Deputy Reeve David Caldwell chaired the meeting. 1. DISCLOSURE AND DECLARATION OF CONFLICT OF INTEREST: Councillor David Burton declared a possible Conflict of Interest with Item 4(d) of the Public Works Section of the agenda. The nature of his conflict is that Lynn Penley mentioned in Item 4(d) of this agenda is the sister of Councillor Burton. 2. DEPUTATIONS: a) 7:35 p.m. Mr. and Mrs. Brian Hobson were present to discuss with the Committee a drainage problem on property described as Lot 50, Concession 6, Plan 807. Also present and representing the corporation of the Township of Oro was Mr. Ron Kolbe, Chief Building Official and Mr. Fred Haughton, Public Services Administrator. Mr. and Mrs. Hobson requested that the municipality consider providing their property with a two foot ditch along the side of his property to alleviate the drainage problem; they also requested that the Public Services Administrator take action that would remove the culvert from Lot 19, Concession 5. Council said they would consider the Hobson's request at a later point during the agenda. c) 9:00 p.m. Mr. Murray Bateman and Mr. Tim Crooks, representing the Oro Lea Hall were present to discuss the possibility of the residents of the Hall assuming various Community Projects. Mr. Alfred W. J. Dick, Solicitor, was present to discuss two proposed Road closings in the Sugarbush area. (Miller/ DeMartini), (G.M. MOTION NO.2 Moved by Crawford, seconded by Burton It is recommended that the correspondence from the Ministry of Natural Resources concerning Development in Bass Lake Wetland, Lot 14, Concession 13, Township of Oro, be received and acknowledged, and further, the Administrator/Clerk is to advise Mr. Dan Mansell of the Ministry of Natural Resources that the municipality is very concerned with any development in recognized wetlands and is taking all appropriate measurers including possible legal action with regards to the construction that took place in this area. MOTION NO.5 Moved by Burton, seconded by Johnson It is recommended that the correspondence from Michael W. Shain, Township Solicitor, with regards to the Township of Oro Noise By-Law, be received, and further, the attached By-Law be placed on the next Regular Meeting of Council. Carried. , I - 5 - MOTION NO.6 Moved by Crawford, seconded by Burton It is recommended that the correspondence from Lynn Peterson, Project Manager, with regards to a questionnaire to be completed with regards to the County study Committee, be received, and further, the Administrator/Clerk is hereby directed to convene a meeting of Department Heads and Council to review and reply to the attached survey. MOTION NO.7 Moved by Burton, seconded by Crawford It is recommended that the correspondence from the Ministry of the Solicitor General with regards to Emergency Planning Conference to be held September 27th and 28th, 1990, be received, and further, the Fire Chief Paul Eenhoorn and Administrator/Clerk, be allowed to attend, if accepted at the above noted conference. carried. MOTION NO.8 Moved by Crawford, seconded by Burton It is recommended that the correspondence from the County of Simcoe's Clerks Office, with regards to: a) b) Georgina Drive, Part 1 RP51R-20014 be received; and, Road Closing between Concession 6 & 7, Sugarbush, be received. MOTION NO.9 Moved by Johnson, seconded by Crawford It is recommended that the Draft Proposed Agreement between the County of Simcoe, with regards to transferring the Administration of Waste Management back to the municipality, be received and further, the Township of Oro enter into the appropriate agreement with the County of Simcoe. MOTION NO. lO Moved by Burton, seconded by Johnson It is recommended that the correspondence from the City of Barrie with regards to an Agreement between the Corporation of the City of Barrie and the Corporation of the Township of Oro, with regards to the City of Barrie supplying the Township of Oro Dispatch Services, be received, and further, the Deputy Clerk prepare an appropriate By-Law to enact the agreement, and further, the Reeve and Administrator/Clerk be authorized to sign the said agreement once the By-Law has been passed. carried. - 6 - MOTION NO. II Moved by Burton, seconded by Crawford It is recommended that the firm of Aird and Berlis be hired to do all the Township's Legal Work, and further, Leo Longo act as the Township of Oro's Solicitor, and further, he be authorized to hire for related matters such as aggregate and/or planning work, solicitor David S. White and/or any other solicitor from the City of Barrie he may feel is appropriate for a particular legal matter, and further, this solicitor shall be recommended in consultation with the Administrator/ Clerk; and further, Mr. Longo and the firm of Aird, Berlis, shall be hired to carry out the Township's legal services as outlined as follows: a) Attendance at the municipality's monthly Technical Advisory Committee Meetings; Attendance at the municipal building on a once a month basis to review with Department Heads any outstanding issues; Attendance at Council and/or Committee Meetings on a request basis; A minimum of a quarterly report to Council and the Administrator/Clerk on the status of any outstanding issues; A detailed quarterly submission of all outstanding invoices including meetings with Township Officials, indicating the topic on which the meeting was held; b) c) d) e) and further, Mr. Longo be invited to a future Committee of the Whole Meeting to discuss fees. MOTION NO. l2 Moved by Burton, seconded by Crawford It is recommended that the Confidential Memo from Beth oosthuizen, Deputy-Clerk, with regards to the Township of Oro Industrial Park By-Laws being registered, be received, and further, we advise the Township Solicitor that we should attempt to have these By-Laws registered on title as the municipality feels it is imperative to do so. MOTION NO. l3 Moved by Burton, seconded by Johnson It is recommended that the Report from Fred Haughton, Public Services Administrator, with regards to tipping fees at Landfill Site, be received and adopted, and further, the Administrator/Clerk request permission from the County of Simcoe to adopt the above noted fees at the earliest possible date. Carried. - 7 - MOTION NO. 14 Moved by Crawford, seconded by Burton It is recommended that the Memo from Fred Haughton, Public Services Administrator, with regards to wages for Eric Douglas, be received, and further, Mr. Douglas's wages be adjusted as indicated in the Confidential Memo dated May 4, 1990. MOTION NO. l5 Moved by Crawford, seconded by Johnson It is recommended that the correspondence from Mr. & Mrs. Penley with regards to their request to hook up to the Harbourwood Water System, be received, and referred to the Township Engineer for a report back to Council. Note: Councillor Burton declared a possible Conflict as Mrs. Penley is his sister; he left the room before the motion was read or discussed. MOTION NO. l6 Moved by Crawford, seconded by Burton It is recommended that the Public Services Administrator, Fred Haughton, prepare tenders for one Tandem plow and sander and one, and one half ton cab and chassis. MOTION NO. 36 Moved by Burton, seconded by Johnson It is recommended that the Parks and Recreation Supervisor be directed to contact Bram Granofsky and other parties interested in having the concession at the Park, interview the candidates, show them the site and make a recommendation with regard to the leasing of the concession. MOTION NO. 41 Moved by Crawford, seconded by Johnson It is recommended that Emmanuel Baptist Church be allowed to have exclusive use of the easterly portion of the Oro Memorial Park (left from the driveway) and access to the change rooms at a fee of $100.00 per day, and further the group is made aware that Township residents are entitled to use the beach area and the ball diamonds in the westerly portion of the Park during the rental period. carried.
