On motion of McEwen and Johnson that the letters be received and same be referred to Committee of Council. . Presented a letter from Ainley & Associates Limited with respect to inspection of Windfield Drive Subdivision seven comments following the inspection and requirements prior to issuing of Certificate of Substantial completion. On motion of Halfacre and McEwen copy of letter as presented be received and filed. Presented letter from President Association of Municipalities (A.M.O.) advising that the Executive Committee have established the special committees of the Association for 1984/85, and advising that the Township Clerk-Treasurer/Administrator has been appointed to the Resolutions Committee and that the first meeting of this Committee IS scheduled for November 9, 1984. On motion of Drury and Halfacre that the expenses for attendance of the A.M.O. Resolutions Committee by the Clerk-Treasurer/Administrator as Director be paid by the Municipality as in previous years, while he attends the meetings. Presented letter from Ontario Legislative Committee Canadian Railway Labour Association regarding C.N. and C.P. Rail application to Railway Transport Committee, Canadian Transport Commission to test and operate cabooseless trains, advising that the Railway Transport Committee, Canadian Transport Commission have scheduled a Public Hearing will commence on Monday, December 3, 1984 at Hull, Quebec in the matter of the aforesaid application. Letter requests that Council write to the Federal Minister of Transportation and Chairman of the Canadian Transport Commission, demanding that Public Hearings be held at convenient locations all across the Country, so that participation may take place in hearings before any decisions are made to conduct any testing or operation of caboose less trains. . On motion of Halfacre and McEwen that Oro Township Council support the request for a Hearing regarding the proposed caboose eliminations and so inform the appropriate agencies. Pg. 246 . TWENTY-FIRST MEETING - OCTOBER 31, 1984 Presented letter from Secretary, Oro Agricultural Society regarding previous enquiry of April 9, 1984, with respect to the possibility of having some renovations carried out at the Town Hall for winter use. On motion of Johnson & Halfacre that Staff to obtain quotations for cost of new doors at both rear entrances of the hall with suitable size for the ramp and a door placed at the back of the stage and Staff to follow up on maintenance and energy saving grants avail- able. Presented letter from Association of Municipalities forwarding "Kit for Local Government Week" in accordance with letter from the Hon. Claude Sennett presented to the last regular meeting. On motion of Halfacre and Johnson that the Kit as presented be received and referred to Committee of Council meeting. Recommendations from Commi - Meeting of October 25, 1984 (a) Park Lands Plan 1488 . On motion of Halfacre and McEwen that further to presentation by Simcoeside Ratepayers Association to Committee of Council on October 25, 1984, a meeting be arranged for the Simcoeside Ratepayers to meet with Council, Township Planning Consultants on the site or at a designated location, ie. Hawkestone Hall. And further that the levelling of the Parklands, Lots 138, 139, 143 & 144 of Plan 1488 be carried out under the Road Supt. 's supervision and costs to be paid from Park Fund Account. (b) Draft Approved Plan Subdivision - extension - Guthrie Plains (Estate of Melville Hastings) further to consideration of request by the Estate of Melville Hastings and their Consultants for extension of Draft Approval. On motion of Drury and Johnson that as recommended by Committee of Council, the Ministry of Housing be advised that Oro Council would not object to an extension of Draft Approval for the file 43T-25103 (Estate of Melville Hastings proposed development, for a period of one year to November 18, 1985. Based on the understanding that no development may take place until the Plan and Subdivider's Agreement are completely reviewed prior to any commencement of any work by the Developer. (c) Request by Mr. Fred McLean Re: Placing on ballot at the next Municipal Election a question on Capital Punishment On motion of Drury and Halfacre as recommended by Committee of Council Oro Council would give consideration to placing the question of Capital Punishment on the ballot at the next Municipal Election, provided that it would not invalidate the Election. Y-FIRST MEETING - OCTOBER 31 1984 (d) Greer Flemmi Rolland & Co. - Auditors Re: Federal Sales Tax On motion of Drury and Johnson that Greer, Flemming, Rolland & Co. be authorized to carry out the services of preparation of Federal Tax Rebate on items purchased to which exemption applies, and that for such service be paid a remuneration as previously paid by the Township for service of this type, namely 20% of the actual rebate received by the Municipality. (e) intment to Count Ad-Hoc Committee On motion of McEwen and Halfacre as recommended by the Oro Township History Committee, the Deputy-Reeve Joanna McEwen, be appointed to the