06 08 2022 Council Agenda The Township of Oro-Medonte Council Meeting Agenda 4 Electronic Meeting Township of Wednesday, June 8, 2022 Proud Heritage,Excitiq Feature 9:00 a.m. - Open Session Effective Monday, March 28, 2022, all Township facilities are open to the Public for Customer Service. Residents and business owners are encouraged to continue to utilize online and telephone services for Township related business; and staff continue to be available to provide assistance by telephone or email. While electronic participation shall remain an option, public attendance at Council meetings is anticipated to resume effective June 22, 2022 with safety measures in place encouraging social distancing and discretionary masks/face coverings. Development Services Committee (DSC) and Council immediately following DSC, will remain virtual until September 2022. Input on agenda items are welcome and encouraged and will be directed in accordance with the Township's procedural by-law. Protocols have been established to advise how to participate electronically in the public portions of these meetings. Environmental Services, in an effort to support climate change and sustainability, have explored the implementation of a rain barrel initiative for all residents in Oro-Medonte. Rain barrels are a proven method to collect rainwater that would otherwise be lost to runoff and diverted to stormpond facilities, streams and Lake Simcoe. Principles of water conservation are not only good for the environment but can help Municipal Drinking Water customers save money on their water bills and reduce energy costs in drinking water system operations. Analysis: Environmental Service Staff has researched rain barrel products and programs with a focus in the Ontario market. In this regard, Environmental Services is recommending working with RainBarrel.ca (www.rain barrel.ca) to implement a "truckload" rain barrel sale for 2022. RainBarrel.ca is a company that reclaims food-grade barrels and repurposes them as rain barrels. Once used to transport fruits and vegetables, they are repurposed to offer years of reliable service as rain barrels; reviews suggest these units are sturdier than comparable barrels. The company offers different sizes and colours of rain barrels, composters and associated products and we understand that barrels can come with a mosquito filter basket, spigot/tap, overflow adaptor and overflow hose. Implementation of this initiative requires a limited time commitment from Township Staff but a great opportunity for residents. The Township will promote the supplier's website (www.Rain Barrel.ca ) through various social media outlets (i.e. Township Website, Twitter, Instagram and Facebook) with RainBarrel.ca providing the promotional templates and support during the truckload sales period in addition to their commercial website updates and promotions. It is envisioned that the open sale in Oro-Medonte will run in June and July. Once the direct buy period has concluded, RainBarrel.ca will provide Environmental Services with sales statistics. This data will be utilized to evaluate the initiative, guide modifications to a long term annual program and support drinking water consumption metrics in those areas serviced by Municipal Drinking Water. Community participation is an easy, straightforward process. Once residents click the link provided by the Township's promotions and/or visit www.Rain Barrel.ca directly, they will be brought to the products page to choose and direct purchase the style of rain barrel and accessories that best suit their needs. Participants can expect to have their purchases delivered to their front door after the local delivery start date. Financial / Legal Implications / Risk Management: As this is considered a truckload sale, wherein RainBarrel.ca manages sales and distributes products to customers, there are currently no material or additional overhead costs to the Township. Environmental Services & Corporate Communications will, however, commit staff time to support the initiative. There are no legal implications for the Township of Oro-Medonte to support this initiative. RainBarrel.ca will not be situated on Township property or engaging with Township staff in person as this is an exclusive transaction between the property owner and product distributor. Background: Development Proposal Applications have been submitted to amend the Township's Official Plan and Zoning By-law to permanently permit the use of the subject lands for: Existing buildings, Buildings Supply Outlet and Showroom, Business Offices, Custom Workshops, Retail Stores accessory to a permitted use, Building Contractors Supply Outlet, Auction Centre, Contractor's Yard, Warehouse, Equipment Sales and Rental Establishment, Banquet Hall, Recreational Vehicle Sales Establishment (Snowmobiles, All Terrain Vehicles), Swimming Pool and Spa Sales Establishment, Dock and Seasonal Sales Establishment, Motor Vehicle Sales Establishment (for a maximum of 50 vehicles), Trailer/Recreational Vehicle Sales Establishment (for a maximum of 135 units), Mobile/Modular Home Sales Establishment (maximum of 5 units) and Service Shops, Light. A statutory Public Meeting was held on May 4, 2022 and second Public Meeting is scheduled to be held on June 8, 2022 to address a minor revision to the applications. Property Description and Background The subject lands are located on the south side of Highway 11 North, west of Line 14 South and have an area of approximately 12.3 hectares (30.5 acres) and a lot frontage of approximately 585 metres (1920 feet) on Highway 11 . A Location Map is included as Schedule 1 to this report and an Aerial Map is included as Schedule 