That Report No. DS2024-047 regarding Zoning By-law Amendment Application 2024-ZBA-02 to remove the "Holding" provision applying to lands municipally known as the Eagles Rest Estates Subdivision, Township of Oro-Medonte, be received and adopted; 2. That By-law No. 2024-041 to remove the Holding Provision applying to a portion of the lands in the Eagles Rest Estates subdivision development be considered by Council; 3. That the applicant be advised of the decision under the Director, Development Services signature. Background The proposed Eagles Rest Estates subdivision is located on lands legally described as Concessions 3 and 4 (Oro), Part Lot 5, RP; 51 R37221, Parts 3 and 4, Township of Oro- Medonte on the north side of Bass Lake Sideroad West, between Line 2 North and Line 3 North. The property comprising 45.77 hectares (113.10 acres) of land and is known historically as the Edgar Adult Occupational Centre. A staff report on the status of the subdivision, including a chronology, was brought to the March 6, 2024, Development Services Committee meeting. Development Services April 17, 2024 Report No. DS2024-047 Page 1 of 12 Page 4 of 26 6.a) DS2024-047, George Vadeboncoeur, Manager, Planning Special Projects... The proposed Eagles Rest Estates development is to be comprised of 208 single detached residential lots and 14 blocks (see Schedules 1 and 2 for Location Map and 2022 Draft M-Plan). The property is currently zoned Residential One Exception 319 Holding [R1* 319(H)] Zone, Residential One Exception 320 Holding [R1* 320(H)] Zone, Open Space (OS) Zone and Open Space Exception 263 (OS* 263), under Zoning By-law 95-95, as amended. The "Holding" provision or "H" designation was put in place to ensure that the Plan of Subdivision for the Eagles Rest Estates development has received final approval from the Township and has been registered on title, the related Subdivision Agreement has been executed and registered, and the Township has received all transfers, payments and securities identified in the agreement. Once a by-law approving the removal or lifting of the "Holding" provision has been approved by Council and the agreement and M-Plan Registered, the Chief Building Official will be able to issue building permits, subject to meeting the Township's requirements and the requirements of the Ontario Building Code and the terms of the executed subdivision agreement. Analysis The Eagles Rest Subdivision has been the subject of considerable discussion between the applicant and the Township for more than three years, including an appeal to the Ontario Land Tribunal of the Draft Plan of Subdivision conditions in September 2023. This appeal, however, was not pressed by the developer in a final effort to resolve matters locally. Through detailed discussions between staff and developer representatives, and the review of multiple submissions over the past six months, all the requirements listed in the Subdivision Agreement for final approval have been addressed to the satisfaction of staff. Attached to this report is Schedule 4 which is a list of subdivision pre-execution requirements including, satisfying all draft plan conditions, the preparation of a subdivision agreement satisfactory to the Township, and the creation of plan of subdivision that meets the Township's specifications. The Subdivision Agreement, including the two Municipal Responsibility Agreements (MRAs) covering the provision and operation of water and wastewater services has been executed by both parties, the plan of subdivision (M-Plan) has been approved, and the securities that the Township currently holds for the pre-servicing agreement are to be allocated to the subdivision agreement upon registration. Securities required for the pre-servicing works total $8,724,933.97 and were used to guarantee the completion of all required site works in the event the development did not proceed to subdivision registration. The developer has completed the majority of the servicing work covered under the pre-servicing agreement and the approved engineering plans and permits from the Ministry of the Environment, Conservation and Development Services April 17, 2024 Report No. DS2024-047 Page 2 of 12 Page 5 of 26 6.a) DS2024-047, George Vadeboncoeur, Manager, Planning Special Projects... Parks (MECP) have been obtained. To ensure the completion of the balance of the subdivision works in accordance with the approved plans, $6,778,352 in security will be retained. This is intended to reduce the risk that the work will not be completed prior to formal Municipal assumption. When the draft plan of subdivision was approved, Forty-two (42) draft plan conditions were imposed and required to be fulfilled prior to final registration. The developer has actively worked to fulfill the conditions of approval and obtain the necessary agency clearances so that the registration of the subdivision could proceed. All conditions required to be satisfied prior to the execution of the Agreement have been