SUMMARY
Jade Acoustics Inc. was retained to monitor the sound levels on and around the
Burls Creek Event Grounds (BCEG) caused by activities on the stages during two festivals
to determine if unattended measurements near surrounding noise sensitive receptors could
be used to assess compliance. Additional sound measurements were conducted to
determine typical sound levels in the area. A portion of the measurement results were
provided to Oro-Medonte Municipal Law Enforcement officers as they were collected.
The sound level measurements at the front of house locations are the most representative of
sound produced by activities on the stages. Front of house sound levels for WayHome were
up to 108 dBA with a typical level of 103 dBA. For Boots & Hearts, front of house sound
levels of up to 104 dBA with a typical level of slightly less than 100 dBA were measured.
During dance parties that took place during the Boots & Hearts Festival, typical sound levels
were 85 to 90 dBA at the front of house (soundboard) at Stage 2 (Front Porch). The sound
level limits as outlined in the agreement between Oro-Medonte and Burls Creek were
exceeded the majority of the time.
The sound level measurements conducted outside of BCEG were influenced by noises such
as vehicles, insects and campers. Based on the analysis of the measurement results
included in Appendices A and B, it is recommended that the front of house sound levels be
used to assess compliance and not the unattended measurements.

1.0 EVENTS
Two festival style concert events were held at BCEG during the summer of 2015. See Figure
1 for a key plan. The first, WayHome, was an alternative music festival which took place
from July 24, 2015 to July 26, 2015 with four stages. The second was Boots & Hearts, a
country music festival which took place from August 6, 2015 to August 9, 2015 with two
stages. The schedules for each festival have been included in Appendix C.
Each festival had a substantial number of camping sites located around the BCEG. See
Figure 2 for a site plan. Attendees began arriving the day before each festival and left by the
day following each festival.
In addition to the current stages, activities, including the playing of music, took place at the
camp sites before, during and after the scheduled concerts. Boots & Hearts also held dance
parties with music on the second stage each night after the concerts.
2.0 MEASUREMENTS
2.1 Equipment
All sound level meters used were Type 1 meters with appropriate windscreens. All were
calibrated before and after the measurements and found to be within the acceptable range.
2.2 Weather
The weather during both festivals was favourable for measurements. The weather between
festivals had some unfavourable conditions such as precipitation and high winds. A log of
the hourly weather has been included in Appendix D.
2.3 Unattended Measurements
Appendix A contains measurement data which was used in the analysis of sound from the
stages at BCEG. Appendix B contains measurement data from locations where correlating
the measured sound levels to events on the stages was not practical.

2.3.1 Long Term

Sound level meters were setup at the Oro-Medonte office and at a residence on the 8 Line
from July 15, 2015 until August 10, 2015. These meters were collecting data throughout this
entire period other than during periodic calibration checks. The data from these meters are
th
presented on Figures A-1 and A-2 for the Oro-Medonte office and 8Line, respectively. For
clarity, the times associated with the WayHome and Boots & Hearts festivals have been
coloured to allow easy identification. As can be seen from the figures, the maximum sound
levels during festivals are similar to sound levels between festivals and the minimum sound
levels are substantially elevated during festivals.
2.3.2 Short Term
During each festival additional sound level meters were setup within BCEG and around its
perimeter. The results of these measurements can be seen in Figures A-3 and B-1 to B-3 for
WayHome and Figures A-5 to A-10 and B-4 to B-7 for Boots & Hearts.
Sound levels measured at front of house on a typical festival day (Saturday July 25, 2015)
are shown on Figure A-4. Individual concerts can be clearly seen in the data.
2.4 Attended Measurements
During each festival, attended measurements were conducted on and around the
Burls Creek Event Grounds. These measurements helped to identify the dominant noise
sources at the unattended measurement locations as well as to investigate additional
locations. Oro-Medonte municipal law enforcement officers provided the addresses of the
location of noise complaints. Many of these locations were used as attended measurement
locations. See Figure 1 for areas outside of BCEG where measurements were conducted.
During each festival, Jade Acoustics Inc. staff conducted attended measurements for a
minimum of six hours per day.
Although the measured sound levels at most locations was affected or in some cases
dominated by road traffic noise and/or insects, music playing at BCEG was audible at all
measurement locations. At distant measurement locations (greater than 2.5 km), depending
on weather conditions and ambient sound levels, only occasionally were there times where
activities at BCEG were not audible.

