Campbell in the chair. The minutes of the last regular meeting of July 7, 1980 and Special meeting of July 17th, 1980 were on motion of Sanderson and McLean, confirmed as printed and received. Presented copy of letter forwarded to the Mayor City of Barrie, following the Special Meeting of Oro Council, in response to request of Council's opinion regarding Dehavil1and Aircraft Company locating in the Barrie area. White Solicitor from C.M. Loopstra Solicitor for Big Cedar Parks Ltd. with respect to Unopened Road Allowance between lots 5 and 6, Con. 13, being a letter further to his correspondence in this regard of November 11,1977. Also enclosing copy of survey Plan 5l-R-959l, showing parts 1,2,3, & 4 referred to in letter. Clerk advised that D.S. White is to further advise the Township according to telephone conversation with G. Roberts. On motion of Smith and McLean copy of letter be received and placed on file. Presented from the Ministry of Environment, copy of certificate of approval (water) to construct a water system, the development by Quandrant Developments Ltd. Plan M-157, as outlined in the approval to a total estimated cost of $83,000.00. Consisting of two wells, chlorination system, three I.G. water pressure tanks, with all piping, valves, electrical controls, heating and mechanical ventilation. The above equipment to be housed in a 141-0 wide by 181-0 long and 111-0 high, masonary superstructure located 3401 east of the intersection of the Ridge Road and Cedarbrook Crescent and approximately 1401 south of Ride Road, together with watermains to be constructed on Cedarbrook Crescent and easement to pumphouse in accordance with plans and specifications prepared by Planmac Consulting Engineers. Clerk advised that copies had been presented to Road Superintendent and Ronald Young. On motion of McLean and Sanderson certificate of approval be received and placed on file for reference as required. Presented letter from Ministry of Transportation and Communications, District Signs of Bldg. Inspector, Owen Sound, in reply to Township letter of June 19, 1980 with respect to illumination at junction of No. 12 highway and Simcoe Road No. 22 (Prices Corners). Letter advises that the Township letter has been referred to the Regional Traffic Section for their consideration. On motion of Smith and Sanderson letter be received and placed on file until further advi sed by M.1. C. Clerk reported that Mr. D.S. White had advised that he is preparing a necessary By-Law for closing of original road allowance between lots 15 and 16, Concession 8, which had been conveyed to William Peacock in lieu of lands for Road Widening of 15/16 sideroad at this point. Mr. D.S. White had been contacted further to letter forwared June 19, 1980. . On motion of McLean and Smith report of Clerk in this regard accepted as satisfactory. Presented copy of letter to Paul G.M. Hermiston, Solicitor re: L.J. Torpey litigation forwarding copy of report of on site inspection by Stuart N. Keyes and plan defining the locations of the unfinished items of the Subdividers Agreement. Also advising that no work has been undertaken by L.J. Torpey as he had advised Mr. Keyes. And letter from Paul G.N. Hermiston in reply advising that the Township do the necessary repair work and therafter he will put the matter in for trial and that the Townships damages would be the cost of doing the repair work. . On motion of Smith and Saoderson that Oro Council are of the opinion that the Township should not exp!end any money on this Subdivision (Plan M-71) until the matter has been dealt with by the courts. White, Solicitor, forwarding copies of the executed offers and relevant surveys in respect to Township proposed purchase of land for road purposes from Marshall, Mcquaig and News~n on 15/16 sideroad and E. Hazlett, intersection of Ridge Road and Line 13. Letter is a request for the solicitor to carry out the necessary title searches and prepare deeds for the proposed transactions which are to close before August 1, 1980. On motion of McLean and Sanderson, letter and action taken accepted as sat- iSfactory and letter be filed for reference to complete the documentation. Treasurer presented a half-yearly statement of money at the credit of the Corporation in accordance with Section 222 of The Municipal Act. On motion of Smith and Sanderson the half-yearly statement as presented accepted and be filed for reference. Presented letter from the Ministry of Environment in reply to the Township of Oro endorsing the resolution of the Village of Markdale with respect to treatment and disposal of liquid industrial waste. And_ copy of the ~inisters letter to the Village of Markdale. On Motion of McLean and Sanderson letters as presented be received and filed for reference. . Presented letter from T. Malak, Solicitor, requesting fence viewing on behalf of his client Dr. J. Ellis, Between his lands, Part 1 Plan 51R-4117 and lands owned by Sheila Tuck, Pt. Lot 9 Plan 1291 under section 4 of the line fences act. Also copy of letter from opposite party and Clerks action forwarding notice to parties (dispute) and Clerk's notices to Fence Viewers to attend at the site of July 18, 1980 at 9:00 