On motion of McEwen and Halfacre, copies of letters as presented and forwarded, accepted as satisfactory and ordered filed for reference and/or presentation to Committee of Council meeting. Old & Unfinished Business Presented letter from Ministry of Revenue, Retail Sales Tax Branch, in response to claim for rebate of Ontario Retail Sales Tax dated November 15, 1982, advising that since the entire claim of 792.80 is beyond the three year limitation and that the claim cannot be dealt with nor can a formal Notice of Objection under Section 22 of the Retail Sales Tax Act, be made because the tax was paid outside of the three year period prescribed by the Act for refund. Clerk advised that copy of the letter had been forwarded to Central Data Processing. On motion of Halfacre and Johnson, letter be received and filed for reference. Presented letter from Ministry of Transportation and Communications returning MR-A-6(80-06) Interim Statement of Expenditure as of October 31, 1982 of Road Expenditures, approving Second Interim Payment to an amount of $58,345.53, being amount submitted less 10% holdback in amount of $47,425.58. Clerk advised that a cheque In the amount of $58,345.53 had now been received. On motion of McEwen and Halfacre, approval of petition for Interim Subsidy for total expenditure to October 31, 1982 as presented for payment of $58,345.53 be received and filed. And cheque received as of this date be creditied to Road Account. Presented letter from Ministry of the Environment confirming that the Ministry would have no objection to material from Lot 1, Plan 1237, Conc. 1 (Petro-Canada Station) being deposited in the Township of Oro Waste Disposal Site and it is recommended that the soil be stock piled and used as cover material. On motion of Halfacre and Johnson, letter be received and a letter be forwarded to the Ministry of the Environment requesting that Council receive a clarification as to amount of contamina- tion in the material and which potential hazard may result from the contaminated soil. Basically what it is and how much. Presented signed Agreement for IBM Data Centre Service for 1983 Tax Billing and other serVIces in 1983, showing all costs for such services. On motion of McEwen and Johnson, Agreement as signed and presented be received and filed for reference as required for services by IBM Data Centre Service in 1983. Clerk advised that President, Hawkestone Community Hall Committee had been in the office with respect to appointments to the Hawkestone Community Hall Committee according to By-Law 1292/82, and presented a letter from Secretary of the Community Hall Committee showing 7 persons servIng on the Committee as well as the three Trustees of Hawkestone Police Village. ~ . . . .. Pg. 31 THIRD MEETING - JANUARY 3, 1983 Clerk further advised that in accordance with the Community recreation Centres Act, where more than four members are appointed, two members of Council must be appointed. It would appear that the Hall Committee and Trustees interpreted the Act to appoint Trustees in place of Council. In accordance with the Municipal Act, Section 347, Special Powers, does not list authority to pass By-Laws with respect to Community Halls and the Community Recreation Centres Act only refers to Councilor Boards. As result President, Jackie Duffie requested that four member Hall Committee be left but requested that Jackie Duffie be included in the By-Law in place of Jennifer Cuppage and the name of Cheryl Morano be corrected (presently reads Meriano). On motion of Johnson and Halfacre, letter be received as well as report of Clerk's explanation to President, Hawkestone Community Hall Committee and that the corrections of name and spelling be made to By-Law No. 1292/83 and Hawkestone Community Hall Committee and Hawkestone Police Village Trustees be advised of appointments in accordance with the Community Recreation Centres Act. Presented letter from D.S. White, Solicitor forwarding account for Professional Services ren- dered on various files during the year. On motion of McEwen and Halfacre, letter and account for Professional serVIces rendered be re- cevied and Treasurer authorized to issue cheque in payment of same. Presented letter from Ministry of Natural Resources, advising that the grant of $10,300.00 had been approved for Oro Memorial Park change rooms under the Parks Assistance Act by an Order- in-Council #3015/82 dated November 17, 1982. Also copy of News Release announcing same. Letter advises that claim for payment of the grant must be submitted. On