3.0 SOUND LEVEL LIMITS
Oro-Medonte and the proponent of the music festivals entered into agreements which
outlined the applicable sound level limits for each festival. Excerpts from these agreements
are included in Appendix E. The agreements outline sound level limits that vary by date and
time of day. For clarity, only the highest sound level limits have been placed on Figures A-1,
A-2, A-5, A-6 and B-1 to B-7 as red lines. For the dance parties, the varying sound level
limits in the agreements are shown on Figures A-7 to A-10 as red lines.
As no time period or descriptive parameter (e.g. average, maximum, etc.) to be used for the
sound measurements was specified in the agreements, the energy equivalent one minute
(Leq 1 minute) sound level was compared to the sound level limits. This metric is
representative of the sound produced by the music and is not unduly influenced by short-
term events, such as yelling.
As stationary noise sources are typically evaluated using a one hour energy average
(Leq1hour), Figure A-11 was prepared using this metric. Due to the nature of concert noise
(high sound levels followed by periods of low sound levels) and difficulty for BCEG staff to
use Leq1hour to control sound levels during a festival, as noted above, Leq1minute was
used in this report as the metric for compliance assessment.
4.0 RESULTS AND CONCLUSIONS
Concerts at BCEG were audible over 8 km away. Therefore, audibility is not a reasonable
metric to be used for assessing compliance as the concerts would not be able to meet this
standard.
With unattended measurements, exceedances cannot be definitively attributed to concert
activities at BCEG. As can be seen on Figures A-1 and A-2 many times the sound level
limits chosen were exceeded even when no festival was occurring at BCEG. Due to the
distances involved, the effect of atmospheric conditions on the sound levels and the
background sound level caused by other activities not related to the concert activities, it is
recommended that off-site locations not be used to assess sound level compliance of the
activities at BCEG.
As the sound levels at front of house (sound board) locations were dominated by music and
external noise sources (such as road traffic) were acoustically insignificant during concerts, it
is recommended that these locations be used to set a sound level to be used to assess
compliance.

DEFINITIONS
Ambient sound level (or background sound): The sound level that is present in the
environment produced by acoustical sources other than the source of interest.
A-weighting: A-Weighting is the frequency weighting characteristics intended to
approximate the relative sensitivity of the normal human ear to different frequencies
(pitches) of sound.
A-weighted Sound Pressure Level: The A-weighted sound pressure level is the
sound pressure level modified by application of the A-weighting. It is measured in
decibels, A-weighted and denoted dBA.
Decibels:The decibels is a dimensionless measure of sound level or sound pressure
levels; see sound pressure levels.
Equivalent Sound Level:The equivalent sound level sometimes denoted (Leq) is the
value of the constant sound level which would result in exposure to the same total
A-weighted energy as would the time-varying sound, if the constant sound level
persisted over an equal time interval.
Noise sensitive receptor (receptor):A noisesensitive land use to be considered in
the assessment. Receptors may include outdoor areas and/or façades of permanent
residences, schools, hospitals, daycare centres, seniors residences, and other
buildings.
Sound Level:Sound level is the A-weighted sound pressure level.
Sound Level Meter: A sound level meter is an instrument which is sensitive to and
calibrated for the measurement of sound.
Sound Pressure Level: The sound pressure level is the twenty times the logarithm to
the base of 10 of the ratio of the effective pressure (p) of a sound to the reference
pressure (p) of 20 µPa. Thus the sound pressure level in dB=20 log p/p.