a.m. On motion of Sanderson and Smith letters be received and Clerk's action regarding request for Fence Viewers and subsequent forwarding of notices accepted as satisfactory and Clerk to present award of fence viewers when received. Presented letter from E. Marshall Green, Solicitor for Sheila Tuck advising that the letter is to confirm that he is asking to have the fence viewing on Friday to be adjourned since he is unable to attend at that time and requesting notice of new date. Clerk advised that a copy of the letter was presented to the fence viewers prior to proceeding to view and inspect the area. On motion of McLean and Smith letter and report of Clerk in this regard accepted and letter be filed with the file along with notices and requests. Presented affadavit of wolf bounty claim filed by J. Perryman, and letter for- warding same to the treasurer, County of Simcoe. . On Motion of Smith and McLean actions taken found satisfactory, claim and corr- espondence be placed on file. Presented letter from Ministry of Natural Resources outlining their revised policy position with respect to shoreline road allowances, crown reserves, and crown lands under water. pg. 167 SEVENTEENTH MEETING. (Cont 'd) July 21, 1980 . On motion of McLean and Sanderson policy explanation be received and placed on file. Staff to continue to refer applicants to the Ministry of Natural Resources for their approval and/or comment where shoreline reserves or crown land are involved. Presented request for grant. in the amount of $500.00 from the Foundation for Aggregate Studies, in return for which research materials would be provided on request. On motion of Smith and Sanderson that correspondence be received and placed on file. Foundation for Aggregate Studies to be advised that such a grant is not available at this time. Presented suggestion from Parks Committee that two privy vaults be placed at Oro Memorial Park by MCGILL Environmental Services. On Motion of Sanderson and Smith that two Privy Vaults be placed in Oro Memorial Park for July and August and rent for the vaults be authorized for a two month period, and letter be forwarded to McGill Environmental as confirmation. . Presented registered letter from R. Boyko, advising that a commercial enterprise carrying on business as "Sugar Bush Hot Tubs" appears to be operating from the Sugar Bush resort residential subdivision, at 97 Huron Woods Dr. On motion of Sanderson and McLean that the owner of 97 Huron Woods Drive be advised that By-Law No. 1031 as amended does not permit a commercial use to be carried on in a resort residential zone, and that should such use not immediately cease that legal actions may be commenced. Copy of letter to be forwarded to R. Boyko. Presented resolution dated June 5, 1980 from the Town of Watchford requesting endorsement operative clauses of the resolution request the Ministry of Education to review their system of funding school busing, to discourage energy wasting school bussing resulting in high costs to the Ontario tax payer. On motion of McLean and Sanderson be placed on file with no action taken. Presented letter from the Hon. Harry Parrott, Minister, Ministry of the Environmen with respect to Environmental Assessment Act Regulations for municipal under- takings and copy of his statement to the Legislature on June 3, 1980. Also O. Reg. 468/80, Regulation to amend Ontario Regulation 836/76 made under the Assessment Act, 1975. And memo as summary of the regulation as prepared by George Roberts. . On motion of Smith and Sanderson letter and O. Regulation 468/80 be received and placed on file should same be required, since in general the Township will not be undertaking projects in excess of $2,000,000.00. Chief Building Official, James Shellswell was present at 11:30 a.m. to present his report for the month of June and to discuss matters pertaining to building with Council. There were 40 building permits and 8 plumbing permits issued with a breakdown as follows: 9 residences at a value of 2 Alterations at a value of 5 agricultural at a value of 7 additions at a value of 4 pools at a value of 7 accessory buildings at a value of 3 renovations at a value of 2 demolitions 1 moving $ 385,600.00 9,000.00 62,000.00 63,600.00 15,500.00 28,960.00 9,600.00 $ 574,260.00 Money received for permits - $2,542.00 Value of permits for June 1979 - $395,348.00 On motion of Smith and Sanderson report of Chief Building Official as presented be received and placed on file. On motion of Sanderson and Smith that as a result of the report of the Chief Building Official Mr. L. Kovacs be granted an extension to complete his residence from July 15 to September 15, 1980. On motion of Smith and Sanderson that the Township of Oro order twenty-four Neptune water meters with remote reading units. . On motion of Sanderson and Smith that Mr. T.H. Jordan owner of Lots 31 & 32 Plan 979 Concession 14, as a result of cancellation of his Building Permit No. 3-80 be given a refund on his permit fee of 80% of the total cost of the permit. Dr. Basil Chadwick was present with the Road Superintendent at 1:20 p.m. to discuss the motion of water draining through his property from Lakeshore Blvd. and