motion of Drury and Halfacre, that letter and news release be received and Clerk-Treasurer to complete claim for payment and forward same to the Ministry for approval and payment. Presented letter from L.H. Edwards, Director, Ministry of the Solicitor General, further to letter of November 24, 1982 from the Hon. George W. Taylor with respect to claims for the Medonte Train Derailment in February 1982, forwarding cheque for the Township of Oro claim in the amount of $2,285.00. Also list of Volunteer Firemen who attended, as submitted by the Township Fire Chief. On motion of McEwen and Halfacre, that letter and cheque in the amount of $2,286.00 be received and Treasurer to issue cheques to Volunteer Firemen who attended the Derailment in Medonte from the Township of Oro Fire Department as prepared by Township Fire Chief. Keyes & Associates with respect to reduction of Bank Letter of Credit for Black Forest Estates Subdivision. And reply from Stuart N. Keyes advising that in his opinion, the estimated costs to complete the services at 1983 prices as submitted by Skelton, Brumwell & Associates in the amount of $51,300.00 should be sufficient to complete the work on the Subdivision employing the same contractor as did the construction work in 1982, thus reducing the Letter of Credit by an amount of $75,800.00. On motion of McEwen and Johnson, that Skelton, Brumwell & Associates Ltd., and the Royal Bank of Canada, International Centre, Toronto be advised that Oro Council upon being advised by the Township Engineer, that the estimated costs to complete the work on the Black Forest Estate Subdivision of $51,300.00 should be sufficient,are prepared to reduce the Letter of Credit No. SB 30215345 by $75,800.00 leaving a balance Letter of Credit in the amount of $51,300.00. All other conditions of the siad Letter of Credit to remain the same. Presented letter from District Manager, Huronia District, Ministry of Natural Resources with respect to up dating of schedules of Flood Emergency Plan. On motion of Drury and Halfacre, that the schedule of the Flood Emergency Plan be updated and copy of same be forwarded to Ministry of Natural Resources and N.V.C.A. New Business Presented letter from Rowanwood Conserver Society Co-Operative, signed by President, E.V. Abbott and Sec-Treas. Gordon Keith, requested a meeting with Oro Council and Planning Board in January 1983 at which time their Planner, John Lang will present the Rowanwood Co-operative proposal. On motion of Drury and Johnson, the letter be received and be referred to Oro Planning Board to arrange for a date for the Rowanwood Co-operative to attend a meeting of Oro Planning Board and Council. Presented from Ministry of Agriculture and Food, notice of 1983 Municipal Drainage Courses for both Clerk's Courses and Superintendnet's Courses. On motion of Halfacre and McEwen, that the letter be referred to Committee of Council meeting for consideration. Presented letter from Community Renewal Branch, Ministry of Municipal Affiars & Housing with respect to Ontario Neighbourhood Improvement Program (ONIP) 1983/84 Program year. Letter advises that applications must be received no later than February 15, 1983. Pg. 34 THIRD MEETING - JANUARY 3, 1983 Presented letter from the Barrie Public Library forwarding copy of letter to the Oro Township Library Board setting out formula the Township suggested in 1982 for linking the Municiplaities contribution to the Provincial Grant for Library services in 1983. The formula suggested being, the grant plus 1.3 times the grant for two thirds of the population. The 1983 Provincial Grant being $2.15. 1.3 (2/3 of 7202 x 2.15) $23,744.00. Payments to be made quarterly, March, June, September and December. On motion of Johnson and Halfacre, copy of letter to Secretary, Oro Township Library Board, be received and further considered once Oro Library Board has made a recommendation or arranged for a meeting with Barrie Public Library Board, Orillis Public Library Board and Council. Presented letter from Ivan Speers, County Weed Inspector with respect to weed control in 1983 and offering assistance to Township assistant Weed Inspector, Fred Haughton. On motion of McEwen and Johnson, letter be received and Road Supt. Fred Haughton to contact County Weed Inspector as required. Presented letter from Ministry of Transportation and Communications, Traffic Management and Engineering Office with respect to Development of sign Standards and Signing Policy for Fire Route, signing and enclosing Questionnaire. Clerk advised copy