COUNCIL CHAMBERS - MARCH 17, 1980
SEVENTH MEETING
Council met pursuant to adjournment with all members present.
Reeve Howard A. Campbell in the chair.
The minutes of the last regular meetings held on March 3rd and 4th, were on motion
of Sanderson and Smith confirmed as printed and received.
Presented copies of letters forwarded as instructed at the last regular meetings,
as follows:
Daily Commercial News forwarding tender ad to be placed in two issues of the paper,
calling for tenders for dust control - (1) liquid calcium (2) prime and sand
cover (3) surface treatment (4) non-asphaltic (waste oil) and to crush, haul
and apply 5/8" (16 mm) crushed gravel and stockpile as well as crush and load
off belt onto Township trucks crushed 5/8" (16 mm) gravel;
Ministry of Transportation & Communications forwarding copy of Township Tender Forms
for approval and advising of tender closing as April 18th and opening of same
on April 21, 1980;
Orillia Packet and Barrie Examiner requesting advertisement in two issues calling
for applications for person or persons to carry out the duties as Caretaker for
Oro Memorial Park;
Ontario Humane Society advising that Council authorize an increase of .10~ per
capita for animal control from $1.95 to $2.05;
Browning-Sanders Sanitation Services Ltd. re: garbage collection contract as accepted
by Council for 3 year term subject to signing of same and producing insurance policy;
Nottawasaga Valley Conservation Authority forwarding necessary resolution to proceed
with Flood Line Mapping and fill and construction lines under Federal-Provincial
Flood Damage Reduction Program;
Orillia Packet & Barrie Examiner - advertisement for Office Assistant, duties
as Assistant to Treasurer and Payroll etc.;
Ron Young forwarding copy of Certificate of Approval for second well in Shanty Bay -
Plan M-66 and requesting he proceed to carry out the necessary tests to comply with
terms and conditions of the approval as soon as possible;

Ontario Hydro requesting additional street light in Shanty Bay on Church Street be
installed as requested by Advisory Board of St. Thomas Church and agreed to by

and request for substantial completion certificate of water mains and valves, etc.;

for signature by the Trustees;

by Winter Carnival Committee which should be deposited to the account of the
Arena Committee;
County Clerk and County Treasurer forwarding calculation of deemed assessment for
County Apportionment Purposes - Section 507 of The Municipal Act as required
under the Act;
Provincial Library Services forwarding annual survey of public libraries 1979
as completed.
On motion of McLean and Swainson, copies of letters as presented and forwarded
accepted as satisfactory and ordered placed on file.