properties on the north side of the said road. Dr. Chadwick had written a letter outlining the problem which was read to Council before recess for lunch. Dr. Chadwick again related his problem and Road Superintendent F. Haughton advised Council of his findings when inspecting the property in question. It was left that Council and Road Superintendent Haughton meet on the site to further investigate the matter and necessary action required in this regard. Road Superintendent, Fred Haughton was present at 1:40 p.m. to consider and review matters pertaining to Roads with Council and to report on work carried out to date this month. On motion of McLean and Sanderson that Council accept the estimate 80H-243 to remove 17 and instal 6-8KV rural line poles with associated framing and conductor work. The Township share of this work to be in the amount of $1,660.00 Road Superintendent also reported on an estimate to improve the approach on Georgian Drive on the north side of the C.N.R. tracks. On motion of Sanderson and Smith that plans for improvement to the C.N.R. approach north side, on Georgian Drive and estimated costs be forwarded to the Canadian Transport Commission for approval. . . . . SEVENTEENTH MEETING (Cont'd) JULY 21, 1980 pg. 169 The matter of a By-Law for to regulate established entrances to Township Roads was presented for consideration. Clerk reported that upon complaint from M. Watson, owner of Lot 14, South Davis Street (Shanty Bay Road) regarding difficulty in deliveries at his property numbered as 191 Shanty Bay Road, because of a property between No. 185 and 189 having been numbered as 197, he had contacted the Barrie Post Office on the matter and then met with Mr. Wes Robinson, letter carrier supervisor on Monday July 14, 1980 at the area in question. It would appear that the property presently known as 197 Shanty Bay Road should have been numbered as 187. The other difficulty being that the City of Barrie also have number 187, 191 and 190 on the north side, which is creating difficulty for the letter carriers. At the on site meeting, Mr. Wes Robinson suggested that the Township of Oro re-number the 100 block to 200 and the 200 block to 300 and also that Mr. Snedden be requested to change the 9 to 8 to read presently as 187 and if renumbered to 287. Mr. Wes Robinson suggested he could meet with Council in this regard and would be present at 2:30 p.m. this afternoon to discuss the matter with council. On motion of Sanderson and McLean that Council would be prepared to renumber the 100 block to 200 and the 200 block to 300, the last two numbers of the present numbering to remain the same except for lot 1 Plan 1069, which is to be number 287 and all owners be advised accordingly. Therefore the numbering as authorized by the post office in 1962 from 185 be renumbered starting at 285 and conti.nued in that order by changing the first number from 100 to 200 and 200 to 300. The Planning Administrator was present at 3:00 p.m. to review current Planning and Development matters. The following was presented: M.O.H., returning documentation and advising that the Township of Oro were not opposed to the approval of the new Vespra O.P. Circulation copy and Notice of Application to the O.M.B. re: City of Barrie By-Law No. 80-89. On motion of McLean and Smith that correspondence as presented be placed on file. Skelton Brumwell & Assoc., Forwarding plans and copies of Subdivision Agreement re: Windfield Estates 43T - 78030, in accordance with resolution of April 21, 1980. On motion of Sanderson and Smith that the Planning Administrator to register the Windfield Subdivision Agreement on title once it has been executed. Presented draft approval and Minister's conditions re: Schaefer subdivision 43-T-7902C On motion of Smith and McLean that draft approval conditions be placed on file pendin~ further actions to be undertaken by the owners to proceed with the proposed developmer Presented 1981 Annual Housing Review Questionnaire forwarded by the Ministry of Housing. On motion of Sanderson and McLean that the Planning Administrator to return the questionnaire and indicate to the Ministry of Housing the Townships tentative agree- ments with the City of Orillia and Township of Innisfil to accommodate such needs or demands for assisted housing as may arise. pg. 1 70 SEVENTEENTH MEETING (Cont'd) July 21, 1980 . Presented letter from Ainley & Associates re: preparation of circulation copies of By-Law No. 1213/80 to be delivered by August 1st for mailing September 2, 1980. On motion of Smith and Sanderson letter be received and placed on file, actions taken found satisfactory. Clerk and Planning Administrator to arrange for circulation as required. . Presented memo from the Hon. Thomas L Wells, Minister, Ministry of Intergovern- mental Affairs - Subject: System for use of 1980 Equalization Factors to determine Municipal Apportionments and Resource Equalization Grants in 1981. New equalization factors are being published in the Ontario Gazette on Saturday July 12th, memo outlines the effects of the new factors or the initial steps towards a more permanent system and that the lower rate of taxation will continue to be applied to residential