Toursandiscalled_TrailoftheMapleLeaf_.ItwilltakethestudentstoBerlin,Amsterdam,Parisandto
Vimyforathreedaycelebration.Attachedisanoverviewofthetripwiththefullitinerary.
Thecostofthetripiscurrently$4200.00perstudentforthe12daysinEurope,whichisthe
reasonwearecontactingallofourlocalcouncils.Thecostforthistripisquitehighandnotattainable
formanyofourstudentswhohaveexpressedaninterestinattendingthisonceinalifetime
opportunity.Wearecurrentlyseekingsponsorshipfromlocalcommunitiesandbusinessestomakea

Dear Mayor Hughes and Members of Council,
We need your assistance in our continuing effort to promote Crime Stoppers in your community and it would be
greatly appreciated if you would recognize CRIME STOPPERS by presenting a motion to declare or proclaim
CRIME STOPPERS, of Simcoe-Dufferin-Muskoka was established on January, 12, 1987 and became
incorporated as a non-profit charitable organization on February 11, 1987. The program is operated by a
volunteer Board of Directors, who oversees all phases of the program;
CRIME STOPPERS is not a Police program nor funded by the provincial or federal government or from police
agencies. The program is operated solely with monies generously donated from the private sector, businesses
or raised through fundraising efforts of the volunteer Board of Directors and committee volunteers;
CRIME STOPPERS is a program that benefits everyone in the community and in 2005 Crime Stoppers
International was recognized by the United Nations as a global force in the fight against crime and terrorism;
CRIME STOPPERS mandate is to assist the Police in solving crimes thereby making our communities and
schools safer. Through the media, the public is encouraged to call a province wide toll free number 1-800-222-
8477 with any information about a crime that has occurred or is about to occur. If the information provided
solves or prevents a crime, the anonymous caller is eligible for a cash reward.
Anonymous calls to CRIME STOPPERS of Simcoe-Dufferin-Muskoka have assisted the Police and other
investigative agencies in making 4,123 arrests, recovering stolen property valued at over $11 million and
seizing over $59 million in illegal drugs. For this information, Crime Stoppers has approved $327, 422 in cash
rewards.

b) Lake Simcoe Science Newsletter
Board members were provided the latest edition of Lake Simcoe Science, featuring Benthic
Macroinvertebrates, noting that these are the bugs that live on the bottom of lakes and rivers, and

Conservation Engineer, gave a brief overview of the Metrolinx SmartCommute program, as well as
Employer of the Year award in 2011, received Gold Status for four consecutive years, and in 2015 was
one of two honorable mentions out of 330 for Employer of the Year.
d) Ryerson University Partnership
CAO Mike Walters advised that LSRCA will be partnering with Ryerson University on a number of
initiatives, including LID monitoring, phosphorus recycling, and a Train the Trainer program involving
training teachers in environmental education. In addition, CAO Walters advised that he has accepted
a position on the Ryerson Urban Water Advisory Board.

V. PRESENTATIONS
Winter Salt in the Lake Simcoe Tributaries
LSRCA staff members David Lembcke, Manager, Environmental Science and Monitoring, and Bill
Thompson, Acting Subwatershed Plan Coordinator, provided Board members with their presentation on
the effects of winter salt (chloride) in the Lake Simcoe tributaries, noting that there is a long-term and
consistent trend to increasing chloride concentrations in Lake Simcoe and its tributaries, as well as in
groundwater. This trend is most noticeable in urban areas during winter months. They advised that
-term or acute exposure
guideline for aquatic health during winters and are typically above the long-term or chronic guidelines
year-round. Data suggests that this chloride is a result of salt used to control ice and snow on roads,
parking lots and sidewalks.
In addition to direct releases to watercourses during winter and spring melts as noted by staff, chloride
that has seeped into the aquifer is discharging out to our creeks year-
identifies reversing this trend as a priority area for action, and staff have begun working with its partners
to develop a suite of resources that will complement the actions municipalities and the MTO have already
taken. These actions include promoting the Smart About Salt certification program, developing guidelines
for the design and construction of new parking lots to reduce the need for salt, and establishing a Lake
Simcoe Salt Working Group made up of municipal and provincial planners and roads staff, as well as water
resource specialists from the LSRCA, MOECC, University of Guelph and the University of Ryerson.
Deputy Mayor Donnell noted that last winter the Township of Ramara used a mixture on their roads
that included granite and found this to be very effective in the treatment of icy roads.

