The minutes of the last regular meeting of April 21, 1980 and Special Meeting of April 19th, were on motion of Sanderson and Smith, confirmed as printed and received. Presented copies of letters forwarded as instructed at the last regular meeting to: Ministry of Transportation and Communications advising of tenders accepted for Contract 80-01 - to crush, haul, ldad and apply 5/8 gravel also to crush and stockpile and crush and load; Contract 80-02 - supply, haul and apply RC-30 (prime) and sand for dust control and surface treatment RS-IK, H14 stone and sand; Contract 80-03 - to supply, haul and apply liquid calcium; Contract 80-04 to supply, haul and apply non-asphaltic oil. Presented letter from the Hon. Lorne Maeck, Minister of Revenue, with respect to Township letter of April 2, 1980 requesting the adjustment of Assessments in the Township under Section 86 Program. Letter advised that he has requested the Deputy Minister, Property Assessment, to prepare a revised Assessment Roll for taxation in 1981, together with tax impact study. On motion of Smith and Sanderson, letter be received for reference when Revised Assessment for 1981, together with tax impact study, as received. Presented letter from R. Fallon, Secretary-Treasurer, Hawkestone Police Village Trustees with regard to Township letter forwarding 9 year comparison summary of revenue and expenditures for Hawkestone Pol ice Vi" age as prepared by the Township Auditor. Letter further requests that the Township write-off the deficit charged against the Police Village to an amount of $4,735.00. On motion of Smith and Sanderson that Oro Council would be prepared to write-off any amount up to $4,735.00 not used in the 1980 Roads Program, which was submitted as $15,470.00 being a greater amount than the Police Village should be allotted on 4 miles of Road. . Presented letter from P. Stefaniak of Jo-Con Developments following his attendance at a meeting of Council held on April 21, 1980 with respect to request to obtaining building permits for lots in Phase II in place of some of the remaining lots in Phase I. Also regarding reduction of letter of credit. Letter requests building permits for lots 23, 24, 25, 26, 27, 28, 29 and lot 41 on Phase II. Also advised proposal for completion of roads. On motion of Sanderson and Smith, Ora Council are prepared to issue building permits for lots on Phase 2 as requested, namely Lots 23, 24, 25, 26, 27, 28, 29 and 41 on the basis that the fill taken from these lots is placed on lots not building on in Phase I, being lots 47 to 51 and 54 to 56 as well as lots 3, 4, and 35. And further that the Oro Township Council are prepared to reduce the letter of credit by $18,500.00 and will advise the Bank holding the letter of credit accordingly once the Township is advised that the balance owed to Cook Construction for the Road Paving in 1979 has been arranged for or payment has been made. Also that the Roads on the balance of Phase I are to be completed prior to the Roads on Phase 2 or in conjunction with should the construction of the homes be completed in time for the road work to be done in 1980. . Presented letter from Senior Resources Technician, N.V.C.A. with respect to Flood Contingency Planning Emergency Response, advising that the recent muni ci pal inventory questionnai re regarding the flood contingency planning by the Authority had been received. Also enclosing copy of list of Authority personnel to contact in case of a flood emergency within the watershed. Letter al so refers to misunderstandings created during spring run-off, with regard to role of Municipality in responding to emergency situations. On motion of Swainson and Sanderson, letter as presented be received and placed on file for reference as need arises. Presented copy of notices as forwarded to all parties involved in the Highway Municipal Drain as instructed advising that the Revised Engineer's Report will be considered at a meeting of Oro Council held on May 21, 1980. On motion of Smith and Sanderson, copies of notices as presented and forwarded accepted as satisfactory. Presented Garbage Collection Agreement in duplicate as completed and signed by the signing officers of Browning-Sanders Sanitation Service Limited as the Contractor for the Garbage Collection in the designated areas of the Township of Oro. On motion of Sanderson and Swainson, Garbage Collection Agreement as presented with signature of contractor accepted and Reeve and Clerk authorized to sign the said Agreement and copy of same be forwarded to the Contractor. Presented letter from Paul G.M. Hermiston, Q.C., Stewart, Esten, advising that an Examination for Discovery, for action against L.J. Torpey, has been arranged for Monday, May 12, 1980 at 10:00 a.m. . On motion of Smith and Sanderson letter be received and Clerk to attend the Examination for Discovery as requested as well as attending with the Solicitor on May 7, 1980 to review the matter. Clerk presented draft copy of information sheet to be enclosed with final Tax Notices, which includes due date, penalty, interest, method of payment of taxes, details of 1980 tax levy, diagram of how tax dollar is apportioned including 1979 comparison and general information. On motion of Sanderson and Swainson, draft information sheet to be included with the final tax notices, showing details of tax levy, etc. as presented, be accepted and Clerk to have sufficient copies prepared. Presented from Ministry of Transportation and Communications letter approving all tenders for roads