COUNCIL CHAMBERS - JANUARY 5, 1981
TH IRD MEETING
Council met pursuant to adjournment with all members present.
Reeve Allan K. McLean in the chair.
The minutes of the last regular meeting of December 15th, 1980 and
Special Meeting of December 19th, 1980 were on motion of Halfacre and
Vousden confirmed as printed and received.
Presented copies of letters forwarded as instructed at the last regular
meeting as follows:
Robert E. Drury and Ross W. Bradley advising of their appointment to
Oro Planning Board;
Howard A. Campbell advising that he has been appointed as member to
Oro Committee of Adjustment;
James Gray advising that he had been appointed as member of Oro Township
Community Arena Committee;
Mrs. Sheila Litster advising that her application to serve as member on
the Oro Township Library Board had been accepted along with Marion McLeod,
Joan Banbury and Besse Crawford, also copies of letters advising them of
their re-appointment;
Trustees Hawkestone Police Village requesting they attend a meeting of Council
and they advise of a suitable date;
Barrie Suburban Road Commission requesting that a meeting be arranged with
Oro Council and representative of the Oro Ratepayers Association, if required;
Simcoe County Board of Education - requesting the Board consider arranging for
transporting children in Shanty Bay until a walk-way is constructed;
Provincial Offences Act Implementation, Executive Co-Ordinator forwarding
Township Draft By-law to authorize "Words and Expressions" with respect to
certain Municipal By-laws also set fines for contravention of same;
City of Barrie Airport Committee advising that Deputy Reeve Stephen Davie
has been appointed by Oro Township Council to attend Barrie Airport Committee
Meetings;
Clerk-Administrator Township of Vespra forwarding account for apportionment
of School Board Election Costs for Ward 8;
Paul G. M. Hermiston, Q.C. Township Solicitor, returning draft agreement with
L. J. Torpey to convey Lot 4, Plan M-71, as partial security for unfinished
work, and requesting Solicitor have same executed as soon as possible;
Skelton, Brumwell & Associates Ltd. advising that Oro Township Council have
no objection to draft approval of Guthrie Industrial Park Subdivision for
a period of one year to January 6, 1982 with copy to Ray Campbell;
Subdivision Branch, Plans Administration Branch, Ministry of Hdusing, advising
that Oro Council would have no objection to extension of draft approval
for Guthrie Industrial Park Subdivision, File 43T-74324 for a period of
one year to January 6, 1982 with copy to Ray Campbell;
Airport Hilton Hotel - reservations for accommodations for newly elected
Councillors seminar, January 9 - 10, 1981;
Simcoe County Board of Education - forwarding balance of account for Shanty Bay
Community and School Centre addition upon receipt of grant under Community
Recreation Centres Act, in the amount of $15,059.54;
Ministry of the Environment re: salt contamination report for well at Oro
Township Machine Shed;