HIGHLIGHTS
of the NVCA BOARD OF DIRECTORS MEETING
No. 12-15 December 11, 2015
Service Delivery and Operational Review Update
Gayle Wood, Chief Administrative Officer, provided an update on recommendations
(2014).
The review was broken into three phases: Phase 1 addressed governance and efficient
operations; Phase 2 addressed an updated performance management system; and
Phase 3 addressed staff compensation.
In total, the Service Delivery and Operational Review contained 26 recommendationsfor
improvement. The CAO reported that of those recommendations, 12 have been
completed and 14 are underway.
Under the 2015 to 2018 Business Plan, the Board has directed the CAO to respond to
the Service Delivery and Operational Review recommendations over the course of
2015/2016.
NVCA Board of Directors Communications Survey
During November, the Board of Directors responded to a communications survey
presented as a result of Service Delivery and Operational Review. The Board provided
positive feedback about how NVCA staff are communicating with them, and also
provided excellent advice for moving forward. Staff continue to focus on improving
communications, both internally and externally.

Heard from Fred Dobbs, Manager, Stewardship Services, regarding the work
NVCA is doing in support of the Township of Clearviews EcoPark Project. The
park is located on Lamont Creek in the Hamlet of Stayner.
In early December, NVCA worked with students from Stayner Collegiate Institute
and Clearview Meadows Elementary School to enhance fish habitat along the
creek. The students removed a large woody blockage from the creek that was
causing high water temperatures and algae growth. They also planted 200 live
willow and dogwood cuttings.
Approved the NVCA Education Strategic Plan for implementation starting in
January 2016.
Learned about the visit of a delegation from
Resources Department to NVCA on December 10, 2015. The delegates came to
NVCA to learn more about how Ontario is managing its water resources.
CAO Gayle Wood thanked NVCA Hydrogeologist Ryan Post for his presentation on
source water protection projects in the watershed. The CAO also recognized Yi
Wang, a volunteer post-doctoral student working at NVCA, for his excellent
interpretive skills.

RE: The Smart Growth for Our Communities Act, 2015
The Smart Growth for Our Communities Act, 2015, which makes a number of
changes to the Development Charges Act, 1997, and the Planning Act, passed in the
Ontario legislature and received Royal Assent on December 3, 2015.
The majority of changes to both the Development Charges Act, 1997, and the
Planning Act will come into force on a day to be named by proclamation. However,
the following provisions relating to the Planning Act have already come into force
through Royal Assent.
Subsection 1(2) of the Planning Act has been amended to restrict the ability of
ministries other than the Ministry of Municipal Affairs and Housing to be added
as a party to an Ontario Municipal Board appeal.
Subsection 3(10) of the Planning Act has been amended to extend the review
cycle of the Provincial Policy Statement from 5 to 10 years.
Subsections 4(1) and 4(2) of the Planning Act have been amended to remove
, as the Minister does not have delegation powers
for site plan.
Subsection 22.1 has been added to the Planning Act to provide certainty that
when new policies or laws come into effect, applications for official plan
amendments are subject to the previous policies or laws only if the required
supporting material (i.e. complete application) has been submitted prior to the
transition date.
This legislation provides for enhanced tools and processes for communities and
residents to determine how their neighbourhoods grow, and to plan and pay for
growth. The legislation aims to help municipalities recover more costs for growth-
related infrastructure, give residents more say in how their communities grow, protect
and promote greenspaces, enhance transparency and accountability, set clearer