Presented memorandum from J. Moffat, Manager, Municipal Roads Office, Ministry
of Transportation and Communications forwarding report of expenditure and subsidy
for the year 1979 as approved and advising that the balance of subsidy for
1979 in the amount of $92,854.80 has been for'llarded to the General Accountant
for payment of subsidy.
On motion of Sanderson and McLean, report of expenditure and subsidy for the
year 1979 as approved be received and placed on file for records.
Presented copy of letter to Ministry of Transportation & Communications, attention
of D. A. Webb, advising that in response to tender call in the Daily Commercial
News for one backhoe loader and backhoe, 4 tenders were received and that the
lowest tender meeting all specifications being Truck and Tractor Equipment Ltd.
to supply one John Deere, Backhoe/Loader with 17'0'L backhoe had been accepted
subject to MTC approval, and enclosing original tenders for inspection. All of
which were delivered by hand when the Road Supt. and Councillors Clarence Smith
and Charlie Sanderson met with D. A. Webb to review the tenders and reason
for Council's action in accepting the above mentioned tender. Also copies of
letters as forwarded to the successful bidders and the three other dealers
that had forwarded tenders. These letters were not forwarded until MTC, Equipment
Personnell had further reviewed the tenders, in particular the tender from
W.R. Buckle Ltd., in order to confirm or comment on Council's action as to whether
tender and brochure accompanying the tender meets all the specifi cati ons according
to Township tender form as called. Verbal approval of Council's action was
received on March 13, 1980, the approval being on the basis of tender from
W. R. Buckle Ltd. not meeting all specifications as submitted along with enclosed
brochure.
On motion of Smith and Swainson, copies of letters as forwarded and report of
verbal approval from MTC of Council's action in accepting the lowest bidder
meeting all specification, namely Truck and Tractor Equipment Ltd. accepted as
sati sfactory, and al so the acti on of forwardi ng 1 etters to successful bi.dder
and other firms from whom tenders were received advising of the tender accepted.
Presented from Ministry of the Environment - "Permit to Take Water" in Section 37
of the Ontario Water Resources Act, from both No.1 and No.2 well on Plan M-66
(Jo-Con Developments, Lot 23, Concession 3) for Municipal Water Supply, at the rate of
409 L/min (90 imperial gallons per minutes) subject to Special Condition No.1,
not exceeding the 295,000 L/day (64,800 imperial gallons per day) subject to
Special Condition No. 1 as set out in the permit no. 80-P-3008. Letter
observed in one well while the other is operating as suggested by the Township
Consultant. Also that a complete water quality analysis should be performed
on water well no. 1.
On motion of Sanderson and Smith letter and "Permit to Take Water" be received
and Ron Young be requested to carry out necessary observations and obtain the
water quality analysis.
Presented letter from J. P. Long, Project Co-Ordinator, Community Housing, Ministry
of Housing, in reply to Township letter of February 19, 1980 advising that the
Township of Oro, after further consideration are not prepared to participate in a
Municipal Housing Statement at this time. Letter outlines Co-Sharing Agreements,
major points, that should be foremost in an Agreement with either the City of
Barrie and/or Orillia and also mentions the 40 Senior Citizen Units that are nearing
in Stroud.

On motion of McLean and Sanderson letter be received and placed on file and
the cities of Barrie & erill ia be adv"ised that Oro Council would be prepared
to enter into a Co-Sharing Agreement and are agreeable to pay 7~% of any unit
operating loss from persons originating from the Township.
Represented correspondence from C. P. O'Dale Limited, O.L.S. and Roger Welsman
along with Township letter to the aforementioned with respect to account for
survey of deviation road on Part E~ Lots 2 & 3. Clerk advised that Roger Welsman,
Councillors Smith and Sanderson, Ross Currie and Road Supt. Fred Haughton had
met with survey crew of C. P. O'Dale Limited on Wednesday, March 12, 1980 at
1:30 p.m. because of the description differences of the survey by Welsman.
Councillor Smith gave a report on the site inspection and the following action
resulted:
On motion of Swainson and McLean the report of Councillor Smith be acknowledged
and matter be left over for further discussion when Mr. Lohuaru of Horseshoe
Valley Limited is to be present later today at 4:15 p.m.
Mr. Lohuaru was present at 4:30 p.m. as requested and Councillor Smith related
the findings that arose out of the site meeting on March 12, 1980, and after
discussion and consideration Council passed a further resoluton.
On motion of Sanderson and Smith that Horseshoe Valley Resort Limited as agreed
to by William Lohuaru, pay the Township of Oro an amount of $1,000.00 towards
the cost of the survey to C. P. O'Dale and the Township of Oro forward the
full amount of the original cost of survey to C. P. O'Dale Ltd., O.L.S. in
the amount of $2,082.00 upon receipt of the cheque.
Presented copy of letter from Louis Kovacs to Simcoe County District Health
Unit regarding temporary holding tank on Lot 11, concession 2, adjacent to
Registered Plan 1237, advising that a proper Class IV sewage disposal system
as required in the Certificate of Approval dated October 2, 1979, File No.
F79074, will be completed by July 15, 1980.
On motion of Sanderson and Smith, copy of letter as presented be received
and placed on file for reference.
Presented letter from Property Section, 659 Exeter Road, London, Ministry of
Transportation and Communications in response to Township letter of
September 5, 1979, forwarding a confidential appraisal, as requested for two
parcels of land in Lot 20, Concession 8, as outlined in MTC File No. L-03121.
Letter requests that Council advise by April 5th, 1980 should they be
interested in the parcels of land.
On motion of McLean and Sanderson, letter be received and Clerk to advise that
the Council of the Township of Oro are not interested in the parcels at
the appraisal amounts quoted ona confidential basis.
Clerk reported that in accordance with letter from Ministry of Culture and
Recreation advising that an interim capital grant had been authorized for
Shanty Bay Community Hall and School Centre, a cheque in the amount of
$12,780.54 had been received under the Community Recreational Centres Act.
Also included in the same cheque is the CRC grant for Jarratt Community Hall.

