D) No flows for Well 1 were recorded on any of the monthly summaries or on the Annual Summary report because the automated polling system is programmed to only record flows of one full m3 and flows from this well were less than one m3 on any given day. The daily log sheets prepared by the operators showed these flows. A total flow of 4 m3 was recorded from Well 1 during the inspection period. Recommendation: A) The Municipality should consider installing a summary of active alarms, operational targets and alarm set points, which should ensure effective disinfection of the produced water, including high and minimum low free chlorine residuals, contact chamber / reservoir depth HLP lock out level, chemical pump failures, flows into and through the works and high and low contact chamber / reservoir depths in the Operations and Maintenance Manuals. B) The Operations and Maintenance Manuals should be reviewed by municipal staff and any inaccuracies should be corrected as soon as possible. C) The Municipality should consider installing metal sheathing on the remaining side of the communications tower at the PH to prevent climbing. D) The Municipality should consider reprogramming the SCADA polling and recording process to include partial m3 for flows so all flows are more accurately captured. B) The communications tower at the pumphouse had metal sheathing installed to prevent climbing but only on two of three sides. C) There was no screen on the water tower overflow discharge. D) The Operations and Maintenance Manuals did not contain a listing of active alarms, operational targets and alarm set points, which should ensure effective disinfection of the produced water including high and minimum low free chlorine residuals, low, high and overflow water tower level alarms, tower level set points for pump starts and stops, chemical pump failures, well pump lock out interlocks and flows into and through the works. E) There were a number of inaccuracies found in the Operations Manuals. F) The raw water pressure switch in the PH contains mercury. Recommendation: A) The inaccurate equipment descriptions (as above) in the DWWP should be corrected at the Municipality's earliest convenience. B) The Operating Authority should consider installing metal sheathing on the remaining side of the communications tower at the pumphouse to prevent climbing. C) The Operating Authority should consider installing a screen on the water tower overflow discharge. Best Practice Issues and Recommendations Issues: 1) The HLP's can discharge water through the contact main and into the distribution piping at a rate of 12.4 Us (1088.64 m3 /day). It would appear that, unless the HLP's and reservoir are taken out of service, that the maximum flow rates into the treatment works are now 12.4 L /s. A Schedule C has been issued for the DWWP and guidance for updating the DWWP and MDWL indicates that corresponding changes to the MDWL would be completed by the Environmental Assessment and Approvals Branch. There have been no new issues of the MDWL during the inspection period. 2) The Operations and Maintenance Manuals did not contain a listing of active alarms, operational targets and alarm set points, which should ensure effective disinfection of the produced water including high and minimum low free chlorine residuals, chemical pump failures, reservoir alarm set points and operating levels, system pressures and flows into and through the works have not been included in the manuals. 3) There were a number of inaccuracies found in the Operations Manuals. 4) A CT calculation was not provided for the original configuration where the reservoir and HLP's are by- passed and only the well pumps and the contact main are used for treatment. 5) Some of the equipment descriptions and information provided in the DWWP and MDWL were inaccurate. See page 12 of the report for a full accounting. 6) There was no wiring which would allow for quick, non - disruptive failure testing of the free chlorine residual analyser installed at the PH (as installed in all of their other facilities). Act & Regulations Duration Action Taken Status Operators were not examining continuous monitoring test results or they were not examining the results within 72 hours of the test. During this inspection period, there was a period of approximately 2.5 months (from mid - November, 2012 until January 10, 2013) where the free chlorine analyser data recorded by the SCADA system showed very little deviation. The record was effectively flat lined at about 1.2 mg /L. The daily summary sheets which provide daily minimum and maximum free chlorine residuals often indicated that these two values were the same (this is unlikely to ever occur). During normal daily operations, free chlorine residuals typically fluctuated a significant amount ( +/- 0.3 mg /L). According to records, operational staff did check these records daily and the analyser was physically observed and verified at least twice per week during this period. However, the flat line readings were not noticed during routine SCADA reviews until this Inspector advised Staff of this situation. The free chlorine analyser was immediately maintained and the problem was corrected on January 10, 2013. It is unknown if this situation adversely affected alarm capabilities if the free chlorine residual had passed out of the programmed control band or what was the actual cause. The free chlorine alarm on a power failure was tested at the time of inspection and that function operated properly. Action(s) Required: The Operating Authority shall ensure that data recorded by the SCADA system for all parameters is thoroughly examined at least every 72 hours and records of any anomalous values shall be recorded separately in accordance with Subsection 6 -5(1) of Schedule 6 or O. Reg. 170/03. Robincrest — 2012 Municipal Summary Report Best Practice Issues and Recommendations Issues: 1) The Operations and Maintenance Manuals did not contain a listing of active alarms, operational targets and alarm set points, which should ensure effective disinfection of the produced water, including high and minimum low free chlorine residuals, chemical pump failures, reservoir alarm set points and operating levels, system pressures and flows into and through the works have not been included in the manuals. 