COUNCIL CHAMBERS - DECEMBER 15, 1980
SECOND MEETING
Council met pursuant to adjournment with all members present.
Reeve Allan K. McLean in the chair.
The minutes of the first meeting of the 1981-82 Council following the
Inaugural, were on motion of Halfacre and Arbour confirmed as printed and
received.
Presented copies of letters forwarded as instructed by Council at the
last regular meeting:
Secretaries Community Hall Committees and Arena Committee requesting each to
advise as to whether present members are prepared to continue to serve or
recommend names of others who would be prepared to act;
Also letters to Community Hall Committees forwarding application for Public
Hall Licence, requesting same be completed and returned with proper fee
for 1981 Licence;
Rural Ontario Municipal Association - forwarding pre-conference registration
forms and reservation for accommodations;
N.V.C.A. - advising of Township representative for 1981;
Royal Victoria Hospital - appointment of member of Council to the Hospital
Board for 1981;
Secretary, Oro Township Library Board - requesting that Council be advised
whether present members are prepared to continue to serve;
Joanna McEwen and Ruth Fraser advising of their appointment to History
Committee for 1981;
Copy of letter from Township Road Supt. to M.T.C. District Office re: catch
basin at intersection of No. 93 Highway and 15/16 Side Road;
Assessment Commissioner confirming use of Town Hall for Open House to be held
for Assessment purposes for Wednesday, January 14th, Thursday, January 15th,
Friday January 16th, and Saturday, January 17th, 1981;
Stewart, Esten, Township Solicitor re: By-law to convey part of original
road allowance between Lots 15 and 16, Concession 8;
D.S. White, Township Solicitor, re: By-law to convey old road allowance
between Lots 15 & 16, Concession 8, under Section 462 of the Municipal Act.
On motion of Davie and Vousden copies of letters as presented and forwarded
be placed on file for necessary reference.
Presented letter from Paul G. Hermiston, Solicitor, acknowledging receipt of
Township letter of November 27, 1980 advising that the Township would be
prepared to accept Lot 4, Plan M-71, from L. J. Torpey as partial security
for unfinished services, enclosing Draft Agreement which he proposes to have
Mr. L. J. Torpey to execute, provided same meets with Oro Council's approval.
Draft Agreement prepared in accordance with Council's resolution of
November 26, 1980.
On motion of Vousden and Halfacre, Clerk to reply and advise that the Draft
Agreement as presented meets with Council's approval and that the Solicitor
have same executed as soon as possible prior to the end of December 1980.
Presented copy of letter from the Township of Vespra to the Hon. James Snow,
Minister, Ministry of Transportation and Communications forwarding copy of
resolution of the Township of Vespra, with respect to use of motorcycles and

all terrain motorized vehicles on private land and in reforestration areas.
And reply from the Hon.Minister. Copy of letter being received since
Council of the Township of Oro had endorsed the resolution of the Township
of Vespra.
On motion of Davie and Vousden copies of letters be received and filed for
reference.
Presented letter from Lyle Bristow of Bristow Cargage in reply to Township
letter of November 27, 1980 with respect to parking of commercial vehicles
in driveway in Residential Zone. Letter advises that the transport trucks
have been relocated, but may appear for only a period of time during the day.
On motion of Arbour and Davie, letter be received and Clerk to advise that
although this would appear to be satisfactory for the present, every effort
is to be made to have all commercial vehicles parked in an area zoned for
such purpose and not in a General Residential "RG" Zone.
Presented letter from Jo-Con Developments Ltd., forwarding hydro accounts for
water system on Plan M-66, which have been paid by Jo-Con Developments from
November 16, 1979 to August 26, 1980 to a total of $815.35 requesting
remittance of same. The water system having been assumed by the Township
as of November 1979.
On motion of Davie and Halfacre, Treasurer authorized to forward cheque to
Jo-Con Developments to cover hydro accounts for the water system, Plan M-66
and M-71, energy account, to a total of $815.35. And, Clerk-Treasurer to
advise Ontario Hydro to have all future energy costs for the said water system
to be billed to the Township of Oro.
Presented letter from the Hon. Rueben Baetz, Ministry of Culture and Recreation
advising that a cheque in the amount of $18,728.83 issued under authority
of the Community Recreation Centres Act for costs related to the Shanty Bay
Community and School Centre will be forwarded in approximately two weeks.
On motion of Halfacre and Vousden letter be received and Treasurer to forward
the balance owing by the Shanty Bay Community Committee to Simcoe County
Board of Education once the grant under C.R.C. is received in the amount
of $18,728.83.
Presented letter from Simcoe County Board of Education advising that the
fourth and final installment of the 1980 tax levy for educational purposes
is due on December 15, 1980 the final instalment being in the amount of
$372,181.42. Letter also refers to Section 430F of The Assessment Act which
requires Supplementary Taxes for the year 1980 to be paid on or before
December 31, 1980. And additionally requests a summary of 1980 mill rates
commercial and residential for elementary and secondary, used to determine
the 1980 taxes paid for educational purposes. Clerk advised that the cheque
had been forwarded in time to meet the required date, along with other
information requested.
On motion of Davie and Arbour letter be received and action taken by Clerk-
Treasurer accepted as satisfactory and the Simcoe County Board of Education,
portion of the Supplementary Taxes to be forwarded prior to December 31, 1980.

