Pg. 201 EIGHTEENTH MEETING OF THE 1983-85 COUNCIL - OCTOBER 2, 1985 . 4 On motion of Johnson and Drury that the Road Accounts for work completed to September 30, 1985, as presented, be received as satisfactory and Treasurer authorized to issue cheques in payment of same to a total of $74,455.55. Communications and Correspondence (a) Letter from Township Solicitor with respect to Pits and Quarries Licences regarding increase of annual extraction of material. Letter being as result of Ainley & Associates Limited to the Solicitor dated August 27, 1985. Solicitor's letter suggests that a letter be forwarded to the Ministry of Natural Resources, by the Solicitor on the two applications setting out Council's position and requesting Council's instructions. 5 On motion of Halfacre and McEwen as suggested by the Township Solicitor, copies of both applications for approval to increase annual tonnage extraction, from E.R. Alexander Construction and Cook Construction along with covering letter from the Township Solicitor, stating that the Township of Oro objects to the increase for reasons set out in letter from Ainley & Associates Ltd. and that no further increased tonnage be permitted until the Township concerns are either dealt with in an agreement with the pit operators or by way of conditions of licence. And further that the Ministry be requested to advise as to what action they will be taking in light of the Township's comments. And that the Township Solicitor to proceed in accordance with this resolution. . Chief Administrator's Report and/or Recommendations Reduction of letter of credit for Langman Subdivision from $14000 to $4700 10 On motion of Drury and Johnson that the Treasurer be authorized to advise Victoria & Grey Trust Co. that the "Langman" Letter of Credit be reduced from the present level of $14,000.00 to the maintenance guarantee level of $4700.00, provided all other original terms and conditions re- main in force. In addition, that a By-law to assume the road "Petherwin Place" be presented on receipt of confirmation from the Ministry of Transportation and Communications that the road is eligible for subsidy purposes. Fire Department Chairman, Fire Committee advised of one meeting held on September 30, 1985 and further meeting to be held on October 8, 1985. Also presented a letter complementing the action of the Shanty Bay Fire Dept. Reports of Municipal Officers . Pg. 208 EIGHTEENTH MEETING OF THE 1983-85 COUNCIL - OCTOBER 2, 1985 Staff Reports - The Planning Administrator was present at 11:00 a.m. to present his reports as follows: Planning & Development The Planning Administrator was present at 9:45 to report on Planning & Development matters. The following was presented: Township of Vespra, Notice of Public Meeting to consider a proposed re-zoning of Part of Lot 25, concession 1, W.P.R., from "A-Agriculturell to "C3-Service Commercial." _ Advised that further to the public meeting held September 11, 1985, that the "Scott" proposed Official Plan and Zoning By-law Amendments are available for consideration, no additional correspondence having been received prior to September 27, 1985 as re- quested by Council. _ Advised that further to the Public Meeting held September 11, 1985, that the "Audubon" Proposed Official Plan Amendment is available for consideration, that an additional exemption has been requested with respect to the proposed zoning by-law to permit an increased building envelope area due to site constraints, and that correspondence from Mr. Jack VanNiekerk and from Bob and Linda Lord would not appear to affect the proposed Official Plan and/or zoning by-law amendments. A staff report and recommendations were presented, as was a revised zoning by-law for consideration. Advised that the Ministry of Municipal Affairs are in receipt of Official Plan Amendment No. 22 and that circulation is in progress. 12 On motion of McEwen and Halfacre that the Planning Administrator's Report be received. Parks & Recreation _ Advised that the capital conservation grant application authorized by Council on September 11, 1985 has been made ahead of deadline to the Ministry of Tourism and Recreation. Advised that the Recreation Master Plan Household Survey is in progress, due to com- pletion on October 7, 1985, following which tabulation is to be undertaken. Further that the Recreation Master Plan Consultants, the Institute of Environmental Research Inc. and the O.C.C.P.R.C. will hold a facility users meeting at 7:00 p.m. on Tuesday, October 22, 1985 at the Town Hall, followed by a public meeting at 8:00 p.m. _ Advised that the O.C.C.P.R.C. will meet on Tuesday, October 8, 1985 at 7:30 p.m. In the Council Chambers. 