Warden's Ad Hoc Committee of the County of Simcoe for the purpose of dedicating No. 93 Highway as a Heritage Road. And in case that the appointed representative is unable to attend, Mrs. Lorraine Lucas be appointed as the alternate representative, from the Township of Oro. (f) inion Re: Use of Lots 2-5 Plan 1145 On motion of McEwen and Drury that the letter of opinion be tabled until a report has been received from M.W. Salter and that the account for the service be paid with October accounts. . (g) Plan 1 Road Status - Road Status was considered by Committee of Council according to coloured plan received from the Township Solicitor. On motion of Halfacre and Drury that the final plan of Road Status, on Plan 1 as prepared by the Township Solicitor be tabled until further information is received from Solicitor as result of meeting with Township Planning Consultants. On motion of Halfacre and McEwen that Council go into Committee of the Whole on Staff matters with respect to proposal for Office Management Study at 11:00 a.m. On motion of Drury and Halfacre that Council come out of Committee of the Whole at 12:20 p.m. ~ Pg. 249 . TWENTY-FIRST MEETING OCTOBER 31, 1984 Mr. Eric Hardy advised that he would be presenting Oro Council with an estimate for an Office Management Study for their consideration as requested. Chief Building Official, James Shellswell was present at 1:00 p.m. to present the Building Report for the month of October, 1984. There were 23 building and 5 plumbing permits issued with a breakdown as follows: 9 residences with a value of 2 additions with a value of 5 accessory buildings with a value of 2 commercial additions with a value of 2 renovations with a value of 3 agricultural with a value of $ 395,330.00 5,000.00 30,500.00 30,000.00 6,000.00 67,000.00 $ 533,830.00 Money received for permits Value of permits for October 1983 $ 1,848.00 $ 229,960.00 . On motion of Drury & Johnson that the Report of the Chief Building Official be received as presented. Chief Building Official brought to attention of Council the following items and actions prepared for each. (1) Status of Fuda Addition (2) Status of D. MacDougal property and Building used for Auto Body Repair Shop for which a Building Permit has not been applied for or issued (3) Status of use of Partridge Agricultural Building Road Supt., Fred Haughton was present at 1:30 p.m. to present his report for work done during the month of October, 1984 and Vouchers 10 and lOA to cover same. On motion of Drury and McEwen the Report of Road Supt as presented be accepted as satisfactory and Treasurer authorized to issue cheques in payment of same to a total of $ 128,004.91. Road Supt. reported on the present status of gravel crushed and applied to date as well as the pit run gravel. Also Hawkestone Police Village proposal to reconstruct Robinson Street. Road Supt. also reported on problems with the two Graders No. 15 and No. 22 as well as several other items. . Pg. 250 . TWENTY-FIRST MEETING - OCTOBER 31, 1984 The Planning Administrator attended at 2:30 p.m. to review Planning and Development matters with Council. The following was presented: Draft Official Plan condensation from the City of Barrie, advising that a public meeting was held onOctober 29, 1984, followed by four public open house sessions, from 9:00 a.m. to 9:00 p.m. in the Council Chambers, Barrie City Hall, from October 30 through November 2, 1984 inclusive, to present a proposed new Official Plan for the City of Barrie. On motion of McEwen and Johnson that the notice of public meetings and open house presentations with respect to the proposed Barrie Official Plan be received and placed on file. Presented correspondence from the Ministry of Municipal Affairs and Housing, regarding the deferral of Section 5.8.5 of the Official Plan proposed by Section 2.41 of Amendment No. 15, "The North Oro Study", pertainin9 to severance policy for areas designated agriculture within the Official Plan. On Motion of Johnson and Drury that the Ministry's correspondence be referred to the next meeting of the Oro Planning Advisory Committee for review and recommendation to Council. . Further to direction given at the previous meeting of Council, documentation and By-laws were presented to adopt proposed Amendment Nos. 19 and 20 to the Township's Official Plan, and to rezone the lands affected. On motion of Johnson and Drury that the By-law to adopt Amendment No. 19 to the Official Plan, establishing policies to allow a second dwelling as an accessory use for a grounds- keeper on I'NA-Natural Area" zoned lands, as introduced, be numbered 1367/84 and read a first time. On motion of Drury and Halfacre that By-law No. 1367/84 read a first time be read a second time. On motion of Halfacre and McEwen that By-law No. 1367/84 read a second time, be read a third time. On motion of McEwen and Johnson that By-law No. 1367/84 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. On motion of McEwen and halfacre that the By-law to implement Official Plan Amendment No. 19, to permit by exception, second residential dwellings on Part of Lot 