Bristow Cartage response to letter with respect to parking of commercial
vehicles in residential area;
Jo-Con Developments Ltd. forwarding cheque in the amount of $815.35 in payment
of hydro accounts from November 1979 when water system was assumed by the
Municipality;
Mobile Tank Industries Ltd. forwarding cheque for 1500 gallon water tank mounted
on Ford cab and chassis, being the tanker truck for Hawkestone Fire Dept. -
advance payment of $500.00 having been forwarded when cab and chassis were
delivered in June of 1980 (total cost $13,792.00);
On motion of Vousden and Davie, copies of letters as presented and forwarded
accepted as satisfactory and same be placed on file for reference as required.
Presented letter from the Hon. James Snow, Minister, Ministry of Transportation
and Communications in reply to Township letter of November 28, 1980 regarding
interchange on No. 11 Highway at Line 9. Letter advises that information
collected on traffic study for analysis and that results of same should be
available during first few weeks in the new year, after which the Minister
will further advise the Township.
On motion of Vousden and Halfacre, letter be received and filed until further
correspondence is received from the Ministry of Transportation and Communications
within the next few weeks.
Presented memo from Municipal Road Office, Ministry of Transportation and
Communications advising that the second application for Interim Subsidy as
forwarded on November 20, 1980 has been approved for payment in the amount
of $60,971.15.
On motion of Davie and ~ousden, notice of approval of second Interim Subsidy
as presented be received as satisfactory and placed on file.
Presented letter from Clerk, City of Barrie in reply to Township letter of
November 5, 1980 being an enquiry as to why the City surveyors were within
your Township. Letter advises of reasons why this took place and further
advises that the matter of not notifying the Township of Oro was an
oversight and hopefully will not occur again.
On motion of Davie and Vousden, letter as presented be received and placed
on file for reference.
Presented letter from D. Kevin Carroll, Solicitor for Dr. Chadwick, Lots
24 and 25, Plan 755, advising that copy of letter from Simcoe County District
Health Unit had been received from the Township of Oro and that the report
seems to answer one portion of Dr. Chadwick's problem. However, he would
request Council advise as to their decision on proposed drainage report
and costs as forwarded by the Township Road Supt. Also presented copy of
letter from Simcoe County District Health Unit dated December 11, 1980 which
had been forwarded to the Solicitor, being the letter the Township had
requested fromS.C.D.H.U., on November 11, 1980 as well as copy of letter
from S.C.D.H.U. to Edward and Catherine Burk, Lot 27, Plan 967, serving as
letter of notification to comply with certain requirements under Ontario
Health Regulation 229/74 made under the Environmental Protection Act, 1971,
as amended.

On motion of Davie and Vousden that letter from D. Kevin Carroll, Solicitor
for Dr. Chadwick be received and Clerk to reply and advise that this Council,
Road Supt., along with the respresentative from the Ministry of Transportation
and Communications will inspect and review this area in question early in Spring,
as soon as weather permits, after which a full report will be forwarded.
Presented letter from Ministry of Intergovernmental Affairs with respect to
1980 apportionment revisions and copy of print out for 1980 Unconditional
Grants Act, 1975, showing a nil balance and that a total of $83,080.00
had been received by the Township.
On motion of Vousden and Arbour l~tter and print out of Unconditional Grant
as presented be placed on respective file for reference.
Presented photo copy of letter forwarded by the Township Road Supt. to
Ministry of Transportation and Communications forwarding partial plan of
Township of Oro construction project on 15/16 Side Road, requesting that the
catch basin that joins some pipes for drainage outlet at the intersection of
No. 93 Highway and 15/16 Side Road be inspected and assistance to improve
same be implemented prior to paving of the Cross Road in 1981.
On motion of Arbour and Halfacre, copy of letter as presented be placed on
file until reply is received from M.T.C.
Presented report of Road Supt. following his inspection with representative
of M.T.C., Mr. Murray Ross, of the drainage works carried out by J. Treloar,
in accordance with the Agreement of Mutual Drain, Lot 21, Concession 11.
On motion of Vousden and Halfacre, report be received and filed for reference
and Road Supt. to review same in spring regarding the minor blockage.
Presented copy of order form for Municipal World for two year period for
Council, Planning Board, Committee of Adjustment and Administrative Officers.
On motion of Halfacre and Vousden action taken and copy of order form for the
Municipal World magazine accepted as satisfactory.
Presented letter from D. S. White, Solicitor, with respect to transaction for
purchase of land for road widening purposes for 15/16 Side Road from
James Ellwood Besse and Robert Francis Besse, part Lot 15, Concession 2
(Part 1 - Reference Plan 51R-9583). Also copy of deed for same registered
as Instrument No~ 723852, dated December 10, 1980. Purchase price for
land being $1,000.00 and Solicitors account in the amount of $198.90.
On motion of Halfacre and Vousden letter and account from Solicitor, as well as
copy of deed registered as Instrument No. 723852, be received and placed on
file and Solicitor's account in the amount of $198.90 and cost of land
according to agreement in the amount of $1,000.00 be added to Road accounts
and cheques for same be forwarded.

Review Committee, dated June 16, 1980, which is to be a subject to discussion
and balloting during the forthcoming Annual Conference - February 8th to 11th.