rules for land use planning, give municipalities more independence to make local
decisions and make it easier to resolve disputes.
Some examples of important improvements to the development charges and planning
systems introduced by the new Act include:
Increasing Funding for Growth-Related Infrastructure by:
removing the mandatory 10 per cent discount required when levying a charge
for transit services
creating an authority to identify services for which a planned service level
calculation would replace the historic 10 year average service level
creating an authority to identify ineligible services exclusively through
regulation (a commitment to bring forward regulatory changes to make waste
diversion as a service for which development charges can be collected has
already been announced)
Enhancing Municipal Transparency by:
--
requiring municipalities to reflect capital projects funded through development
charges in a detailed report
under the Development Charges Act
Increasing Predictability and Accountability by:
linking development charge background studies to municipal asset
management planning
requiring development charges for individual buildings to be set as of the date
an initial building permit is issued, and for development charges to be payable
on that date (there is an exception for multi-phase developments)
Enhancing Citizen Engagement by:
requiring explanation of how public input affected a municipal planning
decision
ensuring consideration of public input at the municipal level by approval
authorities and the Ontario Municipal Board
requiring locally designed public consultation policies
facilitating the modernization of the giving of notice through additional methods
(e.g. email)
increasing use and ensuring citizen membership on planning advisory
committees

limiting requests for amendments to new official plans and/or new

I am writing to you regarding the recent release of our governments report, 3126!Svsbm!
Spbenbq;!Uif!Qbui!Gpsxbse!gps!Poubsjp. Building on the valuable input we have received from
rural stakeholders this report outlines key government priorities and highlights the progress
made in Ontario since the original report was issued in 2014. It also identifies additional
initiatives impacting rural Ontario and sets the stage for ongoing consultations and
engagement with rural Ontarians.
Ontario is committed to creating conditions where the provinces rural municipalities,
businesses and regional economies can grow and prosper. That is why Ontario is:
Investing in infrastructure , approximately $15 billion has been committed through
the Moving Ontario forward Fund to support investments in roads, bridges, transit and
other critical infrastructure in communities outside of the Greater Toronto and Hamilton
Area.
Improving rural health care- the Telehomecare Expansion Project is reducing the
need for rural patients with chronic health conditions to travel to receive health care.
The project helps patients manage their health using remote monitoring technology with
the support of specially trained nurses. As of March 31, 2015, more than 5,000 patients
with congestive heart failure and chronic obstructive pulmonary disease have benefited
from the program.
Helping youth to develop skills for success - as part of Ontarios renewed Youth
Jobs Strategy, the new Youth Job Connection program offers paid pre-employment
workshops, job placement opportunities and mentorship to youth between the ages of
15 and 29, who are unemployed, in school, or in training. The program also offers part-
time after-school and summer job opportunities to high-school students between the
ages of 15 and 18, facing challenging life circumstances.

The Corporation of the Township of Oro-Medonte
By-law No. 2016-012
Being a By-law to Prohibit and Regulate the placing, dumping or removal of fill
and the alteration of the grade within the Township of Oro-Medonte.
(Site Alteration By-law)
Whereas section 142 of the Nvojdjqbm!Bdu-!3112, S.O. 2001, c. 25, as amended,
authorizes the Council of The Corporation of the Township of Oro-Medonte to pass by-
laws for prohibiting or regulating the placing, dumping or removal of fill of any kind, for
prohibiting or regulating the removal of topsoil, and for prohibiting or regulating the
alteration of the grade of land;
And Whereas Council deems it in the public interest to regulate the dumping and
placing of fill, the removal of topsoil, and other site alteration in order to ensure that
existing drainage patterns are maintained and that any changes to existing drainage
patterns are appropriate to protect environmental features; to prevent the importation of
hazardous material and to keep the disturbance of landform characteristics to a
minimum;
Now Therefore the Council of The Corporation of the Township of Oro-Medonte hereby
enacts as follows:

