05 21 1980 Council Minutes . . . Pg. 125 COUNCIL CHAMBERS ~ MA'(21, 1980 THIRTEENTH MEETING Council met pursuant to adjournment with all members present. Reeve Howard A. Campbell in the chair. The minutes of the last regular meeting were on motion of Smith and Swainson confirmed as printed and received. Presented copies of letters forwarded as instructed at the last regular meeting to: Barrie Examiner and Orillia Packet re: change of meeting; Oro Station Community Centre re: use of Oro Memorial Park for annual fire works display for the Community with copy to Fire Chief; Secretary, Trustees Hawkestone Police Village re: Audit Report and advising that Council would be prepared to write~off any amount of the unused portion of the Road Budget towards the deficit of the Police Village up to $4,735.00; Jo-Con Developments, attention of P. Stefaniak, with regard to issuance of Building Permits for 8 buildings on Phase 2 of Plan M-66, provided ftll from same is placed on lots not built on, in Phase 1. Also regarding reduction of letter of credit; N.V.C.A. - completion of Schedule "E", as requested for purpose of appending to formal submission for approval to undertake fill and flood li.ne mapping along Willow Creek, Township of Oro, under the new Federal~Provincial Damage Program; Browning and Sanders Sanitation Service forwarding copy of Garbage Collection Agreement; Tri~County Draft Pony Association - use of fairgrounds for Annual Meet and use of washrooms at Town Hall; Regional Registrar - returning form confirming that the Assessment Roll had been altered in accordance with Court Decisions as required under Sub-Section 13 of Section 52 of the Assessment Act; Minister of the Environment - forwarding resolution of Oro Council, endorsing the resolution of the Village of Markdale; Oro Septic Services re: spreading of Process Organic Waste (Sewage Sludge) on four properties in the Township of Oro, which have been approved by the ~1inistry of the Environment - copy of letter forwarded to Robert Tudhope and Jack Perryman; R. F. Carney, P. Eng., M.T.C. forwarding letter from Reg Smith Motors Ltd. re: cost of radio in Dodge ~ ton truck; Ontario Provincial Police, Barrie, forwarding copy of By-law No. 1095; H. W. Sheppard, owner of Lot 23, R.P. 1310 - advising that the ke.eping of fowl in a residential area is not permitted according to Township Restricted Area By-law No. 1031, as amended and By-law No. 1102. On motion of McLean and Sanderson, copies of letters as presented and forwarded accepted as satisfactory and be placed on file for reference. Presented letter from Secretary-Treasurer, Oro Agricultural Society extending the Directors appreciation to Council for being in agreement to supply the wire fence and posts for portion of the Oro Fairgrounds and advising that the Fairboard will commence to tear down the old fence and erect the new fence, which they would like to commence as soon as possible. On motion of McLean and Smith, that the Oro Agricultural Society be advised that the wire fence and posts will be made available as soon as possible and Road Supt. to have same picked up. Presented letter from Bell-Saunders Limited, Insurance Adjusters advising that after all parties had been contacted and details obtained, circumstances would not indicate legal liability on the part of the Municipality with respect to claim by Earl Scott. Also enclosing copy of letter from Earl Scott to Insurance Adjusters and reply by the Adjusters. On motion of Swainson and Sanderson, letters as presented be received and placed on file for reference. Presented letter from Clerk, City of Barrie, advising that City Council has decided to take no action on the request of the Township of Oro, concerning the Co-Sharing of senior citizen and rent geared-to-income housing in the City of Barri e. On motion of McLean and Sanderson, letter be written to the Ministry of Housing for clarification in this regard. Presented letter to Ministry of Environment forwarding provisional certificate of approval of Waste Disposal Site registered as instrument no. 705617. On motion of McLean and Smith, correspondence be received and actions taken found satisfactory. Copy of provisional certificate of approval to be placed on file. . Presented letter from Stewart, Esten advising Hearing of Discovery for Township of Oro vs. Torpey originally scheduled for May 