I I I I I I I I I I I I I I THE CORPORATION OF THE TOWNSHIP OF ORO BY-LAW NO. 90-77 Being a By-Law to Close, Sell and Convey Part of Georgina Drive in the Township of Oro, being Part 1 on a Reference Plan deposited in the Registry Office for the county of Simooe as No. 51R-20014. WHEREAS The Municipal Act, R.S.O. 1980, Section 298 as amended provides that by-laws may be passed by Councils of local municipalities to stop up and close any part of a highway and to sell and convey a stopped up and closed highway; AND WHEREAS pursuant to the Municipal Act, notice of this by-law to stop up, close and sell the lands described herein has been posted and published; AND WHEREAS the Council of the Corporation of the Township of Oro deems it advisable to exercise this authority pursuant to section 298 of The Municipal Act; NOW THEREFORE the Council for Corporation of the Township of Oro hereby enacts as follows: 1. That a portion of Georgina Drive abutting Block A of Registered Plan 1561, being Part 1 of a Reference Plan deposited in the Registry Office for the County of Simcoe as No. 51R-20014 be and is hereby stopped up and closed. 2. That the Corporation of the Township of Oro do sell and convey the aforesaid described lands to the owner abutting the property, Mr. Archibald John Brown or as it may direct. 3. That the Reeve and the Administrator/Clerk of the Township of Oro be and are hereby authorized, directed and empowered to do all things necessary to complete the sale and conveyance of the said lands and are hereby authorized to execute such conveyances as are necessary to carry out the provisions of this by-law on behalf of the Corporation of the Township of Oro. 4. That attached to this by-law as Schedule "A" is an Affidavit of Robert W. Small, Administrator/Clerk of the Township of Oro setting out the particulars of publication and posting of the said Notice pursuant to the provisions of The Municipal Act and reciting the persons who appeared before the Council. READ a first and second time this 5th day of July, 1990. READ a third time and finally passed this 5th day of July, 1990. Small 1 A F F I D A V I T e In the Hatter of the a By-law to stop up, Close and Convey to the abutting Landowner part of Georgina Drive on Registered Plan 1561 in the Township of Oro in the County of Simcoe, designated as Part 1 of Reference Plan 51R- 20014. I, Robert W. Small, of the city of Barrie, in the County of Simcoe make oath and say as follows: 1. I am the Administrator/Clerk for the Corporation of the Township of Oro and as such have knowledge of the matters hereinafter deposed to. 2. Notice of Road Closing pursuant to section 301 of the Municipal Act, R.S.O. 1980, as amended was given by publishing the "Notice" attached to this my affidavit as Exhibit "A" in two local newspapers, the Examiner and the Packet once a week for four consecutive weeks from Monday April 30, 1990 to Tuesday May 22,1990. 3. I did also cause to be posted a copy of the Notice attached as Exhibit "A" to this my affidavit in six of the most public places in the immediate neighbourhood of the subject roadway for a period of greater than one month pursuant to section 301 of the Municipal Act, R.S.O. 1980 as amended. 4. Notice was given to the County of Simcoe pursuant to section 298(7) on the 24th day of April by personal service and no objection to the proposed by-law was filed within the sixty day period following notice being given. 5. The Minister of Municipal Affairs was notified by first class prepaid mail on the 23rd day of April, 1990 and pursuant to the provisions of the Municipal Act, his approval is attached to this by-law. 6. On the 3rd day of July, 1990 the Deputy-Clerk was present and no one attended to state that their land would be prejudicially affected by the proposed By-law. PUBLIC NOTICE TAKE BOTICB that the Council of the corporation of the Township of Oro proposes to enact a by-law to stop up, close and convey to the abutting landowner part of Georgina Drive on Registered Plan 1561 in the Township of Oro in the County of Simcoe, designated as Part 1 of Reference Plan 51R-20014. The proposed by-law and copy of Plan 51R-20014 may be viewed at the Township Municipal Offices during normal business hours. THE PROPOSBD BY-LAW will come before Council for the Township of Oro for consideration at its regular meeting at the Township Municipal Offices on the 3rd day of July, 1990 at 7:00 p.m. and at that time, the Council will hear in person or by their Counsel, Solicitor or Agent any person who claims that his land will be prejudicially affected and who applies to be heard.
