McEwen (Absent until 3:45 p.m.) R. Drury T. Halfacre A. Johnson Deputy Reeve McEwen was absent until 3:45 due to previous committment. Opening Reeve Davie opened the meeting at 9:00 a.m. with prayer. Declaration of Conflict of Interest - None declared. Minutes The minutes of the last regular meeting of June 18th were on motion of Johnson and Halfacre, con- firmed as printed and received. Ies of Letters Forwarded - As instructed from the last regular meeting of June 18, 1984, as follows: -Barrie Examiner & Orillia Packet - Notice of change of meeting from July 2nd to July 3rd, 1984. -Lee Hart Construction Inc., advising that their tender had been accepted for Township Tender Contract 84-B4C for reconstruction of Lakeshore Road. -Copy of letter to all bidders to Tender Contract 84-B4C advising of tender accepted and acknowledging appreciation of tenders. -Volvo BM Ontario advising that their Tender for the supply of one 1984 Articulated Power Loader, four wheel drive, 2 cubic yard, had been accepted by Council and resolution accepting the tender. -Crothers and Truck & Tractor Equipment Ltd., advising that the tender of Volvo BM Ontario had been accepted and expressing Council's appreciation for their tender and interest. -Sheridan Nurseries Ltd., advising that application for Tile Drainage Loan had been accepted by Council according to required conditions of the Ministry of Agriculture and Food. -Tile Drainage Inspector advising of acceptance of Sheridan Nurseries Ltd., application and forwarding Form 8 (Tile Drainage Completion Report) requesting same be completed as soon as possible in order for documentation for the Loan to be compelted. -Ministry of Agriculture & Food advising of application for Tile Drainage received and aniticipated application in response to Ministry letter requesting Tile Drainage Application in order to review Province wide requirements of allocation for 1984. -The Hon. On motion of Johnson and Halfacre, copies of letters as presented and forwarded, be received and filed for reference. Presented letter from Keith Post, Regional Director - Ontario, Railway Transport Committee with respect to Crossing, Canadian National Railways, Concession 1 and Range 1 Mileage 68.30 Newmarket Subdivision CTC File No. 26711.2271, setting out conditions for Township of Oro and C.N.R. for installation of two flashing lights, signals and bell. On motion of Halfacre and Drury, that the letter be received and filed. Presented letter from Ministry of Municipal Affairs & Housing with respect to installation of BACPAC System and forwarding cheque in the amount of $2,500.00, being 50% of the BACPAC Application follow- ing submission of Interim Report. Clerk also presented copy of letter requesting extension of Final Report to September 30, 1984. On motion of Halfacre and Drury, letter be received and cheque under BACPAC grant in the amount of $2,500.00 be credited to proper account and Clerk to follow-up with final report in conjunction with the Township Auditors when the report may be completed in order to receive balance of the grant. Clerk advised that Township Solicitor, D.S. White, Q.C. had advised that the purchase of property by Oro District Lions Club from Len Cumming, is to close shortly and the Township portion of amount for future Road Reserve should be forwarded to Oro & District Lions Club once the transaction is completed. On motion of Drury and Halfacre, that as authorized at a meeting of Oro Council held on June 4, 1984, Treasurer to forward cheque in the amount of $2,672.55, from Capital Reserve Fund and forward same to Oro District Lions Club once Deed to property is received from Township Solicitor and legal fees be paid when account is received from Township Solicitor. """'lIlIIII Pg. 159 H ING JULY 3 1984 On motion of Halfacre and Johnson, letter be received and Planning Administrator, in conjunction with Township Planning Consultants, prepare proposed plan to deal with Plan 626 waterfront improve- ment request and application as applied for to M.N.R. Presented letter from Jan Hulland, Principal of East Oro Public School in response to Township letter of June 15, 1984 requesting comments or suggestions for the Student Reeve of the Month program. And, letter from Tracey Hastings, expressing her appreciation for the opportunity to participate in the Township program of Student Reeve of the Month, and being the first Student Reeve. Letter indicates that it had been a rewarding experience to sit in on Council Meeting, tour of the Roads with the Road Supt., and tour with Fire Chief of the Fire Department. Suggesting that possibly, consideration could be given to appoint a Deputy Student Reeve, in this way two students at a time could share the experience. On motion of Johnson and Drury, letter be received and filed for reference until further review of the program, after all schools have participated in the Student Reeve program, is scheduled by Council. Presented letter from D.S. White, Q.C., Township Solicitor, advising that a Survey has now been received from Mr. Monteith showing driveway leading from his house to the Ridge Road and requesting a meeting with Oro