On motion of Smith and McLean cheque in the amount of $15,234.54 be received
and Treasurer authorized to issue a cheque in the amount of $12,780.54 to Simcoe County
Board of Education to apply to the Community Hall Committee share of the cost
of the building, and a cheque in the amount of $2,343.27 be forwarded to
Jarratt Community Hall Committee.
Presented letter from Sheila Litster requesting clarifications with respect to
Library Services and Township User Fee of $5.00 and Clerk's reply.
On motion of Sanderson and Smith, letter from Sheila Litster and Clerkls
reply accepted as satisfactory.
The Chief Building Official, Jim Shellswell was present at 11:30 a.m. with respect
to certain matters pertaining to building permit which requires Council IS
attention and direction.
The permit application in question was that of Antonio Mascioli in Ept. Lot "A"
for an addition to Restaurant for new washrooms, entrance and storage.
The Chief Building Official IS concern was on the basis of a previous permit
not completed.
Council advised that the permit as applied for could be issued subject to
all necessary requirements of the Township By-laws and Ontario Building Code.
On motion of McLean and Sanderson, that the Chief Building Official be authorized
to attend the Ontario Building Code - Part 2 and advanced Part 9, a week
course at Georgian College and the Township pay the necessary registration fee.
. Presented letter from Stuart N. Keyes as requested at the last regular meeting
with respect to water mains and valves on Plan M-157. Stuart N. Keyes advises
in his letter that in his opinion, following a further inspection on
March 3, 1980 and inspections in the fall of 1979, the water mains distribution
system as installed between the east side of Lot 24 to north side of Lot 24
may be considered substantially completed, other than the deficiency listed in
letter of November 21, 1979. Therefore, the distribution system between
Lots 14 and 24 as mentioned may be considered substantially completed
as of January 1, 1980.
On motion of McLean and Swainson that the Engineer's Report be tabled until
both the Engineer for the Developer and Township Engineer have appeared before
Council to discuss the matter of water system installation and further that
both Stuart N. Keyes, P. Eng., and Engineer for the Developer be requested to
attend the next meeting of Oro Council.
The Planning Administrator was present at 1:00 p.m. to review planning and
development matters. The following correspondence was presented.
Letter to Bank of Montreal returning letter of credit re: Quadrant Developments
security against 50% of capital lot levies, such levies having recently
been received as per the Subdivision Agreement and placed on account;
Letter to O.M.B. confirming that the Township are not prepared to pass a
zoning amendment as requested by Messrs. A. Fuda et al, re: the appeal to the
Board against a decision of the Committee of Adjustment, Submission No. B27/79

