $479.50 to total tender price of $8,194.50 and for the supply of one Frink two-way sander, dump body, model GA77, completely equipped and installed on Township truck, mounted and operating for an amount of $12,210.00 plus O.R.S.T. of $779.10 to a total tender price of $12,989.10. And further, that Hitch House Ford are to be responsible to supply the truck complete with snow plow harness and two-way sander and dump body to the Township for a total price of $59,973.56, subject to approval of the Ministry of Transportation and Communications. Trustees Hawkestone Police Village were present at 3:00 p.m. as per appointment scheduled with respect to 1981 budget for Hawkestone Police Village. Present from the Trustees were Mrs. Diane McKenzie and Ralph Leigh. Mrs. McKenzie presented a proposed budget consisting of up to $14,000.00 for roads and general expenditures of $7,000.00 for the Trustees, of which the Trustees are requesting the Township to reduce the general mill rate by $5,000.00 and the Trustees would then levy the additional $2,000.00 to the ratepayers of the Police Village for street lights. Also presented for consideration was the Hawkestone Park. Council suggested that Trustees contact the Township Road Supt. with respect to road expenditures and the matter of parks be discussed with the Parks Committee. On motion of Vousden and Arbour that the Trustees H.P.V. be advised that Oro Council would be prepared to reduce the special levy of the Police Village by 50% subject to Trustees being prepared to levy an amount of the balance of the 50% of the Trustees budget, accordingly the general mill rate would be reduced by 50% of the Trustees Budget. ,... . . . ...... SEVENTH MEETING (Cont'd) MARCH 6, 1981 Pg. 83 Mr. Ray Campbell was present at 4:10 ap.m. as previously arranged with respect to the Guthrie Industrial Park and reference to his letter of January 23, 1981 which was presented to a meeting of Oro Council along with a letter from his solicitor to whom a reply had been forwarded. Mr. Campbell again requested Council to respond to his enquiry as well as the Solicitor regarding amount of lot levy. At the time of the development the lot levy had been established at $300.00 per lot. No subdividers agreement had been entered into and letter to Solicitor had indicated that Council may wish to re-examine all requirements, financial and otherwise regarding the development proposal in view of the considerable period of time that had elapsed since its original presentation and date of first draft approval. Present were Mr. Ray Campbell and Mr. Al Beacock who advised that an offer of purchase for the Industrial Park had been received subject to certain conditions, one being the matter of lot levy fees. Mr. Campbell presented a brief summary of the development which was discussed at some length. On motion of Arbour and Vousden, that Oro Council are agreeable to the lot levy remaining at $300.00 per lot to the date of the extension of the draft plan approval subject to a Subdividers Agreement being entered into prior to the date of the expiry of the draft plan approval. Clerk reported that as instructed at a meeting of Council held on February 16, 1981, a notice had been placed in two issues of the Barrie Examiner and Orillia Packet for an Office Assistant and in response 40 applications had been received and are on file. Clerk advised he had reviewed same and 18 should be considered for interview. On motion of Vousden and Halfacre that the Clerk interview the applicants for Office Assistant and at the same time have a typing test carried out, and have the selected applications attend at a Committee of Council meeting to be held on March 12, 1981. Presented a letter from Dave Snider, Simcoe Water Services, R.RJ #2, Shanty Bay, making application to purchase water from the Municipal water supply in Shanty Bay Plan M-66. On motion of Arbour and Vousden that the Council of the Township of Oro are not prepared to sell water from the Township water system for the purpose of water supply for a water service supplier. Councillor Arbour brought the matter of the proposed 1981 fire budget and recommendations from the Committee of Council meeting held on February 26, 1981 to the attention of Council for consideration. On motion of Arbour and Vousden that the Fire Budget for 1981 as presented to a Committee of Council meeting held on February 26th, 1981 for a total of $96,773.00 with an adjustment to gratuities being reduced to $30,600.00 and under general expenditures on page 3 of the budget on item entitled Regional Fire Training School to an amount of $800.00 be added and total budget be reduced by $26.00 to a total budget of $96,793.00, be the approved Fi reBudget for 1981.