12, 1980 has been set ahead to Thursday, June 12, 1980 at 10:00 a.m. On motion of Sanderson and Swainson, Clerk-Treasurer authorized to attend Hearing of Discovery in regard to the Torpey case on June 12th, 1980. Presented copy of letter from Stuart N. Keyes to Donald Jenkins, Solicitor for Aleksander Randsalu regarding requirements at part Lot 25, Concession 10, with respect to culvert pipe and banks along west side of Concession 10, further to inspection made during first week of May. On motion of Smith and Sanderson copy of letter be received and placed on file for reference. . Presented letter from Ministry of Transportation and Communications, being a letter of approval superceding original approval for one (1) half ton Dodge Model D-147, total cost of $6,842.65 which had included one A.M. Radio. Since A.M. Radio does not qualify for subsidy, in the amount of $90.50 plus Ontario Retail Sales Tax of $6.34 to a total of $96.84, will be deducted for subsidy purposes. On motion of Sanderson and McLean letter of approval superseding original approval of January 7, 1980 be received and Treasurer and Road Supt. to apply as approved for Subsidy purposes showing su5sidy for Dodge Model D-147 as $6,842.65 minus $96.84 for an amount of $6,745.81. ~ . . . ..... THIRTEENTH MEETING (Cont'd) MAY 21, 1980 Pg. 127 Presented letter from Ministry of Transportation and Communications, authorizing a supplementary subsidy allocation in the amount of $41,000.00 for 1980 construction, bringing total allocations to $344,000.00, composed of $155,000.00 construction, $189,000.00 maintenance for the 1980 program. On motion of McLean and Smith, that authorization as presented be placed on file, and that such adjustments as are necessary be made to the 1980 Roads Program to incorporate the Supplementary Subsidy Allocation. Road Supt. to be advised accordingly. Presented letter from the Hon. Larry Grossman, Minister of Industry and Tourism, seeking support of the "Ontario - Yours to Discover" tourism marketing campaign, and 1980/81 tourism marketing plan brochure. On motion of Swainson and Smith, that materials as presented be placed on file. Presented copy of Private Bill PR22, being an Act respecting the County of Simcoe. The Act which comes into force on December 1, 1980 reduces membership of County Council from 54 to 39 members, and details in respect to County Council votes by the Reeves and Deputy Reeves (if a Municipality is so entitled) based on the number of electors. On motion of Sanderson and McLean that copy of Bill PR22 be recei.ved and placed on fi 1 e . Presented invitation to the Warden's Picnic to be held at 2:00 p.m. Friday, June 6, 1980 at the Oro Fairgrounds. On motion of Smith and Sanderson, Clerk to advise Warden's Secretary as to anticipated attendance from Oro Township. Presented report of the Chief Building Official in respect to the conditions of the dwelling owned by Martha Massur on Lot 69, Plan 798. On motion of McLean and Swainson, a registered letter be forwarded to owner of Lot 69, Plan 798 advising of condition of the property. Presented resolution from the Council of the Township of Tay requesting endorsement. Operative claus@! of the resolution is in opposition to the Ontario Government's and Simcoe County School Board's Decision to proceed with a French Language facility in Penetanguishene. On motion of McLean and Sanderson, that resolution be received and Oro Council endorse the resolution of the Township of Tay. Presented letter from the Ministry of Agriculture and Food advising that for 1980-81 fiscal year, $10,000.00 has been allocated to the Township for the purchase of Tile Drainage Debentures, and advising that as of March 31, 1980 the balance of borrowing By-law No. 980 was $61,600.00. On motion of Sanderson and Swainson, that letter of allocation be received and filed for reference. Presented letter from Ministry of Culture and Recreation requesting a calendar of Cultural Community Events to be held during the balance of 1980. THIRTEENTH MEETING (Cont'd) MAY 21, 1980 Pg. 128 On motion of Smith and Swainson Clerk to respond to the Ministry of Culture and Recreation with such information as is available. . The matter of new roof for the African Church was again considered by Council, along with other repairs to the said building. On motion of Swainson and McLean, that the African Church be