TWENTY-SECOND MEETING
Council met pursuant to adjournment at 9:30 a.m. for their twenty-second
regular meeting, with all members present except Deputy Reeve McLean
who is attending ACRO Conference as Warden of Simcoe County.
Reeve Howard A. Campbell in the chair.
The minutes of the last regular meeting of September 22nd and special
meeting of September 23rd, were on motion of Smith and Sanderson confirmed
as printed and received.
Presented copies of letters forwarded as instructed at the last regular and
special meetings to:
D. S. White, Solicitor re: Development Agreement, Big Cedar Parks Ltd.
requesting same be registered on title and duplicate original be returned
for Township files;
D. S. White, Solicitor re: Notice of Sale under Mortgage, lands known
as Plan M-66 and reply from Solicitor;
Indian Park Association re: stop sign at intersection of Huron Woods Drive
and Algonquin Trail;
Simcoe County Board of Education forwarding copy of letter from Peter and
Joanna McEwen, which had been endorsed by Council requesting that
Professional Activity days be scheduled for dates that would not interfere
with local Fall Fairs as it had for Oro Fair for the past few years;
Skelton, Brumwell & Associates Ltd. re: Melville Hastings Subdivision
advising that Oro Council are prepared to support an extension of draft
approval for a period of one year to November 18, 1981 and should consideration
for further extension be requested a new Subdividers Agreement would have
to be entered into to meet the present standard agreement with respect
to lot levies and drainage requirements;
Norman Cryderman, Lot 6, Plan 1501 advising that the present existing
drainage ditch not be filled in;
County of Simcoe Recreation Committee forwarding registration form to
register Councillor Gail Swainson for Recreation Resources Seminar;

Presented copy of letter and application for a permit to open, establish or
operate wayside pit on Lot 22, Concession 6 to Ministry of Natural Resources
along with Landowner Agreement with owner of Lot 22, Concession 6. And
letter from Ministry of Natural Resources returning Permit to open, establish
or operate a wayside pit for purpose of fill for Line 5 between CNR tracks
and approach onto County Road 20.
On motion of Smith and Sanderson copy of letter and application for wayside
pit and Permit #148 for same on Lot 22, Concession 6, the permit being effective
to September 25, 1981.
Presented copy of a pp 1 i cati on for entrance permit to be used as access or
entrance onto Line 7 from property owned by Mathew Dooley, owner of
Caribou Motel. The access being by Public Agreement between owner and
Township of Oro as entrance to Line 7. Culvert and road improvement to be carried
out by the Township of Oro. Also presented copy of entrance permit as
issued to Mathew Dooley as owner of the property.
On motion of Swainson and Sanderson copy of letter for entrance permit and
copy of entrance permit received be placed on file along with Agreement
between Township of Oro and owner.
Presented letter from Project Analyst, Capital Support Unit, Ministry of
Culture and Recreation, requesting that appropriate form be completed
for application for payment of capital grant under the Community Recreation
Centres Act for Guthrie Community Hall. Clerk reported that Reeve Campbell
had taken copy of the letter to Community Hall Committee with request
to supply necessary information on completion of the project in order that
application for grant under CRCA may be completed and forwarded.
On motion of Smith and Swainson that matter be tabled until the necessary
information is received after which necessary documentation be prepared
for forwarding to the Ministry of Culture and Recreation.
Presented letter from Ministry of the Environment Technical Support Section,
being a Salt Contamination Report on the well at the Township Machine Shed
and study of private wells around the Township of Machine Shed. The study
was requested to establish salt content of well at Machine Shed and
surrounding wells. Report indicates that the stock pile of sand and salt
would appear to have caused the salt content. Letter suggests that the sand
pile be removed and stored in a protective dome as soon as possible. Report
attached explains in detail the findings.
On motion of Sanderson and Smith letter and report be received and filed
for reference and a reply be forwarded advising that in Council IS opinion
the salt content in the Neil Briggs dug well may not necessarily be attributed,
totally, to the salt/sand stock pile.
Presented letter from Director Subsidies Branch copy of calculation of
the Township Determination of Balance of Payment for 1980 under the Ontario
Unconditional Grants Act, 1975. Calculations show total amount payable
for 1980 as $83,080.00