Council in order to finalize the matter with Mr. Monteith. On motion of Johnson and Drury, letter be received and Mr. D.S. White be requested to attend the next Committee of Council Meeting to be held on July 11, 1984. Also, to be considered at this meet- ing with Mr. D.S. White, is the matter of proposed shoreline improvement on Plan 626. Recommendations of Committee of Council Meeting of June 27, 1984 a) Driftwood Property As recommended by Committee of Council, the matter of 4 x 4 races at Pt. Lot 20, Conc. 11, was again presented for further consideration, along with letter of complaint from Martin M. Rain, Pt. Lot 21, Concession 12. (Background Information - By-Law Enforcement Officer's Report referred to Township Solicitor - Staff Report from Zoning Administrator). On motion of Johnson and Drury, that this matter be held In abeyance pending receipt of the Solicitor's comments. b) Application by E.R. Alexander Construction Co. Ltd. annual tonnage Increase for Licensed Pit on Lot 8, Con. 7. As recommended by Committee of Council, matter be further considered at meeting of Council today, July 3, 1984. On motion of Halfacre and Drury, that this matter be referred to Road Committee for comment and recommendations. c) Designation of Highway 93 as Heritage Highway After further consideration of Report No. 13 of the County of Simcoe Roads & Transportation Committee, the following resolution was passed: On motion of Drury and Halfacre, that as recommended by Committee of Council, the Oro Township History Committee pursue the proposal to have Highway #93 designated as a Heritage Road and arrange a meeting with the appropriate Department of the County of Simcoe. """II1II Pg. 160 FOURTEENTH MEETING - JULY 3, 1984 d) Oro District Lions Club requests of Council i) Approvals for Oro Fest '84 - August 18, 1984 On motion of Drury and Halfacre, that Oro Council would have no objection to application by Oro District Lions Club for (a) Special Occasion Permit for the Oro Fest '84 and (b) License for Monte Carlo Event. And, that the Oro District Lions Club obtain necessary approval and requirements for number of portable toilets and other necessary health and safety precautions. ii) Oro District Lions Club special occasion permit at Barrie Speedway for four Special Events. On motion of Drury and Halfacre, that Oro Council have no objection to the application by Oro District Lions Club for a Special Occasion Permit for events to be carried out at the Barrie Speedway on Pt. E~ Lot 22, Con. 8, on four separate occasions as requested by the Oro District Lions Club for June 1,2 & 3; July 20,21 & 22; July 27,28 & 29; and Sept. 7,8 & 9, 1984, subject to proper controls and Ontario Provincial Police patrols. e) Advertisement for Arena Manager & Assistant Arena Manager On motion of Halfacre and Drury, that as recommended by Committee of Council, the draft advertisement for Arena Manager and Assistant Arena Manager, as presented, be accepted as satisfactory and ad- vertisements be placed in appropriate newspapers for 4 issues. f) arnival Committee - according to recommendations of Committee of Council. On motion of Drury and Halfacre, Oro Council would have no objection to an application by the Hawkestone Carnival Committee for a Special Occasion Permit for the Street Dance to be held on August 10, 1984 at the Hawkestone Open Air Rink, for a Beer Garden located within the said rink, provided that all requirements of the Simcoe County Health Unit and LLBO are adhered to and proper precautions and controls are arranged for. And, subject to the Hawkestone Police Village Trustees having no objection. g) Simcoe Side Ratepayers re: Boat launching at foot of Blackman Avenue. On motion of Johnson and Drury, that the Simcoe Side Ratepayers Association be advised that once a proposal is presented from the Association as to what the Association are prepared to do with respect to maintenance and erection of posts to discourage boat launching at the foot of Blackman Blvd and at the mouth of the Creek on Parklands of Plan 626, Council will review the proposal and advise the Association. h) Caution Signs on Road Allowance where horses are being exercised On motion of Drury and Johnson, that Caution Signs be obtained indicating horses along road as re- quested by Leslie Saila and that the costs for same be the responsibility of Leslie Saila. i) Fire Committee Report and Recommendations On motion of Halfacre and Drury, that the Fire Marshal's Office be requested to include with the Municipal Fire Protection Survey of the Township of Oro, assessment of performance by Fire Chief and Deputy Chief. ~ . . . On motion of Halfacre and Johnson, Council go into Committee of the Whole at 10:00 a.m. to consider the letter from Chief Building Official to Fuda Foods. On motion of Johnson and Drury, that Council come out of Committee of the Whole at 11:05 a.m. On motion of Drury and Halfacre, that the matter be left with the Building and Fire Committee and that the appropriate action be taken under the Building Code Act by the Chief Building Official following the result of the Chief Building Official's attendance at the Ministry of Municipal