2. Surrounding land uses include a contractor's yard to the north, agriculture and natural heritage features to the south, Highway 11 and a Ministry of Transportation works yard to the west, and natural heritage features and rural-residential uses to the east. The Township records include an affidavit from the owner of the property from 1973- 1999 that confirm the use of the property from 1973-75 was an MTO gravel pit, and from 1975-1999 was a commercial logging and lumber operation. Since 1999 the buildings were used for a building supply outlet (window & door sales establishment). On this basis the above-noted uses pre-date the zoning by-law and may continue as legal non-conforming uses. The lands contain two permanent buildings that are divided into units and used for a number of industrial and commercial purposes. The two permanent buildings have a total floor area of approximately 16,000 square feet. In November 2013, the landowners were granted a Minor Variance (2013-A-46) to add a 347 square metre (3731 square foot) addition to the one 557 square metre (6000 square foot) building for their heating and cooling business which to date, has not been constructed. There is also a detached, modular cover-all style building located in the rear of the property that appears to have been established sometime between 2017 and 2020 and that is being used for commercial/industrial purposes. Staff in Report DS2020-073 that this building did not obtain the necessary Minor Variance approval and Building Permit from the Township. The applicant is currently taking the necessary steps to advance the process, including having obtained a Minor Variance (2021-A-62), obtained a Zoning Certificate and having applied for a Building Permit which is currently under review. Temporary Use By-laws In May of 2013 Council approved By-law 2013-089 to permit on a temporary basis: sales and service establishment for heating, air conditioning, plumbing, and electrical services; fenced compound of U-haul trailers; corporate meeting and special event facilities; and a motor home sales and display establishment. In July of 2013, another request for additional temporary uses was made by the landowner to add Mobile/Modular Home Sales Establishment, Motor Vehicle Sales Establishment (for maximum of 5 vehicles), and Outdoor Displays and a revised temporary use by-law (By-law 2013-119) was approved by Council on July 17, 2013. In November 2013, By-law 2013-205 was approved by Council to add the following additional temporary uses: trailer/recreational vehicle sales establishment (for a maximum of 15 units), and an Auction Centre. In May of 2015 (By-law 2014-072), September of 2017 (By-law 2017-116) and September of 2020 (By-law 2020-071) Council approved further extensions to the temporary uses of the lands, which currently permit as follows: a) Uses permitted within an existing building: i. The Development Services Committee adopted the following motion on July 15, 2021 : 1. That DS2021-108, Derek Witlib, Manager, Planning Services re: Zoning By-law Amendment Application 2021-ZBA-08 by 2041063 Ontario Ltd., 5071 Highway 11 North be received. 2. That Application 2021-ZBA-08 be deferred for up to three (3) months (to be re- considered at the October 6, 2021 Development Services Committee meeting) in order to.- a) Staff confirm the number of trailers and RVs on the lands do not exceed 135, and b) The applicant provide the Township with confirmation that the unauthorized building has been removed from the lands, or alternatively c) The applicant apply for and obtain the necessary Minor Variance for the enlargement of a non-conforming use, apply for and obtain the necessary Zoning Certificate and Building Permit; or 3. That, in the event that the applicant fails to satisfy Number 2(b) or 2(c) above, within the identified timing, that Township staff proceed with the necessary enforcement actions against the landowner related to any matters of Zoning By- law and/or Building Code non-compliance. Purpose of Staff Report This report makes recommendations with respect to the current applications to amend the Official Plan and Zoning By-law to permanently permit the use of the lands. Approval of these applications would make redundant the 2021 Temporary Use By-law application. The applicant has to-date addressed the matters identified in the Committee's July 15, 2021 motion, except that a Building Permit, while applied for, is still in-process and has not yet been issued as of the preparation of this report. On the basis of the above, Planning Staff considers it appropriate for Council to proceed with the consideration of the permanent Official Plan and Zoning By-law Amendment applications. Development Services June 8, 2022 Report No. DS2022-091 Page 4 of 16 Page 45 of 152 10.b) DS2022-091 , Derek Witlib, Manager Planning Services re: Official P... Analysis: Provincial Policy Statement 2020 The Provincial Policy Statement (PPS) has been reviewed with particular emphasis placed on the following sections: Section 1.1 .4 Rural Areas in Municipalities, Section 2.1 Natural Heritage and Section 2.3 Agriculture. According to Section 1.1 .4 of the PPS, Rural Areas in municipalities are important to the economic success of the Province and healthy, integrated and viable rural areas should be supported by, among other considerations, promoting diversification of the economic base and employment opportunities through goods and services. The intent of the applications is to permanently recognize that various commercial and industrial uses have been occurring on the lands over the last 30+ years and that have been permitted by the Township's Zoning By-law on a temporary