addressed. The remainder of conditions pertain to copies of the executed agreement being forwarded to the Ministry of Environment, Conservation and Parks and the Nottawasaga Valley Conservation Authority. It is anticipated that the registration process may take several weeks to process and finalize. This is a technical legal process involving lawyers from the Township and Developer and the registry office to ensure all matters are addressed. Even though one of the conditions in lifting the "Holding" provision indicates that the subdivision agreement and M-Plan have to be registered, staff are of the view that once both parties have executed the agreements and the developer has paid all applicable fees (taxes, consulting fees etc..) and posted securities, the "Holding" provision is no longer necessary. The Developer is anxious for the "Holding" provision to be lifted as it will enable the issuance of conditional building permits to the Home Builders that will be constructing the homes on the subject lands. It is important to note that the lifting of the "Holding" provision at this time does not relieve the Developer of the requirement to register the subdivision on the subject lands as registration is required to create the proposed lots and blocks for conveyance to purchasers. Until that happens, the lands are considered to be one parcel and will be until such time as the Subdivision is registered on title. This provides assurance to the Township that the lifting of the "Holding" provision will not result in any additional liability for the Township. This is further reinforced in the issuance of conditional permits, which are issued entirely at the risk of the Home Builders. Financial/Legal Implications/Risk Management On September 5, 2023, the developer appealed the subject Draft Plan of Subdivision application to the Ontario Land Tribunal (OLT) pursuant to Section 51(43) of the Planning Act due to Council's failure to approve the Draft Plan of Subdivision. The developer subsequently placed the appeal on hold to allow for the approval process to take place. There are potential financial and legal implications depending on the outcome of decisions and whether the pending appeal is processed in its' entirety or withdrawn. There has been a concerted effort by all parties since September 2023 to address the requirements for the Subdivision Agreement to be registered, including, clearing all draft plan conditions, finalizing the Subdivision Agreement and Municipal Responsibility Agreements, provision of securities, and finalize the Subdivision Plan. These have all been completed to the satisfaction of both parties. All that remains is the registration of the agreements, related instruments, and the subdivision plan. Schedule 4: Memorandum-Pre-Execution Requirements of the Subdivision Agreement MEMORANDUM QT,ivnsi�i> f f etl'ofIle !'rauJ Nrrimgr,Em atiq I acre To: Mayor and Members of Council From: Brent Spagnol, Director, Development Services Date: April 17, 2024 Subject: Eagles Rest Subdivision Agreement Execution Mayor and Members of Council, The developer of the Eagles Rest subdivision has been diligently working to satisfy conditions of approval through the preparation of a Subdivision Agreement, Municipal Responsibility Agreements (Water and Wastewater), obtain Environmental Compliance Approvals, complete engineering reports/plans, and have undertaken significant site works through an approved pre-servicing agreement under the authority of By-law 2021-091. The purpose of this memo is to provide Council information on the steps taken to satisfy specific conditions of approval along with pre-execution subdivision agreement clauses that have been met to facilitate the execution of the subdivision agreement which is needed to register the subdivision agreement and M-Plan. Subdivision Agreement Pre-Execution Clauses that have been satisfied include the following: Land Ownership — Verification that the lands are registered to the owner in fee simple of the lands described in Schedule "A" and that there will be no encumbrances registered against the said lands have been submitted by the developer via correspondence dated April 15, 2024. Taxes — All Township tax bills issued/outstanding against said lands have been paid by the developer whom is in good standing as of April 15, 2024. Deeds and Easements — All Deeds and Easements are required as per Schedule "C" of the Subdivision Agreement executed by the developer on April 15, 2024, as well as Certification from the Developer's solicitor that the Transfer/Deeds and Easements shall provide the Township with good title, free and clear from all encumbrances. Cash Deposits, Development Charges and Security — All required cash deposits, development charges, cash-in-lieu of parkland and securities have been paid to the Township as required by Schedules "D", "F" and "H" of the subdivision agreement and verified by the Director of Development Services on April 15, 2024. Securities in the