01 21 1980 Council Minutes L . . . ~ pg. 12 COUNCIL CHAMBERS - JANUARY 21, 1980 SECOND MEETING Council met pursuant to adjournment with all members present. Reeve Howard A. Campbell in the chair. The minutes of the last regular meeting of January 7th and Special Meeting on the evening of January 7th, 1980 were on motion of McLean and Smith confirmed as printed and received. Presented copies of letters forwarded as instructed at the last regular meeting to: Orillia and Barrie Public Libraries advising of "User Feel' to be effective for 1980 and copy of letter to Barrie Examiner and Orillia Packet requesting notice to be placed regarding the "user feel!, also copy of the notices; Hastings Electric (Oro) Ltd. advising that their quotation for electrical work on second well on Plan M-66, Shanty Bay had been accepted and copy of letter to Dykstra Brothers Electric Ltd. advising that their quotation for this work had not been accepted; copies of letters were forwarded to Reid and Associates Ltd. and Snider Pumps Incorporated; Mrs. Karen Sanderson, Secretary, Shanty Bay Ratepayers Association re: additional street light on Church Street at St. Thomas Church entrance, requesting Council be advised whether the Association concurs with request from St. Thomas Church Advisory Board; Roxson Contractors Limited re: floor at Oro Township Community Arena; Barrie Examiner and Orillia Packet re: notice retirement night for Ross Currie; Ministry of Transportation and Communications - municipal mileage report up-dating for 1980; Mr. Robert Stinson of Barrie Twin Drive-In Theatre requesting balance of payment for paving Line 4, as agreed to in August 1979. On motion of Sanderson and Swainson copies of letters as presented and forwarded accepted as satisfactory and ordered placed on file. Presented letter from D. S. White, dated January 3, 1980 forwarding copy of letter he had written to York Sand and Gravel Limited, as instructed by Council by resolution passed on December 31, 1979. The aforementioned letter was to put York Sand and Gravel Ltd. on notice, that the Township formally requests compliance with the provisions of the Site Plan Agreement on or before January 15, 1980. Also copy of letter from Peter H. Howden to Mr. D. S. White in reply to his letter and further letter from Mr. White's office advising that he would be away until January 17th, after which he would contact the Township regarding Mr. Howden's letter. And copy of letter from D. S. White, to Peter Howden in reply to his letter of January 18, 1980. On motion of Swainson and Sanderson that correspondence presented be received and placed on file until further information is received from the Township Solicitor. Presented letter from Ministry of Transportation and Communications approving Council's action in accepting the tender of Reg Smith Motors Ltd. to supply one half ton Dodge model D147, ~ ton pick-up truck equipped as per specifications and returning original tenders. . . . pg. 13 SECOND MEETING (Conti d) JANUARY 21, 1980 On motion of McLean and Smith, letter accepted and be placed on file for reference. Presented account from George Snider Pumps Ltd. for the installation of pump in second well at Shanty Bay, Plan M-66 and necessary connection to pump house including conduit cable for electrical connections to submersible pump. Total price for material and installation being $5,710.00 according to quotation accepted. On motion of McLean and Sanderson, account as presented for installation of pump and necessary materials, being according to quotation previously approved, be accepted and Treasurer authorized to issue cheque in payment of same to a total of $5,710.00. Clerk presented cheque from the Ministry of Culture and Recreation, being part of the Wintario Grant for the Shanty Bay Community and School Centre, as applied for November 23, 1979. The cheque being in the amount of $11,401.55. Also presented further letter from the Ministry advising of balance of $27,688.70 approved for the project. Letter requests updating for cash flow needs. On motion of Smith and McLean, cheque be received and same be applied to second and third progress billing as received from Simcoe County Board of Education. Presented letter from Ministry of Culture and Recreation advising that request for Wintario payment for Jarratt Community Hall has now been formulated and will be forthcoming in the amount of $2,338.33 being a difference of $4.85 from payment as requested in the amount of $2,343.18 and leaving an approved balance of $1,336.67. On motion of Sanderson and Swainson, letter and itemized breakdown explaining the formulation used for the first payment, be accepted and cheque in the amount of $2,338.33 be forwarded to Jarratt Community Hall Committee, less the amount paid by the Township of Oro for materials purchased for the project. Presented letter from Secretary-Treasurer, Jarratt Community Hall Committee advising that John Dobson had resigned as member of the Committee and that at a ratepayers