2) There were a number of inaccuracies found in the Operations Manuals. 3) There was no drip pan under the diesel generator and fuel lines within the PH. A new double walled tank was present but not in use and Staff advised that the generator will be replaced with a gas fired unit at some point in the future. 4) Fire pump flows by -pass the treated water /distribution water flow meter and the treated water free chlorine residual analyser. Recording all volumes of water discharged to the distribution system is required by the MDWL. Continuous free chlorine residual monitoring must be provided. There were no fire pumps flows recorded or observed during the inspection period. There were no indicators if the fire pump operated except for observation of precipitous reservoir level drops on trending and /or potentially pressure drops when the HLP's lock out. 5) There was a broken conduit which could provide a route of access for contaminants to the small reservoir. 6) Some of the equipment descriptions provided in the DWWP were inaccurate. See pages 12 and 13 of this report for a full accounting. Recommendation: 1) The Municipality should consider installing a summary of active alarms, operational targets and alarm set points, which should ensure effective disinfection of the produced water, including high and minimum low free chlorine residuals, chemical pump failures, reservoir alarm set points and operating levels, system pressures and flows into and through the works in the Operations and Maintenance Manuals. 2) The Operations and Maintenance Manuals should be reviewed by municipal staff and any inaccuracies should be corrected as soon as possible. 3) The Municipality should consider installing secondary containment for the entire diesel generator installation. 4) Volumes of water discharged to the distribution system by the fire pump must be calculated and recorded in the flow records for the Robincrest PH as required by the MDWL. With no continuous monitoring available, staff must make records of treated water free chlorine residuals immediately before and immediately after fire flows are observed. As an alternative to a dedicated flow meter, an hours of operation meter on the fire pump would aid in tracking length and time of operation of this pump so distributed volumes could be calculated more accurately. Best Practice Issues and Recommendations Issues: 1) The Operations and Maintenance Manuals did not contain a listing of active alarms, operational targets and alarm set points, which should ensure effective disinfection of the produced water including high and minimum low free chlorine residuals, chemical pump failures, reservoir alarm set points and operating levels, system pressures and flows into and through the works have not been included in the manuals. 2) There were a number of inaccuracies found in the Operations Manuals. 3) There was no flow meter on the Well 1 overflow. Technically, water flows discharged from this well to the ground during artesian conditions are considered takings against the PTTW and should be accounted for. 4) A plastic cased and capped monitoring well (WWR 5708758) is located on the PH property. Water was emerging from the ground surrounding this well and running away to the south. 5) Some of the equipment descriptions provided in the DWWP were inaccurate. See pages 12 and 13 of this report for a full accounting. The free chlorine residual analyser described on the contact main discharge is likely not required and will not be installed. 6) The monitoring well was marked by a metal t -bar but is not protected in any other way. Recommendation: 1) The Municipality should consider installing a summary of active alarms, operational targets and alarm set points, which should ensure effective disinfection of the produced water including high and minimum low free chlorine residuals, chemical pump failures, reservoir alarm set points and operating levels, system pressures and flows into and through the works in the Operations and Maintenance Manuals. 2) The Operations and Maintenance Manuals should be reviewed by municipal staff and any inaccuracies should be corrected as soon as possible. 3) The Municipality should consider installing a flow meter on the overflow from Well 1 to capture all takings as required by the PTTW. 4) If the Municipality does not intend to use monitoring well 5708758 for any purpose, it should either be abandoned in accordance with Reg. 903 or maintained in such a way that it does not pose a contamination threat to the aquifer into which it is drilled (i.e. determine where the water is leaking from and seal it). 5) The equipment descriptions in the DWWP should be corrected at the Municipality's earliest convenience. 