28, Concession3, being on Part 1 of Plan 51R-12673 and on Part 1 of Plan 51R-10726, as introduced, be numbered 1368/84 and read a first time. . Planning Administrator to arrange for the notice of passage to be given as required under the Planning Act. On motion of Drury and halfacre that the By-law to adopt Amendment No. 20 to the Official Plan, redesignating Part of Lot 28, Concession 5, from "Environmental & Woodlot" to "Estate Residential", to permit the additional development of two estate residential lots within Plan 51M-187, as introduced, be numbered as By-law 1369/84 and read a first time. On motion of Halfacre and McEwen that By-law No. 1369/84, read a first, be read a second time. On motion of McEwen and Johnson that By-law No. 1369/84, read a second time, be read a third time. . Presented a By-law to authorize execution of an Addendum to the Windfield Estates Subdivision Agreement, entered into July 21, 1980 in respect of the development to be implemented through Official Plan Amendment No. 20 on block 37, Plan 51M-187. On motion of Johnson and Halfacre that the By-law as introduced, be numbered as By-law No. 1370/84 and read a first time. On motion of Halfacre and Drury that By-law No. 1370/84 read a first time, be read a second time. On motion of Drury and McEwen that By-law No. 1370/84 read a second time, be read a third time. On motion of McEwen and Johnson the By-law No. 1370/84 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Reeve and Clerk to execute all documentation as required. Planning Administrator to arrange for registration of the executed agreement addendum on land titles. . Advised that further to circulation of By-law No. 1362/84, to rezone Part of Lot 2, concession 7, to implement Amendment No. 17 to the official Plan and permit development of Draft Plan 43T-84013, that two letters of objection had been received on the last day of the appeal period, October 23, 1984, from John L. Hare and Neil McNiven. Also advised that the two letters of objection have been referred to the Township's Planning Consultants, Ainley & Associates Ltd., for preparation of a Draft response to the objectors which will be presented for Council's consideration. Pg. 252 . TWENTY-FIRST MEETING - OCTOBER 31, 1984 On motion of Drury and Halfacre that the letters of objection presented be confirmed as received and follow-up action taken deemed satisfactory. Presented Planning Advisory Committee resolution 1984.4.5 with respect to a recommendation accepting the terms of reference prepared by Ainley & Associates Ltd. to undertake a review of the Township's Zoning By-law and Official Plan, at a maximum upset project cost of $13,800.00, subject to approval of a Community Planning Grant by the Minister of Municipal Affairs and Housing. On motion of Drury and Halfacre that Council, further to their resolution of November 24, 1983, concur with resolution 1984.4.5 of the Oro Planning Advisory Committee, and authorize Ainley G Associates Ltd. to carry out the consulting work items as set out in their terms of reference dated October 2, 1984, at a maximum upset project cost of $13,800.00 as set out therein, subject to approval of a Community Planning Grant application relating to that work by the Minister of Municipal Affairs and Housing. Presented Planning Advisory Committee resolution 1984.4.3 with respect to proposed Official Plan redesignation and re-zoning of Part of Lot 7, Concession 14. Councillor Johnson declared a conflict of interest as land owner of one of the properties concerned, left his chair and vacated the Council Chambers. . On motion of McEwen and Halfacre that Council concur with resolution 1984.4.3 of the Oro Planning Advisory Committee to redesignate more accurately the extents of environmental, agricultural and rural lands on part of the east half of Lot 7, Concession 14. On receipt of the planning application fees set out in By-law 1334/83 from the proponents, Planning Consultants, Ainley & Associates Ltd. be authorized to prepare the necessary amendments for Council's Consideration. Councillor Johnson re-attended the meeting. Parks & Recreation Advised of correspondence from the Chairlady of the Oro Community Centres, Parks & Recreation Committee, to the Honourable Reuben Baetz, Minister, Tourism & Recreation in respect of the proposed "Framework for a Provincial Policy on Community Recreation Services" and response from the Honourable Reuben Baetz and Alan McLean, M.P.P. On motion of McEwen and Drury that correspondence as presented be placed on file. Advised of a meeting called by Deputy-Reeve J. McEwen, Chairlady, O.C.C.P.R.C., to further investigate a proposed Parks Master Plan with the Ministry of Tourism and Recreations Field Consultant, Murral Minshall. Meeting to be held at the Ministry's Offices, Court House Building, Barrie, on Monday, November 5, 1984 at 10:30 a.m. . further to recommendation of Committee of Council given October 25, 1984, the Deputy Clerk presented a further draft of a Procedural By-law, based on the 1982 Draft presented to Council incorporating the more recent recommendations of the