meeting held on December 4, 1979, two names had been submitted for a new member to the Board. They were (1) David Patterson and (2) Calvin Bailey. Calvin Bailey later declined but advised he would help in anyway. Also letter of resignation from John Dobson. On motion of Smith and McLean, letter be received and placed on file and David Patterson be added as member to Jarratt Community Hall Committee to replace John Dobson and his name be incorporated in the By-law to appoint members to various committees, when same is prepared and presented to Council. Presented copy of letter from Senior Planner, Subdivision Branch, Ministry of Housing, to Skelton, Brumwell and Associates, advising that the draft approval for Guthrie Industrial Park, Lots 21 and 22, Concession 5, File No. 43T-74324, lapses on January 6, 1980 and that the Ministry is granting an interim extension of two months (March 6, 1980) to allow the Municipality and their client time to determine whether or not an extension will be requested. . . . pg. 14 SECOND MEETING (Conti d) JANUARY 21, 1980 Clerk reported that the Township letter recommending extension for one year had been forwarded December 18, 1979 and it would appear that the Ministry's letter and Township letter must have crossed paths. Also presented copy of letter from Skelton, Brumwell and Associates, acknowledging receipt of letter granting interim extension and advising that request had been forwarded December 18, 1979 and letters would appear to have crossed. On motion of Swainson and Smith, copies of letters as presented be received and placed on file for reference as required. Clerk advised that notices of date of Council meeting at which the Engineerls Report on the Highway Municipal Drain, W~ Lot 21, Concession 11, is to be read and considered. The date being January 31, 1980 at 7:30 p.m. This report being a new report after referral of the first report back to the Engineer. A total of 21 notices having been sent to property owners or agencies. On motion of Sanderson and Mclean, report of Clerk that notices had been sent in accordance with Section 41 of The Drainage Act, accepted as satisfactory. Presented copy of letter from R. Bruce Waite, Solicitor, for Stanley Ager to Messrs. Loopstra, Nixon and McLeish re: road allowance conveyance between Lots 5 and 6, Concession 12, further to their letter of November 16, 1979 recommending alternatives for said conveyance and severance of same for right-of-way. On motion of McLean and Smith, copy of letter be received and filed for reference until further request is received from Solicitor for Stanley Ager. Presented letter from Ontario Municipal Employees Retirement Board in reply to Township enquiry and request to prepare cost estimates on providing Supplementary Pension Benefits under OMERS employees. Attached are calcuations for three employees to purchase service prior to participation of the employer in OMERS. On motion of Swainson and Sanderson, letter and calculations be received and filed until employees involved request purchase of service prior to participation of the employer in OMERS. Letter from James E. Domm further to his letter of December 19, 1979 and Township reply of January 2, 1980 with respect to Lakeshore Road at intersection of Line 8. Letter advises that in his opinion Council IS action in this regard will not solve the problems as outlined in his letter and once again requests that Council consider installation of a protective guard rail as requested in his letter of December 19, 1979. On motion of Sanderson and Swainson, letter be received and Clerk to reply and advise that Council are of the opinion that a protective guard rail is not a requirement at this location and does not meet the criteria. proposal of erecting modern type reflectors should be tested prior to any further action at this location. Clerk presented equalized assessment for 1980 of the properties in the Nottawasaga Valley Conservation Authority Watershed had been revised by adding assessment under Section 43. The equalized assessment for 1980 use being 13,514,000 being an increase of 132,000. On motion of Sanderson and Smith, that the Oro Township Arena Board be advised that Oro Council are opposed to the obtaining of a Liquor Licence at the Arena during the Winter Carnival. In Council's opinion no liquor should be served during the Winter Carnival which is considered to be family entertainment. SECOND MEETING (Cont'd) JANUARY 21, 1980 pg. 16 . Presented letter from the Salvation Army requesting Council to continue to financially support in 1980 with a grant as in past years. On motion of McLean and Swainson, letter accepted and Council approve a grant to the Salvation Army in 1980 to an amount of $50.00. Presented letter from North Simcoe Soil and Crop Improvement Association requesting a grant for the Annual North Simcoe Seed Fair in 1980 as in other years. On motion of Smith and Swainson, Council approve a grant of $25.00 to the Annual North Simcoe Seed Fair in 1980 as