6) The Municipality should consider installing some form of protective barrier around the monitoring well to protect it from vandalism and /or vehicular traffic. That Council supports the change of the septic maintenance inspection program to a township implemented program as outlined in option 3 below. BACKGROUND: January 1, 2011 the Ontario Building Code was amended for the implementation of a mandatory onsite sewage maintenance inspection for all properties within 100m of the Lake Simcoe Shoreline. All onsite sewage systems installed prior to January 1, 2011 are to be inspected prior to January 1, 2016 and every 5 years thereafter. 1237 properties have been identified within the Township of Oro - Medonte. January 1, 2012 the Source Water Protection areas were identified. Twelve areas in the Township require an inspection of all properties within 100m of a municipal well head. These inspections are required to be completed prior to January 1, 2017 and every five years thereafter. 138 properties have been identified within these wellhead protection areas. January 1, 2016 all properties within 100m of rivers, streams, lakes or ponds and tributaries that feed into Lake Simcoe are required to have an onsite sewage maintenance inspection prior to January 1, 2021 and every five years thereafter. To date the number of properties has not been identified. March 7, 2012 Council made the decision in the implementation of a Third party certificate program. Refer to Motion # C120307 -16. Notices were sent early in 2012 to 1237 ratepayers along the Lake Simcoe Shoreline providing information regarding the legislation and required compliance. In January 2013 reminders notices were sent out. In addition the 138 properties identified in the Source Protection area were notified of the mandatory program. To date 50 properties have complied with the legislated requirement. (Less than 3 %) Feedback from the public has included concerns with fees from third party, fees for administering the program by the Township and general complaints with having to comply. Further that people feel that waiting to the last year is the best option as the legislation requires an inspection every five years. Concerns • With over 1300 properties requiring an inspection within the next 2 1/2 years staff is concerned with ensuring compliance and follow up that will be required. • The maintenance inspection is mandatory and compliance is not optional. • The Township has no control over cost to the ratepayers from third party persons. • The Township has no control over consistency of the inspection from third party persons. • Lack of record creation including site plan as the Township receives only a sign certificate. • Program will continue to grow with the implementation of all properties within 100m of tributaries • The mandatory program will roll over to phase two in 2016 and every five years thereafter. • The Township staff wants to ensure a positive communication and education to the public with regards to this program Other Municipalities The Township of Tay has chosen to work with CC Tatham as a consultant for all the field inspections of the identified properties along Georgian Bay and the Source Water Protection areas. Tay has over 3000 identified properties and a building division with a small staff compliment and therefore this is their preferred option. The Township of Ramara originally chose to implement a Third Party Certificate option. With little success, the Chief Building Official recommended a different option in 2013 and Council has decided to work with CC Tatham as a consultant for the field inspections of both the Lake Simcoe Shoreline and Source Protection areas. Ramara has over 1400 identified properties and a building division with a small staff compliment, this is their preferred option. The Town of Innisfil has chosen to hire two full time septic inspectors and has one administrative support for the maintenance inspection of both Lake Simcoe Shoreline and Source Protection areas under the supervision of the Chief Building Official. Innisfil has over 1175 identified properties. With the Residential and Commercial development on board for 2013 and a staff of 5, the Town of Innisfil preferred the additional staff. ANALYSIS: Due to staff concerns with the low compliance rate with the Third Party Certificate option, staff is recommending change is the option for implementing the program and achieving compliance. There is a need to set a procedure, create records for a risk management officer, and implement the standardized level for field inspections. With the first stages of this program at the midpoint, it is essential that staff have sufficient time to plan and inspect all properties over the next two years. The implementation of the full program in 2016 and the next phase of inspection will prove to be a very busy time if all properties wait until the last year to achieve compliance. The following options for the septic maintenance inspections are: 1. Continue with the current Third Party Certificate option. Hire an administrative co -op student in 2013 to work with records management staff and Chief Building Official to complete file searches for old septic records contained within property files, scan all records into proper file management system and create septic maintenance files for all properties within 100m of the Lake Simcoe Shoreline, and within the Source Protection Areas. As the maintenance inspection is mandatory, the follow up from Township staff in writing Orders to Comply and obtaining compliance in 2016 would require the addition of qualified staff and not provide the best possible customer service to ratepayers therefore staff does not recommend that we continue with this program due to the low levels of compliance to date. 