13 On motion of Johnson and Drury that the Report of the Secretary of Parks & Recreation as presented be received. Directions - That the Secretary of Parks & Recreation Committee attend the Workshop. (b) Clerk advised that Mr. McArthur, Lot 79, Plan 626 attended at the office with complaint regarding fill being piled up on Promenade, which appeared as an obstruction. Clerk's Report was acknowledged as presented. At this time a resolution was presented by Deputy Reeve with respect to Sports/Recreation as follows: 23 On motion of McEwen and Drury that the Township of Oro on behalf of its citizens send best wishes to the Toronto Blue Jays. Campbell ) Delno Jermey .) members of C of A Also present was Ross Bradley, Chairman of the Township of Oro Planning Advisory Committee (P. A. C.). Barry Ward of the reporting staff of the Barrie Examiner was present at the request of William Bateman. Councillor Allan Johnson declared a conflict of interest at 10:35 a.m. due to the Committee of Adjustment Decision B13/85 and B14/85 the proposed matter of discussion. The Reeve asked Mr. Bateman to make his presentation of his request to attend on behalf of the Committee of Adjustment. Mr. Bateman presented copies of the newspaper article that had appeared in an issue of the Barrie Examiner on September 4, 1985 and referred to the statement of the article which caused concern to the Committee members and asked if the statement was correct as it appeared. That the Committee of Adjustment had made an incorrect decision. - The Reeve responded that documentation had been received from the Planning Consultants which indicated that Policy of the Official Plan was not clear for interpretation and the Reeve made reference to possible loophole which had been indicated to him by Planning Staff. Deputy-Reeve McEwen objected to statement of loophole. - Reeve again indicated that comments from staff persons when questioned had commented that Policy could be construed as having a loophole. - Then asked the Administrator if at a meeting the indication of loophole had been mentioned. - On being again asked by Mr. Bateman the Reeve agreed he had made the statement that appeared in the newspaper article and because of the problem in the document he had jointly appealed the decision of the Committee jointly with Ross Bradley, Chairman of P.A.C. in order to en- deavour to obtain clarification of interpretation or have the Planning Consultants advise of amendment to put in place a clear written policy that could be interpreted by all. And that a notice of motion presented at a Committee of the Whole Meeting could possibly have provided a means to clear up the problem in the Policy for severance. Then added that the draft resolution was again to be presented to this meeting today. Discussion continued at some length with members of Committee of Adjustment and the Chairman of the Planning Advisory Committee and Council with the following points being raised: matter of apparent incorrect mapping was raised land classifications as established by Ministry of Agriculture - mapping correction should be considered Question was asked - was the objection and appeal made as individuals or as Reeve and Planning Advisory committee Chairman. The Reeve after asking for further questions or comments, and there being none, thanked the members for coming to the meeting to express their concerns. Councillor Johnson at this point returned to the meeting. Motions of Which Notice Had Been Previous Given (a) Notice of motion presented at Committee of the Whole Meeting held on September 25, 1985 and circulated to each member of Council. 24 Moved by Councillor Halfacre and seconded by McEwen be it resolved that Ainley & Associates Alternative No.1, be adopted as the Township of Oro1s Rural Severance Policy, and further that the Committee of Adjustment and Planning Advisory Committee be so notified. Deputy Reeve spoke to the motion - have expressed opInIon that the the policy - accordance to the policy will not support the motion that matter go back to P.A.C. Township made an error in prepared to move amendment . Reeve - Ainley & Associates had made several recommendations - Planners have recommended Alternative No. 1. Deputy Reeve McEwen spoke further to the matter - no resolution from P.A.C. to Council. Deputy Reeve moved an amendment of referral seconded by Councillor Drury. The resolution regarding Ainley & Associates Alternative #1 be returned to P.A.C. for clarification on "No Rural Severance" Policy and that the problem of mapping be properly addressed by P.A.C. Further that after that meeting that Council give consideration to any recommendations forthcoming. Before the question on motion of referral, Councillor Drury requested a recorded vote. Presented letter from The Ontario Traffic Conference advising of Seminar on "Construction Work Safety Zone" to be held on Friday, November 8, 1985 (9:00 a.m. to 3:30 p.m.) at the Holiday Inn Barrie, along with registration form for same. Road Supt. requests permission for himself and Working Foreman to attend. Registration fee $35.00 per person. Also attached programme for the Seminar. 36 On motion of Johnson and Drury that the Road Supt. and Working Foreman be authorized to attend and Registration Forms for same be completed. Item #1 - Problem of drainage at Lot 23 Plan 728, and damage to property of J. Pearcey property by the recent rain storm. Road Supt. reiterated the comments in his report after viewing the site and that he had advised Mr. Pearcey that some remedial work would be programmed within the next few weeks.