Presented letter from E. J. McCabe, Regional Director, Ministry of Transportation
and Communications, in reply to Township letter of November 27, 1980 advising
that the Ministry will take appropriate action to assure that funding is
available in 1981 for the Ministry's 80% share of the total estimated cost
for paving three miles of 15/16 Side Road from No. 93 Highway eastward.
This 80% cost sharing being in accordance with the December 18, 1979 letter
from the Hon. James Snow to the Township of Oro. Clerk advised copy of
letter had been presented to Road Supt.
On motion of Vousden and Davie, letter of assurance of funding from the
Ministry for 15/16 Side Road in 1981, be received and filed for reference.
Presented letter from District Officer, Municipal and Private Abatement,
Ministry of the Environment with reference to salt contamination at the
Township machine shed well and the well of Neil Briggs referred to in
Township ,letter of October 7, 1980. Letter requests that further information
be forwarded with respect to abandoned well and future salt storage.
On motion of Davie and Vousden, Clerk to reply and advise that the old well
has been sealed and that the Township does not intend to replace the
sand/salt stockpile at the Machine Shed, which is presently being gradually
removed and that the sand/salt stock pile will be relocated in 1981.
Presented letter from the Ontario Liquor Licence Board of Ontario advising
that after an inspection of the Town Hall premises, approval has been given
for Special Occasion Permits to be issued and Number 4323 has been allocated
for this purpose. Letter also encloses guidelines for hall owners, managers
. and employees regarding the issuance of Special Occasion Permits.
On motion of Vousden and Davie, letter be received and placed on file for
future reference as required.
Re-presented notice from the Assocation of Municipalities of Ontario (A.M.O.)
and Ministry of Intergovernmental Affairs - with respect to seminars for
newly elected councillors.
On motion of Halfacre and Davie, Clerk to complete application form and forward
registration fee for the four members of Council to attend the seminar on
January 9, 1981 at the Airport Hilton Hotel, Metro Toronto.
Clerk presented statement of election expenses by the Returning Officer for
the Election held on November 10, 1980 in accordance with Section 8(1) and (2).
The statement as completed had been turned over to the Treasurer for payment.
Total cost of the Election being in the amount of $6,175.74.
On motion of Vousden and Arbour, statement as presented be filed for reference.
The matter of turkeys for Township employees at Christmas was again
discussed by Council.

On motion of Halfacre and Davie that all permanent employees be given a turkey
as a Christmas bonus and the Clerk to obtain sufficient turkeys to cover all
permanent employees.

Presented letter from Ontario Hydro (Barrie Area) advising of new rates that
will apply for street lights in the Township of Oro, effective January 1, 1981.
Also letter from Ontario Hydro (Orillia Area).
On motion of Vousden and Halfacre, letter forwarding new rates for street lights
effective January 1, 1981 be received and Clerk to apply rates as required
to each of the Subdivisions involved and Hamlet of Shanty Bay for 1981, as well
as Hawkestone Police Village.
Presented letter from Ministry of the Environment, Barrie District Office,
requesting that forms be completed for all staff involved in the operation
of water and waste water facilities, which in Oro would apparently only have
reference to the Township owned water system in Shanty Bay, Plan M-66 and M-71.
On motion of Halfacre and Vousden, letter and attached form be received and Clerk
to have the form completed for Ron Young for the Shanty Bay Water System
(Plans M-66 and M-71) since at present time no other systems have been assumed
by the Municipality.
Presented from Ontario Good Roads Association request for 1981 membership fee
in the amount of $37.00 and pre-registration forms for delegates to attend.
On motion of Davie and Vousden Treasurer to forward membership fee under
1981 accounts and complete the pre-registration form for the delegates who
will be attending O.G.R.A.