2. Have staff create accurate records through file searches and work with a consultant, CC Tatham for the field inspection work. Hire an administrative co -op student in 2013 to work with records management staff and Chief Building Official to complete file searches for old septic records contained within property files, scan all records into proper file management system and create septic maintenance files for all properties within 100m of the Lake Simcoe Shoreline, and within the Source Protection Areas. This is an option for Council's consideration in providing a professional service to the ratepayers. A plan would be implemented for completing the required inspections within the legislated timeframes. The building division has the current staff levels to support the program in house with the addition of a contract inspector five months/ year and a co -op student for four months. Under the supervision of the Chief Building Official, the following would be completed: • Hire an administrative co -op student in 2013 to work with records management staff and Chief Building Official to complete file searches for old septic records contained within property files, scan all records into proper file management system and create septic maintenance files for all properties within 100m of the Lake Simcoe Shoreline, and within the Source Protection Areas. • For the 2013 year; o Staff will work to set procedure, o Assess each onsite septic system as high, medium or low risk in the mandatory sewage maintenance inspection areas. (High being a septic that is greater than 20 years old) o Commencing in September the current staff will begin the assessment review of file information for high risk properties o In closing out the third party certificate option, staff would recommend that owners could use the third party until the end of 2013. Staff would notify all owners of the changes and option. And meet with contractors performing works to ensure positive communication. • Bring a contract inspector on staff five months /year for the next 2 years (2014/2015). This will allow staff the time set up the program, complete the first phase including accurate on site records. • Bring an administrative co -op student on staff in 2016 to create septic maintenance files for all properties identified within 100m of any tributary that feeds Lake Simcoe. • In 2016 staff will review the program success and assess if the current staff compliment can handle the maintenance inspections spread over a 5 year period. The cost to the ratepayer is detailed in the financial section below. Staff will be providing an opportunity for ratepayers to educate themselves about this program and about onsite sewage systems, through two public open houses to be scheduled this summer, one day and one evening meeting. This will allow staff an opportunity to communicate and provide positive customer service to the public. Carried. 3.0 WORK PLAN 3.1 International Zero Waste conference The Orillia Waste Management Advisory Committee is in the early stages of planning an international waste management conference around the theme of `zero waste'. The event would be sometime in 2014. Orillia is well- situated to do this, as their diversion rate and that of the County of Simcoe have been consistently among the highest, if not the highest in the province for the last few years. Compared to other industrialized countries however, Canada generates the most waste per capita. Supporting the notion of Zero Waste is explicitly stated in the Sustainability Plan, Sustainable Severn Sound —March 7th, 2013 Page 98 of 152 12b) Minutes of Sustainability Plan Steering Committee (... along with several other strategic directions that support the reduction of waste, and increase in diversion rates. There was general agreement that Sustainable Severn Sound should be involved in supporting this initiative in any way we can. At this point, things seem to only be at the exploratory phase. It was suggested that Zero -Waste Simcoe should be contacted if they haven't been already, and that the `Green Economy — Waste Industry' study that was done by LURA /ZWS should be re- examined as background material. 3.2 FCM conference report Luke attended the Federation of Canadian Municipalities annual Sustainable Communities Conference in Windsor, February 13 -15th and The report is attached, and is also available for download from our website. There was some There was some discussion of the recent changes to Local Improvement Act that would allow municipalities homeowners to finance energy retrofits or renewable energy projects on their tax bill. This has been done in Halifax and Vancouver and has been done extensively in most US states through "Property- Assessed Clean Energy" programs in most states. There are huge advantages to this: it is revenue - neutral for homeowners, it doesn't require any tax money, and it is has huge energy savings. The program is relatively new in Ontario however, so we will be on the lookout for early adopters. Luke will do some research and see if anyone has implemented anything yet. 3.3 Focus on Nature television spot The plans to prepare for a May /June filming for the Focus on Nature television show were further discussed. There was discussion of what sort of achievements to highlight and filming locations. We are looking for any photographs of municipal council's signing the original plan back in 2009, and Luke will contact LURA if we cannot find it in our files. 