in previous years. Presented letter from Barrie District Administrator for the Canadian Institute for the Blind requesting Council to consider a grant in 1980. On motion of Sanderson and Swainson Council approve a grant to the Barrie District Canadian Institute for the Blind in the amount of $50.00. Presented a letter Barry H. Peyton, 1st Oro Scouts, requesting Financial Aid for Youth Groups. Letter refers to letter of June 21, 1979 when Council advised that the request had been too late for 1979 grants and should again be requested early in 1980 for consideration. On motion of Smith and McLean, Oro Council are not prepared to approve a grant to Oro Scout Troops and Cub Packs in the Guthrie Area since other groups in the Township would then request similar grants. . Presented letter from Information Orillia requesting a grant for 1980. On motion of Sanderson and Swainson, Oro Council authorize a grant in the amount of $25.00 to Information Orillia for 1980. Presented from St. John Ambulance letter outlining activities in 1979 and requesting a grant for 1980. On motion of McLean and Smith, Oro Council authorize a grant in the amount of $50.00 for 1980 as in 1979. . The Planning Administrator was present at 1:15 p.m. to review planning and development matters. The following correspondence was presented. Letter to Ministry of Housing forwarding copies of certificates under Section 35(27) of the Planning Act regarding approval of By-laws No. 1194 (Ucci) and 1198 (L. Johnson); Ontario Government Bookstore, ordering 10 copies of The draft Planning Act; Letter to Quadrant Developments requesting payment of balance of capital lot levies in the amount of $12,000.00 prior to February 22, 1980 as required by the Subdividers Agreement. On motion of McLean and Sanderson, that correspondence as presented be placed on file. Presented copies of City of Barrie By-laws No. 79-184, 79-193, and 79-194, being amendments to the text of the City's Comprehensive Zoning By-law regarding minor changes to setbacks and building heights for certain commercial I.- . . -....I pg. 17 SECOND MEETING (Cont'd) JANUARY 21, 1980 and industrial zones, and uses, additional uses permitted in certain commercial and industrial zones, and home occupation uses in multiple residential zones. By-law No. 79-194 also permits carports and private greenhouses to be erected as accessory uses in multiple residential uses. Council were advised that the Planning Administrator had reviewed each of the By-laws and had concluded that no detrimental affect on Oro Township should be realized as a result of their approval. On motion of McLean and Smith, that City of Barrie By-laws No. 79-184, 79-193 and 79-194 be received and placed on file for future reference. Presented Oro Planning Board resolution recommending that "M-2 - Extractive Industrial" zoning be extended to the Bass Lake Road on lands owned by Ann Buckindale being part of Lots 6 and 7, Concession 10, to permit expansion of an existing sand and gravel pit. On motion of Swainson and Smith, that Oro Township Council approve in principle the application by Ann Buckindale to rezone approximately 10 acres in the west part of Lots'6 and 7, Concession 10 from "A-Agricultural" to "M-2 Extractive Industrial". The applicants are required to enter into agreement with the Municipality whereby they agree to be responsible for all costs incurred to effect the rezoning, including any necessary O.M.B. Hearing into the matter. A letter of credit or cash in the amount of $2,000.00 is required as a deposit against such costs. The applicants are to concurrently apply to the Ministry of Natural Resources for licensing under the Pits and Quarries Control Act. All derelict vehicles, brush, debris and unsightly materials are to be removed from the area to the appropriate licensed disposal sites. Planning Administrator to prepare the necessary draft zoning by-law for consi-eration at such time as the previously mentioned requirements are fulfilled. Presented Oro Planning Board resolution advising that the Board are not prepared to recommend an application by Morley Shelswell to re-designate and rezone part of the east half of Lot 16, Concession 14 for industrial use. On motion of Sanderson and Smith, that Oro Council concur with the resolution of Oro Planning Board not to recommend re-designation and re-zoning of lands owned by M. E. Shelswell, being part of the east half of Lot 16, Concession 14 for industrial use. Presented resolution of Oro Township Committee of Adjustment regarding Submission B4/80 made by Mr. 1. Holmberg on Block "N", R.P. 807. The Committee seek the recommendation of Council on the matter prior to any decision being made. On motion of Mclean and Smith, that Oro Township Council recommend that the Committee dismiss Submission No. B4/80. Council are of the opinion that a plan of subdivision is necessary in the public interest, and that further, a consent of the type proposed would set an undesirable precedent. It is Council's recommendation that the applicant proceed by way of 4It draft plan under Section 33 of The Planning Act. I..