Council met this evening at 7:00 p.m. for the first evening meeting according to By-law 1406/85, proper notice having been given and notice to ratepayers had appeared in the local newspapers. Small The meeting was opened by the Reeve at 7:00 p.m. with prayer. Disclosure of Conflict of Interest - Councillor Johnson indicated that he would be declaring conflict of interest at time on the agenda when item 12(b) would be dealt with. Treasurer presented the accounts for the Road Supt. of the expenditures on roads to September 18, 1985 according to the work carried out for the first half of the month of September. 4 On motion of Halfacre and Drury that the accounts for expenditures on roads in September to September 18, 1985 as presented be accepted as satisfactory and Treasurer authorized to issue cheques for same to a total amount of $59,460.76. . . . (a) Clerk advised that the Student Council Program has been tentatively re-scheduled for October 22, 1985. County Clerk's Office to confirm date after September 17th meeting. 5 On motion of McEwen and Halfacre that once date is confirmed, School Principals to be notified and all necessary arrangements be made for the day and Tour at the County Building and attendance at the County Council Meeting, including obtaining a bus from Sinton Bus Lines for the day. Communications and dence (a) Letter to Reeve with respect to Reeve's Challenge - 1985 Autumnfest Log Sawing Contest from Reeve of Vespra Township. Contest to be held on october 5, 1985 at 1:00 p.m. 6 On motion of Johnson and Drury that members of Council participate In the Vespra Fest Log Sawing Contest. (Reeve's Challenge) October 5, 1985. Card to be sent to Harry Adams at R.V.H. (b) Presented letter from Eric ~ Judy Allinson In response to Township letter re: Parklands for which the Township of Oro had submitted an "Offer to Purchase." Letter is acceptance of Council's "Offer to Purchase", adding that the Township be agreeable to put fence between fence and remaInIng parcel and that the existing ditch to be improved so as not to drain on remaining land. 7 On motion of McEwen and Drury that letter of acceptance of Township of Oro, "Offer to Purchase" approximately 3.85 acres on part lot 2, Concession 14, be received and letter of affirmation of purchase be forwarded along with response to questions of fencing and ditching, which could only be done as parklands are developed. (c) Presented letters from a number of ratepayers along Robinson Street, Hawkestone with respect to proposal by Trustees hawkestone Police Village to improve and extend Robinson Street. (e) Letter from the City of Barrie advising that the letter from the Township of Oro regarding Fire Dispatch Service to the Township of Oro has been referred to Mr. J. McAllister, Fire Chief and is being held pending further investigation and report to City Council for reply. 10 On motion of Halfacre and Drury that the letter from the City of Barrie be received for reference when further correspondence is received. Reports of Committees 12 On motion of Drury and McEwen that the minutes of the Committee of the Whole Meeting held on September 11, 1985 and motions as recommended and circulated to all members of Council, be adopted and incorporated in the minutes of this meeting. . Further to Council's resolution of September 3, 1985 a By-law to adopt Amendment No. 22 to the Oro Official Plan. Redesignate part of Lots 21, 22 Conc. 8 from "Agricultural" to "Special Events Park" was introduced. 13 On motion of Drury and Johnson, numbered as By-law No. 1407/85 and read a first time. On motion of Johnson and McEwen that By-law 1407/85 read a first time, be read a second time. 14 On motion of McEwen and Halfacre that By-law 1407/85 read a second time, be read a third time. 15 On motion of Halfacre and Drury that By-law No. 1407/85 engrossed by the Clerk, signed and sealed by the Reeve. assist in submission of the document to the Ministry of now read a third time, do pass, be Township Planning Consultants to Municipal Affairs for approval. Other Business . (a) Presented letter from William Bateman, Chairman Oro Township Committee of Adjustment, requesting a meeting of members of the Committee of Adjustment, requesting a meeting of members of the Committee of Adjustment and Oro Township Council, to discuss the contents of an article published in the Barrie Examiner on September 4, 1985. Also would request that Barry Ward the reporter for the Barrie Examiner on whose byline the article appeared in the issue of the Barrie Examiner on September 4, 1985. 