basis since 2013. Section 2.3.1 provides that Prime Agricultural Areas shall be protected for long-term use. The proposed addition 3-year Temporary Use By-law will not affect the agricultural potential lands, which appears to have already been largely negated 30+ years ago due to the way the lands have been used and developed. Section 2.3.6 of the PPS allows planning authorities to permit non-agricultural uses in Prime Agricultural Areas for limited non-residential uses, provided that the following are demonstrated: • The land does not comprise a specialty crop area; • The proposed use complies with the minimum distance separation (MDS) formulae; • There is an identified need within the planning horizon provided for additional land to be designated to accommodate the proposed use; • Alternative locations have been evaluated and there are no reasonable alternative locations which avoid prime agricultural areas. The subject lands do not comprise a specialty crop area, and given the history of land uses and development, the lands possess very little agricultural potential. The uses and structures do not create any MDS conflicts. Since the uses are existing, some of which having legal non-conforming status, it is Planning Staff's opinion that examinations of need and alternative locations are not necessary in this case. With respect to Natural Heritage, the existing and historic uses of the lands are located outside those portion of the lands designated Greenlands (County of Simcoe Official Plan), Environmental Protection 1 & Environmental Protection 2 (Township of Oro- Medonte Official Plan) and zoned Environmental Protection (Township of Oro-Medonte Zoning By-law 97-95), and no expansions of the uses on the lands are proposed. Portions of the lands are regulated by the Lake Simcoe Region Conservation Authority (LSRCA), as shown on Schedule 3 to this report. The LSRCA has advised by way of a letter dated May 30, 2022 that, "The LSRCA is satisfied from a watershed management perspective that this application is consistent with the natural hazard policies of the Development Services June 8, 2022 Report No. DS2022-091 Page 5 of 16 Page 46 of 152 10.b) DS2022-091 , Derek Witlib, Manager Planning Services re: Official P... PPS, and in conformity with those applicable policies of Provincial, County, and local plans." Based on the above, Planning Staff finds the application to be consistent with PPS, including PPS policies for Rural Areas, Prime Agricultural Areas and Natural Heritage. A Place to Grow, 2020 A Place to Grow - Growth Plan for the Greater Golden Horseshoe (2020) provides a long-term plan to manage growth and protect the natural environment. Section 2.2.9 Rural Areas is applicable to this application. This section has been reviewed and Planning Staff are of the opinion that the recognition of the existing uses of the lands as proposed by the amendments represents "other rural uses" as permitted by the Growth Plan. "Other rural land uses" that are not appropriate in settlement areas are permitted within Rural Areas, provided they: i. Are compatible with the rural landscape and surrounding local land uses; ii. Will be sustained by rural service levels; and, iii. Will not adversely affect the protection of agricultural uses and other resource- based uses such as mineral aggregate operations. The uses of subject lands have demonstrated compatibility with the surrounding rural area, as evidenced by the existing conditions on the subject lands, primarily commercial and industrial uses, that have existed in similar form for over 30 years. Furthermore, several Public Meetings have been held since 2013 with respect to Temporary Use By- laws, and no land use conflicts or concerns have been identified by the community. The subject property has individual septic and water services, and is not located directly adjacent to active farming operations or mineral aggregate lands. The continued use of the subject lands in this manner does not pose an adverse effect on the protection of agricultural or other resource-based uses. Section 4.2.2, the Province has mapped the Natural Heritage System, but the mapping is not applicable until such time that the upper tier municipality has identified the natural heritage systems in their official plans. Section 4.2.4 (Lands Adjacent to Key Hydrologic Features and Key Natural Heritage Features) is applicable to this application because the lands are adjacent to a Provincially Significant Wetland. The LSRCA has advised by way of a letter dated May 30, 2022 that, "The LSRCA is satisfied from a watershed management perspective that this application is consistent with the natural hazard policies of the PPS, and in conformity with those applicable policies of Provincial, County, and local plans." Based on the above, Planning Staff is of the opinion that these applications conform to the Growth Plan. Lake Simcoe Protection Plan (LSPP) The subject lands are located within the Lake Simcoe watershed where development is subject to the policies of the Lake Simcoe Protection Plan (LSPP) which came into Development Services June 8, 2022 Report No. DS2022-091 Page 6 of 16 Page 47 of 152 10.b) DS2022-091 , Derek Witlib, Manager Planning Services re: Official P... effect in 2009. As per Section 6.45-DP (c), "expansion to existing buildings or structures, accessory structures and uses, ... are permitted subject to a demonstration that the use does not expand into a key natural heritage feature, a key hydrologic feature and any minimum vegetation protection zone associated with a feature or the Lake Simcoe shoreline, unless there is no alternative in which case any expansion shall be limited in