O.M.B. advising of Hearing re: Township of Flos By-law No. 79-7, 11:00 a.m.,
April 10, 1980 at the Flos Municipal Offices;
City of Barrie By-law No. 80-19, rezoning lands at Blake and Johnson Streets
for convenience retail and apartment purposes;
R.G. Campbell, advising that as a member of the C.O.R.A. Ratepayers Association,
that he is in full support of a proposal by the City of Barrie with respect to
the location of an airport on the 4th Concession of Oro Township.
On motion of Swainson and Sanderson, that correspondence as presented be placed
on file.
Presented letter from Simcoe County Industrial Commercial Development Officer
requesting copy of any recent development reports as may have been prepared,
and the name of the Municipality's Development contact.
On motion of Smith and McLean, that the Planning Administrator respond to the
County Development Officerls inquiries.
Advised that Oro Planning Board have recommended to Council for consideration,
passage of the draft Zoning By-law to implement Amendment No. 12 to the
Official Plan as prepared by Ainley & Associates, and further advised that the
draft By-law would be in a form ready for consideration by Council within the
next few weeks. Also advised that a draft By-law to amend the Township's
previous zoning By-laws currently in force, being By-law No. IS 1031,
1097, 1140, 1143, 1144 & 1166 from Imperial to Metric Units was in preparation
and should be ready for passage at the next meeting, Planning Board having
reviewed same.
The Chief Building Official was again present at 2:00 p.m. to discuss the
matter of amending the Township Building By-law with respect to permit fee
schedule and the preparing of an appropriate By-law to authorize same. Also
the matter of including the Ontario Plumbing Code in the same By-law.
After consideration the following action was taken.
On motion of Smith and Swainson that the estimated value be based on $25.00 per
square foot for residential and commercial buildings (increase from $20.00
to $25.00) and that rate to be charged for the permit fee be based on $10.00 for
the first 1,000.00 value and $4.00 per thousand or portion thereof, thereafter
(increase from $3.00) and that an Agricultural Permit fee be raised from
$10.00 to $15.00.
The matter of incorporating the Plumbing Code was next discussed and considered
with the following action.
On motion of Sanderson and McLean that the basic plumbing fee of $5.00 plus
$2.00 per fixture be set when the Ontario Plumbing Code is incorporated in the
Township Building By-law.
On motion of McLean and Sanderson that a $5.00 inspection hook-up fee be charged
prior to approval of the connection to the municipal water system and that
this fee be collected when the Building Permit is issued.
Road Supt. Fred Haughton was present at 1:40 p.m. with regard to various matters
concerning roads and road equipment.

The matter of tires for the A. C. Loader for th.e Waste Dis.pos,al Site was
discussed.

On motion of McLean and Swainson that the Road Supt. be authorized to obtain
prices for four new steel belted tires for the A.C. loader.
On motion of Sanderson and Smith that a letter be forwarded to the Ministry
of Transportation and Communications to enquire whether the Ministry would
agree to a long term lease and rental fee for the existing salt storage
shed in Lot 16, Concession 14, or alternatively a sale price of the portion
of the property where the storage shed is situated, including the shed.

. On motion of Sanderson and McLean that correspondence, communications, etc.
as presented be received and placed on file.
Presented letter from Secretary-Treasurer, Oro Agricultural Society, requesting
Council's approval of a Municipal Grant to help finance the 1980 Fall Fair,
and advising additional programs proposed for 1980. Also proposals to install
additional lighting on the grounds and in the school fair cattle barn as well
as planning to install a water line to the barn. Letter also requests the
use of the 3 bays of the garage again in 1980 from Wednesday, September 24th
to Saturday the 27th.
On motion of McLean and Swainson, Oro Council again authorize a grant to the
Oro Agricultural Society in 1980 to an amount of $900.00 and that the three bays
of the garage will be available again this year for the fair from Wednesday
evening September 24th through Saturday, September 27th, and further that all
necessary arrangements in this regard be made with the Township Road Supt.
Fred Haughton.
Presented letter from Chairman, Kempenfelt Bay District Boy Scouts advising
that they will again be holding a "Trees for Canada" fund raising project
and requesting permission for the boys to canvass the public in the Township.
On motion of Sanderson and Swainson, Oro Township Council would have no objection
to the Boy Scouts project for "Trees Canada" canvassing within the Township
of Oro.