as accepted by Council. Approval is given provided that the Ministry's Share of expenditure involved is to be included in the approved Township Allocations for 1980. On motion of Smith and Swainson, letter of approval accepted and be placed on file for reference. Presented letter from William J. Leslie, Solicitor, confirming attendance before the Ontario Municipal Board on behalf of the Township for the Fuda application which was dismissed. Letter advises that as a result of the position taken by the Chairman at the beginning of the Hearing an adjustment has been made to the account rendered, which is in the amount of $150.00. On motion of Smith and Sanderson, letter be received and Treasurer authorized to issue payment of same to the amount of $150.00. On motion of Sanderson and Smith, that letters be forwarded to property owners where an excessive number of old vehicles appear on the property. Presented letter from Nottawasaga Valley Conservation Authority advising that preparation of a formal submission, on behalf of the Township for "Fill and Flood Line Mapping" will be made shortly to the Federal-Provincial Steering Committee in order to obtain approval to undertake the study under the new Federal-Provincial Flood Damage Reduction Program. A questionnaire required to be included in the submission as an appendix, is enclosed with request that same be completed. On motion of Sanderson and Smith, letter be received and Clerk to complete the questionnaire and return same as requested to N.V.C.A. . Presented copy of letter to IBM Datacentre forwarding 1980 mill rate and local improvement flat rates as well as those applied by mill rate along with local improvement listing and other necessary information required to process the 1980 final tax notice. On motio~ of Sanderson and Smith, copy of taxation data and information as prepared and forwarded to process 1980 final tax notices accepted as satisfactory. Presented letter from Kenneth Hansler expressing his appreciation for the removal of two dead elm trees by the Road Department in Lot 21, Concession 9 (portion of Old NO. 11 Highway). On motion of Swainson and Sanderson, letter be received and placed on file. The Planning Administrator was present at 1:15 p.m. to review planning and development matters. The following was presented: Oro Township Committee of Adjustment, Notices of Hearing A5/80 Hetherington, B12/80 Pinteric/Humar and 813/80 Peacock; Minister of Housing forwarding copy of "A Guide to Residential Planning and Design in Small Communities" publication; AMO Report No. 20 "Response to the Draft Planning Act"; OMB Decision re: dismissal of an appeal after hearing. Appeal by MessTs. Fuda et al, against a decision of the Oro Township Committee of Adjustment, Submission 827/79, the O.M.B. upholding the decision of the Committee. . On motion of Smith and Swainson, that correspondence as presented be placed on file. pg. 115 TWELFTH MEETING (Cont'd) MAY 5, 1980 Presented AMO draft resolution for consideration for endorsement regarding the detailed response (AMO Reports #20) to the Draft Planning Act. . On motion of Swainson and Sanderson, that the matter be left for further review before any action is taken. Presented draft Metric Conversion By-law to convert By-law No. 1031 as amended from Imperial Units of measurement to Metric Units of measurement, as required by policy of the Minister of Housing set out in a letter dated July 1979 addressed to all municipalities. On motion of Smith and Sanderson, the By-law as presented be referred for action later today under By-laws in the Agenda. Mr. Ron Watkin of Ainley & Associates Limited, the Township's Planning Consultants, was present at 1:30 p.m. to review with Council the draft by-law to amend Restricted Area (Comprehensive Zoning) By-law No. 1031 as amended, which implements Amendment No. 12 to the Official Plan. The Planning Administrator advised that Oro Planning Board, by resolution dated March 13, 1980 have recommended that Council consider for passage the draft By-law as presented, and that subject to the terms of the Agreement with respect to the preparation of the Waterfront Study that the costs for printing and circulation of the By-law were to be borne by the Township, and which have been provided for within the current Budget for Planning Board. The following resolution resulted subsequent to Mr. Watkin's presentation on the matter. . On motion of Smith and Swainson, that this By-law be referred for action later today under By-laws in the Agenda. . Mr. Spencer Vernon was present before Council at his request, to seek approval of Council to extend the proposed building on part E~ Lot 11, Conc 7, as ~own on Schedule "A" of the appendix to Amendment No. 11, and also forms part of the Agreement between the Township of Oro and York Sand and Gravel as required by the Ontario Municipal Board approval of the Amendment 11 and Zoning By-law No. 1181. The Building referred to is shown on the site plan as 160 feet and Mr. Vernon proposes to add an additional 80 feet to increase the size to 240 feet in length in order to enable him to assemble the conveyers to be used in the operation which are to be 170 feet in length. Clerk advised that the Township Solicitor had been contacted and he had advised that should Council look favourably upon the approval of the extension of the building, it is suggested that York Sand and Gravel be requested to furnish a new site plan showing the exact location of the building as proposed on the revised site plan