The minutes of the last regular meeting of January 5, 1981 were on motion of Vousden and Halfacre confirmed as printed and received. Presented copies of letters forwarded as instructed to: Ministry of Transportation & Communications, Planning and Design Section forwarding photo copies of invoices from Ainley & Associates Ltd., for engineering services - Mutual Agreement Drain, and photo copies of cancelled cheques showing payment made, in order that payment in the amount of $4,158.90 may be received from the Ministry. The Township share of the total cost of $4,500.00, being $341.10; Rural Ontario Municipal Association - forwarding resolution of Township of Oro to petition the Province of Ontario to permit an increase in rate of penalty and interest that may be imposed for non-payment of taxes; C.N.I.B. forwarding 1981 grant and Canadian Mental Health grant for 1981; Ainley & Associates Limited - forwarding account re: Waterfront Zoning; Stewart, Esten, Attention D. S. White, forwarding account for land purchase from Robert F. and James E. Besse - cost of land $1,000.00 and $198.90 for professional services, and Newson land purchase $366.00 along with undertaking to complete fencing, Elsie Hazelett land purchase $600.00 plus legal fees of $196.00; Regional Municipality of Haldimand-Norfolk - advising that the Township of Oro endorse their resolution with respect to intent of the Ministry of the Environment to locate a permanent liquid waste treatment facility in South Cayuga. Copy of letter forwarded to the Premier of Ontario as requested by the Regional Municipality of Haldimand-Norfolk; Robert Holmes re: Caretaker of Oro Memorial Park for 1981 requesting that he confirm whether he is prepared to carry out the duties in 1981; Ministry of Transportation and Communications - forwarding Township of Oro mileage report and breakdown of classification; County of Simcoe Recreation Department - entry of ririk for County Curl ing Bonspiel; IBM Date Centre forwarding documentation to request programming of Interim Tax Bills for 1981; On motion of Vousden and Davie copies of letters as presented and forwarded accepted as satisfactory and same be placed on file for reference. Presented letter from Ministry of Transportation and Communications acknowledging receipt of Registered Mutual Agreement Drain and advising that the Ministry has recently inspected the drain and has found the works to be satisfactory at this time for Ministry purposes. With the foregoing and in recognition of Council's resolution of July 9, 1980 indicating Township Agreement to shoulder part of the costs of the engineer's report, the Ministry hereby withdraws the petition for a Municipal Drain. Letter further advises that upon receipt of documentation indicating that the Township has paid the engineer's account in full. The pertinent data will be forwarded to the Ministry of Intergovernmental Affairs with recommendation that the costs be accepted and the Ministry pay the Township directly. On motion of Davie and Arbour that the letter be received and that in view of the Ministry now having formerly withdrawn their petition for a Municipal Drain, the petition file be closed, once the cheque for en9ineer's fees has been received. ~ . . . ...... Kevin Carroll, Solicitor for Dr. Chadwick acknowledging receipt of Township letter forwarded following last regular meeting of Council advising that the Township would be making an inspection in Spring. Letter further advises that this delay would result in further flooding as result of the spring run-offs and would request Council advance their consideration. On motion of Vousden and Davie letter be received and Clerk to advise that in the opinion of Oro Council an inspection cannot be satisfactorily accomplished until early spring as stated in Township letter of January 7, 1981. Clerk advised of telephone call from Big Cedar Parks regarding payment of 1980 taxes On motion of Arbour and Halfacre that Oro Council would be prepared to waive the interest on the 1980 taxes for Big Cedar Parks for the month of January, provided that the total amount of taxes for 1980 are received on or prior to January 30, 1981 since at the time of the signing of the Site Plan Agreement it was agreed that the taxes for 1980 were to be paid by September 30, 1981. Presented copy of letter to Skelton, Brumwell & Associates Ltd. from Community Planning Review Branch, Ministry of Housing advising that draft approval for Guthrie Industrial Park, File 43T-74324 be extended for two years to January 6, 1983. Letter quotes that the Township had recommended a two year extension. Clerk advised that upon receipt of this letter he had telephoned Community Planning Review Branch