Mr. Glen McLinton from the Adult Occupational Centre was present at
3:15 p.m. at Council's request with respect to garbage collection at the
centre.
Mr. McLinton presented a letter setting out the number of stops required
for garbage collection in the Adult Occupational Centre showing:
17 staff residences
60 resident & office occupied houses
15 commercial buildings requiring 9 pick-up areas

After discussion and review it was left that the Clerk was to contact
Browning-Sanders and advise of the number of pick-ups and the matter
of having only the staff occupied houses and commercial buildings being
pick-up twice per week and the remaining 60 homes only once per week.
Also that Mr. McLinton is to further investigate what form of assistance
may be received in lieu of payment for the 60 homes and commercial buildings.
He was also to advise whether it would be agreeable to just have twice
a week collection for the 17 staff occupied homes and commercial buildings.

Presented letter from Aggregate Supervisor, Geotechnical Section, Ministry
of Transportation & Communications advising of contract to be called
for the grading, drainage, granular base, paving and structures on #400
Highway from 0.2 miles north of #93 Highway for 10.5 miles including 4
structures. And, service road east side of Highway 400 from No. 93
Highway northerly for 1.5 miles and from County Road #19 southerly for 0.8 miles
In connection with this contract an Aggregate Sources List indicating to the
bidders potential sources for gravel extraction are being prepared and
10 pit sites are listed in the Township of Oro. Letter requests Council's
comments with respect to including the mentioned pits in the proposed
Aggregate List.
On motion of Smith and Sanderson, Oro Council would have no objection to the
mentioned pits being included in the Aggregate Source List except for
H. Wrigley pit, Lot 21, Conc. 13, but would request a meeting with the
successful bidder and a representative from the Ministry of Transportation
and Communications to obtain assurance that the necessary provisions will
be included to provide for dust control, special speed limit of trucks
using the Township roads to the pit or pits, as well as essential provisions
for school bus routes on the roads involved with respect to safety for
the children.
Presented notice from the Assessment Review Court advising that a Court will
be held at the Oro Township Council Chambers on Monday, April 14, 1980 from
9:30 a.m. to 4:30 p.m.
On motion of McLean and Swainson, notice be received and Clerk to have the
Council Chambers prepared and available for this purpose.
Presented memorandum from the Hon. James Auld, Minister, Ministry of Natural
Resources with respect to IIpreparation to Deal with Flood Emergencies and
Flood Contingency Plans."

On motion of Sanderson and Smith, memorandum be received and filed for reference.
Presented letter from Regional Municipality of Ottawa-Carleton with respect to
Symbolic Traffic Signs Public Education and copy of resolution passed by the
Council of the Regional Municipality of Ottawa-Carleton at a meeting held on
February 27, 1980 reading -
"It is recommended that both the Council of the Regional Municipality
of Ottawa-Carleton and the Munic. of the City of Ottawa forward
a resolution to the Province of Ontario requesting that:
(a) As many recent amendments have been made to the Highway Traffic
Act to replace worded message traffic signs with symbolic signs,
it is therefore recommended that the Province of Ontario undertake
an extensive education programme to inform all motorists of these
recent amendments, and
(b) the aforementioned resolution be circulated for support to all Ontario
Municipalities, Regional Municipalities, the Municipal Liaison Committee,
and the Ontario Traffice Conference".
Letter also enclosed copy of Transportation Committee Report No. 4/80 and requests
that the Regional Municipality of Ottawa-Carleton be advised of Council's action.
On motion of McLean and Swainson, letter and resolution as presented be received
and placed on file with no action taken.
Presented letter, publications and questionnaires from the Ministry of Natural
Resources, in respect to the Copeland Forest Resources Management Area, and advising
of Information Drop~In Centres to be held on March 8 and 15, 1980 at the
Craighurst Community Hall.
On motion of Sanderson and Swainson, that correspondence be received and placed
on file, publications and questionnaires distributed to members of Council.
Presented letter from B. Evans, Supervisor of the Canada Employment Centre for
students, Barrie, regarding the 1980 summer program, requesting participation.
On motion of Sanderson and Smith, that correspondence be received and placed on file.
Presented letter from Wood, Gundy Ltd., in regard to a serial debenture financing
alternative in 1981 as a means of cost savings, based on the assumption that
current interest rates will be down during the 1981 period.
On motion of Smith and Sanderson, that correspondence as received be placed on file.
Presented letter from Canadian Books in Print, University of Toronto Press,
requesting information from the Township as a Canadian Publisher Listed, of titles
published to date.
On motion of Sanderson and McLean, Clerk-Administrator to complete and return
questionnaire as forwarded.
Clerk presented copy of letter from President, Association of Municipal Clerks
and Treasurers of Ontario as contained in the Municipal Monitor requesting Councils
administrative employees support in authorizing the attendance of appointed officials
at future meetings of the Association, both Zone and Annual Conference.