scope and kept within close geographical proximity to the existing structure" (p. 54). No expansions into natural heritage features are proposed by these applications. Furthermore the LSRCA has advised by way of a letter dated May 30, 2022 that, "The LSRCA is satisfied from a watershed management perspective that this application is consistent with the natural hazard policies of the PPS, and in conformity with those applicable policies of Provincial, County, and local plans." Based on the above, Planning Staff is of the opinion that the applications are consistent with the LSPP. County Official Plan The subject lands are designated "Agricultural" and "Greenlands" in the County of Simcoe Official Plan. The existing structures and land uses are fully situated within the `Agricultural' designation. Section 3.6.12 states that non-agricultural uses in prime agricultural areas may only be permitted for limited non-residential uses, through a site-specific local municipal official plan amendment, provided that all of the following are demonstrated: a) the land does not comprise a specialty crop area; Planning Staff comment: Conforms, the lands are not in a specialty crop area. b) the proposed use complies with the MDS formulae; Planning Staff comment: Conforms, there are no nearby livestock operations or lands in proximity readily suitable for livestock operations. c) there is an identified need within the planning horizon provided for in this Plan for additional land to be designated to accommodate the proposed use; Planning Staff comment: Conforms, demonstrating need is not applicable, as the lands are already developed. The applications do not propose additional development. d) alternative locations have been evaluated; Planning Staff comment: Conforms, the evaluation of alternative sites is not applicable as the lands are already developed. The applications do not propose additional development. e) the proposed use requires minimal site alteration, as determined through pre- consultation with the local municipality and the approval authority; Development Services June 8, 2022 Report No. DS2022-091 Page 7 of 16 Page 48 of 152 10.b) DS2022-091 , Derek Witlib, Manager Planning Services re: Official P... Planning Staff comment: Conforms, no site alteration is proposed, as the lands are already developed and no additional development is proposed. f) the proposed use shall be compatible with the surrounding agricultural uses or in a location that is separated from the primary agricultural operations by physical features and demonstrated to cause minimal disruption to surrounding area; Planning Staff comment: Conforms; the location is separated from the primary agricultural operations by physical features in the form of natural heritage features and the various existing uses of the lands have not demonstrated any disruption to surrounding area. g) the proposed use will not be located in an area that may have an impact on the efficient and logical expansion of nearby settlement areas; Planning Staff comment: Conforms, there are no nearby settlement areas that could be impacted. h) the proposed use complies with all other applicable policies of this plan; Planning Staff comment: Conforms; as demonstrated by Planning Staffs review of applicable County Official Plan policies. i) applications for non-agricultural uses must be supported by adequate technical assessment to ensure that appropriate services for the proposed use can be provided. Planning Staff comment: Conforms, as the uses of the lands are already existing and are serviced, the suitability of the lands to support appropriate services has already been demonstrated. Section 3.11 .19 states that, "Uses, buildings and structures legally existing on November 15, 2001 are permitted in every land use designation, and shall be zoned accordingly in the applicable zoning bylaw". Considering the history of land uses on the property and the subsequent Temporary Use By-laws, and considering that no development is proposed within the Greenlands designation on the lands, Planning Staff is of the opinion that the applicant's request to permanently recognize the uses of the lands in the Agricultural designation generally conforms to this policy. Section 4.11 .6 states that, "This Plan is not intended to prevent the continuation, expansion or enlargement of legally existing uses on existing lots which do not conform to the designations of the Plan. Expansions or enlargement shall include consideration of Section 4, Policy Statements within this Plan, local official plans and bylaws, and where applicable, be subject to the Niagara Escarpment Plan, Greenbelt Plan, Growth Plan, Lake Simcoe Protection Plan and the Oak Ridges Moraine Conservation Plan. Based on the above, Planning Staff is of the opinion that these applications conform to the County of Simcoe Official Plan. For Council's information, the County of Simcoe has been circulated in advance of both Public Meetings with respect to these applications and County Staff have not provided Development Services June 8, 2022 Report No. DS2022-091 Page 8 of 16 Page 49 of 152 10.b) DS2022-091 , Derek Witlib, Manager Planning Services re: Official P... any comments to-date. Council should have regard for any County comments that may be received. Township of Oro-Medonte Official Plan The subject lands are designated Agricultural and Environmental Protection One and Environmental Protection Two in the Township's Official Plan. The uses of the lands are located entirely within the Agricultural designation, which generally does not permit the types of uses occurring on the subject lands. Therefore, the applicant has requested site-specific