12 31 1979 Council Minutes . . . pg. 328 COUNCIL CHAMBERS - DECEMBER 31, 1979 THIRTIETH MEETING Council met pursuant to adjournment for the last meeting of 1979, with all members present. Reeve Howard A. Campbell in the chair. The minutes of the last regular meeting of Council held on December 17th were on motion of Sanderson and McLean confirmed as printed and received. Presented copies of letters forwarded from the last regular meeting as instructed to: Ministry of Transportation and Communications advising of tenders received for ~ ton truck and acceptance of the tender of Reg Smith Motors Ltd. and copy of letter to Reg Smith Motors Ltd. advising their tender had been accepted; also copies of letters to unsuccessful bidders; Morris Douglas, Eric O'Brien, Juanita Hanney and Andrew Nicholson advising that their applications to issue licences had been accepted and advising that each one come to the office to pick up the necessary supplies; C. Wallace Key advising he will be appointed as member of Committee of Adjustment and to John Vokes advising of same; Copy of letter to David Wororika advising his application to serve on Oro Planning Board was accepted and he will be appointed as a member; Thelma Halfacre advising that she will be re-appointed to Oro Planning Board and copies to Steve Davie and A. G. Pautsch advising them of Council's appointments to Planning Board and expressing Council's appreciation for their interest; Ministry of Housing with respect to extension of Draft approval of the Guthrie Industrial Park, part lots 21 and 22, Concession 5, advising that Council support an extension of one year, with copies of letter to Skelton, Brumwell and Associates Ltd~ and Ray Campbell; Stewart, Esten, Solicitors re: Township of Oro vs. L. J. Torpey returning copy of statement of claim advising that same would appear to comply with Engineer's Report and Subdivider's Agreement; Orillia Packet and Barrie Examiner requesting notice to be placed in one issue regarding next meeting of Council to be held on December 31, 1979 and garbage collection for holiday season in designated areas; Corporation of the Town of Oakville advising that Oro Council support their resolution regarding transportation of hazardous materials; Shanty Bay Community and School Centre forwarding copy of revised calculations for application of Wintario Grant; County of Simcoe forwarding application of Wolf Bounty for Frederick Tews. On motion of McLean and Smith, copies of letters as presented and forwarded accepted as satisfactory and ordered placed on file. Presented letter from Supervisor Planning Administration, Ontario Municipal Board, advising the Board had assigned the file no. R-794076 to the Partial Referral of Amendment No. 12 to the Official Plan for the Oro Planning Area on behalf of the Township of Ora and others. Also acknowledging Hearing fee in accordance with Section 15 of The Planning Act. On motion of Swains on and Sanderson, letter as presented accepted and be placed on file and O.M.B. advised that Council would prefer that Amendment No. 12 Hearing be withheld until the Zoning By-law for same has been prepared and circulated in order that both may be heard at the same time. pg. 329 THIRTIEl'H MEEl'ING (Cont'd) DECEMBER 31, 1979 . Presented copy of letter from R. W. McArthur, P. Eng., Ainley and Associates Ltd. to Stuart N. Keyes and Associates Ltd., forwarding 2 copies of drawing #79429-1 showing proposed sewage disposal system for Lot 24, Plan 882. Letter requests comments and/or approval of the plan enclosed, so that application can be made to the Ministry of the Environment for the approval of the sewage works. On motion of Sanderson and McLean, copy of letter as presented be received and placed on file for reference and until further information is received from the Township Engineer or Ainley and Associates Ltd. Clerk advised that further to Council's consideration at the last regular meeting of Oro Council of the resolution of the Oro Library Board suggesting a user fee to assist in paying costs of the service as is to be charged by Barrie and Orillia Public Library Board in 1980. Ministry of Culture and Recreation had been contacted by telephone and the Ministry had advised that the Township could legally charge a user fee since the Township of Oro was obtaining services from the cities of Orillia and Barrie. . On motion of McLean and Smith, that in accordance with the suggestion of Oro Township Library Board a "user feet! be established in 1980 for persons from Oro Township using Barrie and Orillia Public Libraries at a cost of $5.00 per user of the service, in accordance with the Public Libraries Act. This fee is to be collected by the Township of Oro before a person is entitled to receive a new card at either of the Public Libraries, (Barrie/Orillia) or have their membership renewed. And further, that a notice to this effect be forwarded to all families that were users of the Library Service in 1979 and a notice also be placed in both the Barrie Examiner and Orillia Packet. Presented letter from Ministry of Housing, Project Co-Ordinator, Community Housing, advising of the outcome of the meeting with this division of the Ministry and the City of Orillia and enclosing copy of minutes of the meeting. On motion of Sanderson and Swainson, letter as presented be received and filed and since both the City of Barrie and Orillia have indicated some receptiveness to enter into Agreements with neighbouring Municipalities, contact be made with both cities and should they desire to draft agreements in this regard, the Township of Oro would be prepared to review or discuss such agreements. And further, should either or both cities deem it advisable to hold meetings in this regard same be arranged. Clerk reported that Paul Gleason, P. Eng., Reid and Associates Ltd. had telephoned to advise that he had requested