TWENTY-FOURTH MEETING

Council met pursuant to adjournment with all members present.
Reeve Howard A. Campbell in the chair.
The minutes of the last regular meeting held on October 20, 1980
were on motion of Sanderson and Swainson confirmed as printed and received.
.
Presented copies of letters forwarded as instructed at the last
regular meeting to:
Ministry of Transportation & Communications forwarding the 1980 Petition
for Interim Payment on Road and Bridge Expenditures (Jan. 1, 1980 to
September 30, 1980;
Horseshoe Valley Resort advising that Oro Council are agreeable to
flat rate of $26.00 per hour or part thereof for snow removal and
sanding and the actual cost of sand supply on the roads of Plan 1587;
Peter Howden, Solicitor for York Sand and Gravel Ltd. with respect
to not meeting requirements of the Agreement in as far as removal of
equipment, etc, from Part W~ Lot 11, Concession 7;
Minister, Ministry of Revenue forwarding resolution of Oro Council
requesting the Minister of Revenue to cause the return of the 1980
Assessment Roll for 1981 taxation under Section 86 of the Assessment Act.
Copy of letter was forwarded to Assessment Commissioner;
PERMO Construction Ltd. re: damage to water line on Plan M-66, and
request for payment of damages by registered mail;
Simcoe County District Health Unit requesting an investigation of 4"
tile draining on the north side of Lakeshore Road opposite the property
owned by Dr. Chadwick, Lots 24 and 25, Plan 755 to determine and act
upon the apparent source of pollution, also tests of water samples taken
at this drainage tile and water supply;
John D. D. Graham, reply to enquiry re: Lot 25, Plan M-66 with respect
to incompleted services;
L. J. Torpey requesting he advise the Township as to arrangements for
snow removal on roads of Plan M-71 for the winter of 1979-80;
Al Beacock regarding the offering for sale of part lots 21 and 22,
Concession 5;
Mr. K. Hansler re: mutual drain, Lot 21, Conc. 11, R.P. 1441;
Secretary, Hawkestone Police Village re: Hawkestone Hall Board and

Presented letter from Paul G. M. Hermiston, Solicitor advising that the
matter of Township of Oro vs. Torpey is scheduled to be on the trial
list at the Supreme Court Sittings commencing November 24th, 1980.
Also copy of letter from Mr. Hermiston to D. J. Sugg, Solicitor for
L. J. Torpey advising that the case will be proceeding to trial on
November 24, 1980 and suggesting that Mr. Torpey arrange for the
1980-81 winter snow plowing.
On motion of Sanderson and Smith letter and copy of letter as presented
be received and Clerk to make available any documents and information
required by the Township Solicitor.
Presented letter from F. E. Burns, Solicitor for Township Insurers
advising of Examination for Discovery in the matter of Township of
Oro ats Krausewitz et al - Accident, February 7, 1979 Line 9 and
15/16 Sideroad, requesting representative from the Township of Oro,
who is familar with the matter to attend on December 4, 1980 at
10:00 a.m. Clerk advised that he had contacted Ross Currie, who was
the Road Supt. at that time in this regard and that he had indicated
he would attend along with the Clerk.
On motion of McLean and Sanderson Clerk and Ross Currie to attend
at the Solicitors office as requested on December 4, 1980 prior to the
attendance at the Hearing of Discovery to be held at 10:00 a.m. on
December 4th, 1980.

Presented letter from L. E. Clark, P.Eng., County Engineer, County of
Simcoe forwarding copy of letter to A. Wittenberg, P. Eng., District
Engineer, Owen Sound, Ministry of Transportation and Communications with
respect to assumption and transfers of lands - Highway No. 11 from
0.4 miles south of Guthrie, northerly to Forest Home, advising of
corrections to transfers shown in letter from the Ministry dated
September 29, 1980 which had been forwarded to the County of Simcoe and
Townshi p of Oro advi sing of proPQ;ed transfers and assumpti on. The
Township of Oro having forwarded a similar letter to the Ministry advising
of corrections.
On motion of Smith and McLean, letters be received and filed until further
correspondence and comments from the Ministry of Transportation and
Communications are received regarding the corrections of assumptions
and transfers.