On motion of Davie and Vousden Clerk to complete and correct the subscription
order form for the Municipal World for elected and appointed Officials
and order same for 2 year period.
Presented letter from District Administrator, Canadian Institute for the Blind,
requesting Council to consider a grant for 1981.
On motion of Halfacre and Vousden, letter be received and a grant in the
amount of $50.00 be authorized for the Canadian National Institute for the Blind
for 1981.
Presented letter from Ministry of Natural Resources with respect to application
requirements for a permit to open, establish or operate a wayside pit
or wayside quarry under the terms and conditions of the Pits and Quarries
Control Act 1971 and necessary forms for same.
On motion of Vousden and Davie, letter and forms required for application of
a Wayside Pit be received and Clerk and Road Supt. to review and complete
same when such application is made.
Clerk brought to the attention of Council the matter of licence fees for
dogs in 1981, present fees for 1980 being:

On motion of Halfacre and Vousden that the licence fees for dogs for 1981,
remain the same as in 1980 according to By-law No. 1197.

Barrie Examiner and Orillia Packet requesting interested persons submit
their names or names of other persons willing to serve on Oro Planning Board,
Committee of Adjustment and Community Arena Committee. And that in response,

On motion of Vousden and Arbour the applications of Robert E. Drury and
Ross W. Bradley to serve as members on Oro Planning Board, be accepted
and names be included in By-law to appoint members to Oro Planning Board.
Robert Drury for 3 year term and Ross W. Bradley for 2 year term.
On motion of Oavie and Halfacre, that the application of Howard A. Campbell
to serve on Oro Township Committee of Adjustment, be accepted and name be
included in the By-law to appoint members to Oro Township Committee of Adjustment.
On motion of Vousden and Arbour that the following members of Council serve
on Oro Township Planning Board for the year 1981:
Deputy Reeve Stephen Davie and Councillor Thelma Halfacre.
Presented letter from Secretary, Oro Township Library Board advising that the
present members, Joan Banbury, Marion McLeod and Besse Crawford are willing
to continue to serve on the Board for 1981, Mrs. Drury would prefer not
to continue. Letter advising that Margaret (Mrs. Allan Clipsham) from Shanty
Bay would be interested. Upon telephone call Mrs. Clipsham advised she did
not wish to serve at this time.
On motion of Vousden and Davie, that Sheila Litster be appointed to the
Township of Oro Library Board to replace Mrs. Mae Drury and that the other three
remaining members namely Joan Banbury, Marion McLeod, and Besse Crawford
be re-appointed.
On motion of Vousden and Arbour that Jim Gray be appointed to the Arena Board
to replace Todd Allison.
On motion of Davie and Vousden that Deputy Reeve Stephen Davie and
R.S. Arbour be the representatives on the Oro Township Community Arena Committee.
The Planning Administration was present at 1:15 p.m. to review planning
and development matters. The following was presented:
City of Barrie, circulation copy, By-law No. 80-147, providing for private
art galleries as a permitted use in Cl, C2, and C3 zones;
Ministry of Housing, revised copy of planning guidelines for use of
O. Reg. 78/80 made under Section 35{24) of The Planning Act;
Oatley, Purser, solicitors for developer of Windfield Estates Subdivision,
43T-78030, advising that application for Letters Patent on a non-share capital
corporation in the ame of "Windfield Estates Homeowner's Association Inc."
has been submitted to the Lieutenant Governor and approved as to form, content
and corporate name;
Letters from the Simcoe County Board of Education and the Township of Medonte,
advising that they have no objection to By-law No. 1219/80;
Letters from Irving Kumer, solicitor on his own behalf, and Wildman, Mitchell,
solicitors on behalf of Mr. C. Degroot, that they do not intend to withdraw
their objections to By-law No. 1213/80;

Presented letter from Ainley and Associates Limited, Township Planning
Consultants, in respect to objections received from Messrs. Lock and Dale,
pt. Lot 27, Concession 7, regarding By-law No. 1213/80. Letter forwards
draft responses suggested as being made to the objectors in view of
specific comments received from the Ministry of Natural Resources on proposed
zoning.