amount of $6,778,352 currently in the Township's possession will be allocated to the subdivision agreement to ensure that the development is constructed to applicable standards as per approved reports and plans. Insurance Certificate — Required insurance certificate dated April 15, 2024 has been filed with the Township, confirming those coverages specifically set out in Section 4.10 within the executed subdivision agreement. Postponement Mortgage/Charge — Postponement Mortgage/Charge will be filed with the Township's solicitor prior to registration as per the executed subdivision agreement. Developer's Consulting Engineer— Letter of Retention has been submitted by the developer to ensure that each Consulting Engineer is experienced in the field of Municipal Services for the Developer. Letter dated April 15, 2024 has been filed confirming the terms of Engineer's retainer. Lot Sizes and Retaining Location of Retaining Wall — Frontage and Area requirements for lot sizes were verified August 16, 2023, by municipal planning staff. In addition, a certificate from an Ontario Land Surveyor — J. D. Barnes Limited dated April 15, 2024 has been submitted along with an updated certificate dated April 15, 2024 confirming that the retaining walls fronting on municipal property are entirely located on private property. Engineering Plans, Details and Specifications — The developer has supplied to the Township, those Plans and Specifications necessary to identify the engineering design aspects of the proposed development, found in the Township of Oro-Medonte Development Engineering Policies Process and Design Standards in effect at the time of signing of the Subdivision Agreement and identified within the applicable Schedules and have received an acknowledgment of conformity with design concepts from the Township via the following letters of acceptance: - Letter prepared by the Manager of Development Engineering dated November 3, 2023 verifying that all submitted drawings have been prepared in accordance with the Township of Oro-Medonte Engineering Standards. Electrical Distribution Utility — Electrical Utility Plans have been supplied to the Township for approval, those plans necessary to identify the electrical distribution system, power supply to each lot, building or unit and street lighting requirements, as per the Township of Oro-Medonte Development Engineering Policies Process and Design Standards in effect at the time of signing of the Subdivision Agreement and specifications for an Electrical Distribution Utility provider has been confirmed as of November 2022 and installed via pre-servicing agreement under Council By-law 2021- 091: • The utility provider has been informed of the project and have reviewed the development plans. • Satisfactory arrangements have been made with utility provider for servicing the subdivision without expense or obligation on the part of the Township. • Easement requirements, if any. Canada Post / Community Mail Boxes — The developer has made arrangements for the provision of community mailboxes in accordance with Canada Post Standards without expense or obligation on the part of the Township as per letter received from Canada Post dated October 11, 2023. Fire Chief Approval —Email dated April 12, 2024 has been obtained from the Fire Chief of the Township confirming and approving of the proposed plans for fire protection, and specifying any hydrants, or other equipment, or appurtenances required. That Report No. DS2024-048 be received and adopted. 2. That Council authorize staff to contact the Office of the Provincial Land and Development Facilitator to request assisted mediation regarding the City of Barrie request to expand their municipal boundary into Oro-Medonte in accordance and consistent with direction provided by Council for Oro-Medonte through Motion No. C240214-10. 3. That Council direct staff to prepare options for Council's consideration prior to meeting with the Provincial Land and Development Facilitator that are in keeping with Council's position and Minister Calandra's direction. Background The purpose of this report is to obtain direction to request the assistance of the Provincial Land and Development Facilitator for mediation regarding the City of Barrie's request for a Municipal Boundary expansion. City of Barrie Proposal On November 8, 2023, Mayor Nuttall from the City of Barrie presented his ° proposal to Oro-Medonte Council to expand the City of Barrie municipal boundary into the Township for the provision of employment lands. .......... The requested municipal boundary expansion into the Township of Oro- Medonte would include lands east of Penetanguishene Road, south of Gore Road, west of Line 1 South and north of the Shanty Bay rural settlement area. The area comprises approximately 772 hectares (1,907.65 acres) of land shown below and consists of active farmland and environmentally sensitive features. The subject lands primarily consist of actively farmed agricultural land that is