July, 1984 report of the "Provincial/Municipal Working Committee on open meetings and access to information" forwarded by the Ministry of Municipal Affairs & Housing on October 18, 1984. ~ Pg. 253 I TWENTY-FIRST MEETING - OCTOBER 31, 1984 On motion of McEwen and Halfacre that a Draft of a Procedural By-law as received by all members of Council be introduced for study and comments of Council, which are to be further considered at the next Committee of Council and Council Meetings. Presented letter from Concerned Residents of Oro Township, Bass Lake, with respect to Street Lights Two lights on Broadview Avenue and one at Broadview and Line 14. Also presented copy of letter fo Concerned Residents Bass Lake Area advising that a Petition signed by the majority of Ratepayers of the area involved, be submitted including as- surance in writing that the said Ratepayers involved would be prepared to assume the cost of the lights, installation of same by Ontario Hydro and future energy maintenance. All of which is required before the township can request Ontario Hydro to present an estimated cost for the number of lights required. Letter also advised Ratepayers of the estimated costs as has been made available to the Township from Ontario Hydro for street lights of an area presently in the process of installation. On motion of McEwen and Drury that the letter from Concerned Residents of the Bass Lake Area with respect to Street Lights on Broadview Avenue and Line 14 and Clerk's reply be received and filed until further communication is received from Concerned Residents of Bass Lake Area. Presented News Release from the Ministry of Ministry of Natural Resources, announcing changes to Provincial Floor Protection Criteria. . On motion of Halfacre and McEwen that letter be received and filed for reference. Clerk advised that as instructed at a Committee of Council meeting a notice had been placed in the Barrie Examiner and Packet and Times calling for quotations for the servicing of oil furnaces in Township Buildings at eight locations for the 1984/85 Season. In response two quotations were received. A-I Oil Burner Service - R.R.#l Hawkestone, Ontario, LOL 1TO Comprehensive Service & Parts Protection for Domestic Oil Heating As per Attached Copy of Agreement Note - Paragraph 2: Cost of Initial Cleanout and Service - $37.00 per cleanout and/or $30.00 per hour extra labour plus parts to bring equipment to minimum standards for Parts & Service. Cleanout and overhaul at end of Heating Season included in Parts Plan. Plan 8 Furnaces @ 79.95 per furnace. $ 639.50 - Box 2356 Orillia Ontario L3V 6V7 . Cleanouts are charged at rate for Oil $74.95 per furnace $24.00 during the day 28.00 during the night of $32.00 per unit plus parts required. RST MEETING OCTOBER 31 1984 On motion of Halfacre and McEwen that the Clerk-Treasurer to accept the lowest quotation after review of same and advise both parties that forwarded quotations. The Report is currently being reviewed by the Ministry, A.M.O. and A.M.C.T.O. Copy of the report was made available to all members of Council and the Deputy-Clerk. On motion of Halfacre and Drury that the letter and report be received and to be reviewed by all members of Council. Presented Report of Live Stock Valuer for one Ewe killed by a Wolf, for reasons as outlined in report. Owner of Ewe - Jack Perryman, Lot 17, Cone. 13. On motion of McEwen and Halfacre that Report of Live Stock Valuer for one Ewe killed, owned by Jack Perryman of Lot 17, Concession 13, be accepted and Treasurer authorized to issue cheque in payment of same to Jack Perryman, to a total of $85.00 once necessary affidavit has been taken by Jack Perryman. And further the Form 1 be completed to Ministry of Agriculture and Food as an application for Grant for Live Stock killed by Wolf. . 10. laws As recommended by Committee of Council, letter and Draft Fencing By-law be presented to meeting of Council for further consideration. After discussion it was moved by Halfacre and seconded by McEwen that a By-law to perscribe the height and description of Lawful Fences within the Township of Oro, as prepared by Solicitor, be introduced as By-law No. 1371/84 and read a first time with the added paragraph to repeal By-law No. 1123 and all other By-laws inconsistent with this By-law. On motion of McEwen and Johnson and By-law 1371/84, read a first time, be read a second time. On motion of Johnson and Drury By-law No. 1371/84, read a second time, be read a third time. On motion of Drury and Halfacre By-law 1371/84 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve, copy of same be provided to Township Fence Viewers, Zoning Administrator, Chief Building Official and members of Council. Parks & Recreation Deputy-Reeve McEwen presented a written report of the attendance of the Warden's Ad Hoc Highway #93 Committee which was held on October 29, 1984 at the County Building. Councillor Robert Drury requested the Oro Township Fireman's Association be sent a letter of appreciation for their efforts in arranging for a Turkey Shoot which was a successful fund-raising project.