Hastings Electric and the electricians who had completed the first well on Plan M-66, to submit quotations for the electrical work on the second well and that this quotation is to be forwarded to the Township of Oro for consideration. And, that once a quotation is accepted the contractor is to complete the work and contact Mr. George Snider to attend when the pump is ready to be started. Also presented copies of letter to contractors requesting quotations to be received by the Township of Oro by 12 o'clock noon on Monday, January 7, 1980. . On motion of Smith and Sanderson, report and copies of letters accepted and quotations to be presented for consideration at the next regular meeting. . . . THIRTIEI'H MEETING (Cont'd) DECEMBER 31, 1979 pg. 330 Presented letter from the Hon. James Snow, Minister, Ministry of Transportation and Communications with respect to proposed interchange at the 9th Line and additional subsidy funding for paving of 15/16 sideroad. Letter advises that after a traffic study has been made in the summer of 1980, he will be able to make a decision regarding the need of an interchange at Line 9. The Ministry staff have now reviewed the need for work on 15/16 sideroad and it is agreed that the box beam construction on No. 11 Highway has changed the traffic pattern on the Township roads, in view of this the Minister is prepared to fund the Township through normal subsidy over a two or three years the cost of grading and application of granular base on the sideroad. Following this basic construction, the Ministry will enter into a Special Agreement to cost share the pavement at 80% with the remaining 20% to be paid by the Township. On motion of McLean and Smith, letter be received and Road Committee and Road Supt. to prepare a necessary program for the grading and granular base of 15/16 sideroad on a two or three year basis, and a reply be forwarded to the Hon. Minister requesting that he reconsider the construction on the same basis as the pavement at 80,%, since basing the construction under normal subsidy would take funds from normal works to be carried out on other Township roads. Presented copies of letters from Skelton, Brumwell and Associates Ltd. to Subdivision Branch, Ministry of Housing, with respect to request for extension of draft approval for Melville R. Hastings Subdivision and also for the extension of draft approval for the Guthrie Industrial Subdivision, part lots 21 and 22, Concession 5. On motion of Sanderson and Swainson, copy of letters be received and placed on file for reference. Presented invoice from Thor Motors Orillia (1978) Ltd. for one 1980 - LBOOO Ford Truck, Serial Number 81VVGJ7230 as per tender specification, for a total delivered price of $45,881.60 including O.R.S.T. On motion of Smith and Swainson, cost of the 1980 Ford Truck, equipped as per tender specifications be applied to the December Road Accounts. Presented copy of By-law No. 1979-37 passed by the Township of Orillia to designate the Town Line from No. 12 Highway south to Bass Lake as a through road to coincide with the Oro Township By-law No. 1195. On motion of Sanderson and McLean copy of By-law No. 1979-37 passed by the Township of Orillia designating the Town Li~e from Highway No. 12 to Bass Lake as a "through road", be received and placed on file. Presented copy of letter forwarded to D. S. White of Stewart, Esten enclosing report of the inspection carried out by the Township on the property of York Sand and Gravel Ltd. along with photographs taken, requesting comments regarding same. Clerk advised that Mr. White had by telephone advised he would be present before Council today at 10:00 a.m. to discuss the matter with Council. Mr. D. S. White and Gary Luhowy were present before Council to consider the matter at 10:00 a.m. to discuss the next steps that Council should consider. Mr. D.S. White advised that Council's course should be in the direction of . . . pg. 331 THIRTIETH MEETING (Cont' d) DECEMBER 31, 1979 re-zoning the proposed "M-l" zone, as shown on Plan 51R-7636 to Agricultural "A". Mr. White suggested that Mr. Vernon of York Sand and Gravel should be put non notice" to this effect and that the notice be for a reasonable period of time. On motion of Sanderson and Swains on that further to consideration with the Township Solicitor the findings of the site inspection carried out on December 10, 1979 Council hereby instruct the Township Solicitor that York Sand and Gravel be put "on notice" that the Township of Oro propose to zone the lands shown on Plan 51R-7636 as Industrial "Ml" to Agricultural "A", should all equipment not be moved as required under the Agreement registered as Instrument No. 672454 within 15 days of receipt of the notice. And further, that the letter of credit be drawn upon to cover all costs of the re-zoning. A draft By-law to appoint Fred V. Haughton as Township Road Supt., effective January 1, 1980 was for Council's consideration and action. After consideration of the BY-law as presented, the following action was taken: On motion of Sanderson and McLean, a By-law to appoint Frederick V. Haughton as the Road Superintendent for the Township of Oro was introduced and numbered as BY-law No. 1199, and read a first time. On motion of Smith and Swainson, By-law No. 1199, read a first time, be read a second time. On motion of McLean and Smith, By-law No. 1199 read a second time be read a third time. On motion of Swainson and Sanderson, By-law No. 1199 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve and Clerk to forward a certified copy to Ministry of Transportation and Communications and a copy be presented to Fred V. Haughton. Clerk advised that this had been prepared and forwarded to the County to a total amount of $3,942.62. On motion of Sanderson and Swainson, letter be received and placed on file and the report of forwarding the amount