Reeve Howard A. Campbell in the chair. The minutes of the meetings of March 31st, April 10th and Special Meeting of April 16th and 19th, were on motion of Sanderson and Swainson confirmed as printed and received. On motion of Sanderson and McLean that a letter be forwarded to Jim Dixon requesting that he vacate the living accommodations on April 30, 1980 at Oro Memorial Park. Presented copies of letters forwarded as instructed at meetings of March 31st, April 10th, and April 16th as follows: Jo-Con Developments re: issuance of Building Permits for Phase I; Secretary Oro Agricultural Society re: fence around fairgrounds; Ron Johnston Insurance forwarding Insurance Claims due to Road Conditions as received from J. Bailey and John Bull; TransCanada Pipelines - Municipal Tax Survey completed as requested; Robert Holmes advising that his application had been accepted for the duties of Caretaker of Oro Memorial Park for the 1980 season - also copies of letters to all other applicants advised of acceptance of Mr. R. Holmes for the position; Gordon E. Smith, M.P.P. re: Drainage Complaint Mrs. Rist, Lot 6, Plan 1098. On motion of McLean and Swainson copies of letters as presented and forwarded accepted and be placed on file for necessary reference. Presented letter from City of Orillia in reply to Township letter of March 18th advising that the City of Orillia have by resolution named the Clerk & Administrator and Alderman Myrtle Bowen as the representatives to the Township of Oro and Orillia and Ministry of Housing with a view to recommend Agreements to provide rent-geared-to-income housing - also letter confirming meeting of May 8, 1980. Also letter from Ontario Housing Corporation, Ministry of Housing with respect to 7~% Municipal Sharing - Subsidized Housing Units, advising that operating subsidies for 1981 and future years will be absorbed by the Federal and Provincial Governments. Also enclosed copy of news release of March 11, 1980. On motion of Sanderson and McLean, letters be received and placed on file for reference. Presented letter from Ministry of Intergovernmental Affairs advising that the Administration of Unconditional Grants has been transferred to Subsidies Branch of the Ministry of Intergovernmental Affairs from the Ministry of Treasury and Economics effective March 3, 1980 and that first installment of the 1980 Unconditional Grants has been advanced by more than one month. Clerk reported that the cheque in the amount of 50% of the Township 1979 Grant had been received. Also enclosed the determination of Final Adjustment for 1979 showing a zero balance. On motion of Mclean and Swainson, letter be received and filed for reference. Pg. 98 ELEVENTH MEETING (Cont'd) APRIL 21, 1980 . Presented letter from Eric Finkelstein, Area Consultant, Ministry of Culture and Recreation advising that the Township request for revising the type of arena renovations from bleachers to that of other priorities within the arena had been reviewed and discussed with the Capital Support Unit Project Analyst and letter supporting the revision had been forwarded with request to send letter confirming that these alterations to the Township application as indicated, are acceptable. On motion of Swainson and Sanderson, letter be received and filed until confirmation has been received in this regard. Clerk presented letter from A. F. Gorringe, Highway Equipment Supervisor, Ministry of Transportation and Communications, advising of his inspection of the Allis Chalmer Loader for Transfer and that the Unit appeared to be in above average condition and that $19,500.00 to $20,000.00 would be a true market value of this unit. . On motion of Sanderson and Swainson that letter of appraisal for the Allis Chalmer Loader as presented be received and the said 1979 Allis Chalmer Loader be transferred from the Roads Department to the Township Waste Disposal Site for the sum of $19,500.00 and that the 55% subsidy of the $19,500.00 be credited to the Township Road accounts to a total of $10,725.00. Presented letter from Central Oro Ratepayers Association (CORA) requesting copy of the deed conveying Oro Memorial Park lands to the Township. Letter being from the President, Lloyd George also requested that the minutes of the Council Meetings~ as arranged be forwarded to him and that the Secretary- Treasurer, Mrs. M. Thompson be invoiced for same. On motion of McLean and Swainson letter as presented be received and placed on file and Clerk to forward copies of Council Minutes as requested and copy of deed of conveyance. Treasurer reported on the return of the 1979 Collectors Roll to the Treasurer as of April 1, 1980 showing the total taxes on the Collectors Roll as $2,033,738.65 less discount of $11,257.41 to a total of $2,022,481.24 with penalty and interest added of $9,040.45 to an amount of $2,031,52i.69~ with a total amount paid of $1,857,988.81 leaving a balance uncollected as $175,749.85. Of this an amount of $167,020.00 has been placed against the properties in the Arrears Ledger of the Township with 5% penalty added and notices prepared and sent to the property owners. The balance of $8,729.85 not placed on the Arrears Ledger is composed of $7,987.13 written off under Section 636(a) of the Municipal Act, with an amount of $25.38 Federation to be written off and $717.34 business and commercial to be collected. Notices of Uncollected Business Taxes not returned have been prepared and forwarded, giving them 21 days for payment of same or making arrangements for the amounts to be paid, and if not paid by time required, same be turned over for collection. . On motion of Sanderson and McLean, that the 1979 Collectors Roll as returned to the Treasurer, accepted as presented, also action of placing arrears of taxes on the Township Arrears Ledger with 5% penalty added and notices as forwarded to parties for business taxes, which if not paid or arranged for by May 9th, 1980, be turned over for collection, accepted as satisfactory. . . . pg. 99 ELEVENTH MEETING (Cont'd) APRIL 21, 1980 Presented letter from D. S. White, Solicitor advising that the Solicitor for Big Cedar Estates, C. Loopstra had been recently contacted and Mr. Loopstra had advised that Mr. D. Skelton and Mr. Ross Raymond are in the process of preparing the necessary documents. As a result of a recent Amendment to the Planning Act, the process under Section 35 has changed, and therefore, it is impossible to follow the decision and directions of the Board exactly. Mr. Loopstra is obtaining new instructions from the Board and will then submit draft documents to the Township. On motion of Swainson and Sanderson, letter be received and filed for reference until further information or documents are made available. Clerk advised that the persons appointed by Council to sell Dog Licences have no~ turned in their books and balance of tags. The matter of accepting an application for the position of Office Assistant with major responsibility as Assistant to the Treasurer, was further considered after being referred to this meeting, following the interviews on April 19, 1980 in order to obtain further references on two of the applicants. On motion of Sanderson and Swainson, that the application of Katherine Richardson for Office Assistant with major reponsibilities as Assistant to the Treasurer with duties as outlined at the interview, be accepted on a 6 month probation period at a remuneration of $10,500.00 per annum at commencement which may be reviewed at the end of the six month probation period subject to the applicant accepting same and further that she commence work by May 15th, 1980. Also that the Township of Oro would be prepared to give consideration to applicant to participate in the AMCT Course after the six month probation period. And further, that all applicants that had applied be advised accordingly. Presented list of Federation of Agriculture fees collected for 1979, showing a statement as follows: Amount Paid on Roll $411.86 Amount Not paid on Roll 25.38 Total on Roll $437.24 On motion of McLean and Sanderson statement as presented be accepted and Treasurer authorized to issue a cheque to Simcoe County Federation of Agriculture to a total of $411.86 being the amount paid on the tax roll. Stepaniak was present at 11:25 a.m. in accordance with appointment arranged with respect to Plan M-66, regarding services and letter of credit. Mr. Stepaniak related that he had several matters to discuss with Council: (a) (b) because of some lots are low on Phase I, building permits be issued for some lots on Phase 2 (approximately 8 lots); reduction of letter of credit according to Subdividers Agreement for work completed. After considerable discussion it was left that Mr. Stepaniak advise in writing of his proposal with regard to number of lots he is requesting in Phase II and amount of letter of credit reduction in relation to percentage of work completed on Phase I. Clerk reported that as instructed at a meeting of Oro Council held on March 5, 1980 an advertisement had been placed in the Daily Commercial News, calling for tenders for dust control materials and surface treatment, materials and application of same, and in response tenders were received as follows: . 1. To supply, haul and apply approximately 54,200 gallons (246,500 litres) of RC-30 or SP-6 (MTC prime) and approximately 1700 tons (1550 tonnes) sand on various Township Roads, for dust control and included in the same tender 80-02 to supply, haul and apply approximately 17,000 gallons (77,500 litres) of RS-IK and HL4 stone - 460 ton (420 tonne) and sand cover of 220 ton (200 tonnes) - Tender 80-02. 