3.4 Invasive species communications A second draft of our brochures /poster regarding locally available horticultural species that are also invasive was presented. We will add her to list of potential speakers for the Sustainability Summit. The SSEA is involved with the County and the MNR doing Forest cover mapping using the lasted imagery (2012 aerial photos). They are currently redrawing the drainage maps and will have all the data for RAP targets on a sub - watershed basis (such as overall forest cover, riparian forest cover, and interior area indicators. We can expect this probably in June /July. There has been a second round announcement for the Great Lakes Guardian Fund, though it is very specific as to what it funds; primarily just tree planting. The Great Lakes Protection Act — is being re- introduced at Queen's Park. The development of the feasibility study for the food distribution hub continues. They are looking for broad participation from farmers across the county, so everyone is encouraged to send it out via any available channels. LURA conference — could be here in 2014 Community Bonds? Topic The Penetanguishene Offical Plan review will be starting soon. During pitch -In week, businesses will encourage their employees to help in the "20- minute makeover" clean -up of the town as part of a "business challenge ". There will also be a smart manufacturing summit on April 12`h aimed at manufacturers from outside the area. On Family Day there was an event in Scout Valley Park that had 250 people came out to learn about conservation, with a focus on the children's group "Kids for turtles ". Bob Bowles is also involved with the Huronia Woodland Owners Association, a group we will try to liaise with, as many of their objectives are in -line with those of the Sustainability Plan. Bob will bring up the issue with them, and we may do a presentation if requested. . Severn completed its budget, and has started on an active transportation study It also had a number of joint sessions with SMDHU lately on the issue. The Simcoe County Food Charter has been officially adopted by the County. Waste management changes will also be coming in April.. Midland continuing work on Unimin property master -plan. The Town hopes to make it a leadership model in terms of sustainable development principles for brownfields. This may include incentives for things such as LEED -ND certification, and sould suspend engineering standards regarding road width /parking (i.e. not 66 foot road allowances). Township Development Expenses. The Township has informed Developer that, by virtue of the development of the Project by Developer, the Township may incur certain expenses related to road repair, including but not limited to roads and railroad crossings, due to the development of the Project (collectively, the "Township Development Expenses "). 2. Developer Payment Obligations. The Developer agrees to remit to the Township the amount of TEN THOUSAND CAD ($10,000) (the "Road User's Repair Security "), by way of certified cheque, forthwith upon execution of this Agreement, which amount shall be deposited with the Township to reimburse the cost of any and all damage to the Township roads attributed to the Developer, its contractors or agents. Together with the Road User's Repair Security, the Developer shall provide the Township with a transportation plan for the Project, which shall include the route that the Developer, its contractors and agents will be taking to access the Property, with all roads clearly identified and marked on such transportation plan. 4. The Developer shall notify the Township no later than fifteen days prior to the date the Developer, its contractors and agents will begin to access the Property and utilize the route identified in section 3, above. 5. Upon receipt of the Road User's Repair Security and transportation plan, the Township shall conduct a Baseline Assessment of the roads identified as part of the Project site access route. The Township shall, at its own discretion, conduct a survey of all such roads, based on video evidence taken prior to the commencement of Project construction by the Developer, its contractors or agents. The Developer shall pay the Township's costs of conducting video evidence. The Township shall notify the Developer as to the date upon which the video evidence will be collected and the Developer may be in attendance along with Township representatives when the video evidence is collected. 6. The Developer shall notify the Township immediately upon reaching the date on which commercial operation of the Project is attained, within the meaning of the Supply Contract (the "Commercial Operation Date "). Within 90 days of being notified of the Commercial Operation Date, the Township shall complete an inspection of the roads identified as part of the Project site access route and shall note any damages or items which require repair (the "Damages Assessment "). The Township shall notify the Developer as to the date upon which the inspection of the roads described will take place and the Developer may be in attendance along with Township representatives when the inspection of the roads takes place. The Township shall then forthwith notify the Developer of the results of the Damages Assessment. 7. If no damages to the roads set out on the route identified in section 3, above, are attributable to the Developer, its contractors or agents, the Road User's Security shall be refunded to the Developer, without interest. 