11 26 1980 Council Minutes Pg. 263 COUNCIL CHAMBERS - NOVEMBER 26, 1980 TWENTY-SIXTH MEETING . Council met pursuant to adjournment with all members present. Reeve Howard A. Campbell in the chair. The minutes of the last regular meeting of November 17, 1980 were on motion of Smith and Sanderson confirmed as printed and received. Presented copies of letters forwarded as instructed from the last regular meeting as follows: Ministry of Transportation and Communications forwarding 1980 Second Petition for Interim Payment on road and bridge expenditures - Form OD-MB-14 (Oct. 1 to Nov. 15/80); Regional Director,M.T.C. forwarding duplicate original of the Mutual Agreement Drain as registered bearing Instrument No. 721588 and requesting formal withdrawal of original petition for the proposed Highway Drain, also requesting Ministry's portion of costs of the Municipal Engineer (Ainley & Associates Ltd.) as well as requesting that the Ministry advise the Townshi p of thesuffi ci ency of the works, once Patrol Supervi sor makes his report after the inspection of the Mutual Drain with Township Road Supt.; Ministry of Transportation and Communications returning copies of lease, as executed by the Municipality for a four year term of Part Lot 16, Concession 14, including former MTC salt storage shed and yard; Hastings Electric (Oro) Ltd. advising that his quotation to instal hydro service at the salt shed had been accepted and letter to Hagen Electric advising of quotation acceptance; Simcoe County Board of Education forwarding cheque in the amount of $23,673.97 being the amount of the grant received under Wintario from Ministry of Culture & Recreation for the Shanty Bay Community & School Centre; Mr. Earl McCrone re: Town Hall inspection by Fire Chief and Simcoe County District Health Unit; Mrs. Frances Sutton and Mrs. R. N. Williams, residents of Plan 1561 forwarding copy of letter from Canadian Transport Commission with respect to CNR crossing on Georgina Drive; Simcoe County District Health Unit - requesting reply to letter of October 23, 1980 with regard to inspection of Lots 24 & 25, Plan 755, being property of Dr. Chadwick, also copy of letter to Road Supt. from Solicitor for Dr. Chadwick and copy of his reply; Copy of letter to W.A. Kent forwarding letter regarding the removal of wood or other materials from Road Allowance; Mr. George Sutton expressing Council IS appreciation for his services and leadership as District Fire Chief and acknowledging his advising of his retirement effective December 1, 1980 and that formal recognition will be forthcoming at a later date; Copy of letter to Paris Playground Equipment re: BID Bleachers for Arena; Letter to Loreen Lucas expressing Council I s appreci ation for work and efforts in connection with annual swimming classes; Copy of letter to Ross Bertram advising that his letter will be referred to 1981-82 Council when appointments to Oro Planning Board are made. . . On motion of McLean and Sanderson copies of letters as presented and forwarded accepted as satisfactory and be placed on file for reference. . . . Pg. 264 TWENTY-SIXTH MEETING (Cont'd) NOVEMBER 26, 1980 The matter of placing an advertisement in the local newspapers for interested persons to serve on Oro Planning Board, Committee of Adjustment and Committee to manage and operate the Oro Township Community Arena, was considered by Council and the following action was taken. On motion of Smith and Swainson that the Township advertise in both the Barrie Examiner and Orillia Packet for interested persons to serve as members on Oro Planning Board, COll1l11ittee of Adjustment and Committee to manage and operate the Oro Township Community Arena Board. Presented letter from Larry J. Torpey following a telephone call to the Township Office on Wednesday, November 19th. Mr. Torpey advises that he would be willing to place Lot 4, Plan M-71 as security to guarantee satisfactory completion of outstanding work on Plan M-71 and that he is making arrangements to install the chain link fence next Spring and hopefully resolve the remaining work at the same time. Clerk advised that the Township Solicitor, Paul G. M. Hermiston, Q.C. had telephoned on Monday, November 24th, 1980 after receiving copy of the same letter and suggested that Council consider acceptance of Lot 4, Plan M-71, as security to complete the unfinished work as set out in the Subdividers Agreement as it would appear that the matter would not be coming before the Courts on the November 24th sitting. Clerk also presented copy of letter to L. J. Torpey requesting he forward $500.00 for the snow removal on Plan M-71 following his confirmation of the letter of November 20, 1980 that he is prepared to pay for snow plowing of the roads in the Subdivision for the 1980-81 season. On motion of Sanderson and Swainson, Clerk to advise the Township Solicitor that Township Council would be prepared to accept Lot 4, Plan M-71 as partial security for the unfinished work on Plan M-71 in accordance with the Subdividers Agreement, provided that the lot is conveyed to the Township immediately, free of all mortgage and encumbrances and that the taxes be paid to date. And further, that the lot will remain the