Presented letter of request for a grant in 1981 from the Canadian Mental
Health Association. Letter requests that Council give consideration to a
grant of $35.00 or more.
On motion of Vousden and Davie, Oro Council authorize a grant in the amount
of $35.00 to the Canadian Mental Health Association for 1981.
Presented letter from Treasurer, East Simcoe Plowmanls Association, requesting
an increase in grant for 1981, since the Association has to make a donation to the
1981 International Plowing Match of $100.00.
On motion of Vousden and Halfacre, Oro Council authorize a grant in the amount
of $75.00 to East Simcoe Plowmanls Association plus $75.00 because of the 1981
International Plowing Match to be held in the County of Simcoe in 1981,
to a total of $150.00.
Presented letter from Simcoe County Recreation Department regarding the County
Recreation Curling Bonspeil 1981, enclosing official registration form for
one rink from the Township, same is to be forwarded prior to February 13, 1981.
Entry fee is in the amount of $50.00 per rink of 4, which is to be paid in
advance with submission of registration of a rink. Date of the Bonspiel
is February 28, 1981 and is to be held at the Penetanguishene Community Centre.
On motion of Vousden and Davie that the Township of Oro complete the
registration form for one rink from the Township of Oro and cheque for
entry fee of $50.00 be forwarded along with same.
Presented letter from the Hon. Harry Parrott, Minister, Ministry of the Environment,
with respect to recent amendment to the Environmental Assessment Act
Regulation for Municipal Undertakings, enclosing a copy of the Amending
Regulation 885/80 and explanatory notes, which amends Ontario Regulation 836/76.

On motion of Arbour and Halfacre repor~of Chief Building Official as
presented received as satisfactory.
Chief Building Official advised Council that he required a step ladder
to enable him to do attic insulation inspections and a battery lantern.
On motion of Davie and Vousden that the Chief Building Official purchase
a 4 foot step ladder and battery lantern.
Presented letter from Regional Municipality of Haldimand-Norfolk forwarding
resolution with respect to the intention of the Ontario Government to locate
a Permanent Liquid Industrial Waste Treatment Facility on lands Provincially
owned in the former Township of South Cayuga, now in the Town of Haldtmand-
in the Regional Municipality of Haldimand-Norfolk. The content of the
resolution being to petition the Premier of Ontario to rescind the decision
of the Ministry of the Environment and following the Province's own
environmental assessment process which includes a full enviornmental study,
under the terms of the Environmental Assessment Act and an independent
public hearing by the Environment Assessment Board before proceeding with
any such facility. The Region further would appreciate support and endorsement
of the resolution.

On motion of Davie and Halfacre that the Township of Oro support and endorse
the resolution of the Regional Municipality of Haldimand-Norfolk and Clerk
to notify the Region accordingly and a copy of the letter be forwarded to
the Premier of Ontario.