2. The Planning Administrator was present at 2:50 p.m. to review planning and development matters. Holmberg to be heard Wednesday, April 30, 1980 both at 10:30 a.m. in the Council Chambers. . . . . Pg. 104 ELEVENTH MEETING (Cont'd) APRIL 21, 1980 Ministry of Housing memorandum regarding certificates to be forwarded on passage of zoning by-laws under Section 35(24) of the Planning Act; Oro Township Committee of Adjustment, Notices of Hearing Bll/80 - Drennan, A3/80 Cunningham, and A4/80 Lambacher; Ministry of Housing inter-staff memo re: referrals to Amendment No. 12 to the Official Plan, and recommendation that the O.M.B. hear all matters at the same time; Copies of application for approval to the O.M.B. of City of Barrie By-law No. 80-33 re: elimination of "no-frill housing" provisions and 80-34A re: establishment of "group home" provisions; Copy of application for approval to the O.M.B. of Township of Flos By-law No. 80-7 re: zoning amendments to correct mapping in the Craighurst Area, and to introduce Residential and Commercial "Holding Zone" requirements in conformity with the Craighurst Secondary Plan. On motion of Sanderson and McLean, that correspondence as presented be placed on fi 1 e . The Planning Administrator advised that a By-law to implement Official Plan Amendment No. 12, the Waterfront Study, has now been prepared and is ready for consideration by Council. On motion of Swainson and Sanderson, that the draft By-law to implement Official Plan Amendment No. 12 be brought in at the next regular meeting of Council, and that the Township's Planning Consultants, Ainley & Associates be present at the time of consideration. Mr. Douglas Skelton, Mr. A. Ucci and Peter Ucci were present at 3:05 p.m. with respect to the Developers Agreement and further to resolution of Oro Council at a meeting held on April 16, 1980. A letter of undertaking as requested by the Township in the said resolution was presented for Council's consideration. The letter being subject to certain conditions. The matter of undertaking was considered in detail by Council with Mr. A. Ucci. On motion of McLean and Sanderson, Council would have no objection to the owner of the undeveloped lands lying to the north of the Plan, having the right of access across the reserves (Blocks 47 &48) for recreational, woodland management and drainage maintenance purposes and would be prepared to accept items 1, 2, 3 and 4 in the letter of undertaking dated April 21, 1980 as presented on behalf of 55-65 Broadway Avenue Limited. On motion of Swainson and Sanderson, Oro Council are prepared to execute the Subdividers Agreement in form of the third draft and would be prepared to recommend the draft approval plan for registration upon receipt of all documents and necessary financial requirements according to the Subdividers Agreement. Also upon receipt of the three revisions to the Engineering Drawings as follows: 1. Asphalt to be increased to total depth of 9 cm. 2. Schedule of Driveway Culverts to be provided. 3. Detailed Drawings of retention pond to be provided. And further, that the Reeve and Clerk be authorized to sign the Subdividers Agreement when all the aforementioned have been complied with. . . . ELEVENTH MEETING (Cont'd) APRIL 21, 1980 Pg. 104 (a) Mr. T. J. Leigh and Michael Drury, Solicitor of Clegg & Gordon, were present before Council with respect to issuance of Building Permits on Plan 217, namely Lots 18 and 19. The matter of road allowance and eventual road for M-20 was discussed and what effect this unfinished road has with regard to issuance of building permits in accordance with the Zoning By-law and TO\^Jnship By-laws. On motion of McLean and Swainson, that Oro Council would have no objection to the issuance of a Building Permit for one residence on Lots 18 and 19, Plan 217, subjec to Mr. T. J. Leigh incorporating in the sale of the lot, and same be registered on title, that the property fronts onto an unassumed road, which is not subject to maintenance by the Municipality except by an Agreement entered into by the Developer of Plan M-20; and that any future owner should enter into an undertaking with the Municipality to hold harmless the Municipality for any liability on entering the unassumed road. Mr. Charlie Grant was present at 4:45 p.m. to file with the Township the revised Engineer's Report for the Highway Municipal Drain and referred to the changes the Report filed on February 18, 1980 and considered at a meeting held on March 24, 1980. On motion of McLean and Sanderson that the revised Engineer's Report for