8. If the Township determines that any damages are attributable to the Developer, its contractors or agents, the Township may draw upon the Road User's Security to satisfy the cost of repair of such damages. If the cost to repair such damages, the Township shall carry out, or cause to carry out, the work required to repair such damages. If the cost to repair any damages, attributable to the Developer, its contractors or agents is less than $10,000, the Township will process a refund to the Developer no later than thirty (30) days following the calculation by the Township of the total and final cost of the repairs for damages attributable to the Developer, its contractors or agents. The Developer shall notify the Township no later than fifteen days prior to the date the Developer, its contractors and agents will begin to access the Property and utilize the route identified in section 3, above. 5. Upon receipt of the Road User's Repair Security and transportation plan, the Township shall conduct a Baseline Assessment of the roads identified as part of the Project site access route. The Township shall, at its own discretion, conduct a survey of all such roads, based on video evidence taken prior to the commencement of Project construction by the Developer, its contractors or agents. The Developer shall pay the Township's costs of conducting video evidence. The Township shall notify the Developer as to the date upon which the video evidence will be collected and the Developer may be in attendance along with Township representatives when the video evidence is collected. 6. The Developer shall notify the Township immediately upon reaching the date on which commercial operation of the Project is attained, within the meaning of the Supply Contract (the "Commercial Operation Date "). Within 90 days of being notified of the Commercial Operation Date, the Township shall complete an inspection of the roads identified as part of the Project site access route and shall note any damages or items which require repair (the "Damages Assessment "). The Township shall notify the Developer as to the date upon which the inspection of the roads described will take place and the Developer may be in attendance along with Township representatives when the inspection of the roads takes place. The Township shall then forthwith notify the Developer of the results of the Damages Assessment. 7. If no damages to the roads set out on the route identified in section 3, above, are attributable to the Developer, its contractors or agents, the Road User's Security shall be refunded to the Developer, without interest. 8. If the Township determines that any damages are attributable to the Developer, its contractors or agents, the Township may draw upon the Road User's Security to satisfy the cost of repair of such damages. If the cost to repair such damages, the Township shall carry out, or cause to carry out, the work required to repair such damages. The Developer shall notify the Township immediately upon reaching the date on which commercial operation of the Project is attained, within the meaning of the Supply Contract (the "Commercial Operation Date "). Within 90 days of being notified of the Commercial Operation Date, the Township shall complete an inspection of the roads identified as part of the Project site access route and shall note any damages or items which require repair (the "Damages Assessment "). The Township shall notify the Developer as to the date upon which the inspection of the roads described will take place and the Developer may be in attendance along with Township representatives when the inspection of the roads takes place. The Township shall then forthwith notify the Developer of the results of the Damages Assessment. 7. If no damages to the roads set out on the route identified in section 3, above, are attributable to the Developer, its contractors or agents, the Road User's Security shall be refunded to the Developer, without interest. 8. If the Township determines that any damages are attributable to the Developer, its contractors or agents, the Township may draw upon the Road User's Security to satisfy the cost of repair of such damages. if the cost to repair such damages, the Township shall carry out, or cause to carry out, the work required to repair such damages. If the cost to repair any damages, attributable to the Developer, its contractors or agents is less than $10,000, the Township will process a refund to the Developer no later than thirty (30) days following the calculation by the Township of the total and final cost of the repairs for damages attributable to the Developer, its contractors or agents. If the cost to repair any damages, attributable to the Developer, its contractor or agents is more than $10,000, the Township will send an invoice to the Developer for those costs more than $10,000, which invoice the Developer shall pay within thirty (30) days of receipt of such invoice. 9. Dispute Resolution. If the Parties cannot agree as to the any aspect of damage the Township determines is attributable to the roads identified on route set out in section 3, above, either party may commence a mediation proceeding by giving notice in writing to the other party. Once a notice of mediation has been served by either party, the Parties shall work together to choose a mediator with experience in road construction, repair and /or road engineering matters, who shall commence a Error! If the dispute cannot be settled by mediation, the provisions of the Arbitration Act, 1991, S.O. 2001, c. 17. 10. Expiration Date. If the Commercial Operation Date does not occur within five (5) years of the Effective Date, this Agreement shall terminate and be deemed to be null and void and of no further force or effect and the Township shall return the Road User's Security to the Developer, without interest. 11.