Presented letter from District Municipal Engineer, Ministry of Transportation
and Communications, in reply to Township letter of October 17, 1980
regarding Township's participation into an Employee Benefit Plan,
advising that the District Office of the Ministry is prepared to authorize
subsidy the benefits to those provided to employees of the Ministry,
subject to comments from Head Office. And that the Ministry will not
be able to~ubsidi~the payments to any road employee for the present
accrued sick leave credits prior to an employee IS termination of employment
in accordance with Section 352, Subsection 65 of The Municipal Act.
The Township will be further advised should Head Office have any
further comments.
On motion of Sanderson and Swainson letter be received and filed for
necessary reference with respect to Employee Benefit Plan for road employees.

Presented letter from B. L. Browning, CPL. for Detachment Commander,
Ontario Provincial Police, Orillia with regard to Preventive Patrols -
Halloween, October 31, 1980. Letter again requests the assistance of
Volunteer Firemen in making walking patrols in the Village of Hawkestone
on the evening of October 31, 1980. Clerk advised that he had contacted
the Fire Chief, Ronald Young who was to contact the Ontario Provincial
Police in this regard.
On motion of Sanderson and McLean letter as presented along with Clerk's
action in referring the matter to the Township Chief of the Fire Department
accepted as satisfactory and copy of this letter be given to Fire Chief
for hi s fi 1 es.
Presented letter from Frank Stevens, West Oro Baptist Church advising
that he had not received a reply from the Black Society about the graves
on the Barrie Road. Accordingly no assurance that no relative
of the Thompson family has been located. The reburial cannot be carried
out until written permission is received from family, if any relative
exists or some other legal body or the Township.
On motion of McLean and Smith letter be received and placed on file for
reference should further action be taken on this matter.

Presented letter from Clerk of Session, West Oro Baptist Church with respect
to scheduling of activities at the Oro Township Arena on Sunday, requesting
the activities involving Sunday School ages 5 - 18 years not be scheduled
until after 1:00 p.m. .
On motion of Swainson and Sanderson letter be received and copy forwarded
to Oro Township Arena Committee.

neighbourhood Improvement Component - 1981 Allocations. The letter
is being forwarded on a two~fold purpose and requests the Municipality

since the Township of Oro have not participated in this program to date.

On motion of McLean and Swainson letter and certificate be placed on
file for reference with a copy to the Chief Building Official as a
requirement prior to issuance of a Building Permit for an Agricultural
Live Stock Building.
Presented letter from Regional Municipality of Peel with respect to Control
of Off-Road Motorized Vehicles and resolution approved by the Regional
Council on September 25, 1980, requesting same to be presented to Council
for endorsement and advising the Premier of Ontario of Council's decision.
On motion of Swainson and Sanderson, letter be received and filed with
no action taken.
Presented notice of application by Horseshoe Valley Limited to register
under Land Titles Act, certain lands in the Township of Oro, composed
of parts of Lots 1 and 2 in Concession 3 and part of Lots 1 and 2
Concession 4 and part of the Road Allowance between Concessions 3 and 4
as stopped up and closed by By-law 814 and registered in the Land Registry
Office as Instrument No. 164818. Notice being served upon the Township
because of the jurisdiction and control of the lands adjacent to the
North, South and West of the lands under application.

On motion of Sanderson and McLean, report of Chief Building Official as
presented be accepted as satisfactory and be placed on file for reference.
Presented a quotation from Real Time Datapro Ltd. for tax billing purposes,
which had been reviewed by the Administrative Staff. It is recommended
that for 1981 tax bill ing be 1 eft with IBM unti 1 the matter can be
more fully reviewed with the Township Auditors.
On motion of Smith and Sanderson, quotation and report as presented accepted
and Administrative Staff to review with the Auditors any changes that would
assist in improving tax billing and accounting procedures and recommendation
be presented to 1981 Council for consideration.
Matter of some Committee Reports were next considered by Council.
On motion of Swainson and Smith that a letter be forwarded to the Council
of the City of Barrie advising that it has been brought to the attention
of Council that the City of Barrie had been carrying out survey work within
the Township of Oro. Council would request that in future if such work
is proposed to be carried out that the Township could receive the courtesy
of being advised before any exercise of this nature is to take place.
The Planning Administrator was present at 1:30 p.m. to review planning
and development matters. Ron Watkin of Ainley & Associates, the Township's

Presented as earlier instructed, a draft by-law to establish site plan
control on part of the West ~ of Lot 1, Concession 4, on lands owned
by Horseshoe Valley Ltd. under Section 35a of The Planning Act, and
a draft by-law under Section 35 of The Planning Act to rezone that
part of Horseshoe Valley's lands subjected to site plan control from
"RR - Resort Residential", "A-Agriculture" and "OS1 - Recreation & Open
Space II to "C3 - Resort Commercial II pursuant to Council's resolution of
September 23, 1980.
On motion of McLean and Smith, that draft by-laws as presented be found
satisfactory and returned later in the day for consideration under the
by-laws segment of the agenda.