On motion of Arbour and Halfacre, Clerk to respond to Messrs. Lock and Dale
advising that Council will entertain re-zoning of their lands on receipt of
an adequate site plan or survey. Clerk and Planning Administrator are hereby
authorized to prepare and forward the necessary affadavits, materials and
application fee to the Ontario Municipal Board for hearing of By-law No. 1213/80,
and request that the Board hear the implementing by-law together with the
referral of matters made by the Minister of Housing pertaining to Official
Plan Amendment No. 12. Ainley & Associates to be advised accordingly.
Advised that the appeal period with respect to By-law No. 1219/80 expired
on December 12, 1980 with no objections having been received.
On motion of Halfacre and Vousden Clerk to execute the certificate required
under Section 35(27) of the Planning Act to ~ring By-law No. 1219/80 into
full force and effect. Plans Administration Division, Ministry of Housing
to be forwarded copy of the certificate.
Advised Council of forthcoming meetings of Committee of Adjustment and
Planning Board.

Oro Township Committee of Adjustment and to rescind By-law No. 1201/80 and
introduced be numbered as By-law No. 1222/80 and read a first time.
On motion of Arbour and Vousden, By-law No. 1222/80 read a first time, be
read a second time.
On motion of Davie and Vousden, By-law No. 1222/80 read a second time, be

Clerk presented an invoice from Mobile Tank Industries Limited for the 1500
gallon fire tank supplied and mounted on Ford Cab and Chassis SIN F82HVHKl171
provided by the Township. Total cost according to quote #4653 was in the amount
of $13,892.00, less $100.00 credit for lettering to be done by Township
Fire Department and less advance payment of $500.00, leaving a balance to
be paid of $13,292.00.
On motion of Halfacre and Vousden that the invoice as presented from Mobile
Tank Industries Limited be approved for payment and Treasurer to issue cheque
in payment of same to a total of $13,292.00 from the Township lot levy account.
Clerk presented a draft By-law to establish "Words and Expressions" with
respect to certain municipal by-laws, setting out offences which could be
governed by the provisions of the Provincial Offences Act 1979.
On motion of Vousden and Arbour that the draft By-law to establish
authorized "Words and Expressions" with respect to certain Municipal By-laws
and setting out offences which could be governed by the provisions of the
Provincial Offences Act, 1979 be forwarded to the Attorney General for approval
of same and setting of fines for the offences.
The matter of other new business was next on the agenda.

Deputy Reeve Davie brought up the matter of his appointment to the Barrie
Ai rport Committee and woul d request Council authori ze a letter of
introduction to the said Committee advising that Deputy Reeve Davie has been
appointed by Council to represent the Township of Oro on the Barrie Airport
Committee. It was left that the Clerk was to advise the Barrie Airport
Committee that Deputy Reeve Stephen Davie would be attending meetings on
behalf of the Township of Oro.
The next items was the matter of safety of children on the Shanty Bay Road
and alternative uses.
Moved by Stephen Davie, seconded by Arbour, that a letter be forwarded to
Simcoe County Board of Education, with copy of Lloyd Fletcher, Trustee, Ward 8,
that since arranging for a walkway on Shanty Bay Road in the Hamlet of
Shanty Bay, will take considerable time, and for the safety of the children
involved, Oro Council inform Simcoe County Board of Education and Trustee,
Ward 8, that Oro Council are desirous in busing as a temporary measure in
Shanty Bay, those children who must necessarily walk along the Shanty Bay
Road (Ridge Road) to get to and from school. Also that the Board and the
Trustee be informed that time is of the essence as the most hazardous season
for this topic is upon us, and that the buses are driving the route now.
Also that the Board and Trustee be asked to proceed immediately towards
achieving this temporary safeguard by representing this serious request
to whomever has the power to effect immediate action.
Deputy Reeve Davie next presented the matter of difficulties with Hawkestone
Police Village.
On motion of Davie and Halfacre, that Hawkestone Police Village Trustees be
invited to a meeting with Oro Township Council to be arranged suitable to
both parties.
The next item presented was the matter of the intersection at Oro Station with
respect to the previous requests of the Oro Station Ratepayers to the
Barrie Suburban Road Commission, which have not met with the approval of
the Commission.
On motion of Davie and Halfacre that a letter be forwarded to the Barrie
Suburban Road Commission requesting a meeting of Oro Council and members of
the Commission along with a representative from Oro Station Ratepayers
Association deemed necessary, at the earliest possible date to endeavour
to resolve some of the problem on County Road 20 and 27.
On motion of Vousden and Davie that the matter of shelving for routine
correspondence be arranged for.
Road Supt. Fred Haughton was present before Council with respect to matters
concerning roads. He discussed with Council the matter of the letter from
the Ministry of the Environment. The Reeve advised that the matter had been
considered by Council earlier in the meeting and the resolution passed by
Council was read. Several other matters concerning roads were discussed
prior to the consideration of wages for road employees and the Road Supt.
On motion of Vousden and Halfacre that Council go into the Committee of the
Whole at 3:30 p.m. to consider remuneration for Township employees.