the Highway Municipal Drain as petitoned for by the Ministry of Transportation and Communications, be received and Council are prepared to proceed with the drain and set Wednesday, May 21st, 1980 at 7:30 p.m. as the date and time for a meeting to consider the Revised Engineer's Report and Clerk to send necessary notices of same as required under the Drainage Act. Mrs. Mary Hay was present at 5:00 p.m. regarding Barrie Speedway and inconveniences created by the operation. Mrs. Hay related that in 1979 the operation was of great concern because of parking on the road and overnight camping which took place. After consideration Council passed the following resolution. On motion of McLean and Sanderson that due to problems at the Barrie Speedway in 1979, a letter be forwarded to Mr. Allan Blight, since it is Council's understanding that Mr. Blight is proposing to lease the Barrie Speedway in 1980, requesting that he attend a meeting of Council to discuss the proposals for the use of the property in 1980. The Budget of Municipal Expenditures for 1980 as approved for a total expenditure of $1,073,923 with estimated Revenue of $611,404 leaving an amount to be levied of $462,519 including the 3 Mill reduction of the General Mill Rate for Hawkestone Pol ice Vi 11 age as agreed to by Counci 1 in accordance with Section 478(1) of the Municipal Act, in the amount of $1,380.00, plus the Requisition of the Trustees for added services to the Ratepayers of Hawkestone Police Village to an amount of $4,080.00. The estimated Road Expenditures for H.P.V. being included in Township Road Expenditures. The estimated revenue including all grants and apportionment of Bell Telephone Gross Receipts (Section 304(a) and hospital per bed rating (Section 304) will require an amount of $462,519 to be levied, necessitating a Residential Mill Rate of 42.483 mills on Residential and Farm Assessment and a Commercial of 49.980 Mills on the Commercial Assessment. The added Trustee Requisition of $4,080.00 after 3 mill reduction on Commercial Mill Rate. The mill reduction applied to Commercial 10.561 - 3.00 = 7.561 and Residential Mill Rate 85% of Commercial (7.561 x 85%) = 6.427 on basis of 8.977 - 2.550 = 6.427. . . . ....... Pg. 105 ELEVENTH MEETING (Cont1d) APRIL 21, 1980 This will necessitate a mill rate of 8.977 - 2.550 = 6.427 on the Residential and 10.561 - 3.00 = 7.561 mills on the Commercial rateable property of Hawkestone Police Village, so that the total Hawkestone Police Village Mill Rate will be 48.910 mills Residential and 57.541 mills for Commercial. The general township levy being calculated on 85% of the Residential Assessment of $7,926,752 thereby making a differential of 15% between Residential and Commercial Mill Rate in accordance with Provincial Requirements. On motion of Sanderson and McLean, that the total expenditure of $1,073,923 with an estimated revenue of $611,404 for the Township of Oro General Levy, including a 3 mill reduction of the General Levy for Hawkestone Police Village Ratepayers to an amount of $1,380.00 and an added requisition by the Trustees of Hawkestone Police Village be added to all rateable property of the Hawkestone Police Village in the amount of $4,080.00 be accepted as the 1980 budget. On motion of McLean and Swainson the 1980 expenditure and revenue as adopted requiring an amount of 462,519 to be levied by general municipal rates and necessitating a mill rate of 42.483 for Residential and Farm Assessment and a Mill Rate of 49.980 mills on Commercial Assessment for the Township, with General Mill Rate for Hawkestone Police Village Ratepayers, plus the additional expenditure requisitioned by the Trustees of $4,080.00 necessitating a Residential Mill Rate of 6.427 mills and Commercial Mill Rate of 7.561 mills to a total of 48.910 mills Residential and 57.541 mills for Commercial for Hawkestone Police Village (the 3 mill reduction as agreed to by Council having been applied to reduce the General Mill Rate) and, that these mill rates be applied for 1980 to raise the necessary money and the levies and mills rates be incorporated in the Township By-law to Raise, Levy and Collect Taxes in 1980. The Requisition from the County of Simcoe and copy of By-law No. 3469, 3470 and 3471 passed in accordance with Section 507(5) to determine percentage and setting out amounts apportioned to the Township in Schedule "A", which had been presented to a meeting of Oro Council held on March 31, 1980 showing apportionment for the Township of Oro as: General Expenditure Road Expenditure as $116,730.00 as 88,264.00 $204,994.00 (being 4.545% of total levy) The 1980 County Requisition of $204,994.00 less the allocation of apportionment for Section 304(1) (Bell Telephone