On motion of Smith and Sanderson calculations of unconditional grant and
Clerk's report accepted as satisfactory.
Presented letter to Ministry of Culture and Recreation forwarding
application for further grant under Wintario and Capital Grant under
Community Recreation Centres Act 1974 Shanty Bay Community and School Centre.
Total grant approved being - Wintario $39,090.25 received $11,401.55

Also supports to cover application including invoices, certificates, reports

On motion of Smith and Swainson copies of application as presented and
forwarded be accepted as satisfactory and be filed until further correspondence
or payment of the grant is received from the Ministry.
Presented letter from Ministry of Transportation and Communications forwarding
approval of contract by Robert E. Young for pit run gravel - 15/16 Side Road
- Total contract $37,405.20 being 26,718 cu. yds. at $1.40.
On motion of Sanderson and Swainsonletter of approval for pit run gravel
contract be received and placed on file for reference.
Presented copy of letter from City of Barrie to Gordon Grant, President,
Shanty Bay Ratepayers Association in reply to Mr. Grant's letter to
the Township of Oro with respect to sewage spill that occurred in
Kempenfelt Bay this summer. Letter advises that immediate action had been
taken to guard against future similar power disruptions to the standby
electrical generator at the Barrie Pollution Control Centre. Also
that in accordance with tests conducted by the Simcoe County District
Health Unit and Ministry of the Environment, immediately after the spill,
revealed that water quality along the shoreline of the Township of Oro
was not affected.
On motion of Smith and Sanderson copy of letter be received and placed
on file since reply had been forwarded directly to Shanty Bay Ratepayers
Association.

Presented a letter from South Simcoe and Barrie Housing Authority with
respect to Senior Citizen rent geared-to-income housing in response to
Township letter to the Ministry advising that the City of Barrie did not
appear to be in favour of having residents from outside of the City qualifying
and entering into an Agreement with the Township of Oro.

On motion of Sanderson and Swainson letter be received and filed
for reference when further consideration arises in this regard.
Presented letters of approval from the Ministry of Transportation and
Communications for drilling well at Township Machine Shed - contract awarded
to Knelsen Water Wells - $2,300.00 and also supply of Michelin radial
tires (12 truck tires and 6 grader tires) - awarded to Green and Ross
Tire Co. Ltd. for total price of $9,341.10.

On motion of Smith and Sanderson letters of approval be received and
placed on file for reference.
Mr. Norman McKinney and Mr. John Mealing were present at 11:00 a.m. to
present a complete benefit program proposal which may be provided to the
Township under the County Umbrella Plan. The entire proposal as presented
with copies to each member of Council was considered and reviewed item by item.
Reeve Campbell thanked Mr. McKinney and Mr. Mealing for their presentation
and advised that the proposal along with other proposals would be considered
and that Council may call upon them again for a presentation to the employees.
On motion of Swainson and Smith that the benefit program presented be
further considered by Council along with other proposals and that
representation if necessary be requested to make a presentation to
employees should this be required.
Also presented copy of a proposal for a benefit plan from Mutual Life,
which was left over for further review and consideration.
Chief Building Official Jim Shellswell was present at 11:45 a.m. to
present his report for the month of September.