Presented letter from the Township of North Burgess forwarding a resolution
with regard to amendment to the existing legislation which gives the right
to non-residents to run for office in Municipal Elections, be altered so that
only resident land owners are entitled to run for office in a Municipal Election.
On motion of Arbour and Davie that the Township of Oro not endorse the
resolution and same be placed on file for reference with no action taken.
Gordon E. Smith, M.P.P. Simcoe East was present at 11:45 a.m. to make a
presentation to former Reeve Howard A. Campbell for his services to the
Township of Oro.
Mr. Smith advised that on behalf of the Province of Ontario he was pleased to
formally acknowledge the services of Howard A. Campbell. Mr. Smith further
expressed that he was pleased to make this presentation and also advised that
he had enjoyed working with Howard over the years.
Mr. Campbell replied and expressed his appreciation for the presentation and
recognition by the Province.
The Planning Administrator was present at 1:05 p.m. to review planning and
development matters. The following was presented:
Copies of letters to Mr. & Mrs. M. Dale and Mr. P. Lock Jr. advising as
directed by Council, that the rezoning of their properties will be entertained
on receipt of surveys or adequate plans of their properties;
Ministry of Housing, advising of procedures in respect to objections received
on re-zoning under Section 35(24) of The Planning Act;
Ministry of Housing, advising of revised maximum "adjustment family income"
level under the Ontario Home Renewal Program (OHRP). Maximum raised from
$12,500.00 to $15,500.00.
On motion of Halfacre and Davie, that correspondence as presented be placed on file.
Advised of recommendation of Oro Planning Board made in respect of a
subdivision proposal by Wm. J. Cook Construction Ltd. on part of Lot 24,
Concession 8, to develop 21 general residential lots in the village community
of Oro Station.
On motion of Halfacre and Arbour that Council recommend that Wm. J. Cook
Construction Ltd. make application to the Minister of Housing under Section 33
of the Planning Act for approval of a draft plan of subdivision. Prior to
the Municipality's response to the Ministryls circulation of the draft plan,
Council would be prepared to discuss servicing and financial requirements
with the developer.
Advised of recommendation of Oro Planning Board with regard to are-zoning
proposal by Mr. Ross Cook in respect of part of Lot 18, Concession 1 E.P.R.
On motion of Davie and Vousden that subject to receipt of a letter of credit
as deposit against all costs of the re-zoning, and any necessary plans,
surveys and/or supporting materials, Council are prepared to enact an exception
to By-law No. 1031 as amended, to permit the use of part of Lot 18,
Conc. 1 E.P.R. being an area approximately 175 feet in width by 200 feet in
depth fronting on Highway No. 93 as a convenience retail store. Planning
Administrator to draft an appropriate by-law for consideration on receipt of
the standard letter of credit or cash deposit in the amount of $2,000.00
and such plans as are required.

Advised Council of recommendation of Oro Planning Board in regard to a
proposal by Mr. M. Walt to rezone the former Whalen & Cook garage property
and wrecking yard, part of Lot 21, Concession 5, to recognize the existing
use as "C2 - Highway Commercial" as it formerly was zoned by By-law No. 1031
as amended, and to permit by exception, the additional use of the property
for the sale of used vehicles.
On motion of Davie and Vousden that subject to receipt of a deposit against
all costs of rezoning, and any necessary plans, surveys and/or supporting
materials, Council are prepared to enact a Zoning By-law to rezone part
of Lot 21, Concession 5, from "A - Agriculture" to C2 - Highway Commercial",
and the required exception clause to permit the sale of used vehicles from
the subject lands under Section 13 of By-law No. 1031 as amended. Prior
to re-zoning, the subject lands are to be designated under a by-law passed
pursuant to the provisions of Section 35a) of the Planning Act as being subject
to site plan control. The site plan agreement shall specify, amongst other
matters, the maximum number of used vehicles to be parked on the site at
anyone time, and that only such vehicles as are rebuilt on the site shall
be offered for sale. Prior to preparation for re-zoning, a site plan of
the entire property shall be submitted to Council for their approval.
Planning Administrator to prepare drafts of the appropriate by-laws on receipt
of the standard letter of credit or cash deposit in the amount of $2000.00
and such plans as are required.

Presented to Council preliminary financial statements from the Secretary
Treasurer of the Oro Planning Board and of the Oro Township Committee of
Adjustment for the year 1980, for the purpose of information only.
Road Supt. Fred Haughton was present at 1:30 p.m. to present his report
for work done during the month of December and Vouchers 12 and 12A to
cover same.
On motion of Vousden and Halfacre report of Road Supt. Fred Haughton accepted
as satisfactory and Treasurer authorized to issue cheques to cover same
to a total of $35,273.20.
Road Supt. presented letter from M.T.C. in reply to Township letter with
respect to catch basin at junction No. 93 Highway and 15/16 Side Road.
On motion of Davie and Halfacre letter as presented be received and placed
on file.
Chairman of the Waste Disposal Committee presented a report on estimated
costs to repair the AC840 Loader. After consideration the following action
was taken:

On motion of Halfacre and Vousden that the Road Supt. have the AC840 front end
loader from the Waste Disposal Site brought into the Township Machine Shed
for repairs and the Road Supt. be authorized to obtain the necessary parts.
Presented a letter from the Town of Lincoln forwarding a resolution requesting
that the legislature immediately amend the Municipal Act to permit a charge
of 1 3/4% per month on arrears of taxes and that this be the minimum action
which should be taken by the Legislature at this time to amend Section 553
of The Municipal Act which presently sets a maximum interest charge of 1~%.