16 On motion of Halfacre and McEwen that Mr. Wm. Bateman be invited to attend the next Committee of Council meeting on September 25, 1985. (Committee of the Whole) (b) Presented letter from Ronald Holcroft, a resident on the 7th Line of Oro, registering a complaint with respect to problem he had encountered at the intersection of Line 7 and 15/16 Side Road, by interference from persons in connection with a racing project on 15/16 Side Road, making it difficult to proceed along Line 7 across 15/16 Side Road. Letter indicated he had reported the matter to O.P.P. and outlines their comments and report of the incident. The O.P.P. had been called to the site previously on sunday, September 8, 1985. Letter further indicates O.P.P. advised him that permission for the said races had been granted by the municipality. Clerk advised copy of the letter had been presented to the Road Supt. 17 On motion of McEwen and Johnson that Council go into Committee of the Whole at 7:38 p.m. to discuss a legal matter. 18 On motion of McEwen and Drury to come out of the Committee of the Whole at 7:43 p.m. . (c) Presented letter from Ontario Provincial Police (Barrie Detachment) to the Reeve, signed by Constable S.W. Crowe, advising of a single motorcycle accident on the Lakeshore Road, 460m south of the 7th Line. Letter notes 4 items of concern and also encloses diagram of the area referred to in the investigation of the accident. Letter also suggests solutions to avoid accidents and dangers of the area in question. Clerk advised that a copy of the letter had been presented to the Road Supt. 19 On motion of Halfacre and Johnson that the Clerk to respond to the letter from the O.P.P. on basis of input from Lawyer and Road Supt. Pg. 196 SEVENTEENTH MEETING SEPTEMBER 18, 1985 . (d) Presented application for loan under the Tile Drainage Act from John A. McCuaig, w. part lot 19, Cone. 4, Township of Oro to drain approximately 32.5 hectares. Total cost of the work estimated at $5352.10 for which a loan in the amount of $3200 qualifies based on 60% of the total cost. Work to construct the Tile Drainage System had been completed August 7, 1985. Clerk advised that the 1985 allocation had been used by previous applications approved by Council and debentures for same issued. 20 On motion of Halfacre and Johnson that the application for the tile drainage loan from John A. McCuaig, to construct a Tile Drainage System on the west part of Lot 19, Conc. 4, to a total cost of $5,352.10 for which a loan of $3200 is applicable, based on 60% of the total cost, be approved. And further that the necessary documentation for the issuance of a debenture be pre- pared once further allocation of money is made available to the Township of Oro by the Province of Ontario through the Ministry of Agriculture and Food. And further, that this application as approved by Council be forwarded to the Ministry of Agriculture and Food with request for further allocation of money under the Tile Drainage Act for this application and balance required for previous applications completed in 1985. (e) Presented from Ernest Bidwell, Live Stock Valuer, Report of Live Stock Valuer for one calf killed, owned by Glendenning Farms Ltd. (David Levison) on w~ Lot 26, Conc. 3, valued at $250.00. Report indicates that the calf was killed by a wolf. Owner of the calf David Levison has taken the necessary affidavit. 21 On motion of Halfacre and Drury that the report of Live Stock Valuer for one calf killed and valued at $250.00 be accepted and Treasurer authorized to issue cheque in payment of same to a total amount of $250.00. And Clerk to forward Form 1, application for claim of damage of wolf or wolves, to Province of Onto Ministry of Agriculture and Food. . (f) Presented from Clerk, County of Simcoe letter forwarding copy of Report No.7 of the Children's Services and Education Committee regarding the determination of Trustees for the Board of Education. Report No.7 amends Schedule "c" only as it relates to Ward 11 ~ 12. Report No. 6 established 1 member for the Township of Oro as representative for the Township of oro, as Ward 9. 22 On motion of McEwen and Halfacre that letter and report be received and Clerk to file same for reference for the 1985 Election for Simcoe County Board of Education. (g) Presented from Oro Township Horticultural Society, to members of Council to attend the Pot Luck Supper and Awards Night, to be held on October 7, 1985 at St. Andrew's Presbyterian Church. Invitation to include spouses or companions of members of Council. 