and that an additional agreement be prepared by the Township Solicitor for York Sand and Gravel to incorporate the change in size of the building according to the revised Site Plan. On motion of Sanderson and Smith, that Oro Council would have no objection to the extension of the building as shown on the site plan as 160 feet in length to 240 feet, being an extension of 80 feet, subject to a new site plan being prepared by the Consultants, Skelton, Brumwell & Associates showing the exact location of the building on the revised site plan. And further, that upon presentation of the said revised site plan, the Township Solicitor and Solicitors for York Sand and Gravel prepare an additional Agreement to incorporate the change in size of the building in accordance with the revised site plan along with such necessary conditions as required. . .. . Loopstra, Solicitor for Big Cedar Parks with respect to Zoning By-law to rezone the subject property in accordance with the Ontario Municipal Board Hearing and further advising that the site plan development agreement for the purpose of implementing the site plan control area by-law is being prepared. Also a copy of letter from C. M. Loopstra to the Ontario Municipal Board in this regard. On motion of Smith and Swainson letter from Township Solicitor and copies of letters from C. M. Loopstra, Solicitor for Big Cedar Parks be received and placed on file pending further information with respect to proposed By-law and site development agreement. Presented copy of letter from Bell-Saunders Ltd., Insurance Adjusters to Earl Scott in response to his claim for damages, which has been investigated and that under the circumstances no liability can be attached to the Municipality for the damage to the vehicle. On motion of Sanderson and Swainson, copy of letter be received and placed on file. Presented letter from D. S. White, Solicitor, forwarding account for professional services with respect to York Sand and Gravel, Morton Dale and Percy Lock, Quadrant Developments Limited, to a total of $287.55. On motion of Sanderson and Smith, letter be received and Treasurer authorized to issue payment of same to Stewart, Esten to a total of $287.55. Mr. Allan Blight was present at 3:50 p.m. as requested by Council with respect to the operation of Sarrie Speedway which he has leased for 1980. Mr. Blight advised that he proposed to hold practice meetings on Wednesday night, which will end by 9:00 p.m. The matter of over night parking was discussed with Mr. Blight, and Mr. Slight advised that participants in the race, following the race, and being from a considerable distance, usually remained overnight in their trailer. He also advised that regular clean up maintenance would be carried out after each race. Mr. Blight also advised that the noise factor should be greatly improved in the next blO years, since special mufflers are being manufactured and wi 11 be introduced and eventually enforced at the Barrie Speedway. Reeve Campbell thanked Mr. Slight for coming to Council to discuss the matter. Presented letter from Ministry of Transportation and Communications with respect to metric system measurements, adving that as of April 1, 1980 MTC will be specifying metric sizing for all corrugated metal pipe as the industry is now able to provide metric pipes through IIhard conversionll. Polyethlene pipe is produced solely in metric sizing. Road building materials such as granular and concrete will be specified in contracts in metric units although conversion will be necessary for weigh scales that are not converted or replaced. Also letter with respect to subsidy for Traffic Signal Maintenance. On motion of Swainson and Smith, letters be received and placed on file for reference and copy of same be presented to Road Supt. Presented a letter from the Hon. Thomas Wells, Minister, Ministry of Intergovernmental Affairs, announcing a revision to the Provincial Grant Program administered by this Ministry which pertains to the apportionment of regional and county levies for the 1980 municipal fiscal year. This revision, which augments the previous programs, will pass on an additional $8.5 million to Municipalities this year, and will completely offset any potential tax increases which could be caused by the new assessment equalization factors introduced last year. On motion of Sanderson and Swainson, letter be received and placed on file and the Clerk-Treasurer to contact the Ministry's field office in Orillia for further information. Presented from Oro Agricultural Society application to manage and conduct a raffle lottery, which requires a resolution of Council advising that Council would have no objection to the issuance of a raffle lottery by the Ministry of Consumer and Commercial Relations. Attached to the application is a cheque from the Oro Agricultural Society, to cover the license fee made out to the Ministry of Consumer and Commercial Relations. On motion of Smith and Swainson, Oro Council would have no objection to the application of the Oro Agricultural Society to manage and conduct a raffle lottery according to the application dated April 18, 1980 and Clerk instructed to advise the Ministry of Consumer and Commercial Relations accordingly and forward the application and covering cheque, issued by the Oro Agricultural Society, to cover the fee for the licence, which is attached to the application. . . . Pg. 120 TWELFTH MEETING (Cont'd) MAY 5, 1980 Presented letter from David Woronka, Chairman, Oro Station Community Centre