Reeve Howard A. Campbell in the chair. The minutes of the last regular meeting of May 21, 1980 and Special Meeting in the evening of May 21st, were on motion of Sanderson and Swainson, confirmed as printed and received. In accordance with the Agenda for this meeti ng, 111 appl i cati ons for Tax Adjustments under Section 636(a) of The Assessment Act, were presented for Council's consideration with the following action taken: On motion of Smith and Swainson, the following properties, as recommended by the Assessors of the Simcoe County Assessment Office (Region 16) for assessment reductions be accepted and the appropriate tax adjustments be applied: Application No.1 - Robbin Smith, Lot A, Ept, Conc. 2. The above occupant ceased to carryon business at this address on January 21, 1980. Business taxes based on the Business Public assessment are to be cancelled from January 22nd to December 31, 1980. Any new occupant will be added by supplemental assessment. The 1980 taxes to be written off in the amount of $94.85. Application No. 2 - Maria Louisa Mascioli, Lot A, Ept, Conc. 2. Since tenant #0003 Robbin Smith ceased to carryon business at this location on January 21, 1980 we recommend that taxes to the owner be cancelled on a conversion of rates from Commercial Public to Residential Public based on the occupant assessment of 1450 from January 22nd, to December 31, 1980. The 1980 taxes to be written off in the amount of $44.42. Application No.3 - Terminal Holdings (Barrie) Ltd. Lot 20, Spt, Conc. 6. Since tenant #0002 John Boyko ceased to carryon business at this location on December 31, 1979 we recommend that taxes to the owner be cancelled on a conversion of rates from Commercial Public to Residential Public, based on the occupant assessment of 1350, from January 1st to December 31, 1980. The 1980 taxes to be written off in the amount of $46.97. Application No.4 - John Boyko, Lot 20 Pt, Conc. 6. The above occupant ceased to carryon business at this address on December 31, 1979. Business taxes based on the Business Public assessment of 405, are to be cancelled from January 1st to December 31, 1980. Any new occupant will be added by Supplemental Assessment. The 1980 taxes to be written off in the amount of $93.93. Application No.5 - Norman Basnicki and Michael Prestie, Wpt Lot 11, Conc. 8. The barn on the above property was demolished a number of years ago, and is therefore entitled to a cancellation of building taxes from January 1st to December 31st, 1980. Please cancel the taxes based on the public residential assessment of 250. The 1980 taxes to be written off in the amount of $49.28. Application No.6 - Joseph & Mary Leahey, Wpt Lot 1, Conc. 12. The barn on the above property was demolished in June 1979 and is therefore entitled to a cancellation of building taxes from July 1st to December 31st, 1979. Please cancel the taxes on the separate residential assessment of 700. The 1979 taxes to be rebated in the amount of $64.50. Pg. . The old stable on the above property was demolished in May, 1979 and is therefore entitled to a cancellation of building taxes from June 1st to December 31st, 1979. Please cancel the taxes on the Public Residential assessment of 200. The 1979 taxes to be rebated in the amount of $21.48. Application No.8 - June J. Jongman, Npt Lot 21, Conc. 8. The above occupant ceased to carryon business at this address in 1979. Business taxes based on the Business Public assessment of 1325, are to be cancelled from January 1st to December 31st, 1980. The new occupant will be added by Supplemental assessment. The 1980 taxes to be written off in the amount of $307.32. Application No.9 - Warkworth Cheese Co. Ltd., Lot 7, Plan 1441, Conc. 11. The above occupant ceased to carryon business at this address on January 1, 1980. Business taxes based on the Business Public assessment of 830 are to be cancelled from January 1st to December 31st, 1980. New occupant will be added by supplemental assessment. The 1980 taxes to be written off in the amount of $192.50. Application No. 10 - Martin & Jeannette Schumann, Lot 8, Plan 728, Conc. 13. The cottage on the above property was demolished on or before January 1, 1980 and is therefore entitled to a cancellation of building taxes from January 1st to December 31st, 1980. Please cancel taxes based on the public residential assessment for 1000. 