FIFTEENTH MEETING OF COUNCIL
Oro Council met this morning at 9:00 a.m. pursuant to adjournment with
the following members present:

Opening - Reeve Stephen Davie opened the meeting at 9:00 a.m. with prayer.
Declaration of Conflict of Interest - none declared.
Minutes - The minutes of the last regular meeting of July 3, 1984 were on
motion of McEwen and Halfacre, confirmed as printed and received.
Letters Forwarded - from the last regular meeting of Council held on July 3, 1984:
- Ministry of Agriculture and Food - forwarding copies of three(3) applications
for Tile Drainage Loans as approved by Council to a total of $16,200.00 loan,
which when added to earlier applications for $2,900.00 equals $19,100.00,
being within $100.00 of total Township allocation for 1984 of $19,200.00
(total estimated cost for same $32,213.00).
- copies of letters to Larry Hastings advising that his application for Tile
Drainage on E~ Lot 19, Conc. 6 for $6,000.00 had been approved by Council;
Murray W. Clark, E~ Lot 15, Conc. 1, advising that his application had
been approved for a loan in the amount of $6,000.00; William A. Clark,
W~ Lot 15, Conc. 1, advising that his application in the amount of $4,200.00
had been approved by Council.
- Delno Jermey, Tile Drainage Inspector advising of three Tile Drainage Applications
and requesting he complete Fo~8 when Tile Drainage work has been completed
in order to permit processing of documentation for the Tile Drainage Loans.
- Barrie Examiner and Orillia Packet forwarding Ad to be placed in 4 issues
of each paper for application for Arena Manager and Assistant Arena Manager;
- Ministry of Agriculture and Food forwarding Form I application for
reimbursement of compensation paid for Live Stock killed by wolves, belonging
to Jack Perryman and Bruce Anderson.
- Jack Perryman and Bruce Anderson forwarding cheque for the compensation of
live stock killed by wolves.
- G.R. Morrison, District Signs and Building Inspector, M.T.C., re: application
by J. McDowell for temporary sign on property of Fuda Foods Ltd. advertising
Kempenfelt Dock Service.
- Mr. Bernard Walsh, Representative Fire Marshall IS Office, requesting
assessment of Fire Chief and Deputy Fire Chief be included in Municipal
Fire Protection Survey for the Township of Oro.
- Oro District Lions Club re: application for Special Occasion Permit for the
Oro Fest 1984 to be held in Oro Township Arena and for Special Occasion Permit
for four occasions at the Barrie Speedway.

for street dance to be held August 10, 1984 - copy of letter to H.P.V. Trustees.
Oro Township Agricultural Society re: judging of Queen Contest at Oro
Fair advising that Councillor Johnson would be attending as Judge.
Barrie Agricultural Society re: entry of team for Politicians Milking Contest.
Simcoe Side Ratepayers Association re: boat launching at foot of
Blackman Blvd and reply advising the Association do not wish to pursue
this matter any further at this time.
Dr. & Mrs. Gavin James re: placing of trailer on property during
construction of residence on lot.
Mr. Harold Donnelly and Grace Bryant re: grave at Lot 11, Concession 6
(abandoned cemetery).
Canadian National Railways re: account for Line 3 at mileage 70.50
with copy ot County of Simcoe Road Committee.
Revenue Canada - application for additional number for part time employees.
M.N.R. re: Wayside Pit, Lot 22, Conc. 4 - new owner agreeable to rehabilitate
same.
Simcoe Timberlands re: unsafe building (Lot 35, Conc. 2)

On motion of Drury and Johnson, copies of letters as presented and forwarded
accepted as satisfactory and same be placed on file for reference.
Presented letter from Ministry of Transportation and Communications to confirm
acceptance of Council's action of awarding Contract 84-B4C for the construction
of Lakeshore Road to Lee Hart Construction Inc. at a total cost of $48,996.00
(lowest of five tenders).
On motion of Johnson and Drury letter from M.T.C. as approval of Council's
acceptance of tender of Lee Hart Construction Inc., subject to all work carried
out in accordance with requirements of Ministry, be received and filed for
necessary reference.
Presented letter from Ministry of the Environment in response to Council's
request for burning of wood at the Waste Disposal Site, advising of conditions
under which burning could be carried.
On motion of Drury and Halfacre, letter be received and burning of wood at the
Waste Disposal Site, be carried out on a limited basis under conditions
listed in the letter.
Presented copy of letter to Barrie Automotive Flea Market Association from
M.T.C. with respect to application for Land Use Permit for proposed Special
Events Park on Lot 21, Concession 8, setting out requirements of the Ministry.
On motion of McEwen and Halfacre, copy of letter be received and filed for
reference as required when the application by Barrie Flea Market is presented
for consideration.
Presented letter from the Hon. Margaret Birch, Parliamentary Assistant to
the Premier of Ontario acknowledging receipt of list of persons nominated
for awared of the Ontario Bicentennial medal.