requesting permission to hold an Annual Fireworks Display at Oro Memorial Park on Friday evening, May 16, 1980. Letter further advises that the usual precautions will be made by having the Hawkestone Fire Departmmt present during the display. Also requesting the use of the kitchen facilities in the Pavilion for the evening. On motion of Sanderson and Smith, Oro Council would have no objection to the Oro Station Community Centre holding their Annual Fireworks Display at Oro Memorial Park provided that all requirements of By-law No. 958 are complied with and the Township Fire Department are present as indicated in letter of April 24th, 1980, and that the Parkgrounds be cleaned up after the display. Presented letter from Regional Municipality of Ottawa-Carleton forwarding resolution with respect to Pedestrian Crossover Review. On motion of Smith and Swainson, letter and copy of resolution be received with no action taken. Presented letter from Ministry of Agriculture and Food, advising that the 1980-81 interest rate for Tile Drainage Debenture is to be 8% and that the most any individual may receive is $20,000.00 and that the most that anyone can borrow and have outstanding after April 1, 1980 is $60,000.00 (i.e. a farmer can borrow $20,000.00 in 1980, $20,000.00 in 1981,$20,000.00 in 1982 but in 1983 he can only borrow the portion of these loans that have been paid back). A letter announcing the 1980-81 allocation of funds is to be sent to the Municipality in April. Also enclosed is an amortization schedule for 8% loans of 10 year period. Letter advises that a further $114,168.00 is to be raised by the Committee and that any donation be it large or small will be appreciated by the people of the area. Presented memorandum from Lake Simcoe-Couchiching Pollution Control Conference to members of the Steering Committee and all Clerks of member municipali.ties, advising of a meeting to be held on May 16, 1980 at the Township of Georgian Civic Centre at 10:00 a.m. Letter also encloses a brief summary of the November meeting. On motion of Swainson and Smith, letter be received and filed and representative from the Township to attend. Presented 1 etter from the Town of Dunnvill e with respect to di.sasters such as hurricanes, tornadoes, fire, floods and other acts: of God which frequently strike without warning, causing extensive property damage as well as personal injury and ocassionaly death, for which victims and Municipalities are totally unable to provide the necessary financial assistance to rehabilitate the area and help the unfortunate persons vlno suffered loss and inj ury. Resolution further lists to whom copies are to be forwarded and request Council's endorsation of the resolution. On motion of Smith and Sanderson, that the letter be received and placed on file with no action taken. Presented from the Village of Markdale, a resolution passed at their Council meeting on April 28, 1980 regarding disposal of Liquid Industrial Waste and hazardous wastes. A study recommends to the Mini stry of the Environment that such disposal sites be in the Counties of Grey, Bruce, Dufferin and Simcoe. The operating clause of the resolution being that before further studies take place the Municipalities of the four counties be consulted as to the proposed locations and nature of the waste disposal and/or treatment sites and be guaranteed an active role in any decision making process and request the comments and endorsement of the resolution by all municipalities in the four counties and endorsements be forwarded to the Minister of the Environment and Local M.P.P.'s and A.M.a. and the Municipal Engineer's Association. On motion of Sanderson and Swainson that the Council of the Township of Oro endorse the resolution of the Council of the Village of Markdale and copy of this resolution be forwarded to the Honourable Harry Parrot, Minister, Ministry of the Environment, Local M.P.P. and A.M.a. and Association of Municipal Engineers. . Presented letter from Fred Huggins, of the Tri-County Draft Pony Associati.on requesting the use of the Oro Fairgrounds and washrooms of the Town Hall for the Annual Meet of the said Association on Sunday, June 29, 1980 as in previous years. On motion of Swainson and Sanderson, that Oro Council would have no objection to the Tri-County Pony Club using the Oro Fairgrounds and washroom faci.lities on June 29th, 1980. The Club shall be responsible for the washrooms and see that same are left in a clean state as well as the grounds being cleaned up after the meet. And that the Club be required to pay $10.00 for the use of the facilities. Also that the vehicles, trailers, etc. are to be parked to the north of the race track and definately not anywhere near the Oro Central Presbyterian Church were services are held in the morning. Presented letter from Ministry of the Environment advising the Oro Septic Servi ces presently hol ds the contract to transport and dispose processe.d organic waste produced by the City of Orillia water pollution control plant. Also to inform that the Ministry is in the process of approving applications for four (4) organic soil conditioning sites in the Township of Oro. The purpose of the application submitted by Oro Septic Service is for approval to spread digested sewage sludge originating from the Orillfa control plant. The reason for this condition is attached to the Certificate. The condition requires that the Certificate must be registered in the Land Registry Offi..ce with one copy being returned to the Ministry.