and referred to Township letter of December 17,1980 in which Council's resolution recommends a one year extension. Also presented further letter following the aforementioned telephone call advising that the Municipality had agreed to a one year extension, therefore the extension of draft approval is for one year only to January 6, 1982. On motion of Vousden and Halfacre, letters be received and approval for extension of the draft approval for one year to January 6, 1982 accepted as satisfactory and letter be placed on respective file. Pg. 39 FOURTH MEETING (Cont'd) JANUARY 19, 1981 Treasurer reported on the return of the 1980 Co 11 ectors Roll to the Treasurer as of January J, 1981, showing the total taxes on the Collectors Roll as $2,238,311.93, with penalty added of $13,~20.84, to an amount of $2,251,832.77, with a total amount paid of $2,038.465.38, leaving a balance uncollected as $199,897.55. Of this amount of $194,403.47 has been placed against the properties in the Arrears Ledger of the Township with 11.25% penalty added to interim and 5% added to final taxes and notices prepared and sent to the property owners. The balance of $5,494.08 not placed on the Arrears Ledger is composed of $4,849.93 written off under Section 636(a) of the Municipal Act', with an amount of $26.93 Federation to be written off and $617.32 business and commercial to be collected. Notices of uncollected Business Taxes not returned have been prepared and forwarded, giving them 21 days for payment of same or making arrangements for the amounts to be paid. and if not paid by time required, same be turned over for collection. (Less adjustment of $51.00). On motion of Davie and Vousden that the 1980 Collectors Roll as returned to thB Treasurer, accepted as presented, also action of placing arrears of taxes on the Township Arrears Ledger with 11~% penalty on interim taxes and 5% penalty on final taxes, added and notices as forwarded to parties for business taxes, which if not paid or arranged for by February 15th, 1981, be turned over for collection, accepted as satisfactory. Presented list of federation of Agriculture fees collected for 1980 showing a statement as follows: Amount Paid on Roll Amount Not Paid on Roll Total on Roll $ 415.24 26.93 $ 442.17 On motion of Vousden and Arbour statement as presented be accepted and Treasurer authori zed to issue a cheque to Simcoe County Federati on of Agri culture to a total of $415.24 being the amount pai d on the tax roll. On motion of Vousden and Arbour that a letter be forwarded to Simcoe County federation of Agriculture requesting a copy of the financial statement for the year 1980. Presented letter from Doug Lewis, M.P. forwarding letter from Mr. H. Moffatt, Regional Director, Small Craft Harbours Branch, Government of Canada and copy of letter to Gordon E. Smith, all with reference to wharf at Hawkestone and Carthew Bay. Letters from Mr. H. "Moffat indicate the services of the wharfs could be discontinued, should the Township not be interested in leasing the wharfs and maintaining same. Clerk advised copies of this letter had been presented to all members of Council at the last regular meeting. Dn motion of Halfacre and Davie, letter and copies of letters as received and a letter be forwarded to Mr. D. Lewis, M.P. and explain previous Council's reasons for not having agreed to enter into a lease which would require leasing all the docks along the shore of Lake Simcoe in the Township of Oro and the complications of a WharfMaster. Council would request that Mr. Lewis advise of any alternative suggestions or assistance in this regard in order that the Wharf facilities remain available to the Township Residents and . public in general. ... ~ .. . . White with respect to various ro~d widentngs on 15/16 Side Road for Newson and Hazelett at intersection of Line 13 and Ridge Road. Also reply enclosed payment according to Agreements as well as undertaking for Newson property. On motion of Vousden and Davie, letter from Solicitor and reply forwarding cheques in payment of same as well as signed undertaking for the fencing of the Newson property accepted as satisfactory and accounts be included in January Road Accounts. Presented letter from Ministry of Transportation and Communications with respect to By-law NO. 1220/80 to Establish Employee Benefits and Income Protection Plan. Letter advises that if the Township of Oro had chosen to payoff Sick Leave Credits prior to termination (contrary to Section 352(65) of The Municipal Act, such payments would not be eligible for subsidy in the year of payment or retroactively. The only way such payment would be eligible for subsidy under current policy would be if payment were withheld