- . . . ~ pg,. 18 SECOND MEETING (Cont'd) JANUARY 21, 1980 Road Supt. Fred Haughton was present at 1:50 p.m. and advised that the new 6 ton truck had arrived at Thor Motors Orillia and is having the name and number painted and should be at the Township yard within several days. He also advised that the Road Dept. have now changed working hours by just taking a ~ hour lunch and stopping at 4:30 p.m. which appears to be working very well. The Road Supt. brought up the matter of a calculator with tape and he was advised that one could be purchased. The matter of improvement to the intersection of Line 13 and Ridge Road was again considered. On motion of Sanderson and Swainson that the Road Supt. be authorized to have the intersection of the Ridge Road and Line 13 surveyed for the purpose of improvement of the intersection. Approval was also given to purchase a surveyor's metric level-rod. Presented copy of Workmen's Compensation Board, Employer's Report of Accidental Injury as forwarded for injury to Fred Shelswell, Volunteer Fire Deparment, Station 2, Hawkestone, received while attending a fire at Lot 14, Concession 14. On motion of Sanderson and McLean, copy of accident report as completed and forwarded to Workmen's Compensation accepted as satisfactory. Presented letter from Abner Rawn advising that he is prepared to continue as By-law Enforcement Officer for the Township of Oro in 1980 at the same rate as in 1979. On motion of Smith and Sanderson, letter be received and placed on file for the present, and Clerk to advise Mr. Rawn that the Township has made no decision. Presented letter from District Engineer, Ministry of Transportation and Communications advising that pursuant to the Public Transportation and Highway Improvement Act, R.S.O. 1970, as amended the Hon. James Snow, Minister of Transportation and Communications, has authorized a subsidy allocation for 1980 in the amounts of: Construction Maintenance Total 1980 $114,000.00 189,000.00 $303,000.00 1979 $104,000.00 168,000.00 $272,000.00 Increase $10,000.00 21,000.00 $31,000.00 On motion of McLean and Smith, Subsidy Allocation for 1980 as approved by the Minister be accepted and Treasurer, Road Committee and Road Supt. to prepare Road Program to meet the subsidy allocation allotted and prepare a program for Supplementary Subsidy for construction on Cross Road 15-16 in preparation for paving. Mr. Bruce Fraser, Assessment Commissioner was present before Council at 3:30 p.m. at request of Council to explain and clarify implications of applying for re-assessment under Section 86 of The Assessment Act. ..... . . . ~ SECOND MEETING (Conti d) JANUARY 21, 1980 pg. 19 Reeve Campbell welcomed Mr. Fraser and asked if he would clarify Section 86 of The Assessment Act and requirements of Council in this respect. Mr. Fraser outlined the Section 86 Program and the affect of same, advising that in 1980 the market value would be based on 1978 market value. The greatest difference would be on vacant land and severed parcels with buildings on same. The program would justify and bring all properties to a more equitable level. Mr. Fraser explained that total assessment as shown in the Assessment Roll would not change but the assessment would be on a more equitable basis, generally the increase and decrease would also be equal percentage wise. If the Township wants to proceed the Township should make request to the Ministry of Revenue for a study under Section 86 program. Upon presentation of the study Council must then upon acceptance of the study, advise the Minister that the program be completed. Council members asked a number of questions, which were clarified by Mr. Fraser. Reeve Campbell thanked Mr. Fraser for his clarification. Council considered the matter further and passed the following resolution. On motion of Sanderson and Swainson that the Council of the Township of Oro request the Minister of Revenue to program a feasability study for the Township of Oro in order to invoke Section 86 of The Assessment Act. Presented proposed budget from Oro Township Committee of Adjustment for 1980 for a total requisition of $1,500.00. On motion of McLean and Smith, proposed budget of the Oro Township Committee of Adjustment for 1980 in the amount of $1,500.00 be accepted and be incorporated in the Township budget for 1980. Presented proposed budget for 1980 from the Oro Planning Board for a total requisition of $15,000.00. On motion of Sanderson and Swainson, proposed budget of the Oro Planning Board for a total of $15,OOQOO, be accepted and incorporated in the 1980 Township budget. Presented from County of Simcoe breakdown of 1979 General Support Grant and apportionment. The apportionment for the Township of Oro being 4.75% for a grant in the amount of $11,424.00. On motion of Smith and Swainson apportionment breakdown as presented be received and placed on file for necessary reference. Presented member's