Minutes The minutes of the last regular meeting of November 21, 1983 were on motion of Halfacre and Johnson, confirmed as printed and received. On motion of Drury and Halfacre, letter be received and placed on file for reference as required. Presented from the Royal Bank of Canada, Ontario International Centre, amendment to Letter of Credit for Jo-Con Developments reduction of $68,500.00 to $36,500.00 (expiry date and conditions remaining the same) Juergen Kretzschmar (Black Forest Estate reduction by $39,700.00 to $11,600.00 - as authorized by Council. Leo Contracting (Windfield Estates) reduction from $322,100 to $137,000. Quadrant Developments Ltd., reduction by $25,000 to new balance of $30,000. On motion of Halfacre and Johnson, Letters of Credit as presented for Jo-Con Developments as reduced to $36,500 and Juergen Kretzschmar to $11,600 and Leo Contracting (Windfield Estates) as reduced to $137,000 and Quadrant Developments reduced to $30,000, received and appended to respective Letters of Credit. Presented letter from Adjusters Canada Inc. regarding Accident September 30, 1983, insured vehicle for Collingwood Sand & Gravel, advising that no response had been received from their letter of October 6, 1983 with respect to involvement of Township Grader contributing to the cause of the accident on Line 4, by making a U-turn. Total damages to insured vehicle being in the amount of $6,049.65. Clerk advised that the letter of October 6, 1983 had been forwarded to Township Insurance Company. On motion of Johnson and McEwen, letter from Adjusters Canada Incorporated be received and for- warded to Township Insurance Company for their attention and action. Presented letter from the Hon. Claude Bennett, M.M.A.H. and Margaret Birch, M.P.P., Parliamentary Assistant to the Premier and Chairman Cabinet Committee on the Bicentennial, advising that the more than 675 Municipalities which are participating in the Community Grants Program, plans for 1984 are gathering momentum quickly. Also enclosed with the letter a 3 x 6 foot flag incorpora- ting the Bicentennial symbol, which is presented to Council with compliments of the Cabinet Committee. Suggesting the planning of a special ceremony at the beginning of the New Year when the flag is raised for the first time and that some Councils are holding levees to usher in the Bicentennial Year. Information attached may be helpful in considering organizing a levee. On motion of McEwen and Halfacre, letter, levee information and the 3 x 5 foot Bicentennial flag be received and further consideration be given to the raising of the Bicentennial flag for the first time on January 4, 1983. . . . Pg. 302 TWENTY-FIFTH MEETING DECEMBER 5, 1983 Presented letter from Greer,Flemming,Rolland & Co., Township Auditors, setting out Proposal to implement BACPAC in accordance with BACPAC checklist attached as "Appendix 'A' to the Agree- ment between the Municipality and the Province of Ontario. The estimated costs for this service being $2,500.00, fees and services, which fees and charges are eligible under BACPAC Grant. As previously approved, the following items are eligible under BACPAC to a total of $5,000.00. Also presented the Agreement including the Auditors Proposal as Appendix 'B'. Auditors Proposal Support Hardwares Computer Software $2,500.00 1,500.00 1,000.00 $5,000.00 On motion of Drury and Halfacre, the Proposal from Auditors, Greer,Flemming,Rolland & Co., to implement BACPAC in accordance with BACPAC checklist in Appendix 'A' to the Agreement between the Township of Oro and the Province of Ontario, as presented, be accepted for the estimated cost of $2,500.00 and same be attached to Agreement as Part of Appendix 'B', upon being signed by the Reeve and Clerk. Also that the Agreement as now completed be signed by the Reeve and Clerk on behalf of the Corporation of the Township of Oro. Presented letter of application under Municipal Action '85, Municipal Management Systems Computer Acquisition, including necessary attached documentation. On motion of Drury and McEwen, letter of application under Municipal Action '85, Municipal Management Systems - Computer Acquisition, including necessary documentation as attached, ac- cepted as satisfactory and Clerk to forward same. Recommendation of Committee of Council Engineering Standards On motion of Drury and Halfacre, that as