until termination. All other aspects of the By-law meet Ministry requirements. On motion of Vousden and Halfacre, letter be received and filed for reference. Presented letter from Minister, Ministry of Culture and Recreation advising that a cheque in the amount of $390.65, issued under the authority of the Community Recreation Centres Act for renovations undertaken at the Guthrie Community Hall, will be forwarded in approximately two weeks. On motion of Vousden and Arbour, letter be received and Treasurer to forward cheque in the amount of $390.65 to Guthrie Community Hall Committee when same is received. Presented letter from the Ministry of the Attorney General in response to Township letter with respect to authorized words and fine approvals. Letter advises of changes and corrections suggested and that the materials have been forwarded to Chief Justice Hayes. On motion of Vousden and Halfacre, letter be received and placed on file until approval of fines are received. Presented letter from Robert Holmes to Township letter of January 13, 1981 requesting he advise Council whether he is prepared to carry out the duties of Park Caretaker and Supervisor for 1981. Mr. Holmes advised that he is prepared to assume the position of Caretaker and Supervisor of Oro Memorial Park forthe 1981 season on the same conditions as in 1980. On motion of Vousden and Arbour that the services of Mr. Robert Holmes be retained for 1981 to carry out the duties of Caretaker and Supervisor of Oro Memorial Park for the 1981 season, duties to be outlined by Council as in 1980. The remuneration to be $200.00 per week from May 1 through to October 1, 1981. Remuneration may be reviewed annually should he be prepared to continue the duties. Accommodations as provided are to be available at no charge to the Caretaker during the season of operation and during the off season from October 1, 1981 to May 1, 1982 the Caretaker is to be responsible for the cost of the utilities. The Caretaker is to be responsible for the operation of the Concession Booth which is to remain open as agreed to by Council during the week days and on weekends, a schedule of which is to be posted. The gate receipts are to be turned over to the Township Treasurer on a weekly basis. . . . ... Presented letter from Simcoe Side Ratepayers Association requesting four (4) "Watch for Children" signs to be erected on the Lakeshore Road between Concessions 9 and 10. Clerk advised that the Road Supt. has obtained such signs. Letter also enclosed a cheque in the amount of $25.00 to cover the Associations share of a small piece of park equipment to be installed at Oro Memorial Park. On motion of Halfacre and Vousden, that the Road Supt. to attend the having the signs erected. On motion of Vousden and Arbour cheque in the amount of $25.00 for purpose of a piece of park equipment at Oro Memorial Park be received and same be applied when new equipment is purchased by Park Committee. Presented from the Salvation Army, Public Relations Department requesting consideration for support in 1981 with an annual grant. On motion of Halfacre and Vousden that Council authorize a grant in the amount of $50.00 for 1981 as a continued support of the work of the Salvation Army. Presented letter from Ministry of Transportation and Communications advising that pursuant to the Public Transportation and Highway Improvement Act, R.S.O. 1970, as amended, the Hon. James Snow, Minister of M.T.C. has authorized a subsidy allocation for 1981 in the amounts of: Pg. 42 FOURTH MEETING (Cont'd) JANUARY 19, 1981 Construction 155,000 1980 - 114,000 increase of 41,000 ( 36%) . Dec. 1974) and requesting that one copy of 1981 Road Program be submitted not later than March 31, 1981. Letter advises that any supplementary requests must be submitted by March 31, 1981 and again will only be for construction, and reviewed considering the priority and urgency of the particular project. Necessary forms for same also enclosed with original allocation. On motion of Halfacre and Davie that the 1981 subsidy allocation as presented be applied to the 1981 Road Program and the Road Supt. and Road Committee along with the Clerk-Treasurer to prepare necessary Road Pro9ram for 1981 and present same to Council, as early as possible, for consideration together with a program for supplementary subsidy allocation. Presented memorandum from Ministry of Transportation and Communications with regard to 1980 Annual Returns and Municipal Declaration with respect to Environmental Assessment Act, 1975. A copy of declaration form, which must be submitted by each Municipality with their petition for subsidy. The declaration is required since exemption of Municipality from the