On motion of Vousden and Halfacre that the Township supply safety equipment,
namely hard hats and gloves for each Road Employee and safety parts for
chain saw operators.
On motion of Vousden and Davie that the Road Employees receive an increase
of .70~ per hour for 1981.
The matter of remuneration for the Road Supt. was next considered and left over until
Friday when other employee remunerations are to be considered.
On motion of Arbour and Vousden that the Waste Disposal Supt. receive an
increase of .65~ per hour to an hourly rate of $6.65 for 1981.
On motion of Vousden and Halfacre that the Live Stock Valuer and Fence Viewers
receive the same remuneration per inspection as in 1980, namely $25.00.
On motion of Davie and Halfacre that the Caretaker for Oro Township Hall receive
an increase of .50~ per hour to a total of $6.50 per hour for each opening
of the Hall and $5.50 perrour while cleaning.
On motion of Davie and Halfacre that the Council come out of Commmittee of the
Whole at 5:45 p.m.
On motion of Vousden and Davie that the recommendation in Committee of the
Whole be adopted for remunerations reviewed.
Mr. Ray Campbell was present at 2:30 p.m. according to appointment arranged
previously with respect to the Guthrie Industrial Park.
Also presented letter from Skelton, Brumwell & Associates Ltd. requesting
Council give consideration to extend draft approval for a two year period
to January 6, 1983. The present approval expires on January 6, 1981.
Mr. Ray Campbell next requested Council to consider the matter of retention
of the originally approved lot levy, which at the time of draft approval
was $300.00 per lot, advising that a tentative sale was binding on this sale.
The Reeve advised Mr. Campbell that Council would consider the request for
extension of draft approval and that Council's decisions would be forwarded.
On motion of Halfacre and Vousden that Oro Council would have no objection
to and would support an extension of draft approval for one year to
January 6, 1982 for the Guthrie Industrial Park, Lots 21 and 22, Concession 5,
Township of Oro, File No. 43T-74324.
A delegation consisting Gail Swainson, Gary and Sheila Litster, Andrew
Nicholson, Buffy Woronka and Dave Willams, and Ralph Leigh as observers
were present with regard to return of the Assessment Roll under Section 86
of The Assessment Act.
Mrs. Gail Swainson made a presentation on behalf of the delegation with respect
to return of the Roll under Section 86 of The Assessment Act, a copy of which
is on file for record purposes.

Gary Litster asked a question as to when would the delegation be able to
know of Council's action.
The Reeve advised that this information could be obtained by calling the Clerk.
Deputy Reeve Davie commented on the presentation.
Andrew Nicholson also spoke on the matter of Section 86 and advised that
any inequities arising from Section 86 are open to appeal and each ratepayer
will have that opportunity.
Councillor Arbour asked to have Section 86 opened for discussion and it was
moved by Arbour, seconded by Davie that the matter of Section 86 be
reintroduced for discussion.
Councillor Arbour spoke to the motion stating that he felt that the present
Council should have had an opportunity to consider the matter.
Reeve McLean called for a vote and the motion was lost.
The matter of Christmas and New Year's holidays was introduced for consideration.
On motion of Vousden and Halfacre that the office remain closed on Friday,
January 2, 1981 and December 26th which is a statutory holiday.
On motion of Vousden and Halfacre Council meetings are to be held on the
first and third Mondays and the Committee Meetings to be held on second and
fourth Thursdays of each month.
On motion of Arbour and Vousden, adjourn to meet again on January 5, 1981
at 10:00 o'clock.