property of the Township until all work has been completed on the Plan in accordance with the Subdividers Agreement, including completion of the berm, chain link fence, lot and ditch grading, repairing asphalt as required and culverts where needed as well as money owing to the Township for previous snow plowing, etc. Mr. Fred Haughton was present before Council to express his appreciation of Council IS co-operation during the year, being his first year as Road Supt. with the Township of Oro, which had made it easier for him particularly when he had been unfamiliar with the roads and considerable construction had been undertaken. Councillor Smith one behalf of the Road Committee expressed that it had been a pleasure to work with Fred Haughton as Road Supt. and felt that he had done a super job, accomplishing considerable amount of construction work, namely 15/16 Sideroad and intersections of Line 5 and 13. The Reeve and other members of Council also expressed their appreciation of his co-operation and efforts during the year. Presented copy of letter from the Hon. James Snow, Minister, M.T.C. to Central Oro Ratepayers Association in reply to the Association's letter with respect to bridge on 15/16 Sideroad being of sufficient width for two lane traffic. On motion of McLean and Smith copy of letter be received and placed on file for reference as required, should further studies and increase traffic on the road warrant necessary review by M.T.C. for approval to widen the bridge. Presented letter from Ministry of Transportation and Communications forwarding approval of request for Interim Subsidy payment and advising that same had been forwarded to General Accountant for payment of $63,182.33. On motion of Smith and Swainsonapproval as presented be received and filed for reference. Presented letter from Planmar Consultants Limited, Consulting Engineers and Planners for Quadrant Developments, Plan M-157, advising that Morris Shelswell Excavating and Grading Ltd. will be authorized to instal a culvert to Hawkestone Park from Cedarbrook Crescent for a total cost of $330.00 and that as agreed the Township of Oro will pay half of the cost of this work, being $165.00. . On motion of Smith and Sanderson letter be received and Treasurer authorized to issue a cheque in payment of the Township's share to an amount of $165.00 when invoice is received from Planmar Consultants Ltd. or the Developer, Quadrant Developments. Presented statement of Sick Leave Benefit payments as calculated and method of payment as selected by each employee, showing total payments for 1980 and balance to be paid in 1981. Total payment for 1980 being in the amount of $23,886.30 and in 1981 a balance of $7,590.14. The amounts each employee will receive will be included in the accounts for payment. On motion of Swainson and Smith that Treasurer be authorized to issue cheques in payment of Sick Leave Benefits as selected by the employees. Hawkestone Police Village Trustees were present at 8:15 p.m. , namely Ralph Leigh, Dianne McKenzie (Williams) and Trustee Elect Robyn Fallon. Trustees were present to consider with Counci 1 the matter of deficit of the Police Village as had been carried forward in accordance with the summary sheet from the Auditors. After consideration and discussion on the matter the following action was taken. On motion of McLean and Smith that the deficit of Hawkestone Police Village in the amount of $4,735.00 be written off by the Township Auditors in the 1980 Financial Statement. . Presented draft copy of letter to the Ministry of Transportation and Communications requesting the Ministry to include in the 1981 budget, funds for the paving of the portion of 15/16 Sideroad which was reconstructed in 1980. Approval for additional subsidy by Agreement for this work had been authorized by the Minister on basis of 80% by the Ministry and 20% by the Township. ,.... On motion of McLean and Sanderson that the letter as presented, requesting the Ministry of Transportation and Communications include in the 1981 Ministry Budget the funds to cover the paving of three miles of 15/16 Side Road that was reconstructed in 1980. On motion of McLean and Smith that Oro Council authorize that signs be placed on roads of Plan M-66, and M-71 by the Road Supt. that the Roads are not assumed by the Municipality. Presented letter from J. Haley, owner of Lot 88, Plan 798 being a letter of objection to penalty charged for unpaid taxes since he purchased the property in July and had not received a tax bill from the Township directly. Clerk advised that final Tax Notices had been forwarded in June to previous owner. On motion of McLean and Sanderson, Clerk to reply and advise that final tax notices in 1980 were forwarded early in June to owner then shown on the Collectors Roll and Assessment Roll. Presented letter from N.V.C.A. advising that the Willow Creek program of log jam removal as well as beaver dam had been completed and forwarding an invoice for same along with summary of work done as apportioned. The 36% share to John Wesolowski of Willow Park Motel being in the amount of $113.40. Also presented copy of letter to John Wesolowski requesting he forward a cheque in the