On motion of Davie and Arbour that the Council of the Township of Oro does not
support the resolution of the Town of Lincoln and letter be received and filed.
On motion of Davie and Arbour that a resolution be forwarded to ROMA
requesting that the Government of the Province of Ontario be petitioned
to amend Section 553, subsection 1, of the Municipal Act, to permit a
percentage of up to 1~% per cent per month as a penalty for non-payment of
taxes and subsection 2, to permit interest rate of 1~% per cent per month,
being 18% per annum, to be added to all unpaid taxes in the year in which
the taxes were levied and until the taxes are paid.
Presented letter from Assessment Commissioner, information notices that will

The information sheet is for Council's information as to attachment to
notices.
On motion of Vousden and Davie the information sheet as presented be received
and each member of Council have a copy for information purposes.
The matter of reviewing salaries of two employees as recommend and approved
at a meeting of Council held on December 19, 1980 was entertained by Council.
When the remuneration of the Chief Building Official had been considered the
basic 1980 salary used was in error. And the Deputy Clerk and Planning
Administrator had expressed some concern.
On motion of Halfacre and Davie that following a review of the remuneration
received by James Shellswell, Chief Building Official for 1980 and because
of the error in applying incorrect basic salary, his remuneration for 1981
be set at $16,500.00 rather than $16,000.00 as previously approved at a meeting
of Council held on December 19, 1980 and that this amount of $16,500.00
be included in the By-law to affix the remuneration for certain officers
and employees of the Township.
Deputy Clerk, George Roberts was again asked to be present before Council
to review the salary for 1981 as recommended and approved by Council at a
meeting held on December 19, 1980. And after further consideration, the
following resolution was introduced.
On motion of Davie and Halfacre that after further review of the salary
recommended and approved for George Roberts on December 19, 1980, that his
salary be increased by $500.00 from $19.500.00 to $20,000.00 per annum.
Prior to calling of the vote the Reeve asked for a recorded vote, which
resulted as follows:
Reeve McLean - nay
Deputy Reeve Davie - yea
Councillor Halfacre - yea
Councillor Arbour - yea
Councillor Vousden - nay
Motion carried.
The matter of a By-law to authorize the borrowing to meet current expenditures
was considered by Council, and on motion of Halfacre and Vousden a By-law
to authorize the necessary borrowing to meet current expenditures of the
Municipality for the year 1981, was brought in for an amount of $800,000.00
and introduced as By-law No. 1224/81 and read a first time.

The matter of passing a By-law to authorize an interim tax levy as in 1980
was discussed and considered by Council, and on motion of Halfacre and Davie
a By-law to authorize an interim tax levy in the Township of Oro for the
year 1981, was brought in and introduced as By-law No. 1225/81 and read a
first time.
On motion of Vousden and Arbour, By-law No. 1225/81 read a first time be
read a second time.
On motion of Vousden and Halfacre, By-law No. 1225/81 read a second time,
be read a third time.
On motion of Arbour and Davie By-law No. 1225/81 now read a third time,
do pass, be engrossed by the Clerk, signed and sealed by the Reeve and
Treasurer authorized to make arrangements required to prepare and have
tax bills for an interim tax levy processed by I.B.M. as provided in the
By-law with the due date for the interim taxes be March 31, 1981.
On motion of Vousden and Davie that the due date for the final taxes in
1981 be set as August 31, 1981.
On motion of Davie and Arbour that the following accounts are passed
for payment:
Wages: Office - 4 weeks ending December 26, 1980
Arena - 4 weeks ending December 28, 1980
W.D.S. - 4 weeks ending December 27, 1980
Planning Board - Fourth Quarter for 1980