1980 taxes to be written off in the amount of $215.14. . Application No. 11 - Elizabeth Williamson, Lot 24, Spt., Conc. 7. The old stable on the above property was demol ished in May 1979 and is therefore entitled to a cancellation of building taxes based on the Public Residential Assessment of 200. The 1980 taxes to be written off in the amount of $39.43. Uncollectable taxes under Section 636(1) for Federation of Agriculture for the year 1979 in the amount of $25.38 is to be written off. . Presented copy of letter forwarded to Ministry of Transportation and Communications, Planning and Design Section, London, Ontario re: Highway Municipal Drain, Lot 21, Concession 11, advising of results of meeting of Council to hear the presentation of the Drainage Engineer's Report,as revised the fourth time, held on May 21st, 1980 and requesting the Ministry to attend a meeting of Council along with Mr. J. Treloar, D. Loftus, M. Kondracki and G & R Varriano to discuss alternate proposal by J. Treloar. Clerk reported that Mr. A. Wittenburg, M.T.C. London had telephoned that the Ministry felt that attending a meeting to discuss the verbal proposal would not accomplish very much until such time as Mr. J. Treloar and property owners of Lots 1, 2 and 3 of Plan 1441 present in writing by Mutual Agreement, in accordance with the Drainage Act such an Agreement as would be agreeable to the Ministry, Council and all property owners involved. On motion of Sanderson and Smith, copy of letter as presented and forwarded be received and matter be further dealt with when Mr. J. 'Treloar is present later today. Presented copy of letter to Penetang-Midland Coach Lines regarding application for carriage of passengers together with their baggage and express freight between Midland and Craighurst and ultimately, Midhurst - Toronto, via Highways 12, 27 and 93 and County Road 22, advising that Oro Council support the application. The portions of the roads servicing Oro Township would be for residents along 93 Highway and County Road 22. On motion of Swainson and Sanderson, copy of letter as forwarded accepted as satisfactory. Presented letter from Kenneth Hansler, owner of Lot 20, Concession 10, forwarding copy of letter he had received from the Hon. James Snow, Minister, Mini stry of Transportation and Communi cati ons in reply to hi s enqui ry regardi ng the needed overpass to intersection of Line 9 and No. 11 Highway. On motion of Smith and Swainson, letter and copy of letter from the Hon. Minister as presented be received and placed on file. Presented copy of letter forwarded to Nottawasaga Valley Conservation Authority returning "Appendix E" completed to the extent of the information available as requested and required for formal submission on behalf of the Municipality to the Federal-Provincial Flood Damage Reduction Program, for fill and flood line mapping. Also presented copy of minutes of meeting of NVCA Forestry and Land Use Advisory Board showing that the Advisory Board had received quotation from J. D. Barnes Ltd. for the mapping component of the Oro Fill and Flood Line Study and the proposals for the engineering component be requested from three firms. Presented letter from Clerk, County of Simcoe forwarding copy of By-law No. 3478 a By-law to amend By-law No. 3469 being a By-law to determine the percentage share that each Municipal ity within the County of Simcoe shall contribute for County purposes in 1980 and a copy of By-law No. 3479, a By-law to amend By-law No. 3472, being a By-law to consolidate By-law No. 's3470 and 3471, providing for the raising of sums for 1980 expenditures. The revision by the Minister of Intergovernmental Affairs to provincial grant pertaining to 1980 apportionments does not alter the percentage for the Township of Oro. Marshall, owner of Lot 6(W!z), Concession 4, advising of recent survey showing that when new fence is erected the corner post of the NW corner will be within several feet of the pavement. Letter requests that the Road Supt. inspect the site prior to the erection of a new fence. Clerk advised that Road Supt. had received a copy of this letter showing a diagram of the fence line. On motion of Smith and Swainson, letter be received and Road Supt. to inspect the site and reply to Mr. R. Marshall in this regard. On motion of Smith and Swainson, that the Chief Building Official forward a letter to V. Shanahan with respect to demolition of the old residence in accordance with affidavit agreement taken. On motion of Sanderson and Smith that a temporary Building Permit be issued to Big Cedar Parks for a service building for Phase 2 and that a formal building permit be issued once the Zoning By-law and Developer's Agreement have been completed and approved in accordance with the Ontario Municipal Boa rd Order. Council considered