had been forwarded to Fire Chief. On motion of Drury and Halfacre, that the questionnaire be completed by Clerk & Fire Chief and matter be further considered at a Committee of Council meeting. Presented a letter from President, Ontario Municipal Management Development Board (OMMDB) with respect to program under the Board to assist local government. Letter requests the Municipality advise of decision to participate, both by financial contribution and programs and seminars. On motion of McEwen and Johnson, letter and program material enclosed, be received and filed until the matter is further considered. Presented from Ontario Good Roads Association, Pre-registration for delegates attending the 1983 Convention. The fee for pre-registration being $10.00 less per delegate. On motion of Drury and Johnson, the Pre-registration form be compelted showing as delegates, Road Supt., Fred Haughton, Road Committee and Reeve and that the Deputy Reeve will be atten- ding for 1 day. Chief Building Official, James Shellswell, was present at 11:30 a.m. and presented his report for the month of December and report for the year 1982. The matter of fees for Building Permits issued to Big Cedar Estates was discussed and Chief Building Official was instructed to review the fee structure and also check with surrounding municipalities in this regard. Road Supt., Fred Haughton was present at 1:00 p.m. and presented his report for work completed for the month of December and presented Vouchers 12 and 12A to cover same. On motion of McEwen and Halfacre, report of Road Supt. for work done during the month of December, as presented, accepted as satisfactory and Treasurer authorized to issue cheques in payment of same to a total of $30,873.23 On motion of Johnson and Drury, that Oro Council go into Committee of the Whole to discuss classification and salary and wage scale for Road Employees, in particular with one employee, at 1:20 p.m. On motion of Halfacre and Johnson, Council come out of the Committee of the Whole at 1:30 p.m. As result of consideration and discussion, the error in schedule liB" of By-Law to fix remuner- ation for hourly employees be corrected before presentation for passing under By-Laws later at this meeting. ,. . . . ....... Pg. 36 THIRD MEETING - JANUARY 3, 1983 The Planning Administrator was present at 1:40 p.m. to reVIew planning and development matters. The following was presented: Copy of letter from W.O. Russell to Solicitor for Mr. T. Holmberg, advising as to requirements for execution of the subdividers agreement and release of the proposed subdivision, File 43T- 81024 for registration. M.M.A.H., advising of approval of Official Plan Amendment No. 14 on December 21, 1982 with modifications. On motion of Halfacre and Johnson, that correspondence as received be placed on file. Planning Administrator to register copy of Official Plan Amendment No. 14 in the Registry Office as required under Section 16(2) of the Planning Act. On motion of McEwen and Halfacre, that the Planning Administrator be instructed to prepare and compile a report of all roads not signed along the Lakeshore Area and elsewhere and pre- pare draft By-Law when needed. Presented memorandums from Ministry of Transportation and Communications forwarding M.T.C. Directive B20 - Flashing Beacons Subsidy and M.T.C. Directive B3 - Subsidy on Storm Sewer Construction and Mainatenance and Sewer Report Form to be completed. On motion of Drury and Halfacre, M.T.C. Directives be placed on file and Clerk and Road Supt., to complete Sewer Report Form and return same as requested. Presented letter from the Hon. Claude F. Bennett, Minister, Municipal Affairs and Housing setting our committment available immediately for Canada/Ontario Employment Development Pro- gram and enclosing accompanying letter signed by the Hon. Lloyd Axworthy, Minister of Employ- ment and Immigration Canada and the Hon. Russell Ramsay, Minister of Labour, Ontario as the Federal-Provincial Agreement creating the Canada/Ontario Employment Development Program to assist Municipalities in undertaking work. Contingent upon making a contribution that should average 20% of the total project costs the estimate for the Township of Oro is $20,300.00 as the initial allocation. The balance of the funds not taken up from this initial allocation, will be distributed in the new year. Applications for the Grant to the amount of the alloca- tion and requests for additional funds hould be submitted to Subsidies Branch of MMAH by January 31, 1983. On motion of Drury and McEwen, that