1.0 Definitions
For the purpose of this By-law, the following definitions shall apply:
means lands that are used by a farming business
registered under the Gbsn!Sfhjtusbujpo!boe!Gbsn!Pshboj{bujpo!Bdu-!2::4,
S.O. 1993, c. 21, as amended, for the growing of crops, including nursery and
horticultural crops; raising livestock; raising of other animals for food, fur, fibre,
including poultry and fish, aquaculture, apiaries, agro-forestry, maple syrup
production;
"Commercial Fill Operation" means the placing or dumping of fill involving
remuneration paid, or any other form of consideration provided, to the owner,
tenant or occupier of the land, whether or not the remuneration or consideration
provided to the owner, tenant or occupier is the sole reason for the placing or
dumping of the fill;
"Conservation Authority" means the Lake Simcoe Region Conservation
Authority or the Nottawasaga Valley Conservation Authority;
"Council means the Council for the Township;
means the County of Simcoe;
"Drainage" means the movement of water to a place of disposal, whether by
way of the natural characteristics of the ground surface or by an artificial method;
"Dump, dumped or dumping" means the depositing of fill in a location
other than where the fill was obtained and includes the movement or depositing
of fill from one location on land to another location on the same land;
"Erosion" means the detachment and movement of soil, sediment or rock
fragments by water, wind, ice or gravity;

grade prior to the passing of this By-law;
means any type of material deposited or placed on land and includes soil,
stone, concrete, asphalt, dirt, sod or turf either singly or in combination;
"Grade" means the elevation of the ground surface of lands and shall be
comprised of each of the following, as may be applicable:
i) "Existing Grade" means the elevation of the existing ground surface of
the lands upon which dumping and/or placing of fill or other site alteration
is proposed and of abutting ground surface up to 3 metres wide
surrounding such lands, except that where placing or dumping of fill or
other site alteration has occurred in contravention of this By-law, existing
grade shall mean the ground surface of the lands as it existed prior to the
dumping or placing of fill or to any other site alteration.
ii) "Finished Grade" means the approved elevation of ground surface of
lands upon which fill has been placed in accordance with this By-law;
iii) "Proposed Grade" means the proposed elevation of ground surface of
land upon which fill is proposed to be placed;
"Inspector" means individuals appointed as inspectors or municipal law
enforcement officers and/or their respective designates under this By-law;
means the registered owner of the land on which site alteration is
proposed or occurring and any person, firm or corporation managing or
controlling such lands;