23 On motion of Johnson and Drury that all members of Council that are able to attend to do so. Motions and Notice of Motion (a) Proclamation for World Food Day, as requested by the Hon. Jack Riddell, Minister of Agric. and Food. . . . . Pg. 197 SEVENTEENTH MEETING - SEPTEMBER 20, 1985 24 On motion of McEwen and Halfacre that: WHEREAS well over 500 million people in the world suffer from hunger and malnutrition although the resources and technology are currently available to feed the entire global population of 4.8 billion; and WHEREAS there are people working against hunger In 147 countries of the world who will be ob- serving WORLD FOOD DAY on October 16, 1985; and WHEREAS Ontario government organizations, private sector organizations, voluntary agencies, educational institutions and individual citizens have joined to centre attention on the severity of world hunger by commemorating WORLD FOOD DAY; NOW, THEREFORE, BE IT PROCLAIMED that October 16, 1985 be: "WORLD FOOD DAY" In the Township of Oro and that all citizens will welcome the opportunity to increase their awareness of severe world hunger and its solutions by participating in local events to force the issue into public VIew. Councillor Johnson as previously indicated declared a conflict of interest and left the Council Chambers at 8:00 p.m. because of application of Committee of Adjustment re: File No. B13/85 and 814/85. (b) Notice of motion as presented at the Committee of the Whole meeting held on September 11, 1985 as recorded in the minutes, with respect to decision of Committeeof Adjustment on applications B13/85 and B14/85. Copy of which was included with agenda for this meeting which was delivered to each member of Council Presented letter from the Ontario Municipal Board confirming the booking of hearing accommodation and retiring room for the Ontario Municipal Board for the Ontario Municipal Board on Monday, November 18, 1985 at 10:30 a.m. in the Council Chambers, Township Offices, for a period of one day in reference to the matter of appeal to O.M.B. Files C850255 and C850254 and Appointment of Hearing in matter of Section 52(7) of the Planning Act, 1983 and two appeals by Stephen Davie and Ross Bradley from the two decisions of the Committee of Adjustment of the Township of Oro for the two applications numbered as B13/85 and B14/85. The O.M.B. Appointment of Hearing sets out the requirements and pro- ceeding. ..... Pg. 198 SEVENTEENTH MEETING - SEPTEMBER 18, 1985 . 25 On motion of McEwen and Drury that the Township of Oro support the Committee of Adjustment decision on Submissions numbered B13/85 and B14/85 (O.M.B. Files C8502254 and C8502255) at the Ontario Municipal Board Hearing as scheduled. Reeve Davie asked the Deputy Reeve if she wished to speak to the motion. Deputy Reeve spoke to the motion indicating that the Committee of Adjustment decision would have been based on the document before them which is the guideline for the Committee and expressed her opinion regarding the interpretation of the policy in the document. Councillor Halfacre in speaking to the motion indicated she did not support the Committee of Adjustment decision. Councillor Drury had no comments on the motion. The Reeve then summarized the request for clarification of the policy interpretation, which was directed to be obtained from the Township Planning Consultants through the Secretary of the Planning Advisory Committee. After some further discussion the Reeve called the question. Motion was lost. Deputy Reeve McEwen presented a further motion. 26 On motion of McEwen and Drury that the Clerk correspond with the Township Solicitors to request an opinion as to which of the following positions the Township should take in relation to the Committee of Adjustment decision on File No. 's B13/85 and B14/85 con- cerning Allan Johnson severance: . (a) To support the position of the Committee of Adjustment (b) To oppose the position of the Committee of Adjustment (c) To take no position Defeated. Deputy Reeve then presented another motion. 27 On motion of McEwen and Drury that the Township of Oro will not assume any legal costs concerning the pending O.M.B. Hearing with regards to Allan Johnson severance File No. 's B13/85 and B14/85; tentatively scheduled for November 18, 1985. 28 On motion of Johnson and Drury that the Community Centre Management AMC Committees presently operative continue to carryon as a Committee responsible to the Parks and Recreation Committee for the balance of the term of this Council. 29 On motion of Halfacre and Drury that the Township of Oro History Committee continue to carry out the functions in accordance with their appointment as such for the balance of the term of this Council. aw 30 On motion of McEwen and Halfacre that By-law to confirm the proceedings of this meeting of Council held on September 18, 1985 and recommendations contained in the report of the Committee of the Whole meeting held on September 11, 1985, be introduced, as the Draft By-law having being circulated and numbered as By-law No. 1408/85 and read a first and second time. . 31 On motion of Halfacre and Drury that By-law No. 1408/85 read a first and second time be read a third time. 32 On motion of Drury and Johnson that By-law No. 1408/85 now read a third time, do pass be engrossed by the Clerk, signed and sealed by the Reeve.
