05 02 1983 Council Minutes Pg. 144 COUNCIL CHAMBERS - MAY 2, 1983 . TWELFTH MEETING Council met pursuant to adjournment with all members present as follows: Reeve S. Davie Deputy Reeve J. Davie opened the meeting with prayer at 9:00 a.m. In attendance at the opening of the meeting were: Mr. & Mrs. Peter McGuire, Nick Pollock, Mrs. Shirley Woodrow, Mrs. Velma Bradley, William May, Aart Properj Maria Squire. The minutes of the last regular meeting of April 18th and Special Meeting of April 25th, were on motion of Halfacre and Drury, confirmed as printed and received,by adding to the minutes of the Meeting of April 18th, on page 131, after third paragraph, to include a motion by Johnson and seconded by McEwen, that a letter be forwarded to the Barrie Suburban Road Commis- sion and County of Simcoe Road Committee requesting that consideration be~ven to install warning flashind lights at the intersection of County Road 20 & 27, alternative steps towards three-way stop which is still to be further pursued. The motion was not put to a vote after discussion to refer the matter to next Committee of Council meeting on April 29, 1983. . Presented copies of letters forwarded as instructed from the regular meeting of April 18th, and Special Meeting of April 25th, 1983 as follows: . -M.T.C. advised of all tenders received and resolution of acceptance of tenders 83-01 to 83- 06, as well as quotation for Non-Asphaltic Dust Layer and Equipment Rental Tenders 83-07. -Letters to all firms for which tenders were accepted and letters to all unsuccessful bidders returning their tender cheques and information of Tenders received. -Champion Road Machinery Sales Ltd., advising that their tender had been accepted to supply one Champion Power Motor Grader Model 740A and letter to Truck and Tractor Equipment Ltd., (John Deere) and Crothers Ltd.,advising of tender accepted. -Chamption Road Machinery Sales Ltd. advising of acceptance to accept offer for second Model 740A Graderwithout attachments for a price of $26,800.00 plus applicable taxes according to letter of April 19, 1983 as an adjustment to offset, difficulties, problems and downtime over the period of years. -M.T.C. advising of purchase of second Grader enclosing letter from Champion Road Machinery Sales Ltd., setting out the offer. -Letter to Keith Maxwell accepting quotation to cut grass along Road Side and Township Proper- ties and schedule of payment for work performed. -D.S. On motion of McEwen and Johnson, copies of letters as presented and forwarded from regular meeting April 18, 1983 and Special Meeting of April 25, 1983, accepted as satisfactory and be placed on file for reference. . Presented letter from John Johnston, Drainage Co-Ordinator, Ministry of Agriculture and Food, Capital Improvements Branch in reply to Township letter concerning 1983 Tile Drainage Alloca- tion, which was forwarded after Council accepted Tile Drainage Loan Application from Ivan Clark. Letter advises that the 1983-84 Tile Drainage program has not been finalized, therefore no allocation amount is available and that any unused funds from previous years cannot be added to this year. Also further letter from Assistant Deputy Minister advising that the 60% maximum will be continued on total cost of Loan, however, the interest rate is in the amount of 8% (from 10% to 8%) initial allocation is equal to 1982-83 expenditure. On motion of Halfacre and Drury, that Mr. Ivan Clark be advised that as soon as the Township have been advised of the 1983 allocation, the Loan will be processed and should no other loans have been received at that time, his loan may be approved up to amount of allocation, pro- vided the loan amount does not exceed $20,000.00. Presented letter from Orillia Township enclosing copy of Orillia Township By-Law No. 1983- 17, passed on April 21, 1983, being a By-Law limitingcrle speed limit on the Oro-Orillia Town- line to a maximum of 60 kilometres per hour. Letter requests the Township of Oro pass a simi- lar By-Law with respect to the road within the Township. Oro Council having concurred with the reduced speed limit, by resolution of Council passed at a meeting held on April 5, 1983. On motion of Johnson and Drury, letter and copy of By-Law 1983-17, passed by Orillia Township Council be received and a corresponding By-Law to reduce the speed limit to 60 kilometres per hour, be brought in and introduced under By-Laws on the Agenda of this meeting. Presented letter from Ministry of Municipal Affairs & Housing confirming 1983 Listing of Capacities for Designated Institutions, Section 160 of the Municipal Act. Institution Ministry Capacity Amount . Adult Occupation Centre Community & Social Services 258 @ 50.00 $12,900 Pg. 146 TWELFTH MEETING - MAY 2, 1983 . On motion of McEwen and Halfacre, letter confirming the Adult Occupational Centre per bed rating at 258 which at $50.00 per bed, authorizes an amount of $12,900, be received and ap- plied to reduce the Levy for the Township of Oro and the County of Simcoe. And, further, that the Clerk-Treasurer forward appropriate tax bill to the Adult Occupational Centre after July 1, 1983 as directed in letter. Presented letter from Treasurer, Jarratt Community Hall Committee forwarding copy of Insurance Policy, which expires July 30, 1983, as requested by Township letter of April 19, 1983. Letter requests certain information, since she has just assumed the position of Treasurer. Also letter from Secretary-Treasurer of Guthrie Community Hall forwarding