September 9, 1980 a tender advertisement for winter sand, to supply,
screen, haul and stockpile approximately 3800 cu. yds. of sand and remix
up to 1000 cu. yds. of sand in present stockpile. Tenders had appeared

The following action was taken by Council:
On motion of Swainson and Sanderson that the tender of Oro Sand and Stone Ltd.
P.O. Box 99, Orillia, Ontario to supply, screen, haul and stockpile
approximately 5700 tons (approx. 3800 cubic yards) of sand for Township
Roads, for the 1980-81 season, be accepted, at a flat rate of $2.00 per ton
and that the work is to be completed by October 31, 1980, under the
supervision of the Township Road Supt., in accordance with the Township
tender form, subject to the approval of the Ministry of Transportation
and Communications. And to remix approximately 800 - 1000 cubic yards
of sand in the present stockpile at the Township Pit for a flat rate of
.25t per cubic yard.
The matter of calling tenders for additional snow plow equipment was
brought to the attention of Council by the Road Supt. and after consideration
the following action was taken:
On motion of Smith and Sanderson that tenders be called for snow removal
equipment on Township Roads for the 1980-81 season from December 15th, 1980
to March 14th, 1981. Tenders to state price per hour while operating,
including fuel and helper. Equipment to be four wheel drive, heavy duty
truck or motor power grader with minimum of 150 H.P. and to be equipped
with hydraulically operated snow plow and wing, with adequate flashing
and running lights. Tenders to close at 12 o'clock noon on October 20, 1980
and to be advertised in both the Barrie Examiner and Orillia Packet.

On motion of Sanderson and Swainson Road Supt. to contact Gordon Roehner
with respect to snow removal and sanding for the 1980..,.81 season on roads
in Sugar Bush, Plans M-8 and M..,.9 and M-30 and M-31 as in previous years;
and Jim Kenny with respect to snow removal on Pl an 1069 and Barri e Terrace
Plan 663, Colborne Street and Plan 1561 with snow blower. Also to
Horseshoe Valley to snowplow and sand roads of Plan 1587 as in previous
years and to request the foregoing to submit their quotations in writing
by 12 o'clock noon October 20, 1980.
Presented letter from the Honourable James Snow, Minister, Ministry of
Transportation and Communications, announcing that the Ministry is again
offering educational programmes on quality standards and design and
construction technology to municipal employees involved in those related
areas. Letter lists the 7 different courses and dates each are
to be conducted. Enclosed.as well course outlines and awards from previous
courses, which includes the Scott McKay Award to Road Supt. Fred Haughton
in 1978.
On motion of Sanderson and Smith letter and materials enclosed be received
and Road Supt. to select course desired and application for registration
to same be completed and forwarded.
Presented letter from Ministry of Transportation & Communications with
respect to proposed transfers and assumptions by MTC at the overpasses
along No. 11 Highway from 0.4 mi les south of Guthrie northerly to
Forest Home. Attached to letter are two sets of sketches showing proposed
transfers and assumption, areas outlined in green are to be assumed by
the Ministry from the Township and areas outlined in yellow are to be
transferred to the Township. The transfers and assumptions are necessary
as the result of the new construction on this section of Highway No. 11
which is now. complete. Contract #78-41 as shown on sheets 5, 7, 10, 14,
16, 18, 20, 24 and sheets 30 and 34 and 40. Letter also advises that
area "D" on sheet 10 and area "A" on sheet 24 could be transferred to
Simcoe County if both Councils of the Township and County were in agreement.
Letter suggests that the Township and County should meet in this regard.
The Ministry has written the County with the same proposal. The Ministry
is to be advised of a decision.
Council is requested to forward a resolution accepting the transfers
shown on the sketches after review of same.
On motion of Smith and Swainson letter and sketches of proposed transfers
and assumptions be received and tabled for review and until a meeting has
been arranged for and hel d with the> County of Simcoe with respect to sheet
numbers 10 and 24, concerning the overpasses at Lines 7 and 11. Also
corrections have been noted on sheets 7, 16 and 20 which should read
Township of Oro (area A on sheets 7 and 16 and areas A & D on sheet 20)
instead of County of Simcoe. Clerk to forward letter to County Engineer
and request a meeting regarding assumptions and transfers".
On motion of Sanderson and Smith that the Park Committee be authorized
to have the parking lot in Hawkestone Park levelled.
Road Supt. Fred Haughton, following the opening of tenders and consideration
with respect to tenders for additional snow plow equipment, presented his
report for work done during the month of September and Vouchers 9 and 9A to
cover same.