above legislation was removed June 1980, the requirement is in compliance with Section 6 of the Act. . On motion of Vousden and Davie, that the Road Supt. sign the necessary declaration after reviewing the Act in order to assume that work or undertaking in 1980 has been proceeded with contrary to the Environmental Assessment Act. Completed declaration to be submitted with the 1980 annual returns. Presented from District Municipal Engineer, Ministry of Transportation and Communications, memorandum forwarding copy of MRA-135 Equipment Rental Rates, formerly MR-222. The schedule of rates being effective January 1, 1981. On motion of Davie and Vousden, copy of MRA-135 be received and Road Supt. and Clerk to review same and recommend corrections and/or changes of subsidizable hourly rates required for all road equipment. Presented letter from Town of Dunnville forwarding resolution of the Council of the Town of Dunville that the Government of Ontario be requested to amend the Environmental Assessment Act (1975) to require, without exception and under any and all circumstances, an unbiased and impartial public hearing to be conducted, and the findings be made known before any site or facility for the disposal, treatment or storage of any liquid or solid waste or any material of a toxic or dangerous nature, be established at any location in the Province. Letter requests support and endorsement of the resolution and if endorsed the Minister of the Ministry of the Environment be advised, as well as the Ontario Municipal Association and the local M.P. and M.P.P. . Presented letter from District Manager, Huronia District, Ministry of Natural Resources with respect to "Planning for Flood Emergencies" with reference to letter of November 1979 forwarding copy of sample Flood Emergency Plan, requesting that the Township Flood Emergency Plan be updated by the end of February, 1981. On motion of Vousden and Arbour, Reeve and Clerk to review the Township Flood Emer0ency Plan and same be updated and copy forwarded to the Ministry of Natural Resources and Nottawasaga Valley Conservation Authority. Presented letter from the Hon. Claude F. Bennett, Minister, Ministry of Housing with respect to "making better use of existing resources - a strategy for 1980". Letter suggests that members of Council and other Municipal Officials attend one of the workshops to be conducted by the Ministry. This matter was left over for consideration by the Building Committee. Presented letter from David Hunter, Chairman of the Law Society of Upper Canada programme on the Provincial Offences Act and Municipal Practice, advising of programme conducted, January 17, 1981 and registration form for same. On motion of Vousden and Davie letter and Schedule of Events be received and file for reference. . Presented letter from the Hon. Thomas, Minister, M.l.A. with reference to Statutory duty Council must perform prior to February 15, 1981 in accordance with Section 233(3) of The Municipal Act. The Act requires Council to review its arrangements for security bonds on its staff members. Also enclosed copy of information on typical security bonds available is attached to the letter. Details of coverage is to be forwarded to the Ministry's Field Office in Orillia. On motion of Davie and Vousden that the present Blanket Coverage carried with the Township Insurance Agent would in Council's opinion be sufficient at this time and is again to be reviewed before May 1, 1981 which is the due date of Township Insurance Policy. Presented letter from Waldo Henderson, District Supervisor, Barrie District Field Office, Ministry of Culture and Recreation, advising of Qpen House on Wednesday, February 18, 1981 from 3:00 p.m. to 7:00 p.m.. Purpose of the venture is an opportunity to meet the new staff, which is to the entire staff and members of the Program Divisions from the Toronto Office. On motion of Davie and Vousden, Clerk and Councillor Halfacre to attend the Open House in order to meet new staff. Presented letter from Consumer's Gas Company forwarding the Ontario Energy Board Order - authorizing price increase to customers - increase to be effective February 7, 1981. On motion of Vousden and Halfacre, letter and Ontario Energy Board Order be received and placed on file. . . . . Pg. 44 FOURTH MEETING (Cont'd) JANUARY 19, 1981 Presented letter from Ministry of Agriculture and Food with respect to Drainage Course to be held on April 6th to 10th, 1981 at the Arboretum Conference Centre at the University of Guelph. Two options are available - Option "A" first two days deals with Drainage Act and administration of all aspects of drainage; Option "B" deals mainly with construction, inspection, maintenance