information with respect to Insurance Coverage and expiry date. On motion of McEwen and Drury, letter and copy of Insurance Policy be received and filed and Clerk to reply and forward information requested by Treasurer, Jarratt Community Hall Committee. And, Clerk to obtain further information from Secretary-Treasurer, Guthrie Community Hall Committee with respect to Insurance Policy as directed by Council. Presented letter from Clerk, Township of Vespra in response to request of Oro Council with respect to participation in proposal of a Fire Dispatch Service Agreement with the City of Barrie. Letter advises that it is the view of Vespra Township Council that there would be no immediate purpose served by bec~ming involved in Agreement with the City of Barrie for such service and that the Council do not wish to pursue this proposal. On motion Df Halfacre & Drury, letter be received and filed. . Re-presented letters from and reply to Mrs. Carol Alderdice, lot 26 & 27, Conc. 3 and Mr. S.J. DesRoaches for residents of R.P. 709, with respect to Drainage problems, which were inspected by Council while on Spring Road Tour. On motion of Johnson and Drury that this matter be left in abeyance until Road Committee and Road Superintendent report to Council on this matter. Presented letter from Mrs. Carol Harden and Mrs. Ruby Evans, R.P. 967, $ R.P. 755, with respect to boundry fence between Shelswell Park (West Boundry) and property of Dr. Shoichet. On motion of McEwen and Johnson, that the two letters be referred to next Committee of Council meeting. Presented copy of letter to Allan G. Cook Limited with respect to Wayside Pit on E~ Lot 22, Conc. 11 and copy of Wayside Permit No. 212 to open and operate a wayside pit on the aforemen- tioned property under the terms and conditions set out in the Pits and Quarries Control Act and Regulations. The permit is issued effective April 25, 1983 and expires April 24, 1984. On motion of McEwen and Drury, that all residents in the affected area be advised of the use of the Roads by Allan G. Cook Limited for hauling of material from the Wayside Pit to construc- tion Job Site at 9th line and #11 Highway orverpass. . Deputy Reeve McEwen advised that Mr. William Staines of the Community Arena Committee, Mr. Edward Robinson and Stuart N. Keyes, Township Engineer met at the Arena on Friday, April 29th, with respect to proposed seating structure. As a result, it was resolved that Stuart N. Keyes is to prepare the necessary plan drawings for the seating for which Mr. Edward Robinson will supervise the construction, labour work to be carried out under the Oro Rehab '83 program. Pg. 147 TWELFTH MEETING - MAY 2, 1983 . Councillor Halfacre advised that the Fireman and local residents of Shanty Bay are currently preparing the grounds adjacent to the Shanty BAy Fire Hall for a sports field and have ordered grass seed and fertilizer required and that the Fire Committee recommend that Oro Council authorize the purchase of grass seed and fertilizer. On motion of Halfacre and Drury, that the Council of the Township of Oro are prepared to pay up to $750.00 for grass seed and fertilizer required for the Park lands between the Shanty Bay Fire Hall and Plan M-71 (being Block "A", Plan M-71 and the Communi ty Centre lands.) Recommendations of Committee of il cons as presented to Committee of Council April 25, 1983 after further action was taken: On motion of McEwen and Halfacre, that Deputy Reeve Joanna McEwen and Councillor Allan Johnson proceed as suggested with (1) information meetings with Community Hall Committes, Community Arena Committee, Park Study Committee and Arena Manager (2) Members of Council submit names of ratepayers who may be eligible to be appointed as a member of a proposed Parks & Recrea- tion and Community Centres Committee (3) Council prepare necessary implementary By-Laws as altered, updated and agreed upon. On motion of Drury and Halfacre, that as recommended by Committee of Council on April 25th meeting the matter of retaining a firm of Engineers be considered later at this meeting under new business. No. 20 - Ton Chev. Truck On motion of Johnson and McEwen, that a notice be placed in the Barrie Examiner and Orillia Packet inviting quotations for the Road Department Chevrolet half ton truck. On motion of Drury and Halfacre, that a letter be forwarded to Mr. L. Fletcher and express Council's appreciation for his attendance at a Committee of Council meeting to review the 1983 Simcoe County Board of Education Budget and other matters of the Board. Townshi Motto On motion of Drury and Halfacre, as recommended by Committee of Council that the time for receiving Township Mottos be extended to May 6, 1983. Intersection County Road No. 20 and No. 27 (Oro Station) The recommendation of Committee of Council with respect to safety signing at this intersec- tion was again considered by Council with the following action taken: . On motion of Johnson and McEwen, that another attempt be made to arrange for an on site meeting with members of the Barrie Suburban Road Commission with respect to improved safety signing at the intersection of County Road NO. 20 and 27, which shall include the original request for three way stop signs and/or flashing lights, as soon as possible, in view of the fact that some work is presently proposed on County Road No. 27. Oro Council are of the opinion that this matter should be inlcuded in the work programmed. ....... ..... On motion of Johnson and Drury, that Oro Township