On motion of Swainson and Smith report of the Road Supt. as presented,
accepted as satisfactory and Treasurer authorized to issue cheque in
payment of same to a total of $86,288.64.
Presented letter from Ontario Good Roads Association advising of the 1981
Convention of the Ontario Good Roads Association to be held at the Royal
York Hotel from February 23rd to February 25, 1981. Letter encloses request
for accommodation on enclosed reservation forms.
On motion of Sanderson and Smith reservation form be completed and forwarded
reserving two rooms.

On motion of Sanderson and Smith that Road Supt. be authorized to order
272 tonnes of highway course salt for winter roads.
Presented notice of claim from Bell Canada for buried cable damaged on
15/16 Side Road, Concession 2 (August 21, 1980), Claim No. C311-3315C
and buried cable damanged on September 2, 1980 ~ 15/16 Sideroadin Concession 3.
On motion of Swainson and Smith that the notice of claim from Bell Canada
as presented be received and Road Supt. to further pursue the matter
with Bell Canada and report back to Council.
The Planning Administrator was present at 1:05 p.m. to review planning
and development matters. The following was presented:
Committee of Adjustment, Notices of Hearing, Submissions B21/80 - Boehm,
A8/80 - Gabura, A9/80 - Pallister, B22/80 - Harrington, B23/80 - McKay,
and B24/80 - McLean;
Ainley & Associates Ltd. forwarding Council's resolution of September 23rd, 1980
in regard to works to be undertaken on behalf of Horseshoe Valley,
rezoning Submission Pl/80.
On motion of Sanderson and Smith that correspondence as presented be
placed on file.
Presented letter from Oatley, Purser, solicitors for Windfields Estates
Subdivision (43T-78030) outlining a proposal for private non-profit
corporation ownership and manage.ment of the private open space,
Blocks 47 and 48 on the plan.
On motion of Sanderson and Smith this matter be tabled for further
review.
Presented circulation notice of City of Barrie By-law No. 80-123 being
a by-law to amend By-law No. 69-33 in respect of parking requirements
in the City's Zoning By-law as they affect nursing, senior citizens and
rest homes.
On motion of Sanderson and Smith, that notice of application for approval
of City of Barrie By-law No. 80-123 be received and placed on file.

for consideration, and advised of initial recommendation to have 500 copies

On motion of Sanderson and Swainson that the form of "Application for
Conversion Certificate and Rezoning" be found satisfactory, and Planning
. Administrator to arrange for printing of same.
Presented notice of Planning Staff Workshop sponsored by the Ministry
of Housing to be held at Eaton Hall, Seneca College, on Thursday, November
20th, 1980.
On motion of Smith and Swainson that the Planning Administrator be authorized
to attend and that his registration and expenses be paid.
. Presented letter from Secretary Shanty Bay Ratepayers Association, requesting
Council to advise as to future plans for resurfacing of Bay Street, since
this road has become quite rutted and in poor condition due to heavy rain.
Letter also extends invitation to members of Council to the Association
Annual General Meeting which is to be held on October 10, 1980 at 8:00 p.m. at the
Shanty Bay Community School Centre. Letter further would like the members
of Council who will be standing for re-election to be prepared to answer
questions on current issues affecting our area. And would like to be
advised of new candidates so that the same invitation be extended to them.

On motion of Sanderson and Swainson Clerk to advise that the matter of improving
or resurfacing of Bay Street will be referred to Council for 1981. Members
of Oro Council will attend the Annual General Meeting of the Association.
Presented a letter from the Hon. Thomas Wells, Minister, Ministry of Housing
with respect to the 1981 Ontario Municipal Training Program which was
introduced in 1980. The purpose of the program being to assist local
governments in attracting and developing qualified candidates for management
positions and to provide practical experience to graduates in course of
study directly related to municipal finance and administration. Also enclosing
a set of quidelines describi~the 1981 program in detail is enclosed for your
information. Proposals are to be submitted by November 30, 1980. Successful
municipalities will be selected by December 31, 1980.