Presented letter from Clowes Women's Institute acknowledging payment for
cleaning of the African Church and requesting a picnic table be placed at
the site and offering to donate the $20.00 received towards the purchase
of a picnic table.
On motion of McEwen and Johnson letter be received and Clowes Women's Institute
be advised that a picnic table will be placed at the African Church for the
summer months.
Presented letter from the Ontario Humane Society forwarding, as promised,
copy of Model Animal Control By-law which is recommended by the Society to
municipalities interested in providing a modern approach to animal control.
On motion of Drury and Johnson that the letter and model by-law be received
and a staff report of the said by-law be presented at next Committee of Council
meeting.
Presented letter from Co-Ordinator, Hawkestone facilities, Ukranian National
Federation of Canada further to meeting with Oro Council on June 26, 1984
advising that a submission for consideration will be made shortly. In the
meantime would request copies of the Official Plan and Zoning By-laws as they
apply to the lands of the Ukranian National Federation in Hawkestone.
On motion of Drury and Johnson, letter be received and copies of portions of
the Official Plan and Zoning By-law as they apply to the lands of the Ukranian
National Federation be prepared and forwarded by the Planning and Zoning
Administrator.

Recommendations of Committee of Council - meeting of July 11, 1984
1. Quadrant Development Water System - Plan M-157
Ron Young advised Committee of Council that a problem had arisen with the
water system and required repairs, also that the owner of Lot 8, Plan 232
had connected to the system.
After further consideration, Council passed the following resolution:
On motion of Halfacre and Johnson that a letter be forwarded to Quadrant
Developments with respect to repair of the system and advise that the Township
maintenance person for water systems may be instructed to repair same,
provided that Quadrant Developments assume the costs for repair of same.
2. Disturbance - Lot 232, Plan 626
A delegation of ratepayers from Plan 1488 and Plan 626 attend a Committee
of Council meeting regarding problems at the said property and hazardous
conditions of parking on roads to obstruct traffic. The matter of noise and
misuse of property, disturbance to property owners in the area was further
considered by Council (list of problems in Committee of Council minutes).
On motion of Halfacre and Drury as recommended by Committee of Council a
. registered letter be forwarded to the owners of Lot 232, Plan 626 and relate
the problems that have occurred on the said property on long weekends by
group of young people, which have created a disturbance and concern to
property owners in the area.

On motion of McEwen and Drury the Chief Building Official and Simcoe County
District Health Unit inspect the property of Harold and Corine Petrie,
Lot 232, Plan 626 to determine the sanitary use of the building and safety
of same.
Presented letters from Simcoe Side Ratepayers, which were delivered by
hand to Committee of Council on July 11, 1984.
(a) Letter further to presentation to Committee of Council, enclosing
petition requesting Council to consider passing a "Noise Control
By-law".
(b) Letter advising of new executive of the Simcoe Side Ratepayers
Association for 1985 and list of the executive.
On motion of Johnson and Halfacre, letters as presented be received and
Association to be advised at a later date with respect to "Noise Control
By-law" which is presently under review by Council.
Fuda Foods Addition
Recommendations of Committee of Council following the meeting of July 11, 1984
at which Mr. Rocco Fuda was present to discuss a request for clearance
for partial occupancy of the addition, was further considered.
On motion of McEwen and Halfacre, as recommended by Committee of Council
the Chief Building Official consult with the Engineer for Fuda Food Ltd.
and proceed in the normal manner for all requirements prior to issuance
of a partial occupancy for the addition.
Plan 1 - Roads and Survey for H. Monteith
Oro Council further considered the discussion and presentation by Township
Solicitor D.S. White with respect to the survey now obtained for the property
showing roads and location of building. Also proposals for road closings, etc.
On motion of Halfacre and Drury, that the Township Solicitor proceed to review the
matter of the Roads of Plan One with Township Planning Consultants and further
advise Oro Council in this regard, taking the Township's best interest of
planning into consideration.
Front End Loader Rental for Roads Department
On motion of Johnson and Drury that Oro Council authorize the rental of an
articulated power loader, 4 wheel drive, 2 cubic yard, from Volvo BM Canada
on basis of $2,200.00 per month and that the rental less interest be applied
to purchase price of the loader in 1985, provided that the purchase of a
loader may be included in be 1985 Road Expenditure Program.
Draft Fencing By-law and Noise Control By-law
On motion of Halfacre and Drury that as recommended by Committee of Council
the draft By-law to amend the Township Fencing By-law No. 1123 and draft
Noise Control and Anti-nuisance By-law be forwarded to the Township Solicitor
for review and comment.