exceptions to recognize the existing uses on that portion of the lands that is within the Agricultural designation. No expansion of the existing uses is proposed and no development is proposed in Environmental Protection One (EP 1) and Environmental Protection Two (EP 2) designations. The Agricultural policy objectives of the Official Plan are set out in Section C1 .1 and are: a) To maintain and preserve the agricultural resource base of the Township. b) To protect land suitable for agricultural production from development and land uses unrelated to agriculture. c) To promote the agricultural industry and associated activities and enhance their capacity to contribute to the economy of the Township. d) To preserve and promote the agricultural character of the Township and the maintenance of the open countryside. The intent of the applications is to recognize the existing and long-standing uses of the lands would have no negative impact on the agricultural land base or create any conflicts with agriculture. The lands have already been developed for over 30 years, during which the commercial and industrial activities on the lands have contributed, and continue to contribute, to the economy of the Township with no negative impacts on the character of the countryside. The subject property is accessed from the existing entrance on the Highway 11 overpass. Ministry of Transportation (MTO) has previously stated with respect to the earlier Temporary Use By-law applications that they have no concerns with the current commercial-industrial use of the site and that it is sufficiently setback from Highway 11 . In addition, the MTO has previously approved the signage associated with the current businesses. Planning Staff is not aware of any conflicts with surrounding land uses or of any parking or traffic concerns associated with activities on the property. Sections B2.4 (Environmental Protection One) and B3.4 (Environmental Protection Two) of the Official Plan contain policies for protecting Natural Heritage Features and for limiting development on lands adjacent to such features. In this case the subject lands are adjacent to a Provincially Significant Wetland. The policy objectives EP 1 and EP 2 designation of the Official Plan are set out in Sections B2.1 and B3.1 and are: Development Services June 8, 2022 Report No. DS2022-091 Page 9 of 16 Page 50 of 152 10.b) DS2022-091 , Derek Witlib, Manager Planning Services re: Official P... B2.1 OBJECTIVE (EP 1) a) To maintain and enhance the ecological integrity of the natural heritage system. b) To minimize the loss or fragmentation of significant wetlands and the habitats and ecological functions they provide. B3.1 OBJECTIVES (EP 2) a) Protect environmentally sensitive areas from incompatible activities and uses that would have a negative impact on significant natural features and functions; b) Maintain and enhance the ecological integrity of the natural heritage system; c) Protect from incompatible development significant woodland features and wildlife habitat areas and the ecological functions they provide. Planning Staff is of the opinion that these applications conform to all of the above-noted objectives, for the reasons that: • The long-standing and existing uses of the lands have been carried out with no known negative impacts on Natural Heritage Features; • No development of uses are located within or are proposed to expand into the EP 1 or EP 2 designations; • The applications have been reviewed by the LSRCA in context to Provincial and LSRCA natural heritage and regulatory policies and the LSRCA has advised that they have no objections to the applications. It is also Planning Staff's opinion that since no new development is proposed, it is not necessary for a natural heritage evaluation / environmental impact study to be completed to meet the environmental protection objectives of the Official Plan. Also relevant to these applications is Section E1 .6.1 of the Official Plan, which speaks to Non-Conforming Uses and states: "As a general rule, existing uses that do not conform with the policies of this plan should gradually be phased out so that the affected land use may change to a use which is in conformity with the goals of the Official Plan and intent of the implementing Zoning By- law. In some instances, it may be necessary and practical to allow the replacement, extension or enlargement of non-conforming uses through the granting of a minor variance or by placing the use in an appropriate zone in the implementing Zoning By- law. Council shall, therefore, have regard for the following principles: a) The feasibility of acquiring the property for holding, sale, lease or development by the Township for a more appropriate permitted use; and, b) The possibility of relocating the non-conforming use to another site." Through the history of uses on the subject lands, it has been demonstrated that the uses are compatible with the area and contribute to the Township's economy without negatively impacting agriculture or natural heritage. Therefore, it is Planning Staff's opinion that that phasing out or relocating of the uses on the lands is not desirable. Instead, the uses should be recognized in the Township's Official Plan and Zoning By- law, thereby providing policy and regulatory conformity and allowing businesses to operate with legal certainty. Based on the above, it is Planning Staff's opinion that these applications generally conform to the Township of Oro-Medonte Official Plan, including the policies of the Agricultural, Environmental Protection One and Environmental Protection Two designations. Zoning By-law 97-95 The subject property is currently zoned