required be accepted. Presented letter from City of Barrie, requesting a meeting with Oro Council as soon as possible to discuss the City's plans for a proposed airport in the Township of Oro. Letter further advises that the meeting could either take place in the City of Barrie or in the Township. On motion of Sanderson and Swainsonf letter be received and Clerk to advise that the Township would be prepared to meet with Barrie Council at the Oro Township Council Chambers on either Thursday, January 10th or January 24th at 8:00 p.m. And further, that this meeting be a closed meeting not open to the 4It public or press. ..... .......... pg. 333 THIm'IETH MEETING (Cont'd) DECEMBER 31, 1979 . Presented letter from James E~ Domm, owner of part of broken Lot 27, Concession 9, in Concession 8, the property being at the foot of the Bth Line. Letter requests an inspection and action with respect to actual damage to property and potential danger to pedestrians when vehicular traffic travelling in the direction from the 7th Line to the 9th Line rounds the sharp corner at the bottom of the 8th Line where his property is located. Clerk advised that a copy of the letter had been presented to the Township Road Supt. On motion of McLean and Sanderson, letter be received and Clerk to reply and advise that the Road Supt. and Road Committee will investigate the matter of erecting modern type reflectors. Presented letter from owner of Caribou Restaurant further to being approached by the Road Supt. with respect to snow removal from the Township Office parking lot. Letter advises that snow will be removed when it exceeds one inch in depth at the rate of fifteen dollars ($15.00) per hour with a one-half hour minimum. Also further that the snow would be removed not later than 7:45 a.m. on normal business days Monday - Friday and on request. On motion of Sanderson and Smith, that the services of A. C. Laughlin of Caribou Restaurant and Motel be retained for the removal of snow from the Oro Township Office parking lot at the rate of $15.00 per hour, with a half hour minimum. Presented letter from Kiwanis Club of Barrie extending an invitation to the Reeve and Council together with the Clerk to "Civic Night", a dinner meeting of the Club on January 14, 1980 at the Holiday Inn. Letter requests confirmation . of attendance. On motion of Swainson and McLean, Clerk to advise that four persons will be attending from the Township of Oro. Presented from Ainley & Associates Ltd., Consulting Engineers, invoice for engineering fees on Municipal Drain Hwy. No. 11 in Concession 11. To a total payment of $1,522.32. On motion of McLean and Smith, that the invoice to a total of $1,522.32 be paid. Presented Notice of Renewal of Licence for Land Exterminator ClaffiI for Fred V. Haughton, which expires on January 16, 1980. On motion of Sanderson and Swainson, that the Licence for Land Exterminator Class I for Fred V. Haughton be renewed and Treasurer authorized to issue a cheque in amount of $10.00 for same. Presented letter from Roger Staig, on behalf of the Village Green Association, Shanty Bay, requesting that an additional street light be added to the Shanty Bay Street light system, namely on Church Street near the Church entrance in order to reduce vandalism as well as to provide better access to the Church entrance. Letter seeks Council's approval and would request Council to advise Ontario Hydro, Barrie Area, to instal the additional light on hydro pole in the desired area. . McLean be appointed as the member from the Township of Oro to the Nottawasaga Valley Conservation Authority for 1980. After consideration of appointments to Oro Planning Board and Committee of Adjustment the following action was taken: On motion of Sanderson and Smith, that the members to Committee of Adjustment to be appointed by By-law are: John Vokes - three year term to expire January 1, 1983 Delno Jermey - balance of three year term expiring January 1, 1982 C. Currie presented his report for work done during the month of December with Voucher 12 and 12A to cover same. On motion of McLean and Smith, report of Road Supt. Currie as presented accepted as satisfactory and Treasurer authorized to issue cheque in payment of same to a total of $76,165.50. Road Supt. Currie presented plans from Bell Canada for buried cable in Concession 3. On motion of Sanderson and Swains on , plans from Bell Canada as presented and approved by the Township Road Supt. be received and placed on file. The Chief Building Official, James Shellswell was present before Council at 1:00 p.m. with respect to building permit issued to L. Kovacs, Lot 11, Concession 2, for an agricultural building and a residence. He advised that it now appears that Mr. L. Kovacs is now occupying part of the agricultural building as temporary living quarters. On motion of Smith and Sanderson, that the Chief Building Official to make a complete investigation of the situation and report back to Council at the next regular meeting. Presented copy of letter to Treasurer County of Simcoe forwarding application to the County of Simcoe for rebate of sums paid for fox bounties by the Township of Oro in 1979. The application being for four fox at $4.00 each to a total of $16.00. On motion of Smith and Sanderson application as presented and forwarded accepted as satisfactory and ordered placed on file. Presented copy of application for wolf bounty for one wolf trapped by George Langman, as forwarded to County of Simcoe for payment of the bounty. Presented from Donald and Margaret Simspon a letter of objection to the proposed Barrie Airport and opposing the construction of an airport in the Township of Oro. The appointment of Committee of Council for 1980 was next considered and discussed, following which the Reeve appointed members to serve on the various Committees with first member being Chairman of that Committee.