the request of Dale Plant, south east ~ Lot 10, Concession 9, to occupy the present dwell ing during the erecti.on of a new dwell ing. Al so request of Sybrand Kool e and Johannes Kool e to use the present dwell ing until new dwelling is ready for occupancy on part Lot 26, Concession 4. On motion of Sanderson and Smith, that Dale Plant, south east ~ Lot 10, Concession 9, Township of Oro be authorized to occupy the existing dwelling while a new dwelling is under construction. This authority shall be effective for a period of one year or until completion of the new dwelling as evidenced by a Certificate of Occupancy, the existing dwelling is to be demolished within six months of such date. ~ . . . ........ On motion of Sanderson and Swainson, that a good household or commercial vacuum be purchased for cleaning the Township Office. The Planning Administrator was present at 1:10 p.m. to review planning and development matters. Presented letter from Ministry of Culture and Recreation with respect to Culture and Recreation Capital Review - Development of new capital program. On motion of Sanderson and Swainson, letter be received and placed on file for reference. Presented letter from Nottawasaga Valley Conservation Authority extending an invitation to members of Council and Staff to the Official opening of the Authority Central Workshop by the Hon. James Auld, on Monday, June 16, 1980 at 7:30 p.m.. A reply is requested for number that will be attending. On motion of Swainson and Sanderson, Clerk to reply and advise that 4 members of Council will be attending from the Township of Oro. Road Supt. Fred Haughton was present at 1:35 p.m. to present his report for work done during the month of May and Vouchers 5 and 5A to cover same. On motion of Smith and Sanderson that report of the Road Supt. as presented be approved for payment and Treasurer authorized to issue cheques in payment of same to a total of $30,834.49. On motion of Sanderson and Smith that the Road Supt. be authorized to transfer money from prime and sand D-4(M) to calcium D-3(M) as required, since both items are under dust control, subject to Contractor being agreeable to the change. On motion of Smith and Swainson that a letter be forwarded to Bayshore Village and request that signs be removed from Township Road Allowances. Mr. Stan Vousden was present at 2:45 p.m. at request of Council to discuss the matter of By-law Enforcement Officer. Mr. S. Vousden advised that he had reviewed the Provincial Offence Officers Act and in his opinion the Township would have to be prepared to budget considerable amount of money to carry out the program. On motion of Swainson and Smith that the matter of retaining a By-law Enforcement Officer be left for further consideration. Presented a letter from Dorothy Vousden with respect to services for obtaining tax rebates due to the Municipality, advising she would be prepared to act as the agent for the Municipality to obtain all rebates due and owing to the Municipality and that she would like to discuss the matter with Council. On motion of Sanderson and Smith, that Mrs. Dorothy Vousden be retained as the Agent for the Township of Oro to obtain rebate due and owing to the Municipality for Provincial Retail Sales Tax and or Federal Tax and that the fee for this service based on 25% of the rebate be payable when the rebate is received . by the Municipality. Mr. J. Treloar was present before Council at 4:00 p.m. along with Mr. K. Hansler with respect to the Municipal Drain, Lot 21, Concession 11. Mr. Treloar presented a letter of undertaking signed by himself, D. Loftus _ Lot 1 and Block A and G. Varriano of Lot 3. Clerk also presented a letter from Planning & Design Section, Ministry of Transportation and Communications in reply to Township letter of May 23, 1980 advising of the proposal of J. Treloar. Letter indicates that MTC is not prepared to withdraw the petition for a Municipal Drain until the owner of the property where the drainage ditch proceeds, enter into a mutual agreement under the Drainage Act. . On motion of Sanderson and Smith that the Agreement by Owners in accordance with the Drainage Act be prepared and presented to Council for revi ew, fOllowing which the Agreement be forwarded to MTC for their consideration. Following which the Ministry be requested to attend a meeting of Oro Council and owners signing the Agreement. Various matters were presented to Council for consideration for which the Reeve delegated members of Council to attend to and report back to Council should further consideration be required.