re-shingled with cedar shingles, provided that the shingles may be obtained at the rate of approximately $19.00 per bundle. The matter of marking spaces in the Township parking lot was brought to the attention of Council for consideration. On moti on of Smith and McLean, that Cl erk to obtain pri ces for marking of parking spaces in the Township parking lot. The Chief Building Official was present at 11:40 a.m. to bring several matters to the attention of Council, firstly the matter of R. A. Cooksley, Lot 20, Plan 882, with respect to septic system approval for accessory buildings. It was resolved that the Chief Building Offical to note this on the building permit. Mr. Brian Dubeau of Penetang, Midland Coach lines (PMCL) was present at 11:55 a.m. . On motion of Sanderson and Swainson OroCouncil endorse the application of Penetang-Midland Coach Lines for the carriage of passengers together with their baggage and express freight between Midland, Wyebridge, Waverley, Orr Lake, Hillsdale, Craighurst and Horseshoe Valley via Kings Highway 12, 27, 93 and Simcoe County Road 22. The portions of the above mentioned roads would serve Oro Township residents along Highway No. 93 and Simcoe County Road 22. Mrs. Joanna McEwen was present at 1:00 p.m. to discuss the proposed further hi story program as a follow up to the Story of Oro and Kith I n Kin, with respect to Villages and history of same, in particular during the period of 1890 - 1910. The proposal is to recreate the Villages at their peak periods by way of a pictorial set up with captions for each. Council in general looked favourable upon the proposed project. The Planning Administrator was present at 1:25 p.m. to review planning and development matters. The following was presented: . Ministry of Housing, advising that Condition 6 of the Ministers Conditions of Draft Plan Approval relating to the Windfield Estates Subdivision, Pt. Lots 27 and 28, Conc. 5, File 43T-78030 have been amended as requested; Copy of Letter from J. Holden to the Ministry of Housing and to the Ontario Municipal Board advising that he has decided not to make a formal objection to Amendment No. 12 to the Official Plan; Copy of letter from Ainley & Associates Limited to Horseshoe Valley Resorts Limited, summarizing a meeting held between the Horseshoe Valley group and members of Planning Board and Council on April 28, 1980 and setting out a tentati.ve timetable of procedures that might be followed to fi.nalize a proposed Official Plan amendment and implementing By-law for proposed development in the area. . . . Amendment No. 12 and response. On motion of Sanderson and Swainson correspondence as presented be placed on file. Re-presented a request from the Association of Municipalities of Ontario to endorse the recommendations contained in "A.M.O. Report No. 20: The Draft Planning Act". On motion of Smith and Sanderson, that the Council of the Corporation of the Township of Oro endorse the response to the Honourable, the Minister of Housing, contained within "A.M.O. Report #20, the Draft Planning Act". Fred Haughton, Oro Township Road Supt., was present at 1:45 p.m. to discuss several matters with Council pertaining to roads. 1. Survey and fencing of road allowance of lands obtained from D. M. McQuaig in Concession 3. 2. Culvert installations, entrance culverts - proposed increase for same. The 1979 quotation for 15" culvert was $235.00 installed and suggested to be increased to: 15" X 20' 18" X 20' 21" X 20' 24" X 20' = $250.00 = $272.00 = $294.00 = $316.00 On motion of Sanderson and Swainson that the proposed prices to be accepted and be effective immediately. On motion of Swainson and Smith that the Road Supt. be authorized to purchase a siting level from Mrs. R. W. Roe at the price of $200.00. On motion of Swainson and Smith that the Township purchase an attachable post hole auger for the Roads Department. On motion of Sanderson and Smith that Fred Haughton be appointed as the Assistant Weed Inspector being responsible to the County and Township Weed Inspector Ivan Speers. On motion of Swainson and Sanderson, that the Notice to Property Owners to Destroy Weeds be placed in both the Barrie Examiner and Orillia Packet. Presented account from Reid and Associates Ltd., Consulting Engineers, as invoice no. 4676 for professional services rendered for improvements to Shanty Bay Water System and