considered a prime agricultural area within the new Oro-Medonte Official Plan. Prime Agricultural Areas generally consist of Class 1-3 lands as per Canadian Land Inventory (CLI), which is exceptional for farming purposes. There are several watercourses that traverse the area and a significant portion of the subject lands are regulated by the Nottawasaga Valley Conservation Authority (NVCA). There is also a significant portion of the lands within the floodplain as defined by the Provincial Policy Statement (PPS) that are regulated by the NVCA. There is an area adjacent to the existing residential neighbourhood in Barrie shown on the map that is subject to Policy 2.6.11 of the new Oro-Medonte Official Plan. This policy is intended to establish agricultural policies in locales throughout the Township that abut urban development within neighbouring municipalities. Township Response On January 18, 2024, Mayor Greenlaw, Deputy Mayor Lavoie, and Township Representatives met with Minister Calandra to discuss the City of Barrie's proposal and Development Services April 17, 2024 Report No. DS2024-048 Page 2 of 5 Page 17 of 26 6.b) DS2024-048, George Vadeboncoeur, Manager, Planning Special Projects... the Township's concerns. The Minister indicated that municipalities and upper tiers of government are expected to work cooperatively together to reach fair and amicable partnerships regarding provincial housing and employment needs as well as municipal priorities. On February 14, 2024, Oro-Medonte Council considered a staff report on Mayor Nuttall's boundary adjustment proposal and approved the following recommendations through Council Motion No. C240214-10: 1. "That Report No. DS2024-017 be received and adopted. 2. That Council confirm the following points related to the City of Barrie's proposed municipal boundary expansion: a. the Township of Oro-Medonte does not support the City of Barrie's proposed Municipal Boundary Expansion as presented. b. the Township of Oro-Medonte is prepared to work with the City of Barrie to find an amicable solution to address its employment land needs based on a comprehensive planning process that works for Oro-Medonte, the City of Barrie, the County of Simcoe and the Province. 3. And further, that staff be authorized to prepare additional background documentation in support of the ongoing discussions with the City of Barrie." The Chronology attached as Schedule 1 provides an overview of other actions and dates leading up to the preparation of this report. Analysis Since the February 14, 2024, Council meeting, letters have been sent to the City of Barrie and Minister Calandra advising of Council's decision and informal discussions between Mayor Greenlaw and Mayor Nuttall have occurred regarding the expansion proposal, but nothing concrete has emerged. In keeping with Minister Calandra's comments, the Provincial Land and Development Facilitator could be of assistance to work with the parties to arrive at a solution that meets the goals/objectives of both municipalities and the County of Simcoe. Township representatives have been advised that the Provincial Facilitator is available upon request to address these types of matters. The Provincial Facilitation process allows a third party to review the proposals and alternatives submitted by each municipality in an objective manner and can result in recommended potential solutions. This is a voluntary process and if Council were to approve the request, the City of Barrie and the County of Simcoe would be approached requesting their participation. At a future meeting of Council, staff intend to bring options forward for Council's consideration so that the Township's position is confirmed prior to meeting with the Facilitator, the City of Barrie and the County of Simcoe. Financial/Legal Implications/ Risk Management This is early in the City of Barrie's efforts to expand its boundaries. The Township has stated that it is prepared to work with the City and the County to achieve a solution that meets the objectives for each party. If at some point the City moves to an annexation process, there will be substantial financial implications to the Township that will have to be addressed. Conclusion There is merit to considering options for the provision of employment lands in the spirit of cooperation and partnership with the Province, County of Simcoe and the City of Barrie, that is beneficial to all parties. The Township has a need for serviced residential lands for the provision of medium density housing. To assist with the review, it is recommended that the Township of Oro-Medonte request the assistance of the Provincial Land and Development Facilitator to work with the Township, City of Barrie and the County of Simcoe on finding solutions that are beneficial for both municipalities. All options should be explored in collaboration with the City of Barrie and the County of Simcoe through a comprehensive process that provides information to inform important decisions.