and equipment aspects of drainage. On motion of Vousden and Arbour that the letter and program be referred to the Road Comittee for recommendation. Presented letter from Mrs. L. Boht, on behalf of residents of Shanty Bay with respect to the "Pathway Project" along the Shanty Bay Road. The letter suggests that the Pathway should be financially supported by the Township as opposed to Shanty Bay Residents only. On motion of Davie and Vousden, that the Clerk write the Barrie Suburban Roads Commission outlining the County's recommendations forthcoming from the meeting held with the Roads Commission and County Engineer at the County Administration Centre on Tuesday, January 13, 1981 with a request for confirmation of each of the recommendations as mentioned. The Planning Administrator was present at 1:05 p.m. to review planning and development matters. The following was presented: M. Dale, forwarding site plan of property, part of Lot 27, Conc. 7 adjacent to R.P. 755. On motion of Halfacre and Arbour, that the Dale property site plan be received and placed on file. Re-zoning of the subject lands from "OS2 - Inherent Hazard Lands" to "SR - Shoreline Residential" to be undertaken in conjunction with other amendments to By-law No. 1031 as amended, at such time as the matter of conversion zoning is brought before and resolved by the Ontario Municipal Board. Circulation copy of City of Barrie By-law No. 80-153, amending the text of the Barrie Zoning By-law to permit a bake shop use within a restaurant. On motion of Vousden and Davie, that copy of City of Barrie By-law No. 80-153 be received and placed on file. Royal Bank of Canada, letter of credit in the amount of $2,000.00 on behalf of the Frame Shop and Auto Sales Ltd., in respect of a proposed Zoning Amendment on part of Lot 21, Conc. 5. On motion of Davie and Arbour that letter of credit be received and placed on file. Zoning By-law amendment to be proceeded with at such time as the subject lands are placed under site development control by-law pursuant to Section 35(a) of The Planning Act, and upon receipt of the necessary site plans, survey and Developer's Agreement. Notification of receipt of proof of service and Affadavits in respect of By-law No. 1213/80 from the Ontario Municipal Board. On motion of Vousden and Halfacre, Planning Administrator to advise the Board in respect to an estimate of the length of time required for hearing of the referrals to the Official Plan Amendment (No. 12) and zoning by-law objections as being 5 full days, and to expedite comment to the Board from the Ministry of Housing in regard to the By-law. ~ . . . ....... Pg. 45 FOURTH MEETING (Conti d) JANUARY 19, 1981 Presented information in respect to a one day seminar co-sponsored by the Ministry of Housing and the Provincial Associ.ati.on of tQlUl]Jittees of Adjustment and Land Division Committees for Secretary-Treasurer's to be held at Queen's Park on Friday, March 13th, 1981. Registration cost $8.00 in advance. On motion of Halfacre and Vousden, that the Planning Administrator be authorized to attend, and that expenses to attend be paid. The Road Superintendent was present at 1:30 p.m. to review road matters. The following was presented. The matter of the fuel pumps and fuel supply agent was discussed in light of the deteriorating conditions of the present fuel pumps. A brief report on the cost of the estimated pump installation and supply contract estimates were presented. The matter was held over for further discussion at the Roads Committee. The matter of 15/16 Sideroad construction was also held open for discussion at the Committee level. The Roads Superintendent also reported on the request from M.T.C. regarding revised tender forms, and was requested to attend the Roads Committee meeting scheduled for Thursday, January 22, 1981 at 7:00 p.m. Presented a letter from W. E. Mallory in opposition to Council's actions in respect to "Equalized" Assessment. On motion of Vousden and Arbour, that correspondence be acknowledged as received. Presented a letter from the Ministry of the Environment, the Hon. H. Parrot, in respect to the proposed industrial and hazardous waste treatment site proposed in South Cayuga. On motion of Davie and Vousden, that correspondence be received and placed on fil e . On motion of Arbour and Vousden that the Clerk write to the Township Fire Chief and request he meeet with the Four District Chiefs in order to prepare his 1981 budget for presentation by himself to the Fire and Building Committee of Council at 7:30 p.m. on Thursday, February 12, 1981. Councillor Vousden reported on the repairs being carried out to the Waste Disposal Site equipment, and indicated when it may be available. Presented