recommended by Committee of Council, after review with Road Supt., the Draft Engineering Standards for Roads as prepared by Ainley & Associates Ltd., with the amendment for Cul-de-sac, be accepted as the Engineering Standards for Roads for the Township of Oro. Purchase of property for Road widening Lakeshore road (Con. 7) On motion of Johnson and McEwen, that the Township Solicitor, D.S. White, Q.C. be authorized to complete the Agreement for land purchase from Mr. & Mrs. Rudolph Jassoy and close the Transaction. And further, that a cheque in the amount of $835.00 for the purchase price of the land and $125.00 for the preparation of the closing to a total amount of $960.00 be for- warded to the Solicitor. C.N.R. Crossing at Lines 4 & 5 - letter of November 13, 1983, received, Nov. 23, 1983 with 33 signatures, presented to Committee of Council on November 30, 1983. On motion of Johnson and Drury, that as recommended by Committee of Council the Road Supt. to contact the C.N.R. Roadmaster regarding the crossings at lines 4 & 5, Township of Oro and that a copy of the letter signed by a number of ratepayers using the crossing expressing their concerns, be forwarded to the C.N.R. Roadmaster. On motion of McEwen and Halfacre, that a letter be forwarded to CTC requesting progress of installation of signal lights, Range 1. . . . Pg. 303 H MEETING - DECEMBER 5 1983 Representatives from the Ministry of Natural Resources were present at 11:00 a.m. as scheduled on the Agenda at request of Council with respect to increase of damage to Live Stock by Wolves. Present from M.N.R. Mr. Alex Smith and Mr. Richard Toth. Mr. Toth first related the Ministry's Work Shops on Predator Control and amendments to the Act. Also that the Ministry have three people on staff to assist in dealing with wolf or coyote control. He also indicated that the predator at times could be questionable, since German Shepards could kill identically in the same manner. It was brought to the attention of the representatives that in all cases of kills in the past s, the predator was either seen, caught in action and in two cases, shot. Mr. Smith explained in some detail the comparison of what is referred to as wolves to be coyotes, more comm ly referred to as Brush Wolves, very few Timber Wolves in this area. Mr. Toth indicated that no evidence is available that paying a bounty adds to the predator control. At present, 8 Municipalities in Simcoe County pay a bounty as well as the County. Council were also advised that the Ministry when requested, carry out a predator control pro- gram where wolves are a problem. Reeve Davie thanked the representatives for attending a meeting of Council to familiarize Council with present Ministry programs for predator control. Information Orillia On motion of Halfacre and McEwen, as recommended by Committee of Council, Oro Council authorize financial support to Information Orillia in the amount of $100.00, should the representative be able to attend the International Exposition of Rural Development, by having a successful fund drive to meet the required amount of $6,000.00. Carried On motion of Halfacre and Drury, Council go into Committee of the Whole at 10:10 a.m. to consider the matter of proposed Hospital Site. On motion of Halfacre and Johnson, that Council come out of Committee of the Whole at 10:24 a.m. J. Ross Raymond & Associates Ltd - re: proposed site for new Royal Victoria Hospital. On motion of Drury and Johnson, that J. Ross Raymond & Associates Ltd., be advised that Oro Council would have no objection to the proposed site at Georgian Drive and Duckworth Street, subject to the Township of Vespra having no objection to the site. And, provided Oro Council will have the opportunity to review all studies pertinent to the site selection and site plans of the proposed site. icultural Societ - request for assistance with newsletter On motion of McEwen and Drury, that as recommended by Committee of Council, the Oro Township Horticultural Society be advised of Council's opinion to the newsletter preparation and that Council would be prepared to consider a grant amount during Budget preparation rather than entertain the preparation of a newsletter. ~ . . . ~ Pg. 304 TWENTY-FIFTH MEETING - Oro Lions Club proposal to purchase land for Recreational purposes On motion of Drury and Halfacre, as recommended by Committee of