Agricultural/Rural (A/RU) and Environmental Protection (EP). The two permanent buildings and the more recently constructed cover- all style building are located within the Agricultural/Rural (A/RU) Zone. Section 5.18 of Zoning By-Law 97-95 states that "No lands shall be used and no building or structure shall be used except in conformity with the provisions of this By-law unless such use existed before the date of passing this By-law and provided that it has continued and continues to be used for such purpose, and that such use, when established, was not contrary to a By-law passed under Section 34 of the Planning Act, R.S.O 1990, c.P. 13 or a predecessor thereof that was in force at that time." The intent of Section 5.18 of the Zoning By-law is to ensure that existing non-conforming uses on properties in the Township may not be expanded, such that the expansion may result in an increase in a degree of incompatibility or in any adverse impacts, and that such expansion may not take place without appropriate buffering and mitigation of any negative impacts between such a use, and neighbouring land uses. Based on the above, some of the current uses of the lands do not have legal non- conforming status under the Zoning By-law and have only been authorized through the Temporary Use By-laws that have been passed with respect to the lands since 2013. The continuation of these uses through the Temporary Use By-laws has demonstrated that these uses are able to be carried out in a manner that is compatible with surrounding land uses and in keeping with the objectives of the Official Plan. It is therefore Planning Staff's opinion that it is appropriate to rezone the subject lands to an Agricultural/Rural Exception Zone that recognizes the existing uses, rather than for the Township to have to potentially consider additional Temporary Use By-law applications. Note: As of the preparation of this report, the applicant has not paid the applicable LSRCA review fees as noted in the LSRCA's letter dated May 30, 2022. It is Planning Staff's recommendation that, if the fees are not paid prior to Council's consideration of these applications, the applications be approved in principle but that Council post-pone passing the necessary By-laws to adopt the Official Plan Amendment and to rezone the lands until the Township Staff have been provided with confirmation from the LSRCA that the fees have been paid by the applicant. Background: Braestone Development Corporation is developing a residential development located south of the Horseshoe Valley Road between Line 8 North and Line 9 North. The lands were approved for a 230 lot residential subdivision that included a series of Open Space blocks to be dedicated to the Township (see Attachment #1 Original Plan Open Space Blocks). Braestone has been developing through a series of phases each being registered as a separate plan with the final phase just recently being registered. In each of the required Subdivision Agreements, there has been language incorporated regarding the dedication of the open space/recreation blocks in various phases to the Township. This is in addition to the requirement for the establishment of a Condominium Corporation to manage the wetland blocks. The developer, Braestone Development Corporation, has continued to work with the Township on the evolution of the parkland development for this subdivision that was to be contained within what was Block 126 (on Attachment #1) on the draft plan but now known as Block 61 (on Attachment #2) on Registered Plan M-1113. The revised parkland development and required subdivision agreement amendments are the purpose of this report. Analysis: Section 7.18 of the subdivision agreement contained specific obligations on the developer regarding the parkland development. These provisions also reflected the intent of the Township and the Developer that revisions to the proposed parkland development were being contemplated by Braestone in keeping with their overall vision for the development. In 2016, Braestone retained Envision Tatham, a landscape architecture consultant, to work with Braestone and Township staff to redevelop the park plans. A number of revisions to these park drawings have occurred over the years with input from the developer, Township staff, the Township's Accessibility Advisory Committee, and the public. The final plans have been accepted by the Township; and prior to finalizing the construction of the park, amendments to the subdivision agreement to reflect the revised park drawings and associated costs for the construction are required. The original subdivision agreement was approved through By-law 2017-024 in February 2017 and contained provisions in Section 7.18 of the agreement regarding the Parkland/Recreation Block as follows: "All parkland/recreation block works indicated in Schedule "H" for portions of Blocks 122 and 126 and consisting of Landscape Drawings L1 to L12 are to be constructed in accordance with Section 14 — Park Requirements of the Township of Oro-Medonte Development Engineering Policies, Process and Design Standards (dated April 27, 2016). The Township and the Developer agree that revisions to the proposed parkland works are permitted, and will be subject to an amendment to this agreement, and are subject to the acceptance of such parkland revisions by the Township. The additional parkland/recreation block dedications and required works will be dedicated to the Township as part of Phase 1 B-1 C of the subdivision agreement. The parkland/recreation works shall be completed at the expense of the developer. The Township will contribute up to a maximum of $30,000 for the purchase, installation and