"Place, placed or placing" means the distribution of fill on lands to
establish a finished grade different from the existing grade;
"Retaining Wall means a wall designed to contain and support fill which has a
finished grade higher than that of adjacent lands;
"Site Alteration" means the placing or dumping of fill on land, the removal of
topsoil from land, or the alteration of the grade of land by any means including
placing fill, clearing and grubbing, the compaction of soil or the creation of
impervious surfaces, or any combination of these activities;
means material commonly known as earth, topsoil, loam, clay, sand or
gravel;
"Topsoil' means those horizons in a soil profile, commonly known as the "0" and
"A" horizons, containing organic material and includes deposits of partially
decomposed organic matter such as peat;
"Township" means The Corporation of the Township of Oro-Medonte.
2.0 Regulations
2.1 No person shall place or dump any fill, remove any peat or topsoil, or otherwise
alter the grade of land by causing or permitting any form of site alteration involving
the placing or dumping of more than two thousand cubic metres (2,000 m3) of fill
on any lands within the Township;
3.0 Exemptions
3.1 This By-law is not applicable to the following:
3.1.1 The use, operation, establishment, alteration, enlargement or extension of
a waste management system or waste disposal site within the
meaning of Part V of the Fowjsponfoubm!Qspufdujpo!Bdu, R.S.O.1990, c.
E.19, as amended, or a waste, waste disposal or waste management
system that is exempted by regulation from said Part V;
3.1.2 The construction, extension, alteration, maintenance or operation of works
under section 26 of the Qvcmjd!Usbotqpsubujpo!boe!Ijhixbz!Jnqspwfnfou!
Bdu, R.S.O. 1990, c. P.50, as amended;
3.1.3 Emergency measures taken by the Township, County or Conservation
Authority or any other federal, provincial or governmental agency or body,
to prevent flooding, erosion, slipping of soil or damage of trees;
3.1.4 The activities of the Township, County or the Conservation Authority
related but not limited to the establishment or maintenance of utilities and
services, roads, bridges, flood and erosion control facilities, walkways,
bicycle paths, fences, retaining walls, steps and lighting;
3.1.5 The placing or dumping of fill, removal of topsoil or alteration of the grade
of land imposed after December 31, 2002 as a condition to the approval of
a site plan, a plan of subdivision or a consent under section 41, 51 or 53 of
the Qmboojoh!Bdu or as a requirement of a site plan agreement or
subdivision agreement entered into under those sections;
3.1.6 The placing or dumping of fill, removal of topsoil or alteration of the grade
of land imposed after December 31, 2002 as a condition to a development
permit authorized by regulation made under section 70.2 of the Qmboojoh
Bdu or as a requirement of an agreement entered into under that
regulation;
3.1.7 Aggregate (as defined in the Bhhsfhbuf!Sftpvsdft!Bdu, R.S.O. 1990, c.
A.8, as amended) brought onto a pit or quarry operating under a licence or
wayside permit issued under that statute as part of the operations of that
pit or quarry;

3.1.8 The placing or dumping of fill, removal of topsoil or alteration of the grade
of land undertaken on land described in a licence for a pit or quarry or a
permit for a wayside pit or wayside quarry issued under uif!Bhhsfhbuf!
Sftpvsdft!Bdu;
3.1.9 The placing or dumping of fill, removal of topsoil or alteration of the grade
of land undertaken on land in order to lawfully establish and operate or
enlarge any pit or quarry on land,
i) that has not been designated under the Bhhsfhbuf!Sftpvsdft!Bdu
or a predecessor of that statute; and
ii) on which a pit or quarry is a permitted land use under a by-law
passed under section 34 of the Qmboojoh!Bdu;
3.1.10 Any rehabilitation or filling activity in a pit or quarry licensed under the
Bhhsfhbuf!Sftpvsdft!Bdu, and specifically addressed on the approved
site plan when there is insufficient overburden retained to rehabilitate such
pit or quarry in accordance with that statute;
3.1.11 The placing or dumping of fill, removal of topsoil or alteration of the grade
of land undertaken as an incidental part of the drain construction under the
Esbjobhf!Bdu, R.S.O. 1990, c. D.17, as amended, or the Ujmf!Esbjobhf!Bdu
R.S.O. 1990, c. T.8, as amended;
3.1.12 The placing or dumping of fill, removal of topsoil or alteration of the grade
of land undertaken by a transmitter or distributor, as those terms are
defined in section 2 of the Fmfdusjdjuz!Bdu-!2::9, S.O. 1998, c. 15, Schedule
A, as amended, for the purpose of constructing and maintaining a
transmission system or a distribution system, as those terms are defined
in that section;
3.1.13 The removal of topsoil from agricultural lands incidental to a normal
agricultural practice including such removal as an incidental part of sod-
farming, greenhouse operations and nurseries for horticultural
products. This exception does not include the removal of topsoil for sale,
exchange or other disposition;
3.1.14 The harvesting of peat in a commercial operation as approved by the
Conservation Authority.
3.1.15 Existing Commercial Fill operations that are actively and lawfully accepting
fill prior to the passing of this By-law.
3.2 Section 2.1 does not apply to the following:
3.2.1 Construction where a permit authorized under the Building Code Act has
been issued by the Chief Building Official including erection, installation,
construction, demolition of a building, structure or on-site sewage system.
3.2.2 The placing or dumping of fill in an excavation to the elevation of existing
grade following the demolition or removal of a building or structure for
which a building permit has been issued.
3.2.3 Fill being placed or dumped on lands for the purpose of flood or erosion
control to establish finished grade shown on a grading and drainage
plan approved by the Conservation Authority, County or by the
Township in conjunction with a subdivision approval.
3.2.4 The resurfacing or paving of existing driveways where there is no
alteration to the existing driveway base and no significant change in
the direction or rate of drainage to neighboring properties.
3.2.5 Replacement of topsoil for restoration of agricultural lands used for normal
agricultural practices, as an incidental part of sod farming, greenhouse
operations, and nurseries for horticultural practices. Storage of such
topsoil shall not exceed two thousand (2000) cubic metres.