amount of $113.40 to cover his share of the work. . On motion of Sanderson and Swainson, letter and invoice along with breakdown of apportionment as presented as well as Clerk's letter to' John Wesolowski requesting he forward cheque in the amount of $113.40 to cover the 36% of the total cost of the work as agreed to in his letter of September 26th, 1980 accepted as satisfactory and Clerk to follow up receipt of same if requi red. Clerk advised that the 6 months probation period for Katherine Richardson was completed on November 12, 1980 and that as of November, O.H.I.P. payments would now qualify for normal deduction rather than employee being responsible for 100% of the monthly payments. On motion of Smith and Sanderson that since Katherine Richardson now having completed here six months probation period, she be considered as a permanent employee, provided that she is satisfied. Bernal Johnston, letter of appreciation for the presentation of a wrist watch to him as recognition of 25 years service as Volunteer Fireman; Arena Committee Meeting minutes of November 12, 1980; Lottery Licence issued to Simcoeside Ratepayers Association; University of Guelph - acknowledging receipt of $50.00 grant for research project on fertility control in cats; Association of Municipalities - Municipal Study Tour to Israel & Egypt; N.V.C.A. minutes of Executive Meeting held on November 13, 1980 - reference to Willow Creek log jam and debris removal at location of Willow Park Motel; Ministry of Intergovernmental Affairs - Background Issue, October 31st and November 7, 1980; Pg. 267 TWENTY-SIXTH MEETING (Conti d) NOVEMBER 26, 1980 . Copy of letter to Silverman & Freed, Solicitors requesting information on Plan M-30 regarding Subdividers Agreement compliance as it affects Lot 46, Plan M-30; Ministry of Natural Resources - District Release re: 1980 Simcoe and Dufferin County Deer Hunt - preliminary report; On motion of McLean and Sanderson correspondence~ communications, etc. as presented be received and filed for reference. Clerk advised of complaint received from owner of Lot 22, Plan 1069 that owner of Lot 21, Plan 1069 was carrying out a commercial operation of an apparent delivery service and parking of up to 6 trucks for this purpose. On motion of Smith and Swainson~ letter be forwarded to Lot 21, Plan 1069 with respect to operation of delivery service and storing of trucks on his property which is contrary to By-laws of the Township in a Residential Area (RG Zone). Committee Reports were called for by the Reeve, Chai rman of each Commi ttee advised that no outstanding matters were apparent. Councillor Smith did advise that the tanker truck for Hawkestone Fire Department was still not completed by Mobile Tank Industries Ltd. There being no further business scheduled for the meeting, Council members commented as follows: . Councillor Smith wished to thank all members of Council for co-operation during four years and wished to commend Reeve Campbell for his leadership. Stating also that he had enjoyed working with all of Council and Staff. He mentioned in particular the good work of the Road Supt. who in his first year had accomplished a lot of construction work and it had been a pleasurer to work with him. Reeve Campbell expressed his appreciation for all the co-operation of Council members during his four years as Reeve. It has been an honour and pleasure to serve as the Reeve of the Township and represent the Township, indicating that it had always been his policy to serve the people of the Township with their interest being foremost and that he felt all of Council felt this way and worked towards this goal and all decisions had been made with this in mind. He also, commended Staff of the Township both Administration and Roads and mentioned the retirement of two long time employees who had served the Township well. He concluded by reiterating that as stated four years ago that he wanted to serve as Reeve for the four years and then retire, and he wished the new Council well and hoped that the same interest would be carried out by the new Council. He also commended Deputy Reeve McLean on his year as Warden and related that Warden's from Oro had been spread out in a thirteen year spread each time in most instances. . Deputy Reeve Allan McLean expressed his appreciati on for Council' s co-operation and helping him to carry out the duties of Warden of the County which without the help of Council, n would have been more 'difficult to fulfill the duties of Warden. He also stated that it has been a pleasure working with this Council and complimented the Staff of the Township for ... - . . . Councillor Sanderson also expressed his appreciation to all members of Council and recalled the first four meetings of four years ago which had been pretty hectic with No. 11 Highway Improvement and the barrier, which was a major concern of the ratepayers. He commended the Reeve for hi shard work and dedication. He also wanted to express his appreciation to the Administrative Staff and Road Department and felt he would miss working together with Council and Staff. Councillor Swainson also expressed her appreciation and said she agreed with all that had been said.