Presented a letter from District Engineer, Ministry of Transportation and
Communications with respect to enforcement of municipal bridge by-laws
under Section 77 of the Highway Traffic Act.
On motion of Smith and Sanderson letter be received and placed on file.
Presented letter from John Wesolowski with respect to log jam and beaver
dam removal in Willow Creek. Letter requests that Council approve a general
clean up of Willow Creek at the junction of Highway No. 11 south to
93 Highway. Also letter serves as a committment that he is prepared to pay
36% of the cost with the understanding that the Ministry of Natural Resources
grant the remaining 64%. Mr. Wesolowski advises that he has contacted
N.V.C.A. in this regard.
On motion of Swainson and Sanderson that Oro Council is prepared to authorize
the cleaning out of Willow Creek with respect to log jams and beaver dams in
Willow Creek at Willow Park Motel, part Lot 8, Conc. 1, Township of Oro

under the supervision of Nottawasaga Valley Conservation Authority provided
that John Wesolowski, owner of Willow Park Motel, part Lot 8,
Conc. 1 assumes the 36% of the cost of the work and the Ministry of
Natural Resources approve a grant for the balance of 64%. And further,
that John Wesolowski according to his letter of committment to pay the
.36%, dated September 26, 1980, is prepared to pay his costs within
30 days of billing for same.
Presented letter from Peter H. Howden, Solicitor for York Sand and
Gravel Limited, advising that material has been removed from the agricultural
lands, except for materials which will be used on those lands.
And that he had requested that he relay this information to the Township
so that the Township is aware that York Sand and Gravel has honoured
its undertaking.
On motion of Smith and Sanderson letter be received and Zoning Administrator
and Chief Building Official attend at the stte with Mr. Spencer Vernon
to ascertain whether all requirements according to the Agreement have
been met. After which a reply is to be forwarded to solicitor for
York Sand and Gravel.
Presented letter from Ministry of Intergovernmental Affairs with respect
to Municipal Tax Assistance Act payment of assessment made under
The Drainage Act, 1975 and memorandum of information required for an
application.
On motion of Swainson and Smith letter and information guide lines be
received and placed on file for necessary reference.
Presented letter from D. Kevin Carroll, solicitor for Dr. Basil Chadwick
part lot 24 and 25, Plan 755, Concession 7 Township of Oro, requested
on behalf of his client that the drainage on the norther side of Lakeshore
be altered or improved to decrease the additional water flowing over his property.
Solicitor would be pleased to discuss the matter with the Township
Engineer or other representatives of the Township.
On motion of Smith and Sanderson that an on site meeting be arranged with
the Solicitor for Dr. Basil S. Chadwick with Road Committee and Road Supt.
Presented notice of dog tags for 1981 samples and price list. The
special tag for 1981 being shape no. F-128.
On motion of Sanderson and Smith, Clerk authorized to order sufficient
dog tags for 1981, shape no. F-128.
Presented letter from Robert Holmes, Caretaker of Oro Memorial Park for
1980, being a letter to advise that he is prepared to carry out the same
duties for 1981 under the same contract agreement.
On motion of Smith and Sanderson that Mr. R. Holmes be advised that in
accordance with his agreement he is to remain in the accommodation at the
Park for the winter and be responsible for the hydro costs and that the matter
of caretaker for the 1981 season will be reviewed by the 1981 Council.