Presented recommendation from Oro Planning Board in respect to a proposed rezoning
of part of the East ~ of Lot 20, Concession 11, to permit developme.nt of a
proposed Tourist Campground.
On motion of Sanderson and Swainson that Council approve in principle of
the rezoning of part of the east ~ of Lot 20, Concession 11 from
"A - Agriculture" to "T2 - Tourist Campground", subject to receipt
of specific detailed servicing approval from the Ministry of Environment
and/or Simcoe County District Health Unit. Proposed development to take
place in accordance with By-law No. 1013. Planning Administrator to prepare
the necessary draft-site plan control and rezoning by-law amendment
on receipt of a deposit in the amount of $2,000.00, either by cash or
letter of credit, against all costs of rezoning, including any Ontario
Municipal Board Hearing. Extent of IT2" zoning to be as recommended by
Planning Board.

Presented all correspondence received in response to circulation of By-law
No. 1213/80 (Waterfront Zoning). Mr. Watkin advised on the specifics of
each objection received, and recommended to Council that a response be
made to each objector prior to forwarding of the Affadavits to the O.M.B.
Responses to the objectors, and a position to be taken on each objection
would be recommended at the next regular meeting.
On motion of McLean and Smith the objections as presented and reviewed
with Planning Consultant be received and Planning Consultant and Planning
Administrator have replies and or comments to the objections completed
with copies to be made available to Council before the next regular meeting.

Clerk advised that as instructed at a meeting of Oro Council held on
October 6, 1980 tenders were called for additional snow removal
equipment for 1980-81 season with notices of tender call appearing in
both the Barrie Exami ner and Ori 11 i a Packet and in response one tender
was received by noon October 31, 1980 as follows:

On motion of McLean and Smith that the tender of Morris Shelswell
for a F.W.D. Diesel Truck, four wheel drive, with hydraulically equipped
V snow plow/one way and wing.for the 1980-81 season at the rate of
$32.00 per hour while operating, including operator, helper, fuel and
repairs and equipped withtwo.,..way radio and $16.00 per day stand by time
for seven (7) days each week, beginning December 15, 1980 and ending
March 15, 1981 be accepted, subject to the approval of the Ministry
of Transportation and Communications.
Presented from Gordon Roehner submission for snow removal on roads of
Sugar Bush, Plans M-8 and M-9, and M-30 and 31, for the 1980-81 season,
with one F.W.D. Truck and V snow plow or one way plow and wing including
fuel, helper and running lights at a flat rate of $32.00 per hour while
operating and $18.00 per hour while operating sander.
On motion of Sanderson and McLean that the bid from Gordon Roehner to
snow plow roads on Plan M-8 and M-9 (Sugar Bush) at a flat rate of $32.00
per hour, while snow plowing, with one F.W.D. truck and V plow/one way
plow and wing, including fuel, helper and running lights, and $18.00
per hour whil e operating sander, be accepted for the 1980-81 season, subject
to the approval of the Ministry of Transportation and Communications.
Presented quotation from Jim Kenny for snow removal on Plan 1069 and
Barrie Terrace, as well as Plan 1561, for the 1980-81 season with one
White 2-105, four wheel drive tractor (120 H.P.) with Hagedoorn 9 foot
double auger snow blower at a flat rate of $18.00 per hour.
On motion of McLean and Smith that the quotation from Jim Kenny
for snow removal on the roads of Plan 1069, Barrie Terrace - Plan 663 and
Colborne Street and Plan 1561 for the 1980-81 season with one White
2-105 tractor (four wheel drive - 120 H.P.) with Hagedoorn double auger
and 9 foot blower at a flat rate of $18.00 per hour, be accepted, subject
to the approval of the Ministry of Transportation and Communications.
Road Supt. Fred Haughton was present during the opening of the tenders and
following same presented his report for work done during the month of
October and Vouchers 10 and lOA to cover same.

On motion of Sanderson and Swainson report of Road Supt. accepted as
presented and Treasurer authorized to issue cheques in payment of same
to a total of $94,658.24.