Council, a letter be forwarded to D.S. White, Q.C. Township Solicitor advising that the Council of the Township of Oro is prepared to accept title of the property the Oro District Lions Club propose to purchase from Leonard & Pearl Comming, part, W~ Lot 20, Concession 5, subject to the restrictive Covenant in the Agreement to Purchase. And, that the Township of Oro are prepared to contribute an amount of $2,672.55 towards the purchase of the lands for the portion shown for auxilliary uses such as parking or other Municipal purposes. Employee Holidays - Christmas & New Years On motion of Johnson and Drury, that the employee holidays for Christmas and New Years be: Roads December 26 & 27th for Christmas December 30th for New Years (Road employees authorized the week of December 26th to 30th, subject to road conditions _ all employees on call if required) Other Staff December 25 & 27th January 2nd at Christmas for New Years The Chief Building Official was present at 11:30 a.m. to present his report for the month of November, as follows: There were 18 building and 3 plumbing permits issued with a breakdown as follows: 3 residences at a value of 5 additions at a value of 2 alterations at a value of 2 chimneys at a value of 2 accessory buildings at a value of 1 commercial at a value of 1 agricultural at a value of 1 institutional at a value of 1 moving 151,940.00 48,100.00 8,000.00 6,000.00 11,000.00 30,000.00 4,500.00 39,000.00 $298,540.00 Money received for permits Value of permits for Nov/82 $ 1,396.00 461,800.00 On motion of Drury and Halfacre, report of Chief Building Official as presented accepted as satisfactory. Chief Building Official brought forward the matter of cost of Building Permit for Fudas Expansion and request from Fuda for basis of fee for the permit. Present, representing Fuda's was the project manager, Juluis Vajda and Store Manager, Ron Ross. Mr. Vajda presented their plea to Council on basis that the building program is a job creation program assisted by the Government. Since all internal plans are not complete, the winter plan is to erect a shell for the building. Although total cost of the building based on Township By-Law fee rate is approximately $489,000.00, material only, is approximately $250,000.00. After consideration, Council passed the following resolution: . . . Pg. 305 TWENTY-FIFTH MEETING On motion of Drury and Halfacre that the Chief Building Official to treat the Building Permit application and fees for the Fuda expansion according to same requirements for any Building Permit application. Chief Building Official reported on his attendance at a Building Code Seminar at the Continental Inn on December 1, 1983 along with the Deputy Fire Chief. He also advised of a further Seminar on the new section of the Building Code to be held on December 13, 1983. On motion of Halfacre and Drury, that the Chief Building Official be authorized to attend a further one day Seminar at the Nottawasaga Inn on December 13, 1983 and that the registra- tion and mileage to attend be paid by the Municipality. Road Supt., Fred Haughton, was present at 1:10 p.m. to present his report for work done for the month of November and presented Vouchers 11 and llA to cover same. On motion of Johnson and Drury, report of Road Supt., as presented for expenditures during the month of November accepted as satisfactory and Treasurer authorized to issue cheques in payment of same to a total of $78,429.50. Planni The Planning Administrator was present at 1:30 p.m. to reVIew planning and development matters. The following was presented: Advised that the Langman subdivision on part of lots 5 & 6, Concession 14, had been released for registration by the Ministry of Municipal Affairs & Housing. Presented Oro Planning Advisory Committee resolutions 19B3.2.3 and 2.4. On motion of Halfacre and Drury, that Council concur with the recommendations of the Planning Advisory Committee to re-designate and re-zone part of Lot 26, Concession 5, the lands owned by Mrs. S. Chew, to permit the re-establishment of a convenience retail outlet, as set out in Development Application P9/83. On receipt of the standard developers deposits, Planning Administrator to arrange for preparation of the necessary Official Plan and Zoning By-Law amendments. On motion of McEwen and Johnson, that Council concur with the recommendations of the