4It Request for Building Permit by Gordon Keith
On motion of Drury and Halfacre~ that as recommended by Committee of Council
this matter be further considered after Draft Plan approval has been received
for the proposed development on Part Lot 2, Concession 7.
Drainage Tile
At proposed ball diamond, drainage tile to be completed by the Oro District
Lion's Club. Drainage Tile is to be constructed to take the water from
the parking lot and Hawkin's Ga/rage lot and proposed ball diamond area
to ditch on Line 4.
On motion of McEwen and Halfacre, that as recommended by Committee of Council
the cost of the Drainage Tile from parking lot in front of arena and Hawkin's
Garage lot and proposed ball diamond area be assumed by the Township of Oro
to a total of $880.00.

On motion of Halfacre and Johnson, correspondence, communications, etc.
as presented be received and filed.
Presented letter from Ontario Good Roads Association forwarding a decal
to recognize that the Township Road Supt. Fred Haughton has completed
another three day course in the "C.S. Anderson" Road School sponsored by
the Ontario Good Roads Association. The decal is to be affixed to the
certificate previously presented to the road employee.
Letter requests that this matter be brought to the attention of Council.

On motion of Drury and Johnson letter be received and the decal be presented
to Road Supt. in order that he may affix the decal to his certificate.
The decal was presented to the Road Supt. by the Chairman of the Roads
Committee, Councillor Allan Johnson.
Presented notice from Association of Municipalities of Ontario (A.M.a.)
request for nominations to 1984-85 A.M.a. Board of Directors. The
nominating Committee will meet on July 26, 1984 and it is therefore imparative
that all nominations be received on or before that date.
On motion of McEwen and Johnson notice from A.M.O. be received and filed.
Presented letter from Molnar Systems Groups with respect to period of guaranteed
maintenance for the general ledger, accounts payable, and tax systems began
on June 1, 1984. Also sample of standard Software Support Agreement that
will be put in place at the end of the guaranteed maintenance period. The
cost of the services provided under the agreement are one percent (1%)
per month of the original software cost.
On motion of Johnson and Drury, letter and sample agreement be received
and placed on file.
Presented letter from Ontario Humane Society requesting Council's consideration
for a 6% increase for services effective January 1, 1984.

On motion of Drury and Johnson that the letter be received and Clerk to
advise the Ontario Humane Society that budgetary considerations should be
received in November of the previous year to be included in the budget
for the following year.
Presented copy of letter from Township of Essa to City of North York forwarding
resolution of the Council of the Township of Essa in support of locating a
dome stadium in the City of North York at the Downsview Site. Requesting
same be placed before Council for consideration and endorsement.
On motion of Halfacre and Drury, Oro Council support and endorse the resolution
of Township of Essa.

Presented letter from Norman E. Shelswell, Real Estate, advising that
Mr. J.R. Hunter of Ricketts, Harris and Keachie, Barristers & Solicitors
have granted Norman E. Shelswell Real Estate authority to present for sale the
East Half of Lot 9, Concession 6.
On motion of Johnson and Drury, that David N. Shelswell of Norman E. Shelswell
be requested to attend the next Committee of Council meeting.
Presented a draft By-law to appoint Mr. Andrew Clark, Tile Drainage Inspector
for the purposes of the Tile Drainage Act.
On motion of Johnson and Drury, that the By-law introduced be numbered
13.55/84 and read a first time.
On motion of Drury and Halfacre, that By-l~w No. 1355/84 read a first time,
be read a second time.
On motion of Halfacre and McEwen, that By-law No. 1355/84 read a second time,
be read a third time.
On motion of McEwen and Johnson that By-law No. 1355784 now read a third time,
do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Clerk
to advise of appointment as required.

Mr. Ron Robinson of Ainley & Associates Ltd. was present at 11:35 a.m. to
report on status of various subdiviso~and other work carried out by Ainley
and Associates to date.

Reeve Davie related several matters for which the Township Solicitor would
be contacting the Planning Consultants.