On motion of McLean and Smith that the Road Supt. be authorized to have
survey work completed on 15/16 Side Road from 3rd Line to 7th Line.
On motion of Sanderson and Smith that Brian Benham, road employee be
re-scheduled from Labourer to Part Time Truck Drive~with hourly pay
from $5.70 per hour to $6.00 per hour effective November 1, 1980.
A By-law to implement Site Plan Control on lands owned by Horseshoe
Valley Limited, being part of the West Half of Lot 1, Concession 4,
as shown on the By-law schedule was on motion of McLean and Sanderson
introduced and numered as By-law No. 1218/80 and read a first time.
On motion of Smith and Swainson, By-law No. 1218/80 read a first time
be read a second time.
On motion of Swainson and Sanderson, By-law No. 1218/80 read a second
time, be read a third time.

On motion of McLean and Smith, By-law No. 1218/80 now read a third time,
do pass, be engrossed by the Clerk, signed and sealed by the Reeve.
A By-law to further amend By-law No. 1031 as amended, to rezone lands owned
by Horseshoe Valley Limited, being part of the West Half of Lot 1,
Concession 4, as shown on the By..law Schedules, from "RR", "A" and 10Sl"
to IC3" and to permit by exception a maximum building height of 20 metres,
to permit building expansion at the main lodge facilities, was on motion
of McLean and Smith introduced and numbered as By-law No. 1219/80
and read a first time.
On motion of Sanderson and Smith By-law No. 1219/80 read a first time
be read a second time and tabled and be re-presented for third reading
once the Developer's Agreement has been satisfactorily executed or
approved for execution.
Mrs. Lorraine Lucas and Mrs. Pat Honeywood were present with respect to
swimming classes each summer held at Oro Memorial Park for the
past 28 years. Mrs. Lorraine Lucas reviewed the programme and advised
that after 28 years she would like to be relieved of the responsibility
of the administration of same. She further advised that Mrs. Pat Honeywood
has consented to carry out this work which is a volunteer,basis.
Mrs. Lorraine Lucas presented a report in this regard for the Township
files. Mrs. Lucas further advised that the volunteer work would be
more difficult and this programme will eventually have to be carried out
on County basis.

On motion of Sanderson and Smith the report as presented be received and
placed on file for reference.
Councillor Sanderson presented samples of Township emblems for which
he had obtained quotations. The flower used being the marigold. Price
quotations being 19<t each for 5,000, 21<t each for 3,000 and 31<t each
for 1,000.
On motion of Sanderson and McLean that the Township order 3,000 emblems
according to sample presented.

On motion of Sanderson and McLean that Council wish to go on record in
thanking the Reeve and Mrs. Campbell for the lunch prepared for Council and
Staff today which was greatly enjoyed by all.
On motion of Smith and Sanderson that a letter be written to Mobile
Tank Industries Ltd. to request that the Tank Truck and accessories
be completed without any further delay in order that the truck be
available for service before December 1st, 1980.
On motion of Swainson and Smith that the Township of Oro loan the
Shanty Bay Community and School Centre Committee an amount of up
to $15,000.00 to pay the Simcoe County Board of Education a portion of
the balance of the $50,733.51 and further that the Township loan the
money interest free until December 31, 1980.
On motion of Sanderson and Swainson that the Council of the Township of
Oro authorize recognition to Volunteer Firemen in the following manner:

5 - 10 years - letter or certificate of appreciation from
Oro Township Council and/or Fire Department
10 - 20 years - letter of appreciation and wall plaque showing
name and years of service on the Fire Department.
20 years & over - letter of appreciation and watch with
inscription of name and years of service for
a value of up to $125.00 plus inscription.
And that the costs of the above recognitions to be taken from the
Fire Department Budget.
On motion of McLean and Sanderson that the resale price for the Story of
Oro be increased from $3.00 to $5.00 and the wholesale price for 10
or more to be $4.00 each, effective immediately.
Presented a letter from R. B. Matthews, owner of Shanty Bay Woodlands
Limited expressing concern of what the letter terms as the Province's
assessment scheme, which appear to be in reference to the application of
assessment return under Section 86 of The Assessment Act.
On motion of Swainson and Sanderson that Clerk to reply and relate
Counci l' s positi on since the return of the roll for 1981 assessment
has been requested under Section 86.
PresenteQ a draft By-law to establish employment benefits and income
protection plan was presented for Council's consideration.
On motion of Sanderson and Smith the draft By-law as presented be
further reviewed and presented to the next regular meeting for passing
of same .

Presented a letter from Fran Nesbitt and Joe Kitchen expressing appreci ati on
of the improvement to the fill line from the CNR Tracks to the Ridge Road.
On motion of Smith and Sanderson letter be received and Clerk to reply
and acknowledge the letter of appreciation.