surfacing for the playground development which includes rubber resilient surfacing. The specifications are noted on Schedule 1 and Schedule 2 identified in Schedule H. The selection of the playground equipment will be mutually agreed upon by both parties prior to park construction and will not exceed a maximum total value of $75,000. The parkland/recreational block works must be completed to the satisfaction of the Township and the phasing of these works will be to the satisfaction of the Township." The agreement language is proposed to be amended to reflect the revised parkland drawings and parkland construction costs required from Braestone and the Township costs associated with the play equipment. Additionally, the Township once assumption of the development is complete, will have ongoing capital/infrastructure renewal costs and annual operating costs associated with the maintenance of Starfall Park that will be incorporated into future annual budgets considered by Council. The agreement requires the Township to contribute a maximum of $ 57,700 towards the playground equipment. Future annual operations and maintenance costs or equipment renewal will be the subject of the annual budget considerations by the Township. The purpose of a Dog Tag program is to return stray/lose canines to their rightful owners as soon as possible and hopefully avoid kennel/pound use charges (nuisance perspective), and to trace canines to owners as soon as possible in the event of a bite or other contact (public health perspective). Responsible dog owners want their pets returned safely. Responsible pet owners are the residents who will spay/neuter and microchip their dogs. The Township of Oro-Medonte should recognize and encourage responsible dog ownership by having a one-time dog license for residents who spay/neuter AND microchip their dogs. The breed, colour and sex of the dog (no longer intact), along with the microchip and its number does not change over the life of the dog. Responsible dog owners register their dogs the first year, or for a couple of years and then forget. In speaking with responsible dog owners who spend thousands of dollars already on each dog they have, many view this an unnecessary "Cash Grab". Distribution of annual metal tags were stopped a couple of years ago. This change will reduce the staff time required to implement and record the annual registration of a dog and owner already on record. With the reduction of duplication and cost to the Township, I hope this will also encourage responsible dog ownership by spaying/neutering and microchipping thereby aiding in quick return of stray canines, quicker reporting of public health issues, and a reduction in kennel use for those dogs picked up by by-law enforcement (as the microchipped dogs can be returned without overnight stays). I am not proposing a change in the charges relating to kennel/pound stays, etc. There will have to be consideration given to those residents who have already licensed their dogs with the Township prior to this motion being adopted. The Severn Sound Environmental Association has coordinated this program since 2007 and it is an effective partnership between SSEA and our member municipalities. The goal of the program is to encourage tree planting on the landscape by offering reasonably-priced, native tree seedlings to residents and ratepayers of the municipalities. This year's program was very successful, with eight tree species and one shrub species offered. Response to the initiative was good: in fact, we sold out of available seedlings before the order deadline in January. In total, 228 participants from all municipalities purchased and planted 8,740 native seedlings, including 34 participants and 1,530 seedlings from the SSEA portion of the Township of Oro-Medonte. The COVID-19 pandemic continued to add a layer of complexity to planning and implementing the Tree Seedling Distribution Program, but municipal staff, including Jennifer Whitley and Jenny Legget, were helpful in promoting the initiative, and Mayor Hughes and Councillor Veitch were most helpful in providing assistance with transportation of seedlings. Thank you again for your municipality's participation in this year's Tree Seedling Distribution Program. We received positive feedback from participants, and we already have people interested in next year's program - both new and returning participants. We could not have implemented the program so successfully without the Township's support, and we value this partnership that helps facilitate local tree planting. (BB-Long-term) Single-tier/County/Region's purposes (Capital Works Rate Offer Borrowing By-law—Long-term—w/o FA) THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NUMBER 2022-064 A BY-LAW TO APPROVE THE SUBMISSION OF AN APPLICATION TO ONTARIO INFRASTRUCTURE AND LANDS CORPORATION ("OILC") FOR THE LONG-TERM FINANCING OF CERTAIN CAPITAL WORKS OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE (THE "MUNICIPALITY"); AND TO AUTHORIZE THE ENTERING INTO OF A RATE OFFER LETTER AGREEMENT PURSUANT TO WHICH THE MUNICIPALITY WILL ISSUE DEBENTURES TO OILC WHEREAS the Municipal Act, 2001 (Ontario), as amended, (the "Act") provides that a municipal power shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; AND WHEREAS the Council of the Municipality has passed the by-law(s) enumerated in column (1) of Schedule "A" attached hereto and forming part of this By- law ("Schedule "A") authorizing the capital works described in column (2) of Schedule "A" ("Capital Works") in the amount of the respective estimated expenditure set out in column (3) of Schedule "A" , subject in each case to approval by OILC of the