Council are not prepared to make any deci- sion at this time because of lack of information and that the City of Orillia be advised ac- cordingly. Reeve Davie asked for a recorded vote. Reeve Nay Deputy Reeve Yea Councillor Yea Councillor Yea Councillor Yea Presented letters from two ratepayers, Mrs. Pat Pollock and Mrs. Gail Robinson objecting to the re-introduction of a joint Orillia-Barrie Municipal Airport and asking Council to uphold the opinion of the ratepayers of the Township of Oro and not support the proposal of an Air- port in Oro. Both letters again express their concern as presented to previous Councils. On motion of Halfacre and Drury, that the letters be filed for reference until the matter is considered as a presentation of a proposal on this matter. Presented copy of Appointment of Hearing by the Ontario Municipal Board to be held on May 24th, 1983 at 10:00 a.m. at the Boards Chambers, 180 Dundas St., West (8th floor) in the City of Toronto. Hearing is for lands in Vespra Township for the lands shown on map attached for Parts 1,2, & 3. . On motion of Halfacre and McEwen, Hearing as received and presented be received and that Staff prepare opinion and/or recommendations and that the Township Solicitor be contacted as to whether the Township of Oro should be represented at the OMB Hearing to be held on May 24/83. Presented letter from Consumers' Gas advising that the Consumers' Gas Company has made an Application to the Ontario Energy Board for an Order authorizing it to increase its rates to recover an additional $28.5 million per year. As directed by the Board, the Township is herewith served the Ontario Energy Board's Notice of Application and copy of the Appliccation. On motion of Drury and Halfacre, letter, notice of application and copy of application be received and filed with no action taken. Presented letter from the Hon. Claude F. Bennett, Minister of Municipal Affairs and Housing, forwarding the final installment of the Township Study Grant, Community Planning Grant #4, for the Official Plan Amendment completed and submitted to the Plans Administration Board for approval. The final cheque enclosed being in the amount of $9,482.61. Since the Study was completed slightly under budget estimates, the final payment has been reduced to 50% of the eligible study costs. Clerk advised that copy of letter had been presented to Road Supt., for comments. After consideration of the letter and Road Supt., report, the following action was taken: On motion of Johnson and Drury, that the letter be referred to Road Committee and Road Super- intendent for comment and further'report. Presented letter from Mr. A.J. Brown, owner of lot 6, Plan 1561, adjacent to Township Park land, Block "A". Letter advises that it has come to his attention that the Township may be considering various park lands, and if so, he would again like to be considered, should Block "A" be considered to be sold. Letter makes reference to earlier offer to purchase Block "A" and enclosing copies of such correspondence. On motion of Johnson, McEwen, letter be received and Mr. Brown be advised that the matter of sale of Block IIA", Plan 1561 may be considered at some future date, but not at the present. The matter of repairs to the Town Hall were again considered by Council as well as how the repairs are to be carried out. It was left that the Chief Building Official carry out inspec- tion as directed by Resolution of Council on April 18, 1983. . Stuart N. Keyes, P. Eng. was present at 11:45 a.m. as requested by Council and presented a report on work still outstanding on projects he had attended to, namely Jo-Con Developments; Quadrant Developments, Drainage work. A. Randsalu (Pt. Lot 24, Conc. 10) and advised: Jo-Con Development - very little progress made since last year. Roads need more granular "A" Timothy Acres (Black Forest Estates) finalized except for some culverts to be replaced- surface on roads. Windfield Country Estates - no further progress since 1982. Norshell Developments - still work to be completed including entrance culverts. Guthrie Industrial Park - no action for 4 years. Quadrant Developments Have not visited this Spring. Water system seems mostly complete. Alex Randsalu - Pt. Lot 24, Conc. 14 - Culvert installed but some redirection of flow required. On motion of Halfacre and Drury, verbal report as presented by Stuart N. Keyes on unfinished matters accepted as satisfactory. On motion of Johnson and McEwen, that the Fire Chief who is the person responsible for the Water System Maintenance, be requested to do frequent tests on water and if similar problems continues, the Engineers for the Developer and the Township Engineer, and Township Fire Chief are to meet and proceed with necessary steps to resolve the problem that occured on the first test by the Fire Chief. After consideration of the Engineers report, the Reeve on behalf of Council and the Ratepayers of the Township presented a Plaque recognizing 35 years of service. . Councillor Johnson brought several items of the Road Department to the attention of Council. Councillor Drury brought up matters with respect to the Waste Disposal Site which included the clearing of trees. Councillor Halfacre, presented the matter of age limit of Volunteer Firemen at Hawkestone and other Volunteer Firemen within the Township Fire Department. Prior to adjournment several items of business were discussed by Council including matters having recently come to the attention of Council.