Affairs & Housing (Building Code Branch) on July 3, 1984 and results of same. Councillor Halfacre presented a report to Council as Chairman of the Fire Committee which she wished to have recorded in the minutes as follows: It is my considered opinion as Chairman of the Fire Committee of Council, that Council consider advertising for a full time Fire Chief. This could possibly eliminate the necessity of a Deputy Chief. On motion of Halfacre and Johnson, that based on the considered opInIon of the Fire Committee of Council, that for the benefit of the Township of Oro, Council consider advertising for a full time Fire Chief. Further, the Fire Chief and Mr. B. Walsh of the Fire Marshal's Office be invited to the next Committee of Council meeting to discuss this issue. Appointment: 11:00 a.m. Mr. T.I. Hughes, Executive Vice President, Ontario Humane Society was present along with Donna Koens, Orillia Branch and Wardens W. Walker and Tom Malloy as scheduled at the request of Mr. Hughes with respect to Township letter signed by the Deputy Clerk with res- pect to Animal Control practises. Mr. Hughes related to the several reference made in the Township letter signed by George Roberts, appeared libelous and damaging to the Society, and also presented what he referred to as facts, that Mr. Tom Malloy and other Warden had made every effort to capture the dogs in question and as last resort to kill the dogs with shotgun and authorized type of shot, in accordance with the policy of the Ontario Humane society. Also that it was not the policy of the Society to protect the Officer if it was felt that the officer had acted improperly. He further indicated that the Officer had been questioned on the matter and reprimanded on some of the methods used. ~ . . . ""'lIlIIII Pg. 163 FOURTEENTH MEETING - JULY 3, 1984 Reeve Davie replied to the comments and the position of the Society in this incident. Councillor Halfacre brought up the matter of using Tranquilizer guns. Mr. Hughes replied that it was illegal to use same and explained the preparation required to arrive at a proper dosage of drugs for such purpose which was not allowed. Mr. Tom Malloy related his experience of the incident. Reeve Davie questioned Mr. Malloy on type of gun and shot, to which Mr. Malloy repleid that he could only use what was authorized by the policy of the Society. Councillor Johnson asked questioned of Mr. T.I. Hughes and other questions were asked by members of Council. Mr. W. Walker advised of action taken by Mr. Malloy and his attempts and that he had assisted In this incident. Reeve Davie suggested the Society should possibly consider changing type of firearms and shot to be used by the Officers. Mr. Hughes suggested that Council possibly could consider adopting a model By-Law that would pena- lize owner of dogs that appear irresponsible. And further, suggested that Oro Council again review the letter to the Ontario Humane Society from the Township, which in the opinion of the Society deserves some withdrawal or apology. Mr. Gordon Keith and Dr. F. Abbott were present at 11:55 a.m. with respect to Building Permit, Stop Work Order and Council's authorization to proceed with the Building. On motion of Halfacre and Drury, that the Zoning Administrator and Chief Building Official to visit the site and report to Council as whether the present building qualifies for a residential Building Permit. Bill Ormerod, By-Law Enforcement Officer was present at 1:05 p.m. to report on several inspections: Pt. Lot 20, Con. 7 -(Previously Four Boys from Barrie) Also Pt. Lot 21, Con. 7. Plan 1488 re: Refrigerator with doors on it on property (The door has now been removed) Road Supt., Fred Haughton was present at 1:15 p.m. to present his report for work during the month of June and other matters pertaining to Roads. And Vouchers 6 and 6A to cover same. On motion of Johnson and Drury, the Report of the Road Supt., for work done during the month of June as presented, be received and Treasurer authorized to issue cheque in payment of the accounts to a total of $185,143.29. Presented letter from County Clerk forwarding copy of Report No. 17 of the Property, Protection and Reforestration Services Committee which was adopted, without Amendment by County Council on June 19, 1984 and copy of By-Law 3654, a By-Law to prohibit motorized vehicles in County Forest known as the Schumacher Tract, and being part of Lot 5, Concession 9, Township of Oro. Copies of letters to District Signs & Building Inspector, MTC as application for display of such sign, by John F. McDowell and copy of letter from Rocco Fuda regarding the sign. And letter from G.R. Morrison, District Sign Inspector MTC, setting out requirements, one of which being a written con- sent from the Township of Oro. On motion of Halfacre and Drury, that Oro Council would have no objections to the sign on a temporary basis as requested, provided that all requirements of the MTC are complied with in this regard. On motion of Halfacre and Drury, that the Chief Building Official be authorized to attend the Chief Building Officials Conference in Kitchener from September 30th to October 1st, 1984.