and farm than that on Commercial and Industrial. Also setting out dates of meeting on this subject the meeting for Bruce Grey Simcoe and Dufferin will be held on August 13, 1980 in Owen Sound from 2:00 p.m. to 5:00 p.m. for Simcoe & Dufferin. On motion of Smith and Sanderson memo with respect to Equalization Factors to be used in 1981, be placed on file for reference as needed. Reeve and Clerk Treasurer to attend the meeting. Presented letter from the Ministry of Transportation and Communications, concerninl the speed limit on No. 11 Highway between Barrie and Oril1ia, letter indicates that the installation of the protective barriers and interchanges has placed this portion of Highway No. 11 somewhere between the category of a four lane undivided roadway (80 km/h) and a full freeway (100 km/h) and that the separation of conflicting traffic movements has led the ministry to believe this four lane divided roadway could operate at a posted speed of 90km/h with no anticipated deterioration in the present level of safety. Letterfurtner requests that if Oro Council concurs with this recommendation, a resolution of Council endorsing the raising of the maximum speed limit to 90 km/h on No. 11 Highway, throughout the Township of Oro be forwarded. On motion of Smith-that Oro Council would concur with the raising of the maximun speed limit to 90 km/h, provided that the Township of Orillia concur with their maximum speed limit, otherwise a third change would be involved after leaving No. 400 highway. Council have some concern whether the raising of the speed limit is in keeping with energy conservation, since it has been indicated by some studies that motor vehicles consume less fuel at a speed of under 90km/h - motion lost as no seconder for the motion. . On motion of Sanderson and Smith that the speed limit through the Township of Oro on No. 11 Highway remain at 80 km/h. Presented letter from the Corporation of the City of Brampton advising that the City had recently requested the Minister of Intergovernmental Affairs for a grant to cover the additional cost of conducting an election every two years rather than three years. Also copy of the Minister's letter rejecting such a request. The Council of the City of Brampton then passed a resolution directing that a survey be undertaken to determine the views of Municipalities as to their preferen for a one, two or three year term for Municipal Council. On motion of Smith and Sanderson that Oro Council are of the opinion that a two year term would appear satisfactory. Presented letter of the Executive Director of Association of Municipalities of Ontario with respect to "Emergency Preparedness in the Eighties" and advising of Conference to be held November 16 to 19, 1980. Registration cost and reservation schedule also enclosed. Also a letter with respect to request for nomination 1980..., A.M.O. Board of Directors from the president of the Association. On motion of Sanderson and McLean letters as presented be received and filed for reference. On motion of Mclean and Sanderson, final statement of account be held until the Community Hall Management Committee turn over more funds and Clerk to prepare and forward application for final grant from the Ministry of Culture and Rec- reation when all necessary documents and certificates have been received. As instructed at a meeting of Oro Council held on July 7, 1980, that a By-Law to authorize conveyance of a portion of the original road allowance between concession 10 and 11 in lot 9, be presented for consideration once necessary registered survey was made available. Clerk advised that copies of the survey had been received along with copies of deed prepared by Solicitor for Nelson Robertson. A by-Law to authorize conveyance of portion of Road Allowance between concession 10 and '1 in lot 9 more particularly described as part 3 on Reference Plan 51R- 9476 attached to the By-Law asSchule IIA-l" and Part 1 on Reference Plan 51R-9618 attached to the By-Law as Schule IIA-211 being deemed not to be required for public use and conveyed to Nelson Robertson as authorized pursuant to Section 462 (1) of the Municipal Act., R.S.O. 1970, C. 284 as amended, was on motion of Sanderson and Mclean introduced and numbered as By-Law No. 1215/80 and read a first time. On motion of Smith and Sanderson. By-law No. 1215/80 read a first time be read a second time. On motion of McLean and Smith. By-Law No. 1215/80 read a second time be read a third time. . On motion of Sanderson and McLean, By-Law No. 1215/80 now read a third time do pass, be engrossed by the Clerk, signed and sealed by the Reeve and Reeve and Clerk be authorized to sign the deeds of convyance and further that the By-Law and deeds be forwarded to the Solicitor for Nelson Robertson for Registration with request that the duplicate copy of the By-Law, after registration be returned to the Township. ... ....... pg. 172 SEVENTEENTH MEETING (Cont'd) JULY 21,1980 . On motion of McLean and Sanderson that the Reeve look into the matter of preparing certificate for 50th wedding anniversary and every five years thereafter and 90th birthday and every five years thereafter, to be presented to Oro Residents.