a Committee of Council and the Clerk-Treasurer meet on January 7, 1983 at 10:00 a.m. to prepare a program and complete the application for the amount of the allocation of $20,300.00 Presented application for Fox Bounty from N.R. Dwinnell, RR # 1, Shanty Bay for 22 Fox trapped in lots 5 in Concession 1 to 8, Township of Oro, Between November 1st to December 1st, 1982. On motion of Drury and Johnson, application for 22 fox trapped between November 1st, to December 1st, 1982 in Concessions 1 to 8 by N.R. Dwinnell, be approved and Treasurer authorized to issue a cheque to cover same to a total of $88.00 (22 fox @ 4.00 ; 88.00). Presented letter from Township of Tosorontio forwarding resolution of the Council of the Township with respect to Councils of the County of Simcoe being invited to have some input in the Simcoe County Board of Education and requesting endorsement of same. Jl"'" . . . ~ Pg. 37 THIRD MEETING - JANUARY 3, 1983 On motion of Halfacre and McEwen, that although Oro Council agree in principle with the resolu- tion, Council are not prepared to endorse the resolution as presented until Oro Council have met with the representative to Simcoe County Board of Education for the Township of Oro, with whom Council have good rapport, which is scheduled for January 27, 1983 and that the Township of Tosorontio be advised accordingly. Presented letter from K.A. Bush, Lot 50, Plan 1291, Concession 9 with respect to several matters concerning the west side of Oro Memorial Park. On motion of Drury and McEwen, that Clerk reply to the letter on the three items of concern. By-Laws Further to consideration of establishing salary and wage ranges for administrative, clerical and hourly rated employees of the Township of Oro at a meeting of Council held on December 20, 1982 and resolution of Council passed at that meeting instructing that By-Laws be prepared and presented to this meeting, Council after review of such By-Laws, enacted as follows: By-Law to amend By-Law No. 1279/82, being a By-Law to establish a system of Salary and Wage ranges for Administrative, Clerical and hourly rated employees of the Township of Oro and to amend By-Law No. 1278/82, being a By-Law to establish a system of classification of officers, employees and servants of the Township of Oro, according to Job Descriptions along with a By-Law to amend By-Law 1280/82 to fix the rates of remuneration for employees of the Township of Oro for the year 1983 were on motion of McEwen and Drury introduced and numbered as By-Law Nos. 1293/83, 1294/83 and 1295/83 respectively and read a first time. On motion of Drury and Halfacre, By-Law Nos. 1293/83, 1294/83, and 1295/83, read a first time, be read a second time. On motion of Halfacre and Johnson, By-Law Nos. 1293/83, 1294/83, and 1295/83, read a second time be read a third time. On motion of Johnson and McEwen, By-Law Nos. 1293/83 1294/83 and 1295/83, now read a third time, do pass, be engrossed by the Clerk, si9ned and sealed by the Reeve and Clerk-Treasurer, Administrator to apply the rates as set, effective January 1, 1983 and copies of the By-Laws be made available to all Departments and members of Council, Auditors andM.LC. for Road Employees. The matter of a By-Law to authorize the borrowing of funds to meet current expenditures was considered and a draft By-Law was presented. On motion of Halfacre and Johnson, that a By-Law to authorize necessary borrowing to meet cur- rent expenditures for 1983 to an amount of $800,000.00 was introduced and numbered as By-Law No. 1296/83 and read a first time. On motion of Johnson and McEwen By-Law No. 1296/83, read a first time, be read a second time. On motion of McEwen and Drury, By-Law No. 1296/83 read a second time, be read a third time. On motion of Drury and Halfacre, By-Law No. 1296/83 now read a third time, do pass, be engros- sed by the Clerk, signed and sealed by the Reeve and duplicate original copy of the By-Law be presented to the Canadian Imperial Sank of Commerce, Orillia Branch. ~ Pg. 38 ETING JANUARY 3 1983 . On motion of McEwen and Johnson, that Council invite Miss Sally Gower of the Packet and Mr. Tony Panacci, Barrie Examiner, to a general Committee Meeting to discuss some concerns that Oro Council has regarding general newspaper coverage of Township Affiars. On motion of Halfacre and Johnson, that Clerk to prepare a general complaint form which IS to be made available to Council and staff, which is to be pre-numbered. On motion of Johnson and Drury, adjourn to meet again on Monday, January 17, 1983 at 9:00 a.m.