long-term financing for such Capital Works requested by the Municipality in the Application as hereinafter defined; Aar"00 AND WHEREAS before the Council of the Municipality approved the Capital Works in accordance with section 4 of Ontario Regulation 403/02 (the "Regulation"), the Council of the Municipality had its Treasurer calculate an updated limit in respect of its then most recent annual debt and financial obligation limit received from the Ministry of Municipal Affairs and Housing (as so updated, the "Updated Limit"), and, on the basis of the authorized estimated expenditure for the Capital Work or each Capital Work, as the case may be, as set out in column (3) of Schedule "A" (the "Authorized Expenditure" for any such Capital Work), the Treasurer calculated the estimated annual amount payable in respect of the Capital Work or each Capital Work, as the case may be, and determined that the estimated annual amount payable in respect of the Capital Work or each Capital Work, as the case may be, did not cause the Municipality to exceed the Updated Limit, and accordingly the approval of the Local Planning Appeal Tribunal pursuant to the Regulation, was not required before any such Capital Work was authorized by the Council of the Municipality; Page 143 of 152 17.d) 2022-064: By-law to approve the submission of an Application to On... - 3 - AND WHEREAS subsection 401(1) of the Act provides that a municipality may incur a debt for municipal purposes, whether by borrowing money or in any other way, and may issue debentures and prescribed financial instruments and enter prescribed financial agreements for or in relation to the debt; AND WHEREAS the Act also provides that a municipality shall authorize long-term borrowing by the issue of debentures or through another municipality under section 403 or 404 of the Act; AND WHEREAS OILC has invited Ontario municipalities desirous of obtaining long-term debt financing in order to meet capital expenditures incurred on or after the year that is five years prior to the year of an application in connection with eligible capital works to make application to OILC for such financing by completing and submitting an application in the form provided by OILC; AND WHEREAS the Municipality has completed and submitted or is in the process of submitting an application to OILC, as the case may be to request financing for the Capital Works by way of long-term borrowing through the issue of debentures to OILC, substantially in the form of Schedule "B" hereto and forming part of this By-law (the "Application"); AND WHEREAS OILC has accepted and has approved or will notify the Municipality only if it accepts and approves the Application, as the case may be; AND WHEREAS at least five (5) business days prior to the passing of the debenture by-law in connection with the issue of Debentures as defined below, OILC will provide the Municipality with a rate offer letter agreement substantially in the form as provided to the Municipality on or prior to the date of this By-law (the "Rate Offer Letter Agreement"); NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE ENACTS AS FOLLOWS: 1 . The Council of the Municipality hereby confirms, ratifies and approves the execution by the Treasurer of the Application and the submission by such authorized official of the Application, duly executed by such authorized official, to OILC for the long-term financing of the Capital Works in the maximum principal amount of$1,600,000, with such changes thereon as such authorized official may hereafter, approve such execution and delivery to be conclusive evidence of such approval. 2. In accordance with the provisions of section 25 of the Ontario Infrastructure and Lands Corporation Act, 2011, as amended from time to time hereafter, the Municipality is hereby authorized to agree in writing with OILC that the Minister of Finance is entitled, without notice to the Municipality, to deduct from money appropriated by the Legislative Assembly of Ontario for payment to the Municipality, amounts not exceeding the amounts that the Municipality fails to pay to OILC on account of any unpaid indebtedness of the Municipality to OILC under the Debentures (the "Obligations") and to pay such amounts to OILC from the Consolidated Revenue Fund. 5. For the purposes of meeting the Obligations, the Municipality shall provide for raising in each year as part of the general levy, the amounts of principal and interest payable in each year under the Debentures issued pursuant to the Rate Offer Letter Agreement, to the extent that the amounts have not been provided for by any other available source including other taxes or fees or charges imposed on persons or property by a by-law of any municipality. 6. (a) The Mayor and the Treasurer are hereby authorized to execute and deliver the Rate Offer Letter Agreement, and to issue the Debentures, one or more of the Clerk and the Treasurer are hereby authorized to generally do all things and to execute all other documents and papers in the name of the Municipality in order to perform the terms and conditions that apply to the Municipality as set out in the Rate Offer Letter Agreement and to perform the Obligations of the Municipality under the Debentures, and the Treasurer is authorized to affix the Municipality's municipal seal to any such documents and papers. (b) The money realized in respect of the Debentures, including any premium, and any earnings derived from the investment of that money, after providing for the expenses related to the issue of the Debentures, if any, shall be apportioned and applied to the respective Capital Work and to no other purpose except as permitted by the Act. 7.