Gross Receipts) of $4,975.77 and apportionment of Section 304 (Public Hospital per bed rating) of $4,014.48, for a total reduction of $8,990.25, plus 1979 underley of $2.00, will require an amount of $196,005.75 to be raised, which will be levied on a Residential Assessment of 9,325,591 and a Commercial Assessment of 1,327,253, requiring a Residential Mill Rate of 18,004 mills and 21.181 mills for Commercial. This amount being a decrease of 1.138 mills for Commercial and .967 for Residential. Decrease in mill rate of 5.10%. The Residential Mill Rate being 85% of the Commercial Mi 11 Rate. On motion of Sanderson and Swainson the Simcoe County Levy of $204,994.00 less portion of Bell Canada Gross Receipts (Section 304(a) of $4,975.77 and Public Hospital per Bed Rating (Section 304) of $4,014.08, plus 1979 underlevy of $2.00 leaving an amount to be levied of $196,005.75 which shall be raised by applying a Residential Mill Rate of 18.004 mills and a Commercial Mill Rate of 21.181 mills and that these mill rates be applied in 1980 and be included in the Township By-law to Raise, Levy and Collect Taxes for the year 1980. ~ """'l1lI ELEVENTH MEETING (Cont'd) APRIL 21, 1980 Pg. 106 . The 1980 Simcoe County Board of Education Operating Budget as approved by the Simcoe County Board of Education at a meeting held on March 27, 1980 for a total Budget of $88,755,120 of which 39,744,893 is to be raised by Municipal Taxes within the County of Simcoe, as presented to a meeting of Council held on March 31, 1980 was again presented along with Mill Rates required to raise the total requisition as instructed by Council for approval, after having met with representatives of Simcoe County Board of Education for a further explanation of calculations and extensive increase over 1979. The total net requirements for the Township of Oro being in the amount of $1,458,347.00 being a sharing ratio of the total budget of .03786 and .03589 for Secondary. On motion of Sanderson and Swainson that the necessary mill rate to raise the amount of $1,250.00 for Shanty Bay Street Lights in 1980 be applied and incorporated in the By-law to Raise, Levy and Collect Taxes for 1980. The amount of $1155.00 less overlevy of $133.00 plus additional for hydro increase and services of $218.00 to a total of $1,250.00 be raised requiring a mill rate of 4.034 mills on Residential Assessment of 303,740 and a Commercial Mill Rate of 4.746 mills on a Commercial Assessment of 5175 to a total assessment of 308,915 for Shanty Bay Street Light area. On motion of Sanderson and Swainson that the flat rate charges for garbage collection services on properties defined under the provisions of By-law No. 976, as amended, be collected by applying a flat rate of $18.00 per year for Residential and Farm, once per week collection, and a flat rate of $32.00 per year for once per week Commercial and flat rate of $55.00 per year for twice pwer week Commercial collection. And further, that the resolution passed at a meeting of Council held on December 7, 1979 increasing the flat rate by $2.00 per pick up be rescinded due to increase in new garbage collection contract and the aforementioned rates be applied. On motion of Sanderson and Swainson, a By-law to Raise, Levy and Collect Taxes for 1980 in accordance with the Township of Oro Budget, as approved, and to levy County and School Requisition as well as special area levies and garbage collection, be introduced and numbered as By-law No. 1211/80 and read a first time. Presented a letter from the Ministry of Transportation & Communications advising of acquiring 0.245 acres from Audus and Shirley A. Wright under Agreement No. L-16507 title to the property was obtained by registration of a deed as Instrument No. 701320 on March 21, 1980, in the Registry Office for the County of Simcoe, at Barrie. The 0.245 part of an acre is surplus to requirements and will be subject to a grant-in-lieu of taxes, under the Municipal Tax Assistance Act. The property shown as Part 6 of the attached print of Plan P-1726-62. For payment of the 1980 taxes, three copies of the tax bill are to be forwarded to Head, Property Section, M.T.C., London, Ontario. The Assessment Rolls are to be amended accordingly. Presented letter from Chairman of Fund Raising Committee for the Port Hope Disaster Relief Fund requesting a generous donation to the Fund. The Province has declared the Town of Port Hope a disaster area and has agreed to match every dollar raised by a Fund up to a maximum of three dollars from its own Treasury. Therefore the fund needs to raise of minimum of $1,250.000.00. On motion of McLean and Sanderson that the Township of Oro authorize an amount of $50.00 towards the Port Hope Disaster Relief Fund.