installation of pump and hook up of second well on Plan M-66. The total amount of the account being $1,763.20. On motion of Smith and Swainson, that the account from Reid and Associates Ltd., Consulting Engineers, for the professional engineering services rendered for improvements to Shanty Bay Waterworks, Plan M-66, second well, for a total of $1,763.20, be received and payment forwarded once the system is completely connected and operating. . . . Wells, Minister of Intergovernmental Affairs, on the Municipal Elections Amendment Act. The Bill for the Amendment was introduced for a first reading on May 15, 1980. The statement outlines the proposed changes. On motion of Swainson and Sanderson, the statement as presented be received and placed on file for reference. Presented letter from Ministry of Transportation and Communications, Property Section, London, Ontario advising that MTC has leased 40 acres from Lots 15 and 16, Concession 14, to Ronald Shaw for a term of 1 year. The 40 acres now become eligible for full taxation and the remaining 21.832 acres of the MTC property are eligible for a grant-in-lieu payment of taxes. On motion of Smith and Sanderson, that letter be received and Treasurer to amend the Collectors Roll accordingly and forward copies of tax notices as requested. Presented letter from the City of Orillia Economic Development Commission inviting Reeve H. A. Campbell as a Director of the Orillia and District Chamber of Commerce to a full Board meeting to be held at a special dinner meeting on June 18, 1980 at 6:30 p.m. On motion of Smith and Sanderson that the Reeve be authorized to attend the dinner meeting on behalf of the Township of Oro and Clerk to advise accordingly. Pg. 132 COUNCIL CHAMBERS - MAY 21, 1980 SPECIAL MEETING Council met this evening at 7:30 p.m. according to resolution passed at a meeting held on April 21, 1980 to hear and consider the Engineer's Report on the Highway Drain, in accordance with Section 41(1) of the said Drainage Act. Present - All members of Council Reeve Howard A. Campbell in the chair. Present for the meeting were: Charlie W. Grant, P. Eng. - Ainley & Associates Ltd. (Drainage Engineer) Mr. Kenneth Hansler - W~ Lot 20, Concession 10 Mr. Don Ackroyd - W~ Lot 20, Concession 11 Mr. P. Neskovski - E~ Lot 21, Concession 10 Clerk presented copy of notice forwarded according to Section 41(1) of the Drainage Act and list of persons and agencies to whom notices were sent. Also represented letter from Ministry of Transportation and Communications, Planning and Design Section, London, Ontario advising that the Ministry will not object to the Engineer's Report of February, 1980 as filed on February 18, 1980. No reply had been received to notice for this meeting. A letter dated April 21, 1980 and received on May 5, 1980 from Kenneth Hansler, owner of Lot 20, Concession 10, was presented. Mr. Hansler objects to any assessment against his property for the said Municipal Drain. Reeve Campbell after opening the meeting called on Mr. Charlie Grant, the Drainage Engineer to present his Engineer's Report for the Highway Municipal Drain in the Township of Oro as described on page 3 of the said Report. The Report having been further revised from the revised report of December 1979 and February 1980, which was presented to a meeting held on March 27, 1980 which was referred back to the Engineer. Mr. Charlie Grant, P. Eng., presented the Engineer's Report, File No. 78128 of April 1980 and asked if Councilor anyone present wished the entire report to be read. Mr. Grant them asked for questions on the report. Mr. Hansler presented an observation to the report and related where the problem in his opinion appears to originate and presented a letter to support his observations. In conclusion, he expressed that in his opinion, MTC should be responsible for the entire cost since the silt in the ditch would appear to originate from the Highway ditch. Mr. C. Grant replied to the observations of Mr. Hansler. Mr. Ackroyd indicated that he agreed with Mr. Hansler's observations. On motion of McLean and Sanderson, the hearing on the report be adjounred until Council contact the Ministry of Transportation and Communications, on basis of the verbal proposal by Mr. John Treloar to clean out the drain through his property and Mr. Treloar be requested to present his proposal in writing . . .