Planning Advisory Committee to apply to the Ministry of Municipal Affairs G Housing for a Community Planning Study Grant, to undertake a major revision of the Township's Zoning By-Law, incor- porating implementation of Amendment No. 15, the North Oro Study. Planning Administrator and Township Planning Consultants to prepare the necessary terms of reference for review prior to making application. Presented information from Carswell Legal Publications offering the volume "Letters of Credit: The Law and Current Practice", and recommendation that the same be purchased for office ref- erence. On motion of Drury and Halfacre, that the Planning Administrator be authorized to order a copy of the required reference text and Treasurer authorized to issue payment of same. Also enclosing Newsletter on the 1984 Convention to be held at the Holiday Inn, London, Ontario on January 18, 19, & 20, 1984. Also enclosing Program of the convention and Application for Membership - Municipalities $50.00 and Registration for Convention. On motion of Drury and Johnson, that letter and registration form for the Ontario Farm Drainage Association be received and filed for reference. Presented letter from the Cookstown Business Build advising of research of Commercial Develop- ment possibilities in Cookstown, which could be of value and assistance to Municipalities. The research had been supported by Federal and Provincial Grants. The final report will be completed shortly and may be obtained for $75.00, in advance. Presented letter from Simcoe County Board of education letter advising of fourth instalment of 19B3 Municipal Tax Levy for education purposes is due on December 15, 1983, after which inter- est at 13% will be charged. On motion of McEwen and Drury, that the Treasurer to issue cheque and forward same to Simcoe County Board of Education for a total amount of $543,868.00 for the final 1983 instalment by December 15, 1983. And further, that a cheque be forwarded to Simcoe County Roman Catholic Sep- arate School for the 1983 final payment to a total amount of $11,645.25. On motion of Johnson and Halfacre, that this be referred to Township Insurance Company for their attention and action. Presented from Ontario Good Roads Association letter forwarding program for Annual Convention to be held february 19 to 22nd, 1984, and Pre-registration forms for delegates. On motion of Johnson and Halfacre, that Ontario Good Roads Association Pre-registration forms for delegates to attend the 1984 Annual Convention be completed for Road Supt., Fred Haughton, Reeve, Steve Davie and Councillor Bob Drury. Presented a By-Law to assume Gowan Road, Steele Road, Patterson Road, Graham Street and William Street, being the roads within registered Plan M-66, within the Township's Road System. On motion of Johnson and Drury, that the By-Law presented be introduced, numbered 1332/83 and read a first time. On motion of Drury and Halfacre, that By-Law No. 1332/83 read a first time, be read a second time. On motion of Halfacre and McEwen, that By-Law No. 1332/83 read a second time, be read a third time. On motion of McEwen and Johnson, that By-Law No. 1332/83 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Clerk to forward certified copy to the Ministry of Transportation & Communications and to Jo-Con Developments Ltd. Road Supt. to be advised accordingly. Presented a By-Law to amend By-Law No. 1286/82, In that the description of lands contained In Schedule 'A' to By-Law No. 1286/82 was found to be defective subsequent to registration as Instrument No. 778285. On motion of McEwen and Halfacre, that the By-Law introduced be numbered 1333/83 and read a first time. On motion of Halfacre and Drury, that By-Law NO. 1333/83 read a first time, be read a second time. On motion of Drury and Johnson, that By-Law No. 1333/83 read a second time, be read a third time. On motion of Johnson and McEwen, that By-Law No. 1333/83 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Clerk to forward certified copy of same to Solicitors Graham,Wilson & Green for registration. Presented a By-Law to establish a tariff of fees for the processing of applications made in respect of planning matters and provided for under Section 6B of the Planning Act, S.O. 1983, as directed from the previous meeting of Council, reflecting the recommendations of the Plan- ning Administrator.