On motion of Swainson and McLean that the Clerk-Treasurer and/or Deputy Clerk
Treasurer be authorized to attend the Zone Meetings and th_e Annual Associati.on
Conference.
Presented letter from Stewart, Esten, Solicitors advising of disbursements
on several files of the Township and requesting remittance of same.
On motion of McLean and Smith, that Stewart, Esten be contacted and request that
an itemized statement showing disbursements apportioned.
Presented registered letter from John D. Burgar (Owen, Burgar), Solicitors
for Mr. & Mrs. Barry Kenter and Bradley Kenter with respect to the Accident
between their vehicle and Township truck and snowplow, advising th~t a claim
will be made on behalf of his clients for damages arising out of the aforesaid
collision. .
On motion of McLean and Smith that copy of letter be forwarded to Township
Insurance Agency.
Presented letter from Family and Children's Services of Simcoe County (incorporated
as the Children's Aid Society of Simcoe County) requesting the us.e of Oro
Memorial Park for their Annual Children's Picnic on July 9, 1980 or alternatively
should it rain on that day, would like to hDld it on July 16, 1980.
On motion of Sanderson and Smith, that the Family and Children's Services of
Simcoe County be advised that Oro Council would again be prepared to accept the
fee of $10.00 and that the Memorial Park will be reserved for July 9th and provision
made for July 16th, should the weather not permit the picnic to be_ held on
the 9th due to rain.
Mr. Terry Hehn of Green, Fleming, Rolland and Company, the Township Auditors,
was present at 4:50 p.m. to present the Township of Oro Fi.nancial Report for
1979, as audited. Mr. Hehn reviewed the Financial Statement and answered questions
of Council regarding same. Copy of statement for publication was also presented.
On motion of McLean and Smith that the Financial Statement and necessary financial
information return as presented by the Auditor and revi.ewed with Council and
Treasurer to forward duplicate copy of the 1979 Financial Information Return
to the Ministry of Intergovernmental Affairs as required. And that the audi.t
fees, when received from the Auditors be presented for payment. And, Clerk
instructed to have statement for publication placed in the local papers.
Reeve Campbell thanked Mr. Hehn for his presentation and explanation and asked him
to remain to answer some questions that the Hawkestone Police Village Trustee
might have.
Mrs. D. McKenzie, Trustee Hawkestone Police Village and Mrs. R.Fallon, Secretary
for Trustees, was present on behal f of the Trustees, Hawkestone Pol i.ce Vill age
in response to the letter forwarded advising of the Township agreement to
reduction of the General Mill Rate for the ratepayers of Hawkestone Police Village
in 1980.
Mrs. McKenzie again approached Council behalf of the Trus.tees and requested Council
consider a further reduction of the General Mill Rate to include the cost of the
street lights and presented formul as of 1 evy and benefits and express:ed the concern
of the Trustees that the Village Ratepayers were contributing larger amounts to
the Township than other areas.

As a result of the discussion Mrs. McKenzie was advised that Oro Council are not
prepared to reduce the General Mill Rate by a greater amount than 3 mills as
per resolution of the meeting held on March 4, 1980.
On motion of McLean and Smith, adjourn to meet again on Wednesday, March 19th
at 1:00 p.m. to complete the business scheduled for this meeting.