letter from Simcoe East M.L.A. Gordon E. Smith, Parliamentary Assistant to the Minister of Industry and Tourism, in respect to the Oro Memorial Park. The matter was held over for further discussion at the Committee level, to be reviewed on Thursday, January 22,1981. Thomas Kinn, owner of part of Lot 9, Concession 11, not being present at 2:30 p.m. as arranged for to discuss with Council the matter of the unopened 11th line above the Barrie Road - the matter was not dealt with. The recommendation of Committee of Council with respect to Library services with the Barrie and Orillia Public Libraries as proposed by the Library Boards and considered at a meeting of Committee of Oro Council with Oro Library Board were further considered by Council with the following action taken. ~ . . . ~ FOURTH MEETING (Cont'd) JANUARY 19, 1981 Pg. 46 On motion of Vousden and Halfacre, that Clerk to advise both Barrie and Orillia Public Library Boards and advise that Oro Council are prepared to match the library grant and that the $5.00 library fee by the Township will no longer be required if the Library Boards in Barrie and Orillia accept this matching of the grant. A By-law to confirm the appointment of certain Township Officials and employees and to fix their remuneration and to prescribe their duties for the year 1981, was presented according to remunerations approved at the meeting of Council held on December 19, 1980 and after further consideration, a By-law to confirm the appointment of certain officers and employees was on motion of Halfacre and Vousden introduced as By-law No. 1226/81 and read a first time. On motion of Vousden and Davie, By-law No. 1226/81 read a first time, be read a second time. On motion of Arbour and Davie, By-law No. 1226/81 read a second time, be read a third time. On motion of Halfacre and Vousden, By-law No. 1226/81 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. As requested by Council, representatives of the Simcoeside Ratepayers Association were in attendance at 3:45 p.m. with regard to the Park lots on Plan 1488. Oro Council in 1980 had authorized the Association to clear brush for portions of the four lots for recreational use and Council requested the representatives of this Association to attend the meeting today in order to clarify the proposed work and what had taken place to date. The President of the Association and 8 members were present. The Reeve asked the President of the Association, Mr. Garry Litster to report on proposed use and progress of the work on the park lots. Mr. Litster presented a plan of the proposal for the four lots and progress of the work to make the lots suitable for recreational uses. Members of Council asked questions for the clarification purpose to which Mr. Lister replied advising that the work was in accordance with the approval of the 1980 Council as outlined when an on site inspection with Council and members of the Association had been held in 1980 and later confirmed by letter. The Reeve advised that although last year's Council had met at the site with representatives of the Association, this was the first time a plan had been actually presented to Council, therefore it would appear that Council members should have an opportunity to inspect the site since certain members of the Association had expressed concern to members of Council. Mr. Litster advised that the individuals who had expressed concerns to Council had not contacted the Association regarding their concerns and that he had personally contacted various members about meetings of the Association regarding work on the park lots. Several members of the Association added comments regarding some of the concerns of people in the area. ~ . . . ~ Pg. 47 FOURTH MEETING (Cont'd) JANUARY 19, 1981 The Reeve advised that the information from the Association members present had been very informative and Council would visit the park lots and suggested that no further cutting of trees should be carried out until after Council's inspection. Hawkestone Police Village Trustees were unable to attend due to illness. Mr. Paul Spears and Mr. Paul Jones were present at the request of Council and sat in on the meeting. Since the Trustees were not present the Reeve asked Mr. Paul Spears to relate to Council what the Police Village was entitled to and what alternatives could be available to them. On motion of Davie and Halfacre that the Clerk contact the stores in the Township of Oro and ask if they would be prepared to handle dog licences in 1981. On motion of Vousden and Halfacre that a humidifer be installed in the Township Office on the furnace. On motion of Vousden and Davie adjourn to meet again on February 2, 1981 at 10:00 a.m.