4.0 Orders
4.1 If after inspection, an Inspector is satisfied that a contravention of this By-law has
occurred, the inspector shall notify the registered owner of the land of the
to subsections 444(1) and 445(1) of the Nvojdjqbm!Bdu-!3112, as amended, at the
same time and provide all occupants with a copy of the notice and such order
shall contain:
4.1.1 the municipal address and the legal description of the land;
4.1.2 reasonable particulars of the contravention;
4.1.3 the period of time within which there must be compliance.
4.2 The Inspector, by a written Notice of Contravention and/or an Order to Comply
pursuant to subsections 444(1) and 445(1) of the Nvojdjqbm!Bdu-!3112, as
amended, may require any person who has altered the grade of land, or who has
caused or permitted the grade to be altered contrary to the provisions of this By-
law, or who has placed or dumped fill, or has caused or permitted fill to be placed
or dumped, or who has caused or permitted any form of site alteration contrary to
the provisions of this By-law:
4.2.1 to cease all work in respect of site alteration;
4.2.2 to remove the fill;
4.2.3 to fill in any excavations or ponds; and/or
4.2.4 to do all work necessary;
4.2.4.1 to eliminate any hazards resulting from the alteration of the grade
or the dumping or placing of fill and to restore the land to a
condition of safety;
4.2.4.2 to restore the land to its former condition prior to the alteration of
the grade of land to the placing or dumping of the fill on the land or
other site alteration.
5.0 Enforcement
5.1 The enforcement of this By-law shall be performed by the Inspectors of the
Township as may be appointed by Council.
5.2 Inspectors and/or their designate may, at any reasonable time enter and inspect
to determine compliance of this By-Law.
6.0 Offences
6.1 Every person who contravenes the provisions of this By-law is guilty of an
offence and liable upon a conviction to penalty as set out in the Qspwjodjbm!
Pggfodft!Bdu, R.S.O. 1990, c. P.33, as amended.
6.2 Every person who contravenes the provisions of any section of this By-law and
every director or officer of a corporation who knowingly concurs in the
contravention by the corporation, is guilty of an offence under the provisions of
the Nvojdjqbm!Bdu-!3112.
6.3 In addition to any fine or any other penalty, any person who is convicted of
contravening a provision of this By-law or an order issued pursuant to this By-law
and subsections 444(1) or 445(1) of the Nvojdjqbm!Bdu-!3112, as amended, may
be ordered by a court of competent jurisdiction at the expense of the person to:
6.3.1 rehabilitate the land;
6.3.2 remove the fill placed or dumped;

6.3.3 restore the grade of the land to its original conditions.
6.4 Every person who hinders or obstructs, or attempts to hinder or obstruct, any
person exercising a power or performing a duty pursuant to this By-law is guilty
of an offence as provided in section 426 of the Nvojdjqbm!Bdu-!3112.