Road Needs Study - all traffic counts have been completed. Road widths are
presently being studied.
Energy Study - report should be available in August.
Subdivisions - Langman Subdivision according to copy of letter presented
under correspondence.
Windfield Subdivision - Ainley & Associates have not received amendment
to the roads on the plan.
Phase II of the development proposal was presented
for discussion.
Lakeshore Construction - it was suggested that Mr. Ron Robinson visit the
construction area in the 10th Concession.
Rowanwood Subdivison - road construction on this development was discussed.
Mr. Ron Robinson was also asked to attend this site
for comments.
The Planning Administrator was present at 11:50 a.m. to review planning
and development matters. The fOllowing was presented:

- complaint received from Mr. A. Carter, Pt. Lot 27, Concession 7, Roll 9-352
response from Chief Building Official and inquiry to Ministry of Natural
Resources regarding approvals or permits to undertake shoreline improvement
works.
- advised that draft IIFencell and IIAnti-Noisell By-laws have been forwarded
to Municipal Solicitor and Ministry of Municipal Affairs and Housing for
review and comment prior to the next meeting of Council.
- advised of meeting arranged with Ministry of Natural Resources and Ainley
and Associates, at 10:15 a.m. Tuesday, July 17 at the Plan 626 promenade
to investigate shoreline improvement requirements on-site.
- advised of site visit attended with the Chief Building Official, to
the proposed Rowanwood Sbudivision, part Lot 2, Concession 7, to determine
whether or not a partially completed structure on the property would
qualify for a residential building permit. Provided that the portion
of the building beneath the uppermost level is totally finished as a living
area within the provisions of the Ontario Building Code, and is sited to
comply with the IICR - County Residentialll setback provisions of the Zoning
By-law it would appear that the structure would qualify for a residential
building permit once the proposed subdivision is registered and the internal
access road has been dedicated to the Township and is constructed to
municipal standards.
The matter of advertising for Office Staff replacement was presented for
Council's consideration along with letter from one staff member.

On motion of Halfacre and Drury, that the Clerk be authorized to advertise
for one staff subsequent to staff meeting on the topic of office structure.

Road Supt. Fred Haughton was present with respect to road matters and progress
of construction work.
Present from Plan 985 to consider with Council the matter of Poplar Crescent and the
lakeshore construction were the following ratepayers:

Mr. R. Jones acted as spokesman for the delegation.
Mr. Jones mentioned that Councillor Johnson had attended a meeting on Saturday
and referred to the following concerns:
- detour route on Poplar Crescent
- signs at both ends indicating same
- property owners had placed gravel on ,roads to level the holes which
had been disturbed by grader
Township erect slow signs - warning children in area during the construction
period
- dust control due to traffic
speed of additional traffic
- removal of gravel from top of road while grading
- allowance re: upkeep of Lakeshore Road
could Township bring forth a road levy to each property owner
- vacant lots have created some difficulty
- 8 permanent ratepayers who contribute financially to maintenance of the
road (30 lots on the subdivison)
Comments by Dennis Aikens - co-operation from Roads Dept.
- detour signs not authorized by Township Road Dept.
- road levy an assistance to the Association
- slow signs and children signs
Road Supt. advised that at no time was it indicated to Lee Hart Construction
that Poplar Crescent was to be used as a detour route.
Not asking the Township to take over the road but ask that the Township
assist to recover the road to the original condition.
Ba~ically the delegation indicated that they would have no major objection
to use of Poplar Crescent being used as a detour road, provided that the
road would be replaced to its original with gravel and in the interim the
requested signs be erected and dust control applied during the period of
construction.
Report of Road Supt.
Road Supt. related the progress of the work by the Contractor on Lakeshore
Road and the unfortunate situation that has taken place during the said work.
Road Supt. reported that the paving of 15/16 Side Road had commenced and
that when this is completed the Contractor will move to the Lakeshore Road
in Concession 7.

Presented letter from D.S. White,Q.C., Solicitor advising that the
purchase of land from Cumming, Part Lot 20, Concession 5 (Part 1 - Reference
Plan 51R-12666) Township of Oro, by Oro and District Lions Club and
submitting final report and enclosing copy of deed of the property to
the Municipality, registered as Instrument No. 834231 - along with account
for professional services, disbursements, and legal fees for Solicitor
for the Vendor. Letter also contains Solicitor Certificate of Title,
Survey Plan 51R-12666.
On motion of Drury and McEwen that the letter from Stewart, Esten and
enclosures, including deed registered as Instrument No. 834231 and Survey
Plan 51R-12666 along with account and other documents pertaining to this
item be received and filed for necessary reference and Treasurer to forward
cheque to Oro District Lions Club in accordance with resolution of Council
passed June 4, 1984.
On motion of Drury and Johnson, adjourn to meet again on Tuesday, August
7th, 1984 at 9:00 a.m. and that this meeting be advertised.