Presented copy of letter from Skelton, Brumwell & Associates Ltd. to
Ministry of Housing requesting the Ministry to grant a further one year
extension to November 18, 1981 for the Guthrie Plains Subdivision as
draft for Melwill Hastings (part Lot 20, Conc. 5). Oro Council having
supported such an extension at a meeting of Oro Council held on
September 22, 1980.
On motion of Smith and Swainson copy of letter as presented be received and
filed for reference.
Presented letter from William J. Leslie, Solicitor, enclosing a cheque
in the amount of $276.30 being full payment of an execution against
Mr. P. Kneeshaw in favour of the Township and further letter with respect
to Order from Mr. Justice Osborne which was registered against the property
owned by Paul Kneeshaw and Barrie Restoration. Later letter requests
Council advise whether they are satisfied with the retirement of the
debt whi ch was secured by executi on., he will on Counci l' s i nstructi ons sign
a consent to vacate the said Order. Also enclosed is a letter form Solicitor
for Paul Kneeshaw requesting Mr. Leslie to endorse the consent to vacate
the order on behalf of the Township.
On motion of Swainson and Sanderson that Solicitor William J. Leslie
be advised that Oro Council would have no objection to consent to vacate
the order, since the debt has been retired and no outstanding orders
appear to exist at present.
Presented copy of letter from M. H. Moffatt, Regional Director, Small
Craft Harbours Branch, Fisheries and Oceans, Government of Canada to
Gordon E. Smith, M.P.P. in reply to his letter forwarded to Ministry

On motion of Sanderson and Smith that copy of letter to Gordon E. Smith
with respect to docks at Carthew Bay be received and placed on file for
reference should the Federal Department again contact the Municipality
with regard to leasing of the docks.
On motion of Smith and Swainson that Clerk to contact the Township Solicitor
Paul Hermiston, Q.C. with respect to the Torpey matter as to when the
action may be scheduled before the Court.

Councillor Swainson brought to the attention of Council the request
by the Boy Scout Leader to Trustees Hawkestone Police Village to use the
Hawkestone Park for training sessions. Councillor Swainson advised that
the Trustees look favourably upon the porgram provided Oro Council
would have no objection.
On motion of Swainson and Sanderson that a letter be forwarded to Hawkestone
Police Village Trustees advising that Oro Council would have no objection
to the Boy Scouts using the Hawkestone Park for scout training sessions.
Presented letter from President, Central Oro Ratepayers Association (CORA)
forwarding cheque in the amount of $25.00 which is to be used to purchase
one childrens play horse in Oro Memorial Park.
On motion of Swainson and Sanderson that letter from (CORA) Central
Oro Ratepayers Association forwarding $25.00 cheque to be used for
a children's play horse at Oro Memorial Park be received and that this

SPECIAL MEETING
Council met this evening at 7 p.m. for a Special Meeting at the call of
the Reeve, to meet with the members of the Arena Committee and to consider
a proposal Benefit Plan for employees as well as other matters requiring
Council's consideration before the next regular meeting.
All members present.
Reeve Howard A. Campbell in the chair.
The Reeve called the meeting to order at 7 p.m. to consider certain
matters with the Oro Township Arena Committee.
Present from the Oro Township Arena Committee was A. Bolechowsky -
Chairman of Arena Committee.

Mr. A. Bolechowsky brought Council up to date on the financial position
of the Arena Board, Advising that the Arena Board at present had an
outstanding account of $27,306.05 of which they could cover $10,000.00.
In addition another outstanding account of$700.00 for paint and scaffold
rental. As a result the Arena Committee is looking for financial assist-
ance from the township for an amount of $18,000.00.
On motion of McLean & Smith that Oro Council are prepared to loan the
Oro Township Arena Committee an amount of up to $18,000.00 to assist
in paying the outstanding accounts of the Arena Committee. The loan is
approved on the basis of repayment as soon as possible with a maximum limit
of two years without interest. The funds for the financial assistance is
to be issued from the Parkland's Account to an amount of $12,000.00 and
$6,000.00 from the Lot Levy Account.
Following the meeting with the Township Arena Board, Council considered
the matter of A Benefit Plan for employees, and discussed the proposal
previously presented at a meeting of Council by Norman McKinney, with
respect to basis of apportionment cost to the Township and Employee.
At 8:15 p.m. employees were present to hear the proposal presented by
John Mealing and Norman McKinney.