hearing notice for Assessment Review Court to be held at the Council Chambers of the City of Orillia, for the Municipalities of the City of Orillia, Oro, Orillia Township, Medonte and Rama, on Tuesday, February 5, 1980 at 1:30 p.m. On motion of McLean and Sanderson notice be received and placed on file. Presented letter from Ministry of Agriculture and Food advising of Drainage Commissioners four and one half day course to be held April 7th to 11th, 1980, at the University of Guelph. Course has three options the first option being office administration aspects of drainage. On motion of Sanderson and McLean, notice of Drainage Commissioners Course be received and placed on file for the necessary reference. Presented letter from Drainage Co-Ordinator, Food Land Development Branch, Ministry of Agriculture and Food re: Tile Drainage Allocations 1980-81. Advising that the initial allocations will be based on a pro rata calculations of the previous three years applications on hand August 31st. Letter also sets out criteria on which loans are to be based. Also enclosing amortization schedules and Minister's statement to the Legislature. On motion of Smith and McLean, letter and enclosures be received and placed on file for reference and application as required. Presented copy of survey on solid waste procedures in Ontario. A copy of same is being forwarded to all survey participants. On motion of Sanderson and Swainson, survey on solid waste procedures in Ontario be received and placed on file for reference. Presented letter from StandingrJResources Development Committee advising that the Legislature's Standing Resources Development Committee will begin public hearings on Bill 127, an Act to revise the Pits and Quarries Control Act, 1971 on Tuesday, January 22, 1980 in the Committee Room No.1 of the Main Parliament Building. Letter requests that if the Municipality is interested in making a presentation to the Committee on this Bill the Committee be advised. Also letter from the Foundation of Aggregate Studies outlining a news bulletin, the major problems appear to be less control to the Municipality and letter requests municipalities to support the concerns expressed. On motion of McLean and Sanderson, letters be received and placed on file. Presented letter from Dorothy Hoffman, objecting to the proposed airport by the City of Barrie, also copy of letter to Mayor City of Barrie, objecting to the City's proposal for an airport in Oro.' Also letter from Ed Martin Lot 15, Conc. 3 supporting an airport. Presented as well a letter from Mrs. Dorothy Hoffman, a letter of objection to method of imposing library user fee for 1980. And letters from Mrs. Vilda R. Campbell and Melwille Hastings supporting the proposed airport in the Township of Oro. On motion of Sanderson and Swainson, letters be received and placed on file for necessary reference as may be required. Presented Tonnage and Acreage Report 1979 for Township gravel pit and Statement of Return required under the Pits and Quarries Control Act, 1971, for the period ending December 31, 1979. The assessed tonnage for 1979 being 39, 195 at .02~ per ton rehabilitation to a total of $783.90. Total deposit carried forward for rehabilitation being $4,644.50. ..... . . . -...... Presented copy of Wolf Bounty claim as applied for by William Peacock and forwarded to Treasurer, County of Simcoe. On motion of Sanderson and McLean, application for Wolf Bounty for William Peacock as presented and forwarded accepted and copy be placed on file for reference. Presented resume from Jeffery N. Potts for employment in the Planning Department having had previous experience in the City of North York Department of Planning. On motion of Swainson and Sanderson, that the resume of Jeffery N. work in capacity of Planner be received and placed on file. Presented a letter from the Hon. Thomas L. Wells, Minister, Ministry of Intergovernmental Affairs with respect to 1980 Involvement in Municipal Administration Program (IMA). On motion of Sanderson and Smith that letter be placed on file for further review should the Township see fit to participate in the program. Presented a proposed Fire Budget for 1980 as prepared by the Fire Chief and Fire Committee. Proposed budget also requests compensation difference to 100% of the $16,200.00 compensation rate, since compensation rate is 75% of the $16,200.00. Also a request for Life Insurance Plan, as well as proposal for a new fire truck. On motion of Sanderson and Swainson that proposed budget be tabled for further review and Fire Chief be requested to attend the next regular meeting of Council when the 1980 budget is to be further considered. Presented account from Simcoe County Board of Education for the Shanty Bay Community Hall and Education Centre, being Progress Draw No. 5 to a total of $3,267.25. On motion of Smith and Swainson, account for the Shanty Bay Community Hall and Education Centre as presented be placed on file for reference as funds are available for payment.
